116 Creation of covenant by plan of subdivision or consolidation (1) A covenant may be created by registering: (a) a plan of subdivision, or a plan of consolidation, showing clearly the lot or part of the lot to be benefited and the lot or part of the lot to be burdened by the covenant to be created on the plan's registration; and (b) an instrument of covenant validly executed. (2) The instrument must specify: (a) the nature of the covenant and its terms; and (b) the lot or part of the lot to be benefited and the lot or part of the lot to be burdened by the covenant. (3) For the avoidance of doubt, a lot may be shown on a the plan as having both the benefit and the burden of a covenant.
