### 40C Direction to prepare draft amendments of LPS

> > (1) The Minister, by notice in writing to a planning authority in respect of a municipal area, may direct the authority to prepare under [section 40D](#GS40D@EN) a draft amendment of an LPS that applies to the area, for any one or more of the following purposes:
> >
> > > > (a) to ensure that the LPS will comply with, or be consistent with, the SPPs;
> > >
> > > > (b) [*\[Section 40C Subsection (1) amended by No. 36 of 2018, s. 21, Applied:17 Dec 2018\]*](/view/html/inforce/2018-12-17/act-2018-036#GS21@EN) to ensure that the LPS is, as far as practicable, consistent with the applicable regional land use strategy;
> > >
> > > > (c) to ensure the satisfactory application of a State Policy;
> > >
> > > > (d) to ensure that the LPS is in accordance with a direction of the Minister under this Act;
> > >
> > > > (e) on the advice of the Commission, any other purpose the Minister thinks fit.

> > (2) A direction to a planning authority under [subsection (1)](#GS40C@Gs1@EN) requiring the planning authority to prepare a draft amendment of an LPS may require that the draft amendment of an LPS so prepared be provided to the Commission by a date, specified in the direction, that is not less than 42 days after the date on which the direction is given.

> > (3) The Minister must give notice, in a newspaper published in, and circulating generally in, Tasmania, of a direction given under [subsection (1)](#GS40C@Gs1@EN) .
