44 Powers of Court In proceedings under section 40 or 43 the Court may on the application of a party to the proceedings or on its own motion: (a) determine any question of fact arising (including questions of title) in the proceedings or give directions as to how the questions are to be determined; or (b) direct that inquiries are to be made and accounts are to be taken as necessary for the purpose of ascertaining and adjusting the rights of the parties.
