32 Restriction on executory limitations (1) If there is a person entitled to: (a) land or an equitable interest in land for an estate in fee simple or a lesser interest; or (b) any other property or an interest in any other property, with an executory limitation over on default or failure of all or any of the person's issue, whether or not within or at a specified period of time, the executory limitation becomes void and incapable of taking effect if, and as soon as, there is issue living who is an adult and has the capacity of the class on default or failure of which the limitation over was to take effect. (2) Subsection (1) does not apply if the executory limitation is contained in an instrument which came into operation before the Law of Property Act 2000 18
