165 Modification or extinguishment of statutory right of user (1) The owner of dominant land or servient land may apply to the Court for an order modifying or extinguishing the statutory right of user imposed in respect of the land under section 164. (2) Where the Court is satisfied that: (a) the statutory right of user the subject of an application, or some aspect of it, is no longer necessary for the purposes of the reasonable use of the dominant land; or (b) some material change in the circumstances has taken place since the order imposing the statutory right of user was made, the Court may make an order modifying or extinguishing the statutory right of user.
