140 Costs and expenses (1) A lessor is entitled to recover as a debt due to the lessor from a lessee all reasonable costs and expenses properly incurred by the lessor in respect of a breach giving rise to a right of re-entry or forfeiture that is, at the request of the lessee, waived by the lessor or from which the lessee is relieved under this Act. (2) A lessor is entitled to recover costs and expenses under subsection (1): (a) in addition to any claim for damages on the part of the lessor against the lessee; and (b) whether or not the lessee has rendered forfeiture unenforceable against the lessee under section 138.
