25 Offence by witness (1) A person commits an offence if the person is given a notice under section 24 and the person fails to comply with the notice. Maximum penalty: 100 penalty units. (2) A person commits an offence if: (a) the person appears as a witness at an inquiry; and (b) the person does not: (i) take an oath when required by the Registrar-General; or (ii) answer a question the person is required to answer by the Registrar-General; or (iii) produce a document or thing the person is required to produce by the Registrar-General. Maximum penalty: 100 penalty units. (3) An offence against subsection (1) or (2) is an offence of strict liability. (4) It is a defence to a prosecution for an offence against subsection (1) or (2) if the person has a reasonable excuse. Note for subsection (4)
