165 Offence for certain fraudulent acts
(1) If any person—
(a) fraudulently procures, assists in fraudulently procuring or is
privy to the fraudulent procuring of any instrument, or of any
entry in the register, or of any erasure or alteration in any entry
in the register, or in any instrument or form issued, approved or
otherwise sanctioned by the registrar-general; or
(b) fraudulently uses, assists in fraudulently using, or is privy to the
fraudulent using of any form purporting to be approved or
otherwise sanctioned by the registrar-general; or
(c) knowingly misleads or deceives any person authorised by this
Act to demand explanation or information in respect of any land
or the title to any land which is the subject of any application to
bring the land under this Act, or in respect of which any dealing
or transmission is proposed to be registered or recorded; or
(d) knowingly makes any false statement in any document produced
to the registrar-general;
he or she commits an offence.
Maximum penalty:
(a) for paragraph (a)—100 penalty units, imprisonment for 1 year
or both; or
(b) for paragraph (b), (c) or (d)—50 penalty units, imprisonment for
6 months or both.
(2) Any instrument, entry, erasure or alteration so procured or made by
fraud, shall be void as between all parties or privies to the fraud.
