36 Tenants in common of equitable estate acquiring the legal estate If 2 or more persons, who are entitled beneficially as tenants in common to an equitable estate in property, are or become entitled, whether as joint tenants or tenants in common, to the legal estate in the property equal to and coextensive with the equitable estate, both the legal and equitable estates are held by them as tenants in common unless the persons otherwise agree.
