> > (1) The Minister must not make the State Planning Provisions under [section 27](#GS27@EN) unless the Minister is satisfied that the State Planning Provisions meet the SPPs criteria.

> > (2) The Minister, before making the State Planning Provisions under [section 27](#GS27@EN) , may inform himself or herself, in the manner he or she thinks fit, in relation to any matter.

> > (3) Without limiting the manner in which the Minister may inform himself or herself for the purposes of [subsection (2)](#GS26@Gs2@EN) , the Minister may require the Commission to provide him or her with further information for the purposes of that subsection.
