### 57A Mediation

> > (1) In this section,
> >
> > > ***party*** means any of the following persons:
> > >
> > > > > (a) a person who made an application to a planning authority for a permit under [section 57](#GS57@EN) ;
> > > >
> > > > > (b) the planning authority to whom the application for a permit under [section 57](#GS57@EN) was made;
> > > >
> > > > > (c) any person who made a representation under [section 57(5)](#GS57@Gs5@EN) in relation to the application for a permit under [section 57](#GS57@EN) .

> > (2) If the applicant for a permit under [section 57](#GS57@EN) or any person who has made a representation under [section 57(5)](#GS57@Gs5@EN) requires mediation to be conducted in relation to the application, the applicant or other person must notify, in writing, the planning authority.
>
> > (3) If the planning authority receives notification under [subsection (2)](#GS57A@Gs2@EN) or wishes mediation to be conducted in relation to an application for a permit under [section 57](#GS57@EN) , it must notify in writing any other party and seek the agreement of that party for mediation to be conducted in relation to the application.
>
> > (4) If 2 or all parties agree that mediation should be conducted in relation to an application for a permit under [section 57](#GS57@EN) , the parties must agree on the person who is to conduct the mediation and on any other terms or conditions in relation to the conduct of the mediation.
>
> > (5) If 2 or all parties agree that mediation should be conducted in relation to an application for a permit under [section 57](#GS57@EN) , the period within which the planning authority must make its decision in relation to the application may be extended under [section 57(6A)](#GS57@Gs6A@EN) .
