108 Abolition of consolidation of mortgages (1) A mortgagor seeking to redeem a mortgage is entitled to do so without paying any money due under another mortgage (whether made by the mortgagor or a person through whom the mortgagor claims) of property not subject to the mortgage which the mortgagor seeks to redeem. (2) This section: (a) has effect despite any term of a mortgage to the contrary; and (b) applies only if the mortgages referred to in subsection (1) are, or one of them is, made after the commencement of this Act.
