#### 43 Notice of misconduct matters to be given by Commission 43 Notice of misconduct matters to be given by Commission > > (1) As soon as practicable after receiving or becoming aware of a misconduct matter concerning a police officer or administrative employee or the NSW Police Force, the Commission is to give the Commissioner of Police notice of the misconduct matter. > > > (2) As soon as practicable after receiving or becoming aware of a misconduct matter concerning a Crime Commission officer or the Crime Commission, the Commission is to give the Crime Commissioner notice of the misconduct matter. > > > (3) The notice may include a summary or sufficient details of the misconduct matter to indicate the nature of the misconduct for the information of the Commissioner of Police or Crime Commissioner. > > > (4) Nothing in this section requires a copy of a misconduct matter to be referred to the Commissioner of Police or Crime Commissioner if the Commissioner of Police or Crime Commissioner already has a copy (or a summary or sufficient details) of the misconduct matter. > > > (5) The Commission is not required to give notice of a misconduct matter under this section if the Commission is of the opinion that it is not in the public interest to do so.
