### 35J Matters to be considered by Commission

> > (1) As soon as practicable after receiving a report under [section 35F(1)](#GS35F@Gs1@EN) in relation to a draft LPS and holding any hearings under [section 35H](#GS35H@EN) , the Commission must consider –
> >
> > > > (a) the report and the draft LPS to which it relates; and
> > >
> > > > (b) the information obtained at the hearings; and
> > >
> > > > (c) whether it is satisfied that the draft LPS meets the LPS criteria; and
> > >
> > > > (d) whether modifications ought to be made to the draft LPS.

> > (2) The Commission, after receiving a report under [section 35F(1)](#GS35F@Gs1@EN) in relation to a draft LPS and holding all hearings that it is required to hold under [section 35H](#GS35H@EN) , may consider whether there are any matters that relate to issues of a technical nature or that may be relevant to the implementation of the Local Provisions Schedule if the Local Provisions Schedule were approved under [section 35L](#GS35L@EN) in the terms of the draft LPS.
