Landscape South Australia (Water Management) Regulations 2020

The Regulations cluster around a small set of operational concepts that implement the Act’s water-management architecture. Those core concepts are: prescribed areas and plans, administrative process rules, levies and refunds, metering and metrological control, approvals and their cancellation, allocation and trade mechanics, forest licence rules, information-gathering, and enforcement mechanics.

Prescribed areas and plans. The Regulations concretely define territorial scope for at least one statutory term by prescribing the Mount Lofty Ranges Watershed via a named plan (r 4). They also enable water allocation plans to specify exemptions and publish detailed rules for how water allocation plans can classify entitlements, set priorities according to management zones, and permit transfers between consumptive pools (r 28-r 31).

Administrative process rules. The Regulations prescribe notice and consultation mechanisms tied to the Act’s procedural sections. Licence-holders must receive written notice about proposed water allocation plan amendments with at least two months’ time to lodge submissions (r 5). Notices for ss 113, 137 and 144 must comply with s 222 of the Act and must include identified particulars and an address to inspect applications, and the Regulations set a 20 business day window for representations (r 22-r 24). The Regulations require representations and responses to be made available for public inspection for a minimum period of 12 months after the decision (r 42).

Levies and refunds. The Regulations permit the Minister to determine by Gazette a charge to recover reasonable costs incurred by the Department in administering the Act when a person fails to pay a water levy; those charges are recoverable as a debt to the Crown (r 6). They also define an “environmental donations entitlement” and treat donations or condition variations that shift allocations to environmental use, accredited by a regional landscape board, as eligible bases for partial water-levy refunds under s 87, with the refund proportion calibrated to the proportion donated and the date of effect within the financial year (r 7).

Metering and metrological control. A detailed metering scheme runs through Part 5. The Minister may supply and install meters or direct a person to do so; payment for such work may be required and remains a debt to the Crown (r 9). The Regulations authorise Ministerial entry to read, inspect and maintain meters, set mandatory accuracy standards for new meters and testing regimes for removed or on-site testing, specify that testing and repair must be by competent persons approved by the Minister and that certificates of testing must be lodged within prescribed periods (r 10-r 15). The Regulations proscribe interference with meters and associated pipes, and impose duties on responsible persons to keep meters free of deposits and vegetation, with failure exposed to a maximum penalty of $7,000 and expiation $350 (r 12, r 16).

Approvals and cancellations. The Regulations prescribe circumstances and procedures for cancellation of water resource works approvals and site use approvals, setting thresholds based on non-construction, non-use over specified time periods, consultation requirements before cancellation and an express prohibition that cancellation should not proceed if it would have an unreasonable impact on a water resource or other natural resource (r 26-r 27).

Allocation, trade and classification. The Regulations permit water allocation plans to authorise transfers between consumptive pools, but only where reasonable connection and pool capacity criteria are met (r 28). They set out permissible classification characteristics of water access entitlements, linking class to use purpose, priority/reliability, tradability, carry-overs and association with management zones (r 29). The Regulations allow water allocation plans to set policies and principles for licence variation and conversion of entitlements (r 30). They address interstate trade through tagged interstate water trades, setting a fee-on-registration model and permitting no further fee for subsequent transfers in a registered series (r 32).

Forest licences and special rules. The Regulations carve out forest management activity definitions (r 34), prescribe notice formats for transfers and assignments (r 35), set prescribed periods for certain variation regimes with special longer periods for specified unconfined aquifer areas in the Lower Limestone Coast (r 36), allow refusal of transfer where levies are unpaid (r 37(1)), and prescribe offence rates and surrender circumstances (r 38-r 40).

Information gathering. The Regulations require SA Water and other reticulated service providers to provide specified infrastructure, capacity and water quantity and quality information at the Minister’s request and bring that information within s 9(3) of the Act (r 43).

Enforcement and remedies. The Regulations create debt recovery mechanisms, enable the Minister to enter land for compliance, set expiation fees for meter-related offences, prescribe that any condition of a water management authorisation can attract expiation under s 104(7) (r 20), and set prescribed dates and time limits for procedural matters (r 21, r 24, r 41).

Across these concepts the Regulations routinely vest discretionary specification powers in the Minister or in water allocation plans, and set administrative defaults and prescribed procedural minimums that convert statutory powers into enforceable, time-bound administrative processes.

The Regulations affect a wide range of stakeholders involved in water management in South Australia. The text itself identifies those persons and entities, and prescribes obligations and entitlements accordingly.

Licence-holders and water access entitlement holders. Holders of water licences, water access entitlements and water allocations are subject to consultation obligations under r 5, may be directed to supply, install, maintain and pay for meters under r 9-r 13, can be party to joint applications for variations under r 33, and may be constrained by classification and reclassification regimes under r 29-r 31. They are potential recipients or donors under the environmental donations entitlement regime in r 7, where donation or condition variation may generate a refund entitlement in respect of water levies.

Owners and occupiers of land. Owners of land on which Minister-supplied meters are installed may be required to pay costs of supply, installation or sealing, creating a debt due to the Crown until paid (r 9(2)-(3)). Owners of land are defined as “responsible persons” in relation to meters and carry maintenance duties including clearing vegetation and preventing deposits around meters (r 12(4)). The Minister may enter land to read, inspect, service and otherwise manage meters on land where meters are installed (r 10(2), r 11(1)).

Regional landscape boards. These boards are given a role in accrediting persons and recognising environmental donations entitlements under r 7. A board must apply Minister-determined accreditation criteria when deciding whether to issue accreditation for a water licence or water allocation to be an environmental donations entitlement (r 7(2)).

SA Water and other infrastructure/service providers. The Regulations expressly require SA Water and any other persons who provide reticulated water supply, sewerage or water drainage services to provide the Minister, on request, specified information about infrastructure location, materials, capacity and water quantity and quality stored, lost and discharged (r 43(1)).

Forest managers and licensees. Forest water licence-holders and forest managers are subject to specialised provisions in Part 8: harvesting definitions are set (r 34), transfer notices and assignment notices have prescribed forms and timeframes (r 35), transfers may be refused on unpaid-levy grounds (r 37(1)), and allocations cannot be dealt with in ways that would reduce offsetting allocations below the level required by the relevant water allocation plan (r 37(2)).

Minister and relevant authorities. The Minister is the primary decision-maker and specification-maker across many provisions: determining reasonable cost recovery charges (r 6), making specifications for meters (r 15), approving competent persons for testing (r 13(3), r 14(6)), determining the manner and form for notices and for provision of documents under r 35, r 22 and r 42, and exercising powers to supply, install and seize meters and to cancel approvals under prescribed schemes (r 9, r 26, r 27). Relevant authorities are required to give notices under ss 113, 137 and 144 in accordance with s 222 and to ensure representation availability under r 42(1).

Third parties in trades and transfers. Persons engaged in interstate and tagged trade schemes are affected by the registration fee and the registration model where a fee is payable to register transfers and no further fee applies for subsequent transfers in the registered series (r 32(1)(e)-(f)). Applicants to transfer allocations must be current with water levies or risk refusal (r 37(1)).

Well drillers. Holders of well driller licences must comply with prescribed conditions about record keeping, production of records, sampling and directions from the Chief Executive, and must sight permits or approvals before commencing work that requires them (r 25).

Members of the public and representors. The Regulations set how notices must be published and what must be included (r 22), and specify that representations must be in writing and state contact details, and give a 20 business day window for lodging representations and the option to indicate whether the representor wishes to appear to be heard (r 23). The public is given free access to inspect representations and responses for a 12 month period after decision (r 42).

Collectively, these rules create direct compliance costs for licence-holders, landowners, forest managers, SA Water and service providers, and administrative duties for regional landscape boards and the Minister. The Regulations also allocate regulatory leverage: the Minister’s capacity to set specifications, approve persons and enter land to affect outcomes materially changes transaction costs and operational modalities for water users.

The Regulations establish concrete duties, limited rights and procedural entitlements across several domains. Below are the principal duties and rights as prescribed in the Regulations, with the relevant regulation citations.

Meter-related duties and rights

• Ministerial supply and installation powers: The Minister may supply, install or seal a meter, or direct a person to supply or install a meter (r 9(1)). That creates a duty on the person who receives a direction to comply.
• Payment obligation: Owners of land or persons who hold or benefit from a water management authorisation that uses a Minister-supplied meter can be required to pay costs of supply, installation or sealing; those costs become a debt to the Crown (r 9(2)-(3)).
• Rent and entry rights: A holder or beneficiary of an authorisation using a Minister-owned meter is liable for rent comprised of the prescribed fee, and the Minister may enter land where the meter is installed to read, inspect, service, test, validate, maintain, seal, repair or replace the meter (r 10(1)-(2)).
• Inspection rights for privately owned meters: The Minister may enter land with other persons’ meters to read, inspect or seal them and may direct persons to service, test, validate, maintain or repair their meters (r 11).
• Non-interference and maintenance duties: Persons must only take water through a meter, must not tamper with seals, adjust or alter meters, cut into relevant pipes or change configuration without Ministerial authority, and must keep the meter area free of deposits and vegetation (r 12(1), r 12(4)). If meters or associated infrastructure are damaged, responsible persons must repair or replace them at the Minister’s written direction (r 12(5)).
• Technical compliance: New meters must be rated by their manufacturer to at least plus or minus 2.5% accuracy and meet Ministerial specifications; testing, servicing and maintenance must be done by competent persons approved by the Minister and in accordance with Ministerial specifications; only manufacturer-supplied or approved parts may be used (r 13).
• Testing regime and certificates: Detailed testing rules require reading immediately before removal, provision of readings and certificates within specified periods, reinstallation within 28 days unless otherwise approved, and certificates submitted within 14 days of testing (r 14).

Levies, refunds and recovery

• Ministerial recovery charge: The Minister may determine by Gazette a charge to recover Departmental steps where a person fails to pay a water levy; the charge must not exceed reasonable costs and is recoverable as a debt to the Crown (r 6).
• Refund eligibility: Donations or condition variations that transfer whole or part of a water access entitlement or allocation to the holder of an accredited environmental donations entitlement are recognised as natural resources management practices that may support a refund application; the refund equals the proportion of allocation donated with a sliding percentage by date (r 7(3)-(5)).
• Transfer refusal for unpaid levies: The Minister must refuse an application to transfer an allocation if the applicant has not paid a water levy, or part thereof, and the Minister considers refusal appropriate on that basis (r 37(1)).

Consultation and representation rights

• Notice and submissions for plan amendment: Holders of licences must be given written notice about proposed amendments and at least two months to lodge submissions (r 5(1)-(2)).
• Representations process: Notices under ss 113, 137 and 144 must follow s 222 of the Act in manner, and must set out particulars including land affected and address for inspection; representations must be in writing, within 20 business days, provide contact details and nominate a representative where multiple persons make the same representation, and state whether the person wishes to be heard (r 22-r 23).
• Time to reply: Applicants have 10 business days to respond under ss 113(5), 137(d) and 144(d), subject to extension at the relevant authority’s discretion (r 24).

Approvals, variations and cancellations

• Cancellation schemes: The Minister may cancel water resource works approvals and site use approvals under prescribed circumstances including non-construction, non-use over set periods and prolonged non-use after consultation, provided the Minister does not cancel where cancellation would have an unreasonable impact on a water resource or natural resource (r 26(1)-(3), r 27(1)-(2)).
• Joint application obligations: Holders of multiple licences or approvals may make joint applications to vary water take or use limits so that volumes can be reduced under some instruments and increased under others, subject to consistency with section 124(3), 136(4) or 143(3) of the Act (r 33).

Forest licences specifics

• Definition and exceptions for harvesting: Harvesting excludes forest thinning, salvage operations after pests, wind-throw, fire or other damage, and activities stated in relevant water allocation plans to be non-harvesting (r 34).
• Prescribed periods for variation and condition changes: The Regulations prescribe specific temporal limits for applying variations or condition changes in the forest context, including longer periods for certain unconfined aquifer areas (r 36, r 38).

Information and record-keeping duties

• Well driller conditions: Well drillers must keep and produce records as directed, take and submit samples at the Chief Executive’s direction, and comply with directions about drilling, plugging or sealing wells or casing repair (r 25).
• Obligations on service providers: SA Water and other reticulation or drainage service providers must supply location, materials, capacity, volume and quality information on request by the Minister (r 43).

Enforcement rights and remedies

• Penalties and expiation: Failure to comply with Part 5 directions or provisions is an offence with a maximum penalty of $7,000 and an expiation fee of $350, except for regulation 12 which is enforced under s 79(5) of the Act; the Minister may enter land to remedy contraventions and recover costs as a debt (r 16).
• Debt recovery: Charges determined under r 6 are recoverable as a debt to the Crown.

Collectively the Regulations create a suite of enforceable duties on licence-holders, landowners, service providers and specialised operators such as well drillers and forest managers, while granting the Minister, Chief Executive and relevant authorities rights to enter land, prescribe technical standards, refuse transfers on unpaid-levy grounds, and recover costs.

The Regulations provide a mix of criminal fines, expiation fees, debt recovery mechanisms and administrative enforcement powers, and they assign enforcement roles primarily to the Minister, the Chief Executive and authorised officers. The relevant provisions combine monetary penalties, permit/approval cancellation schemes and direct remediation powers.

Criminal penalties and expiation

• Metering offences: Contravention of Part 5 (metering provisions) is an offence. Regulation 16(1) prescribes a maximum penalty of $7,000 and an expiation fee of $350 for failing to comply with a Ministerial direction under Part 5 or contravening provisions of that Part. Regulation 16(2) carves out regulation 12 for enforcement under s 79(5) of the Act, which imposes its own enforcement pathway for meter tampering and related matters (r 12).
• Forest water offences: Regulation 40 prescribes a rate for offences under s 175(2)(a)(i) of the Act at $25 per kilolitre, which operationalises a volume-based penalty in the forest licensing context.

Administrative remedies and cost recovery

• Ministerial remedial action and debt recovery: Where a person fails to comply with a direction under Part 5 or contravenes a provision of that Part, the Minister may enter the land and take such action as the Minister thinks fit to remedy the contravention or failure, and the Minister’s costs become a debt due to the Crown by the person who contravened (r 16(3)). This creates an administrative enforcement loop where the Minister can remedy noncompliance at the regulated person’s expense, potentially bypassing court-ordered remedies for remediation.
• Recovery charge for unpaid levies: Regulation 6 permits the Minister to determine, by notice in the Gazette, a charge to cover steps taken by the Department in administering the Act where a person fails to pay a water levy. The charge must not exceed the reasonable costs to the Department and is recoverable as a debt to the Crown (r 6(1)-(3)). The debt recovery mechanism attaches to levy non-payment and effectively converts administrative costs into a legally enforceable debt.

Refusal and cancellation powers

• Transfer refusal for unpaid levies: Regulation 37(1) mandates that for purposes of s 169(7)(d), the Minister must refuse an application for transfer if the applicant has not paid a water levy, or part of it, where the Minister thinks refusal is appropriate on that basis. This gives the Minister discretion to block transfers pending levy compliance and creates a compliance lever for levy collection.
• Cancellation schemes: Regulations 26 and 27 set out prescribed schemes for cancelling water resource works approvals and site use approvals respectively. Those schemes include time triggers (for example non-completion within 2 years, or non-use for specified periods) and require at least one month’s notice prior to cancellation in some circumstances (r 26(2)). Both regulations include a substantive limitation: the Minister must not cancel if cancellation would have an unreasonable impact on a water resource or other natural resource (r 26(3), r 27(2)). Cancellation is thus both an enforcement tool and a regulatory control point that can remove permissions where use or construction lapses.

Testing, sealing and validation enforcement

• Sealing and authorised persons: Regulation 14 prescribes that security seals attached to meters may only be removed by a person approved by the Minister, meters must be tested by competent persons approved by the Minister, certifications provided within prescribed timelines and meters reinstalled within 28 days after removal unless the Minister approves otherwise. These rules create enforceable chains linking technical competence, certification and timely reinstatement as elements of compliance; failure to follow them falls within the offence and remedial regime in r 16 read with the Act’s enforcement provisions.

Procedural enforcement

• Representation and publication obligations: Regulatory obligations about notices and representation availability (r 22-r 24, r 42) can attract expiation under section 104(7) where any condition of a water management authorisation or permit is contravened (r 20). The Regulations therefore integrate procedural obligations into the general enforcement architecture via expiation fees and administrative remedies.

Interaction with Act enforcement provisions

• Certain enforcement paths are left to the Act. Regulation 8 prescribes specific sections of Part 5 of the Act for recovery of penalties under s 88(6) of the Act, listing the sections so prescribed (r 8). Regulation 16(2) defers the enforcement of regulation 12 to s 79(5) of the Act. This means penalties and enforcement are implemented through a combination of statutory sanctions in the Act and the Regulations’ specified monetary penalties and administrative remedies.

Operational effect on compliance risk

• The Regulations create multiple compliance and enforcement touchpoints: monetary penalties, expiation fees, cancellation of approvals, refusal of transfer applications for unpaid levies, and direct Ministerial remediation recoverable as debt. The Minister’s discretion to determine specifications, approve competent persons and refuse transfers on unpaid-levy grounds concentrates enforcement levers in one administrative office and ties technical compliance (meter testing, sealing and certification) to the ability to transact (transfers and allocation changes). The Regulations therefore convert technical, procedural and financial noncompliance into concrete administrative consequences.

The Regulations are subordinate to and interlock with the Landscape South Australia Act 2019 and reference other statutory instruments. They both implement specific Act sections and modify or prescribe processes that operate alongside or within other statutory schemes. Key interactions are:

Direct implementation of Act provisions. The Regulations frequently state their purpose as implementing particular Act sections. Examples include:

• Definition provisioned by the Act: r 4 prescribes the Mount Lofty Ranges Watershed for the definition in s 3(1) of the Act.
• Consultation and notice provisions: r 5 implements the Act’s s 55(3)(b) requirement about consultation on proposed amendments to water allocation plans.
• Metering regime: Part 5 of the Regulations is expressly designed to operationalise parts of Part 5 of the Act, including supply, installation and testing under s 79 and related sections; r 8 prescribes sections of the Act relevant to recovery of penalties under s 88(6) (r 8).
• Representation, notice and publication obligations: r 22 cross-references s 222 of the Act for giving notices required under ss 113, 137 and 144.
• Water Register interactions: r 45 clarifies that for the purposes of Schedule 4 clause 7(2)(a) of the Act the Minister will give effect to transfers by approving the transfer under Part 8 of the Act.

Interplay with other subordinate instruments and regulations. The Regulations explicitly reference or incorporate other instruments:

• Water Resources (Lower Limestone Coast Prescribed Wells Area) Regulations 2004: r 36(2) imports the definition of Lower Limestone Coast Prescribed Wells Area from that instrument to determine where a 4 year prescribed period applies.
• The Regulations rely on Ministerial specifications, approvals and forms which are likely to be set out in administrative instruments or published policy documents. For example, r 15 expressly allows specifications “determined or approved by the Minister” to apply variably.

Cross-cutting administrative law and rights. The procedural rules for notices, representations, access to documents and publication require the relevant authority or Minister to consider effective publication and provide inspection access; r 22(2) requires consideration of what form of publication will bring the notice to the attention of those most likely to have an interest, without requiring personal service. These procedural prescriptions sit within administrative law principles of natural justice and merits review rights that the Act provides and which are not displaced by the Regulations themselves.

Overlap with environmental regulation and land-use regimes. The Regulations interact with water allocation plans and water affecting activities control policies under the Act (r 18-r 19, r 44). They allow a water allocation plan to exempt persons from s 104(5) water resource works or site use approvals in specified cases (r 19(1)-(3)). Regulation 44 restricts the application of Schedule 2 clause 4 in respect of amendments by a prescribed authority where the amendment is only to correct an error or change form, not substance, thereby trimming procedural requirements for minor administrative amendments. This interface potentially affects land-use and environmental approvals where a water allocation plan prescribes that a licence is required for construction or use (r 19(3)).

Information-sharing and privacy. Regulation 43 requires SA Water and other service providers to provide detailed infrastructure and operational information to the Minister, including volumes, losses and quality. Regulation 43(2) brings the information within s 9(3) of the Act, which concerns use and disclosure. This interacts with other statutory privacy or information-protection regimes by specifying the Minister’s statutory authority to obtain operational data; providers must therefore reconcile these obligations with other legal duties they may hold under privacy or contracts, subject to the Act’s s 9(3) conditions.

Interstate trading frameworks. Regulation 32 addresses transfers under an Interstate Water Entitlements Transfer Scheme, and requires registration fees for initial registration while waiving subsequent fees for transfers in a registered series. It also requires that an intergovernmental agreement underpinning the scheme be recognised by the Minister via determination for the regulation to apply, linking the Regulations to external interstate agreements and corresponding laws of other jurisdictions.

Criminal and debt recovery law. The Regulations prescribe offences and expiation amounts and create debt obligations recoverable as a debt due to the Crown under r 6 and r 9(2)-(3). Those debt recovery paths interact with general public law debt-collection mechanisms, insolvency rules and civil enforcement processes.

In short, the Regulations do not operate in isolation. They concretise many of the Act’s delegations of power, link to other subordinate instruments and to interstate arrangements, affect information flow between public authorities and private infrastructure providers, and embed enforcement and procedural mechanisms within broader administrative and civil enforcement frameworks.

The Regulations include a legislative history section that records their making and variation. The principal instrument and subsequent variations are recorded in the text.

Commencement and principal regulations

• The principal Regulations appear as Landscape South Australia (Water Management) Regulations 2020, No 223 of 2020. The Gazette reference is Gazette 25 June 2020 p 3538 with r 2 (commencement clause) showing commencement from 1 July 2020 for the relevant provision(s) (Legislative history table entry “2020 223 Gazette 25.6.2020 p3538 1.7.2020: r 2”).

Amendments and variations

• A variation instrument is recorded as No 319 of 2020, Gazette 17 December 2020 p 5778, with commencement from 17 December 2020 as to the variation (Legislative history table entry “2020 319 Gazette 17.12.2020 p5778 17.12.2020: r 2”).
• The legislative history identifies specific provisions varied. Notable entries include:
  • r 2 (the regulation that would be the short form commencement provision) was omitted under the Legislation Revision and Publication Act 2002, with that omission recorded as having effect from 17 December 2020. The table states “r 2 omitted under Legislation Revision and Publication Act 2002 17.12.2020”.
  • r 36 in Part 8 was substituted by r 4 of the variation instrument 319/2020, with effect from 17 December 2020. The table entry reads “r 36 substituted by 319/2020 r 4 17.12.2020”.

Notes and references

• The Regulations include a standard note pointing readers to further information on the Act and subordinate legislation via the Index of South Australian Statutes or the legislation.sa.gov.au website.

Interpretation of history entries

• The legislative history table records the principal regulations and one identified variation in 2020. Clause-specific effects recorded include a substitution of r 36, reflecting a change in the prescribed period for certain forest-licence variation matters (r 36 now prescribes a 4 year period for certain unconfined aquifer management areas of Coles, Short and Zone 3A in the Lower Limestone Coast Prescribed Wells Area, and 2 years in other cases).
• The omission of r 2 reflects an administrative housekeeping amendment under the Legislation Revision and Publication Act 2002, which commonly results in the renumbering or omission of technical commencement provisions.

Practical consequence of the amendments

• The recorded substitution of r 36 indicates a tailored temporal regime for variations in the Lower Limestone Coast unconfined aquifer management areas, lengthening the prescribed period from the default 2 years to 4 years in those specific areas. That change was effected by the 17 December 2020 variation instrument No 319/2020.
• The legislative history does not record additional subsequent amendments beyond 2020 in the text provided. Practitioners should check the South Australian legislation website for any later amendments, commencement notices, or related statutory instruments that alter Ministerial specifications or fees, or that add further operational directions.

The Regulations’ legislative history as presented shows initial framing in mid-2020 and a material amendment later that year focusing on Part 8 timing, with housekeeping omissions under the Legislation Revision and Publication Act 2002. The history as recorded is limited; users should confirm currentness against the consolidated online version.

The Regulations as provided include no cases, judicial decisions or recorded litigation history. The legislative text does not cite any court decisions, nor does it annotate prior litigation concerning any of the provisions in the Regulations. Therefore the direct litigation history at the instrument level is nil in the source.

Operational implications of the absence of litigation history

• Absence of recorded decisions means there is no judicially developed interpretive guidance specific to the Regulations available within the text. Key areas where judicial clarification might be sought but is not recorded here include:
  • The scope of Ministerial discretion to determine specifications, approve competent persons and set conditions for meter installation and validation (r 13-r 15).
  • The threshold for what constitutes an “unreasonable impact” on a water resource or other natural resource that would bar cancellation under r 26(3) and r 27(2).
  • The limits on the Minister’s decision-making when refusing transfers on unpaid levy grounds under r 37(1), including procedural fairness obligations in exercise of that discretion.
  • The interplay between r 6 debt-recovery determinations and insolvency law or contractual priority where a regulated person has competing creditors.
  • The interpretation of “associated infrastructure” and the scope of pipes and fittings a person may not cut into without Ministerial authority under r 12(2), which materially affects property configuration.

Compliance and administrative risk in the absence of case law

• Administrative discretion is significant in the Regulations: the Minister determines specifications, approves competent persons, determines charges by Gazette and has discretion in refusal and cancellation decisions. Where the instrument is silent on the limits of discretion or procedural modalities, the regulated community faces higher compliance and legal uncertainty risks that may only be resolved by administrative appeals, merits review avenues under the Act, or through judicial review proceedings where statutory rights and obligations are engaged.
• Practitioners should therefore treat the Regulations as a framework that has not yet been the subject of judicial gloss. This increases the importance of careful compliance, detailed record-keeping, seeking required approvals in writing, and, where appropriate, obtaining procedural protections such as requests for reasons or decisions in writing to support review rights under the Act.

Recommended practical approach in light of no litigation precedent

• Capture and retain documentation of each interaction with the Minister or relevant authority, including notices, approvals, testing certificates and evidence of meter readings and maintenance, so that if disputes arise there is an evidentiary record to support administrative review or judicial proceedings.
• Where significant rights are at stake, such as transfers of allocation, cancellation of approvals, or conflicting rights about meter ownership and costs, consider seeking binding advice, merits review applications or pre-emptive negotiation with the relevant authority to secure written positions before undertaking irreversible actions.

Because the Regulations contain no litigation history in the provided source, practitioners must rely on the text, the Act, administrative law principles and any related policy documents for interpretive guidance until case law develops. Checking for updated consolidated versions and any subsequent, post-2020 judicial decisions concerning the Act or the Regulations is prudent.

The Regulations contain numerous technical and procedural traps that can produce consequential administrative, financial and operational outcomes if not anticipated. The following lists concrete “gotchas” identified in the text, with citations and practical consequences.

Meter governance and ownership

• Minister retains meter property until costs paid: A meter supplied by the Minister remains the property of the Minister unless all relevant costs are paid or the Minister transfers the meter (r 9(3)). Practical consequence: paying installation costs may not confer ownership unless the Minister transfers title; unpaid costs leave a debt to the Crown and may constrain subsequent dealings with the meter or land sale.
• Rent liability for Minister-owned meters: Users measured by Minister-owned meters are liable for rent comprised of the prescribed fee (r 10(1)). Ensure budgeting for ongoing rent and confirm the “prescribed fee” under the Act as it may change.

Technical accuracy and testing deadlines

• Manufacturer accuracy and testing thresholds: New meters must be rated by the manufacturer to at least plus or minus 2.5% accuracy (r 13(1)(a)). During testing, meters found outside an accuracy rating of plus or minus 4% must be refurbished and certified before reinstallation (r 14(11)). Practical consequence: a meter marginally outside tolerance triggers refurbishment and recertification costs plus potential measurement uncertainty periods.
• Time-limits for removal, testing and certification: A removed meter must be tested and reinstalled, or a replacement installed, within 28 days after Ministerial approval for removal, unless the Minister approves a longer period (r 14(7)). Certificates of testing must be provided within 14 days after testing (r 14(9)). Practical consequence: tight timelines require pre-scheduling of approved testers and logistics; delays risk non-compliance and remedial cost recovery by the Minister (r 16(3)).

Approval and transfer risks

• Refusal of transfer for unpaid levies: The Minister must refuse a transfer application if the applicant has not paid a water levy, or part of it, and the Minister thinks refusal appropriate (r 37(1)). Practical consequence: unpaid levies can block transfers even where the transfer should otherwise be permitted; levy diligence is essential before lodging transfer applications.
• Tagged interstate trades registration fee model: For interstate series transfers, an initial registration fee is payable but no further fee is payable for later transfers in the registered series (r 32(1)(e)-(f)). Practical consequence: failure to register the series may lead to multiple fees or delay; ensure the intergovernmental agreement is recognised by Ministerial determination.

Environmental donation timing and refund calculation

• Timing-sensitive refund percentages: The refund percentage for donated entitlements varies by the date the donation or condition takes effect in the financial year, from 100% for donations taking effect 1-10 July, down to 0% for donations taking effect 1 April-30 June (r 7(5)). Practical consequence: poorly timed donations yield reduced or no refund for the current financial year; donors must plan the effective date to maximise refund entitlements.

Interference prohibitions and associated infrastructure definitions

• Prohibitions on altering relevant pipes and fittings: Regulation 12(1)(d) prohibits cutting into pipes, installing fittings providing access to pipe interiors, or changing pipe configuration without Ministerial authority. The definition of how far downstream/upstream this applies includes the S bend, first T junction, elbow or any other distance determined by Ministerial specification (r 12(2)). Practical consequence: private plumbing or retrofits near meters may require prior Ministerial approval, and the scope can be varied by Ministerial specifications; unauthorised work risks penalties.

Ministerial specification and approval dependence

• Many obligations depend on Ministerial specifications or approvals: r 13, r 14 and r 15 repeatedly require that meters be installed, tested, maintained and certified in accordance with specifications determined or approved by the Minister and tested by competent persons approved by the Minister. Practical consequence: regulated persons cannot unilaterally comply by following manufacturer guidance alone; they must secure Ministerial approvals and keep pace with specification changes.

Debt recovery and remedial entry

• Ministerial remedial action recoverable as a debt: If a person fails to comply with meter-related directions, the Minister may enter the land and remedy the failure, and the costs are a debt to the Crown (r 16(3)). Practical consequence: delay in complying with a direction risks immediate remedial action and potentially higher costs than voluntary compliance.

Procedural timing traps

• Short representation timeframes with limited extension: Representations under r 23 must be in writing and made within 20 business days of notice. While r 24 allows the relevant authority to extend the 10-business-day response period for applicants, there is no express parallel extension for representors. Practical consequence: missing the 20-business-day window risks inability to be considered; organisations should monitor notices and act promptly.

Cancellation triggers and “unreasonable impact” caveat

• Cancellation on non-use or non-construction: Water resource works approvals and site use approvals may be cancelled if not constructed within 2 years, removed without replacement within 1 year, or not used for specified durations, subject to consultation and a prohibition on cancellation that would have an “unreasonable impact” (r 26, r 27). Practical consequence: developers and operators must monitor construction and use timelines to prevent automatic cancellation; but the “unreasonable impact” standard is administratively discretionary and not defined in the Regulations.

Information-sharing demands on SA Water and others

• Wide data requests: r 43 requires SA Water and other providers to provide extensive data on infrastructure location, materials, capacity and volumes and quality of stored, lost and discharged water. Practical consequence: service providers must have systems to extract and provide technically detailed operational data on demand, and third-party confidentiality or contractual limits must be reconciled with the Minister’s request powers.

Prescribed date and retrospective framing

• Prescribed date implications: r 21 prescribes 2 July 1997 as the relevant date for s 111(1) of the Act. Practical consequence: rights or timings that depend on that date may be affected; historical title or entitlement issues may hinge on that date.

In sum, the Regulations embed multiple timing, technical, ownership and procedural details that can easily be overlooked. Each “gotcha” is rooted in a statutory provision that creates either an immediate compliance duty or a latent bar to transaction (for example transfers blocked for unpaid levies). Practitioners should map obligations to operational calendars and ensure approvals, testing, payments and documentary proofs are pre-arranged.

This section outlines a practical compliance checklist and recommended steps tied to specific Regulation citations. Compliance requires attention to technical metering regimes, levy payment and refund rules, notification and representation processes, approval and transfer rules, data obligations and enforcement risks.

1. Meter inventory and status audit

• Identify all meters on your land, whether Minister-owned or privately owned, and determine which are required under water management authorisations (r 9(1), r 11(1)).
• Record ownership status, installation dates, manufacturer accuracy ratings, serial numbers and presence of security seals. Note whether meters are Minister-supplied and therefore remain property of the Minister until costs are paid (r 9(3)).

2. Technical compliance: installation, testing and maintenance

• Ensure any new meters purchased or installed are rated by the manufacturer to plus or minus 2.5% accuracy and meet any Ministerial specifications (r 13(1)(a)-(b)).
• For installation, engage persons approved by the Minister if required, and install meters according to Ministerial specifications (r 13(2)-(3)).
• Arrange regular maintenance in line with Ministerial specifications and ensure only manufacturer-approved parts are used for repairs (r 13(4)-(5)).
• For testing: schedule tests with competent persons approved by the Minister, obtain readings immediately before removal and again immediately after installation, provide readings to the Minister within any period determined by the Minister, and obtain certificates of testing in the required form within 14 days after testing (r 14(4)-(11)).
• If testing on site is approved by the Minister, ensure on-site testing meets the Ministerial specifications and that any refurbishment prescribed is carried out and certified (r 14(16)).

3. Avoid meter interference and maintain the immediate area

• Do not take water except through the meter and do not tamper with seals, adjust the meter or change relevant pipes without Ministerial authority (r 12(1), r 12(2)).
• Keep sand, soil and other materials from building up around the meter and maintain cleared vegetation around the meter (r 12(4)).
• If damage occurs, follow any written directions from the Minister to repair or replace the meter or associated infrastructure promptly (r 12(5)).

4. Manage financial obligations

• Pay water levies promptly to avoid transfer refusal risks under r 37(1) and possible recovery charges determined under r 6.
• If a Minister supplies or installs a meter, be prepared to pay costs that will be a debt to the Crown until paid; ensure that budgetary approvals cover such costs (r 9(2)-(3)).
• For Minister-owned meters, budget for the prescribed rent fee (r 10(1)). Confirm the current prescribed fee under the Act.

5. Plan and document environmental donations carefully

• If donating whole or part of an entitlement for environmental purposes and seeking a levy refund, ensure the recipient is an accredited environmental donations entitlement-holder under the criteria determined by the Minister and applied by the regional landscape board (r 7(1)-(2)).
• Time the effective date of the donation to maximise refund percentage under the prescribed table; note the sliding percentages by date (r 7(5)). Keep documentary proof of the effective date and accreditation.

6. Transfer and trade readiness

• Before applying to transfer allocations, confirm payment of water levies and any other statutory debts to avoid refusal (r 37(1)).
• For joint applications to vary water take or use limits across multiple licences or approvals, ensure the variation is consistent with sections 124(3), 136(4) or 143(3) of the Act and file joint applications where appropriate (r 33).
• For tagged interstate trades, ensure the intergovernmental agreement is recognised by the Minister’s determination and register the transfers to benefit from the one-fee registration model (r 32(1)(d)-(f)).

7. Procedural and representation compliance

• If you are a licence-holder who might be affected by a proposed amendment to a water allocation plan, expect written notice and at least two months to submit (r 5(1)-(2)). Track notice dates and prepare submissions accordingly.
• Where a notice is published under ss 113, 137 or 144, inspect the application as per the address included in the notice and lodge any representation in writing within 20 business days, including name, address and whether you wish to be heard (r 22, r 23).
• For applicants responding to representations under ss 113(5), 137(d) or 144(d), prepare a response within 10 business days unless the relevant authority extends the period (r 24).

8. Well driller and forestry licence compliance

• Well drillers should keep records, produce samples and comply with Chief Executive directions, ensuring records are kept in the manner and for the period directed (r 25).
• Forestry operators must understand the Regulations’ exceptions for harvesting activities, prescribed periods for variation in the Lower Limestone Coast unconfined aquifer management areas, and circumstances where transfers may be refused if levies are unpaid (r 34-r 37).

9. Responding to Ministerial information requests

• SA Water and other reticulated service providers must be prepared to provide infrastructure location, materials, capacity and water volume and quality information at the Minister’s request; maintain systems to extract and deliver that data in the form the Minister may determine (r 43(1)-(2)).

10. Records, audit trail and administrative protection

• Keep copies of all notices, approvals, meter readings, test certificates, invoices, payments and communications with the Minister and regional landscape boards to enable administrative review or to defend enforcement actions. Certificates of testing must be kept and provided within the required timeframe (r 14(9)-(10)).
• Where Ministerial approvals or specifications are sought or received, obtain them in writing and record the exact scope and any limitations.

11. Engage early with approvals and dispute resolution

• If a proposed cancellation of a water resource works approval or site use approval appears possible under the prescribed schemes, engage early with the Minister, provide evidence of intended use or reasonable construction progress, and if necessary raise the risk of “unreasonable impact” on the resource to avoid cancellation (r 26(2)-(3), r 27(1)-(2)).
• For any dispute about a Ministerial decision, consider statutory merits review processes under the Act and preserve grounds for judicial review if administrative decision-making lacks procedural fairness.

12. Monitor regulatory changes and fees

• The Regulations reference Minister determinations and the Act for prescribed fees and powers. Regularly check the consolidated Regulations and the Gazette for fee determinations, Ministerial specifications, competent person approvals and any new Ministerial determinations or intergovernmental recognitions relevant to interstate trades (r 6, r 10, r 13-r 15, r 32).

This compliance blueprint maps specific regulatory sources to required actions. For larger operators, consider a dedicated compliance register and scheduled rehearsals of meter testing, certifications and payment cycles to avoid timing-related penalties and transfer blockages.
