### 59 Failure to determine an application for a permit
> > (1) [*\[Section 59 Subsection (1) amended by No. 51 of 2013, s. 7, Applied:01 Mar 2014\]*](/view/html/inforce/2014-03-01/act-2013-051#GS7@Hpa@EN) The failure of a planning authority to determine an application for a permit to which [section 57](#GS57@EN) or [58](#GS58@EN) applies before the expiration of the period, or, where applicable, the further period, referred to in [section 57(6)(b)(i)](#GS57@Gs6@Hpb@Hqi@EN) or [(ii)](#GS57@Gs6@Hpb@Hqii@EN) or [58](#GS58@EN) [(2)](#GS58@Gs2@EN) is deemed to constitute a decision to grant a permit on conditions to be determined by the Appeal Tribunal.

> > > > (ab) [*\[Section 59 Subsection (2) amended by No. 51 of 2013, s. 7, Applied:01 Mar 2014\]*](/view/html/inforce/2014-03-01/act-2013-051#GS7@Hpd@EN) if the Heritage Council has notified the planning authority under [section 36(3)(b) of the](/view/html/inforce/2026-04-12/act-1995-117#GS36@Gs3@Hpb@EN) [Historic Cultural Heritage Act 1995](/view/html/inforce/2026-04-12/act-1995-117) that it wishes to be involved in the determination of the application, on the Heritage Council; and

> > that the permit has been deemed to have been granted on conditions to be determined by the Appeal Tribunal.

> > > > (b) grant the permit and direct that the permit must contain specified conditions; or

> > (5AA) [*\[Section 59 Subsection (5AA) inserted by No. 43 of 2009, s. 9, Applied:01 Jan 2010\]*](/view/html/inforce/2010-01-01/act-2009-043#GS9@Hpb@EN) The Appeal Tribunal must not make an order under [subsection (5)](#GS59@Gs5@EN) directing a planning authority to pay costs for a failure to determine an application within a period, or a further period, referred to in [subsection (1)](#GS59@Gs1@EN) , if the failure only arose because a purported decision of the authority within that period was of no effect in law.

> > (8) Where a planning authority makes a decision under [subsection (7)](#GS59@Gs7@EN) it must, within 7 days of making the decision, serve notice of its decision on the applicant and, where representations have been made in relation to the application under [section 57](#GS57@EN) [(5)](#GS57@Gs5@EN) , on all persons who made representations.
