39 Agreement and determination under Subdivision P made before 30 September 1998 (1) Where, immediately before 30 September 1998: (a) an agreement under section 31(1)(b) of the old Native Title Act had been made; or (b) a determination under section 38(1) of the old Native Title Act had been made, the agreement or determination is saved and applies instead of the pre-acquisition procedures under Divisions 1 and 2 of this Part.
