28 Abolition of rule in Shelley's Case If, by an instrument coming into operation after the commencement of this Act, an interest in land is expressed to be given to the heir, heirs or issue, or a particular heir or a class of heirs or issue, of a person in words which, but for this section, would, under the rule of law known as the Rule in Shelley's Case and despite section 22, have operated to give to that person an estate in fee simple or an entailed estate, the words operate as words of purchase and not of limitation and are to be construed and have effect accordingly.
