Lands for Public Purposes Acquisition Act 1914

The Act defines several key concepts. Land is defined broadly to include messuages, tenements, hereditaments, houses, buildings, and any estate or interest (legal or equitable) in land, as well as any easement, right, power, or privilege in, under, over, or affecting land (s 2). Owner includes any person with any estate or interest (legal or equitable) in land, or any easement, right, power, or privilege, or who by the Compulsory Acquisition of Land Act 1925 is enabled to sell and convey such interests (s 2). This is a wide definition that captures not only fee simple owners but also holders of leases, mortgages, easements, and other incorporeal rights. Proclamation means a proclamation made by the Governor and published in the Government Gazette (s 2). Public purpose is defined entirely by reference to s 4: a purpose that the Governor has declared by proclamation to be a public purpose. Section 4 lists three categories: (I) providing offices, buildings, and premises for carrying on the government of the State or any department; (II) any work or undertaking that the government is empowered by any Act to carry out but for which there is no power (except this Act) to acquire land; and (III) any purpose that both Houses of Parliament resolve shall be a public purpose (whether in the same or different sessions). Once declared, that purpose “shall be deemed to be an undertaking within the meaning of the Compulsory Acquisition of Land Act 1925 … as if it were an undertaking authorised by Act of Parliament” (s 4). Promoter of the undertaking is defined in s 2 as the promoter appointed by proclamation with regard to the particular public purpose. The Governor may appoint a person or the holder for the time being of a specified office (s 5(a)). This promoter then has the powers of “promoters of an undertaking” under the incorporated Acts (s 8). Vesting is addressed in s 6: all acquired land is conveyed to and vests in the person or officer nominated by proclamation, or if none is nominated, in His Majesty the King. Section 11 sets out the registration procedure: when land vests in His Majesty, the Governor may lodge the muniments of title with the Registrar-General, who must make entries in the Register Book. If the land is under the Real Property Act 1886, the Registrar-General cancels the existing certificate of title and the land is thereafter treated as if it had never been alienated from the Crown (s 11(3)). Surplus land is land taken or acquired for a public purpose that is no longer required for that purpose; it may be used for another public purpose, sold, exchanged, or otherwise disposed of with the Governor’s consent (s 17(1)). The Act requires an annual report to Parliament by July of each year listing all surplus land dealings, the price or other consideration, and terms and conditions (s 17(5)). Finally, moneys for acquisition must be voted by Parliament, either under this Act or under the appropriation for the specific public purpose (s 18).

The Act directly affects three primary groups: (1) the Crown and its instrumentalities; (2) owners of land (as broadly defined); and (3) officeholders and persons appointed as promoters or nominees. For the Crown, the Act provides a mechanism to acquire land for purposes that otherwise lack a compulsory acquisition power. The Governor is the central actor: he or she decides whether to declare a purpose a public purpose, whether to direct that particular land be acquired, and whether to appoint a promoter and nominee. The promoter - who may be a named person or the holder of a specified office (e.g. the Minister for Infrastructure) - is the party empowered to take and acquire land, enter into agreements, and carry out the compulsory process. The nominee (who may be the same or a different person) holds legal title to the acquired land on behalf of the Crown, or the land vests directly in His Majesty. Owners of land affected are those whose property is identified for acquisition. Because “owner” includes any person with any legal or equitable interest, this includes lessees, mortgagees, and easement holders. They are subject to compulsory acquisition, but the Act itself does not prescribe their rights to compensation or procedural safeguards; those are found in the incorporated Compulsory Acquisition of Land Act 1925. The Registrar-General is also affected: upon vesting in the Crown, the Registrar-General must cancel existing certificates of title and make entries treating the land as never alienated (s 11). This affects any subsequent dealings, as the land reverts to Crown land status. Parliament is affected through its funding role: all moneys for acquisitions must be voted by Parliament (s 18), and annually the Governor must table a report on surplus land dispositions (s 17(5)). That report gives Parliament oversight of executive decisions to sell or repurpose acquired land. Potential purchasers or recipients of surplus land are also affected: they deal with the Crown or nominee, and the Act provides that a person paying money need not prove the Governor’s consent nor inquire whether a proper case has arisen for the exercise of power (s 17(2)). That provision protects purchasers from having to investigate the validity of the disposal. Finally, the Act expressly excludes land that is within a public park or park lands vested in or controlled by a municipal corporation or district council (s 3). Those bodies are not subject to acquisition under this Act for their park lands.

The Act creates few explicit duties and confers broad discretionary rights on the Crown. The principal right is the right of the promoter (on behalf of the Crown) to “take and acquire, either by agreement or compulsorily, any land which is required for the said purpose” (s 6). This right is conditional: (a) the Governor must have declared the purpose a public purpose under s 4; and (b) the Governor must have given a written direction that the particular land be acquired (s 6 proviso (a)). Without this written direction, the promoter has no power to act. The right also depends on the incorporation of the Compulsory Acquisition of Land Act 1925, which will contain the detailed powers (e.g. to enter land, survey, negotiate compensation, and take possession). Importantly, the promoter is given the same powers as “promoters of an undertaking” under the incorporated Acts (s 8). The Act also confers a right on the Governor to dispose of surplus land: it may be used for another public purpose, sold, exchanged, or otherwise disposed of, but only with the Governor’s consent (s 17(1)). The person in whom the land is vested (or the Governor if vested in His Majesty) may execute any assurance, deed, or instrument necessary to effect the disposal (s 17(2)). The Act confers a right on purchasers or other parties dealing with the Crown: they are not required to prove the Governor’s consent or to inquire into the propriety of the transaction (s 17(2)). This provision shields good-faith purchasers from later challenges based on procedural defects. The Registrar-General has a duty, upon receiving the transfer or other instrument when land vests in His Majesty, to make the necessary entries in the Register Book, including cancelling the certificate of title (s 11(2)(3)). The Governor has a duty to cause an annual report to be prepared by July of each year, with particulars of all surplus land dealings, and to lay it before both Houses of Parliament within 14 days of preparation or of the next session (s 17(5)). That is the only explicit reporting obligation in the Act. Landowners whose property is acquired have rights under the incorporated 1925 Act (e.g. compensation, objections, valuation), but the 1914 Act itself does not enumerate any rights for owners beyond the definitional inclusion that an “owner” is someone who, by the 1925 Act, is enabled to sell and convey interests (s 2). That is a recognition that the 1925 Act governs the transfer of title. The Act also implicitly gives the Governor a right to determine who holds title: the nomination of a person or officer under s 5(b) can be made in the same proclamation as the declaration of public purpose or a subsequent one. There is no apparent right for an owner to challenge the declaration of public purpose under this Act; the only recourse would be under the incorporated Act or by judicial review of the Governor’s decision.

The Lands for Public Purposes Acquisition Act 1914 does not itself prescribe any penalties for non-compliance. It creates no criminal offences, no civil penalties, and no specific enforcement mechanisms for failure to comply with its provisions. The only obligation that carries a potential consequence is the duty on the Registrar-General under s 11 to make entries upon vesting, but that duty is directory and the Act does not specify a sanction for delay or failure. The annual reporting requirement under s 17(5) is a statutory duty on the Governor, but again no penalty is provided for late or incomplete reports. The Act relies for enforcement on (a) the incorporated Compulsory Acquisition of Land Act 1925, which may contain penalties for obstruction, refusal to give possession, or other misconduct; and (b) general law remedies such as judicial review of a Governor’s decision (e.g. for jurisdictional error, bad faith, or failure to comply with statutory preconditions). A landowner who wishes to challenge an acquisition would need to invoke the 1925 Act’s provisions (e.g. for compensation or objections to the validity of notices). The 1914 Act is a pure enabling and procedural statute; it delegates virtually all substantive enforcement to the incorporated Act. Furthermore, the Act’s provision protecting purchasers from having to inquire into the Governor’s consent (s 17(2)) effectively removes any incentive for a purchaser to enforce compliance by the Crown. If the Crown fails to obtain the necessary consent or to follow proper procedure, the purchaser is not liable and cannot be required to investigate. That is a structural feature that reduces the risk for buyers but also weakens the enforcement of the Governor’s internal controls. Theoretically, the Auditor-General or a parliamentary committee could scrutinise the annual report for irregularities, but the Act does not create a private right of action. In short, the Act relies on political accountability (Parliamentary oversight) and the procedural safeguards of the incorporated 1925 Act rather than on its own penalties.

The Act is explicitly designed to interlock with two other South Australian statutes: the Compulsory Acquisition of Land Act 1925 and the Real Property Act 1886. Section 7(1) states that the Compulsory Acquisition of Land Act 1925 is incorporated with this Act for the purposes of taking and acquiring land and for all matters incidental to that, but that where a provision of the 1925 Act is inconsistent with this Act, this Act prevails. This means that the entire machinery of compulsory acquisition - including notices of intention, entry, valuation, compensation assessment, and possession - is imported by reference, except to the extent that the 1914 Act overrides specific provisions. The 1914 Act does not specify which provisions of the 1925 Act are inconsistent; that would need to be determined case by case. The 1914 Act also creates a new category of “undertaking” for the 1925 Act: once a purpose is declared a public purpose under s 4, it is deemed “an undertaking within the meaning of the Compulsory Acquisition of Land Act 1925 … as if it were an undertaking authorised by Act of Parliament” (s 4). This is a critical interaction because it brings the 1925 Act’s compulsory acquisition powers to bear on purposes that might not otherwise qualify. For example, category II in s 4 refers to a work or undertaking that the government is empowered to carry out by another Act but for which there is no land acquisition power. The 1914 Act fills that gap by deeming it an undertaking under the 1925 Act. The Act also interacts with the Real Property Act 1886. Section 11(3) requires the Registrar-General, upon receiving a transfer or other instrument conveying land to His Majesty, to cancel the certificate of title and treat the land as if it had never been alienated from the Crown. This provision effectively erases the Torrens title and reverts the land to the Crown’s original paramount ownership. Section 11(4) requires the Registrar-General to cancel any existing grant and issue a fresh certificate for any balance not acquired. The 1990 and 2016 amendments to s 11 reflect changes to that procedure (e.g. electronic conveyancing). The Act also interacts with local government and parks legislation. Section 3 excludes from its operation any land that is within a public park or park lands that is vested in or under the control of a municipal corporation or district council. This means that a different acquisition mechanism (likely under the Local Government Act or specific park legislation) must be used for such land. Section 17(4) provides that nothing in s 17 interferes with any power of leasing surplus land under an enactment relating to Crown lands, so the Crown Lands Management Act (or equivalent) may also be relevant. Finally, because all moneys for acquisitions must be voted by Parliament (s 18), the Act operates within the framework of annual appropriations and the Constitution’s control over public expenditure.

The Act was originally enacted as The Lands for Public Purposes Acquisition Act 1914 (No 1154 of 1914), assented to and commencing on 24 September 1914. It has been amended six times, according to the legislative history provided. The first amendment was by the Statute Law Revision Act 1935 (No 2246 of 1935), a standard housekeeping measure that likely corrected cross-references or repealed spent provisions. The National Parks Act 1966 (No 77 of 1966) amended the Act, but the specific provision varied is not shown in the table for s 11 (the table only shows amendments after 3 February 1976). Given that s 3 excludes public parks, the 1966 amendment may have adjusted that exclusion or definitions in light of the new National Parks Act. Similarly, the National Parks and Wildlife Act 1972 (No 56 of 1972) amended the Act, again likely to align with the new national parks regime. The most significant substantive amendment came from the Real Property Act Amendment Act 1990 (No 9 of 1990), which amended s 11(3) and s 11(4) effective 21 May 1990. The 1990 amendment replaced references to the old Real Property Act 1886 procedures with updated wording, including the cancellation of certificates of title. The Real Property (Electronic Conveyancing) Amendment Act 2016 (No 29 of 2016) further amended s 11(1) and s 11(4), effective 4 July 2016, to accommodate electronic conveyancing and electronic lodgement of instruments. The legislative history notes that earlier versions of the Act (historical versions) are listed at the end of the legislative history, and that references in the legislation to other Acts or bodies may be obsolete. The Act itself has not been the subject of a comprehensive rewrite; it remains very close to its 1914 form, with only these targeted amendments to s 11 and the exclusion provisions. No amendments have altered the core structure of ss 4, 5, 6, 7, 8, 17, or 18 since 1914, which means the Act has remained a stable enabling framework for over a century.

The source text for this Act does not record any litigation history. No cases are cited in the Act itself, and the legislative history does not refer to any judicial decisions. This is unsurprising for an enabling Act of this type, which is rarely litigated directly. Most disputes arising from acquisitions under this Act would likely be brought under the incorporated Compulsory Acquisition of Land Act 1925, which would contain provisions for compensation disputes, objections to notices, and challenges to the validity of acquisition. Landowners who wished to contest a declaration of public purpose could potentially seek judicial review of the Governor’s proclamation, but the source does not indicate whether any such challenges have occurred. The Act’s broad language - allowing the Governor to declare any purpose in the three categories, with category III effectively letting Parliament designate any purpose - gives the executive wide latitude, making a successful challenge difficult. The exclusion of public parks (s 3) might generate disputes over whether particular land qualifies as a public park or park lands vested in or controlled by a council, but again no cases are reported in the source. The surplus land provisions (s 17) could theoretically be litigated if the Crown attempts to sell land that is still required for the original purpose, but the Governor’s consent to disposal is a subjective decision and the purchaser is protected by s 17(2) from having to inquire. The annual reporting requirement might be enforced by Parliament, but that is a political remedy. In summary, the source provides no evidence of litigation under this Act. Practitioners should be aware that any relevant case law would likely be found under the Compulsory Acquisition of Land Act 1925 or under general administrative law principles. Because the Act is so skeletal, the likelihood of direct litigation on its wording is low.

Several provisions in the Act are easily overlooked and can produce counterintuitive results. First, the definition of “owner” in s 2 is extremely broad: it includes any person with any estate or interest (legal or equitable) in the land, and also any person “by the Compulsory Acquisition of Land Act 1925 enabled to sell and convey such estate, interest, easement, right, power, or privilege”. This means that a leaseholder, a mortgagee, or even a holder of an unregistered equitable interest is an “owner” for the purposes of the Act. However, the Act does not require that all such owners be individually notified or compensated under its own terms; the process falls to the incorporated 1925 Act. If that 1925 Act has narrower notification requirements, some interest holders might be missed. Second, s 6(a) requires that the Governor give a written direction that “the same shall be so acquired” before any land can be taken or acquired. This direction is a precondition to the exercise of the power. If the direction is not in writing, the acquisition is invalid. However, the Act does not specify the form or content of the direction, and it is unclear whether the direction can be for a class of land or must specify each parcel. Third, s 3 excludes from the Act any land within a public park or park lands that is vested in or under the control of a municipal corporation or district council. The exception is conditional on both elements: the land must be a public park (or within one) AND vested in/under control of a council. If a park is owned by the Crown or a state authority, the exclusion does not apply and the Act can be used to acquire it. This creates a gap where community parks not under council control can be acquired without the protection the exclusion would provide. Fourth, the Governor’s power to declare a public purpose under s 4 is not limited to purposes previously authorised by Parliament, except for category II (which requires the government to be empowered to carry out the work by some Act). Category I covers any offices and buildings for carrying on government - a very broad category. Category III allows Parliament by resolution to designate any purpose, with no requirement for an Act. This means the scope of “public purpose” is essentially unlimited if the executive can secure a parliamentary resolution. Fifth, the annual report requirement in s 17(5) does not require the report to include compensation paid or the original cost of acquisition. It only covers surplus land dealings. Thus, Parliament has no statutory right to receive aggregate data on all acquisitions or their costs under this Act. Sixth, the protection for purchasers in s 17(2) (“it shall not be necessary for the person paying any moneys … to prove the consent of the Governor … nor to inquire whether a proper case has arisen”) places the entire risk of wrongful disposal on the Crown. If the Governor consents to a sale of land that is still needed for the public purpose, the purchaser takes good title and the public loses the land. The Act provides no mechanism to claw back such land. Seventh, the Act does not contain a provision requiring the Crown to pay compensation before taking possession. That is left to the incorporated 1925 Act, but if that Act is not properly followed, the Crown could theoretically take land without immediate payment. Eighth, section 8 gives the promoter the same powers as “promoters of an undertaking” under the incorporated Acts, but the 1914 Act does not define those powers beyond referring to the 1925 Act. A promoter must therefore read both Acts together; relying solely on the 1914 text will miss critical procedural steps.

Compliance with the Lands for Public Purposes Acquisition Act 1914 is a multi-step process for any government entity or promoter seeking to acquire land. Step one: confirm that the proposed acquisition is not caught by the exclusion in s 3. If the land is within a public park or park lands that is vested in or under the control of a municipal corporation or council, this Act cannot be used; a different acquisition mechanism must be sought. Step two: ensure that the purpose for which the land is required falls within one of the three categories in s 4. If it is category I (offices and buildings for government) or category II (a work the government is empowered to carry out but lacks land acquisition power), the Governor can proceed by proclamation. If it is category III, the promoter must first secure a resolution from both Houses of Parliament declaring the purpose a public purpose. Step three: cause the Governor to issue a proclamation under s 4 declaring the purpose a public purpose. The same or a subsequent proclamation must appoint a promoter of the undertaking (s 5(a)) and nominate a person or office holder to take title to the land (s 5(b)). If no nominee is appointed, the land will vest in His Majesty the King. Step four: before any acquisition can proceed, the Governor must issue a written direction under s 6(a) specifying that the particular land be acquired. The direction should be in writing and should identify the land with sufficient particularity. No acquisition can occur without this direction. Step five: the promoter then proceeds with the acquisition mechanism under the incorporated Compulsory Acquisition of Land Act 1925. This will involve giving notice to owners (as defined in s 2), negotiating price, and if no agreement is reached, resorting to compulsory procedures such as serving a notice to treat or a notice of intention to acquire. The promoter must comply with all requirements of the 1925 Act except where they are inconsistent with the 1914 Act (s 7(1)). Step six: upon completion of the acquisition, the land is conveyed to the nominated person or officer, or to His Majesty. If the land is under the Real Property Act 1886, the promoter or the Governor must lodge the transfer or other instrument with the Registrar-General for registration under s 11. The Registrar-General will cancel the certificate of title and the land will revert to Crown land status. Step seven: secure funding. All moneys for the acquisition must be paid out of moneys voted by Parliament either under this Act or for the specific public purpose (s 18). The promoter should ensure that a sufficient appropriation exists before committing to purchase. Step eight: if at any later time the land becomes surplus to requirements (i.e. no longer needed for the original public purpose), the Governor may consent to its use for another public purpose, sale, exchange, or other disposition (s 17(1)). The person holding title (or the Governor if vested in the Crown) can execute the necessary documents. The proceeds must be paid into general revenue unless the land was originally paid for out of funds voted for a particular public purpose, in which case they are credited to that purpose (s 17(3)). Step nine: every July, the Governor must cause a report to be prepared listing all surplus land dealings during the preceding financial year, including the price or other consideration and terms and conditions (s 17(5)). That report must be laid before both Houses of Parliament within 14 days after preparation or after the commencement of the next session. Failure to report does not invalidate the disposal but may lead to political consequences. Step ten: maintain records of the Governor’s written directions, proclamations, and the consent to any disposals, as these may be needed to demonstrate compliance if a transaction is later challenged. A purchaser of surplus land is protected by s 17(2) and need not check the Governor’s consent, but the vendor Crown should still ensure proper authorisation to avoid internal audit issues.
