Land (Revocation of Reservations) Act 2024

Key legal concepts and recurring mechanics in the Act are: revocation of Orders in Council, revocation of Crown grants, conversion to unalienated Crown land, temporary re‑reservation, appointment or dissolution of committees of management, preservation of leases and public rights, statutory savings and recording obligations.

Revocation of Orders in Council and Crown grants. Each Schedule item identifies the historic instrument and the land description. The Act revokes the named Orders in Council (for example s 3 revokes the item 1 Order in Council for Shepparton land) and where specified, revokes Crown grants (for example s 13(2) revokes Crown grant Volume 3042 Folio 245 for Haunted Stream). Where a Crown grant is revoked the Act takes the grant away "to the extent that it relates" to the relevant allotment (s 13(2), s 14(2), s 15(2), s 16(2), s 28(2), s 30(2)). Revocation of a Crown grant extinguishes that legal instrument insofar as the Act says; the Act then prescribes post‑revocation legal status for the parcel.

Taken to be unalienated Crown land, freed and discharged. For the majority of items the Act provides that the land is "taken to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (repeated across Parts 2 to 10: s 4(a), s 8(a), s 12(a), s 17(a), s 20(a), s 22(a), s 25(a), s 29(a), s 31(a), s 34(a)). That phrase is the principal legal effect: removal of prior limitations that followed from the land’s reserved status and related instruments. The phrase is precise to the Act; it does not itself create a process for alienating or granting new tenure but it alters legal capacity to do so.

Temporary reservation and committee appointment. For the Shepparton parcel, the Act immediately takes the land to be temporarily reserved under s 4(1) of the Crown Land (Reserves) Act 1978 (s 5), and treats Greater Shepparton City Council as committee of management under s 14(2) of that Act (s 6). The result is an administrative transfer of management responsibility and a continued public purpose, albeit under temporary reservation.

Reserved forest conversion. The Haunted Stream parcel is treated differently: the Order in Council and Crown grant are revoked, but the land is taken to be reserved forest for the purposes of the Forests Act 1958, as if dedicated under s 45 of that Act (s 18). The Act therefore moves the parcel from Mechanics’ Institute reserved status into a specific forest reserve regime.

Savings for leases and rights. The Act preserves certain legally significant interests. It expressly preserves leases granted under s 17D of the Crown Land (Reserves) Act 1978 in two instances: the Toolangi lease over Crown Allotment 2008 (s 9) and the Clunes lease with Wesley College (s 26). The Act contains non‑derogation or non‑breach clauses that say nothing in the Part is to be regarded as placing a person in breach of, or as constituting a default under, any provision of those leases, or as triggering rights to terminate or discharging obligations (s 10 and s 27). For Port of Geelong and certain Walhalla parcels the Act preserves the land as a road under the Land Act 1958 and protects existing rights, easements or privileges (s 23 and s 35). For the Wombelano parcel the Act dissolves the incorporated committee of management and states that its members go out of office (s 20(b)).

Registrar of Titles obligation and repeals. Section 37 mandates that the Registrar of Titles must make any recordings or amendments to the Transfer of Land Register necessary because of this Act, signalling a mandatory administrative step to reflect the land status changes. Section 36 repeals Part 4 and item 7 of the Land (Reservations and other Matters) Act 1999, which is a legal housekeeping step removing prior statutory material that the new Act supersedes.

Interplay with other statutes. The Act repeatedly references and interacts with the Crown Land (Reserves) Act 1978, the Forests Act 1958, the Land Act 1958, the Transfer of Land Act 1958 and the Land (Reservations and other Matters) Act 1999. The relationships are governed by the specific saving and re‑designation language in the Act: temporary reservation and committee appointment (Crown Land (Reserves) Act 1978), reserved forest dedication (Forests Act 1958), preservation of road status and public rights (Land Act 1958), and register amendments (Transfer of Land Act 1958).

Legal status versus administrative action. The Act changes legal status immediately on commencement for the parcels described. Whether that status results in sale, new grants, private conveyance, lease or other administrative actions is not prescribed; the Act creates capacity but leaves subsequent decisions and instruments to the Crown and relevant administrative bodies. The areas where the Act prescribes further action are limited and specified.

Directly affected parties are narrow and discrete because the Act targets particular parcels listed in Schedule 1. A non‑exhaustive list of categories of affected stakeholders follows, with statutory references to where the Act treats each group.

Crown and Crown agencies. The Crown is the immediate legal owner after revocation in the sense that the land is "taken to be unalienated land of the Crown" (e.g. s 4(a), s 8(a)). Responsible Ministers and departments that administer Crown land, including those administering the Crown Land (Reserves) Act 1978, the Forests Act 1958, and the Land Act 1958, will need to manage, decide and record the changed status. The Registrar of Titles has a statutory duty to make amendments to the Transfer of Land Register (s 37).

Committees of management and incorporated bodies. Existing committees of management appointed over the reserved land lose their appointment to the extent it relates to the affected land (see the repeated revocation language in ss 4(b), 8(b), 12(b), 17(b), 20(c), 22(b), 25(b), 29(b), 31(b), 34(b)). In one express instance the Act dissolves an incorporated committee of management and declares that its members go out of office, the Wombelano Fire Shed Committee of Management corporation (s 20(b)). Those committees, their members, and any related volunteer organisations will have management roles altered or terminated.

Leaseholders with specified leases. The Act preserves specific leases granted under s 17D of the Crown Land (Reserves) Act 1978: the lease in Toolangi between the Minister and the Victorian Seed Potato Certification Authority and the Victorian Strawberry Industry Certification Authority (s 9), and the Clunes lease between the Minister for Environment and Wesley College Melbourne (s 26). For these lessees the Act adds statutory protections: revocation does not place them in breach, does not allow termination rights to be exercised merely because of the revocation, and does not release obligors from their obligations (s 10 and s 27).

Local government and committees of management where new appointment occurs. Greater Shepparton City Council is taken to be committee of management for the Shepparton parcel under s 6 by operation of s 14(2) of the Crown Land (Reserves) Act 1978. This shifts management responsibility to the local council and imposes administrative duties and costs on that council for the temporarily reserved land (s 5 and s 6).

Owners and holders of registered Crown grants and interests. Where Crown grants are revoked (s 13(2), s 14(2), s 15(2), s 16(2), s 28(2), s 30(2)) the legal effect is to remove that grant to the extent specified. Any person or organisation that previously held rights through those Crown grants will be affected; the Act does not expressly provide compensation or substitution, but it does create savings for certain leases and rights in other provisions.

Members of the public and road users. For the Port of Geelong land and specific Walhalla parcels the Act preserves road status and public rights (s 23 and s 35). Natural persons who have past user rights, or who rely on easements or other privileges over those roads, retain those rights. More generally, communities local to Mechanics’ Institute parcels, parks and baths sites will be affected by a change of legal status which may affect local access, management and future use.

Registrar of Titles, conveyancers and land professionals. The Registrar is required to make amendments to the Transfer of Land Register as required by the Act (s 37). Conveyancers, surveyors, title insurers and others dealing in those parcels must update title records, plan references, and due diligence materials to reflect revocation of orders or Crown grants. The Schedule provides the plan references and volume/folio details that these professionals will need to consult.

Other statutory regimes. Foresters and agencies administering the Forests Act 1958 are affected in that the Haunted Stream parcel is taken to be reserved forest as if dedicated under s 45 of the Forests Act 1958 (s 18). Agencies administering the Crown Land (Reserves) Act 1978 will manage temporary reservation and committees under ss 5 and 6.

Who bears costs and who benefits. The Act concentrates administrative burdens on Crown departments and specific local government entities (for example Greater Shepparton City Council). The beneficiaries are not directly stated in the operative provisions; the statutory changes create administrative flexibility and legal capacity for future Crown dealing with the parcels. The Act protects some existing private interests (leases and roads) while extinguishing others (where Crown grants are revoked without a saving).

The Act imposes duties on government actors and creates or preserves rights and obligations for private and public parties. Key statutory duties and rights flow from the operative provisions.

Registrar of Titles duty. Section 37 imposes a positive duty on the Registrar of Titles to make recordings or amendments to the Register kept under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Act. The duty is mandatory in language; it requires the administrative steps to reflect the legal changes to title and reservations.

Committee of management appointment and duties. For Shepparton land, Greater Shepparton City Council is "taken to be the committee of management" appointed under s 14(2) of the Crown Land (Reserves) Act 1978 (s 6). That legal fiction imposes the normal statutory duties of a committee of management under the Crown Land (Reserves) Act 1978 on the local council for that land while it is temporarily reserved (s 5). Those duties typically include management, control and maintenance consistent with the reserve purpose, but the specific obligations derive from the Crown Land (Reserves) Act 1978 as referenced in s 6.

Dissolution of corporation and cessation of office. Section 20(b) dissolves the incorporation of the Wombelano Fire Shed Committee of Management under s 14A of the Crown Land (Reserves) Act 1978 and declares that the members "go out of office" on revocation. That is an automatic administrative effect rather than a discretionary administrative step to be taken later.

Preserved leases and lessee protections. The Act preserves certain leases and expressly states that nothing in the relevant Part is to be regarded as placing any person in breach, constituting a default under, or allowing a right or remedy to be exercised in respect of, those leases (ss 9-10 and 26-27). For example, the Toolangi lease under s 17D of the Crown Land (Reserves) Act 1978 (s 9) and the Wesley College lease at Clunes (s 26) remain in force despite revocation. The Act also specifies that preservation of a lease does not release an obligor from its obligations (s 10(c), s 27(c)). These provisions impose a statutory limitation on claims by lessors or other parties seeking to rely on the revocation as a ground for termination or acceleration.

Public rights and roads preserved. For the Port of Geelong land and certain Walhalla parcels the Act preserves road status and existing rights, easements or privileges, so those public rights continue to apply despite revocation (s 23 and s 35(1)(b)). That right preservation is explicit and overrides any general statement that the land becomes unalienated Crown land.

Conversion to reserved forest as a right or duty. Section 18 takes the Haunted Stream parcel to be a reserved forest "as if it had been dedicated as a reserved forest under section 45" of the Forests Act 1958. That reclassification places the parcel under the Forests Act regime, with the rights and duties attaching under that Act.

Freedom from encumbrances and interests. For most parcels the Act takes the land to be "freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (see, e.g., s 4(a) and comparable provisions elsewhere). That phrase removes prior encumbrances by statutory operation. Practically, that affects mortgages, easements recorded pursuant to the prior reserved status, trust obligations connected to the reserve, and other limitations which are statutorily extinguished by the Act.

Repeal obligations. Section 36 repeals Part 4 and item 7 of the Land (Reservations and other Matters) Act 1999. That repeal alters the statutory landscape and removes prior cross‑references or provisions that had previously applied to some reserved lands. Any duty or right that depended upon the repealed provisions must be assessed against the new legal regime.

Who decides. The Act makes Parliament the decision‑maker in revoking the Orders in Council and grants. Implementation decisions about management, further reservation, grant of new interests, or sale will be taken by the Crown, responsible Ministers and administrative officers consistent with their statutory powers under other Acts (Crown Land (Reserves) Act 1978, Land Act 1958, Forests Act 1958 and so on). The Act constrains some of those decisions by preserving leases and public rights in specified cases.

This Act contains no express criminal penalties, fines or infringement offences. Its provisions are largely declaratory and administrative in character: revocation of instruments, declaration of land status, appointment or dissolution of committees, preservation of particular interests, and a mandatory record‑keeping duty for the Registrar of Titles (s 37). There are no express enforcement mechanisms that impose monetary sanctions or criminal liability on private parties within the Act’s text.

Enforcement and compliance instead occur through administrative obligations and the practical effect of register amendments. The primary enforcement mechanism is the statutory duty on the Registrar of Titles to update the Transfer of Land Register as required by s 37. Compliance risk for public officials or the Registrar would be an administrative failure to make necessary recordings; the Act does not specify penalties for failing to do so. Practical enforcement in that context would be by administrative direction or judicial remedies available under general public law, not by an express penal provision in this Act.

The Act dissolves the incorporation of the Wombelano Fire Shed Committee of Management (s 20(b)), but it does not create liabilities for the corporation’s officers beyond the statutory statement that the members go out of office. The Act also provides non‑derogation provisions for leaseholders (ss 10 and 27), which limit the ability of lessors to treat the revocation as a breach or trigger for termination; this reduces enforcement options for parties wishing to assert rights based purely on the change of reservation status.

Where the Act revokes Crown grants and takes land to be unalienated Crown land "freed and discharged from all ... encumbrances" (e.g. s 4(a)), the effect on registered encumbrances is statutory extinguishment; the Act does not provide for compensation or remedial processes in those sections. Any dispute about whether an encumbrance has been properly extinguished, or about the operation of the saving provisions, would be litigated under general principles and through the Land Titles register as amended; the Act itself contains no dispute resolution or penalty provisions.

For the parcels where road status and public rights are preserved (s 23 and s 35), the statutory language protects public rights from being extinguished by the revocation, so there is an enforcement effect: public rights under the Land Act 1958 and common law presumptions of dedication continue to be available to the public or private holders of rights.

Finally, the Act repeals provisions in another statute (s 36). That repeal changes the statutory framework and may materially affect compliance obligations that previously existed under the repealed provisions. Parties must identify any previously applicable enforcement or penalty regimes in the repealed provisions and transition accordingly, but the Act does not itself create transitional penalties.

The Act is framed to operate within existing Victorian land law and to modify the operation of specific statutory schemes by revocation, reclassification or repeal. It references and interacts with at least five principal statutes: the Crown Land (Reserves) Act 1978, the Forests Act 1958, the Land Act 1958, the Transfer of Land Act 1958 and the Land (Reservations and other Matters) Act 1999. The Act creates or changes legal status only by reference to those statutes.

Crown Land (Reserves) Act 1978. The Act frequently uses the Crown Land (Reserves) Act 1978 as the frame for temporary reservation and committee appointments. Section 5 takes Shepparton land to be "temporarily reserved under section 4(1) of the Crown Land (Reserves) Act 1978 for public purposes." Section 6 treats Greater Shepparton City Council as the committee of management under s 14(2) of that Act. Several consequences of revocation include the revocation of regulations made under s 13 of the Crown Land (Reserves) Act 1978 to the extent they apply to the land (see, e.g., s 4(d), s 8(d), s 12(d), s 17(d), s 20(e), s 22(d), s 25(d), s 29(d), s 31(d), s 34(d)). Where the Act preserves existing leases those leases are described as being granted under s 17D of the Crown Land (Reserves) Act 1978 (s 9 and s 26), and the Act puts in place saving clauses so that those leases are not invalidated or terminated by the revocation (s 10 and s 27).

Forests Act 1958. Section 18 takes the Haunted Stream mechanics institute parcel to be a reserved forest "referred to in section 42(1)(c) of the Forests Act 1958 as if it had been dedicated as a reserved forest under section 45 of that Act." That operation imports the statutory regime of reserved forest status and its administrative requirements into the parcel immediately on revocation. Agencies and officials administering the Forests Act will have duties and powers over that parcel from the date of commencement.

Land Act 1958. Sections 23 and 35 expressly preserve road status under the Land Act 1958 for certain parcels (the Port of Geelong land and specified Walhalla parcels), and protect any rights, easements or privileges in relation to that land. The Act therefore does not remove rights that exist under the Land Act 1958 by the mere operation of revocation.

Transfer of Land Act 1958. Section 37 requires the Registrar of Titles to make recordings and amendments in the Register kept under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Act. Revocation of Crown grants (s 13(2), s 14(2), s 15(2), s 16(2), s 28(2), s 30(2)) will necessitate register work, and the statutory duty on the Registrar ensures the legal record is updated. The Act’s removal of trusts and encumbrances may have direct effect on registered matters; the Registrar’s amendment is the operational step to reflect such statutory changes.

Land (Reservations and other Matters) Act 1999. Section 36 repeals Part 4 and item 7 of that Act. Where earlier arrangements or transitional provisions were in that Part or item, they are removed. The repeal is a direct statutory amendment to the wider framework for how reservations and related matters are treated in Victorian law.

Relationship between revocation and future dealing. The Act changes legal status but does not itself give express powers to sell or alienate a parcel. By returning land to the category of unalienated Crown land and removing trusts and encumbrances the Act clears legal obstacles to subsequent Crown dealings. However any future alienation, sale or grant of a new interest will occur under separate statutory powers and administrative instruments, and will be subject to the Crown Land (Reserves) Act 1978, the Land Act 1958, planning and environmental laws, and any preserved leases or rights. The Act therefore functions as a preparatory legal step rather than a comprehensive framework for later transactions.

Savings and non‑derogation. The Act contains express savings that limit its interaction with other laws in particular situations. For example, ss 9-10 and ss 26-27 preserve leases and prevent parties from treating revocation as a breach or as ground for termination. Sections 23 and 35 preserve road status under the Land Act 1958 and related public rights. These savings control how general extinguishment clauses operate against other statutory rights and private agreements.

Registers, plans and Central Plan Office references. The Schedule gives precise plan numbers and Central Plan Office references (for example OP125137 for Shepparton item 1, OP122949 for Toolangi items 2-3, and LEGL./23‑025 for Port of Geelong item 10). The interaction with the Transfer of Land Act’s register and the need for plan‑based identification requires that conveyancers, surveyors and land professionals coordinate across map, plan and register systems when implementing the Act’s consequences.

The Act’s endnotes provide the legislative chronology and identify that, at the date of publication of the version supplied, there were no subsequent amendments recorded. Key dates and amendment facts from the Act’s endnotes are:

• The Act was assented to on 20 February 2024. The endnotes state that the Land (Revocation of Reservations) Act 2024 "was assented to on 20 February 2024" (Endnotes, General information). The long title set out in the Endnotes records the Bill’s subject matter, indicating parliamentary intent.

• Commencements are staggered. Sections 1-6 and 11-37 commenced on 1 June 2024, as recorded in Special Gazette No. 274 dated 28 May 2024 at page 1 (Endnotes, General information). Sections 7-10 commenced on 1 November 2024 by operation of s 2(2) (Endnotes and s 2(2) provide that unspecified provisions commence on 1 November 2024 if not proclaimed earlier). The Act includes a general commencement provision (s 2) covering proclamation and the fallback date of 1 November 2024.

• No amendments had been made to the Act by other Acts or subordinate instruments at the time the version was produced. The endnote "Table of Amendments" states "There are no amendments made to the Land (Revocation of Reservations) Act 2024 by Acts and subordinate instruments" (Endnotes, Table of Amendments). That means the version supplied reflects the enacted text without later statutory amendment.

• The Act repeals Part 4 and item 7 of the Land (Reservations and other Matters) Act 1999 (s 36), which is an internal amendment to the statutory framework that the Act effectually updates. That repeal is part of the Act’s own operation rather than an external amendment to this Act.

• The Version No. and date at the head of the Act are Version No. 002, "Version as at 1 November 2024". This confirms that the printed version incorporates commencements up to that date.

For readers tracking future changes, the Act’s own endnotes instruct that the Victorian legislation website provides current versions and up‑to‑date legislative information. If an interested party needs to know whether this Act has been amended since Version No. 002, the proper course is to consult the official online legislation database.

The Act’s text and endnotes do not record any litigation, and the schedule of cases or judicial decisions does not appear within the document. The endnotes list the Minister’s second reading speech dates in the Legislative Assembly and Council (Legislative Assembly: 15 November 2023; Legislative Council: 30 November 2023), the assent date (20 February 2024) and the commencement dates (sections 1-6, 11-37 on 1 June 2024; sections 7-10 on 1 November 2024). No judicial proceedings, appeals or reported decisions are included in the text or the endnotes. The Act itself does not cite judicial authority and contains no transitional dispute resolution mechanisms.

In practical terms, the absence of recorded litigation in the Act and its endnotes means that, at least as of Version No. 002 dated 1 November 2024, there is no established case law interpreting or challenging the statutory revocations, their savings or the statutory phraseology used by the Act. Any future disputes concerning the operation of the Act,such as challenges to the effect of the revocation on particular registered interests, or disputes arising from the Registrar’s amendments under s 37, or claims related to the extinguishment of encumbrances, would proceed under general judicial avenues, such as the Supreme Court’s jurisdiction over property and administrative law matters, and under the dispute resolution avenues available in the statutes referenced (for example, rights and obligations under leases preserved by the Act could be litigated under contract or equitable principles).

Because the Act extinguishes certain instruments and preserves others, future litigation that might arise includes disputes about the interpretation of the saving clauses (for example whether a particular instrument qualifies as the type preserved by s 9 or s 26), the scope of "freed and discharged from all trusts ... encumbrances" (e.g. whether a particular mortgage or registered encumbrance is extinguished), and administrative law challenges to how implementing agencies perform register amendments or manage newly unalienated land. None of those disputes have a recorded history in this document.

Practitioners advising clients should therefore assume that judicial interpretation is not yet available and should plan for conservative due diligence, careful review of plan references and register entries, and, where necessary, protective drafting or administrative engagement with the responsible Crown agencies and the Registrar of Titles.

The Act is precise in its revocations and savings but there are several practical and legal traps that advisers and stakeholders must note. The following are concrete issues grounded in the Act’s text and schedule.

Statutory extinguishment is broad. The repeated formula that land is "taken to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 4(a) and parallel provisions) is sweeping in language. That statutory extinguishment operates automatically on the revocation; it may extinguish registered or unregistered encumbrances, interests created by trust instruments, or other land limitations unless a specific saving applies. Users must not assume continued encumbrances remain; instead check whether a saving clause applies (e.g. ss 9-10, 23, 26-27, 35). Conveyancers and registered interest holders need to closely review the registrar’s amendments required under s 37 to see what remains on title and what has been extinguished.

Revocation does not itself authorise sale or alienation. The Act frees land from its existing reservations and makes it unalienated Crown land, but it does not itself provide a statutory mechanism for alienating land, disposing of land, or granting new freehold titles. Any future disposition will be under other statutory powers. Parties seeking to buy or develop land should treat the Act as creating capability but not a transaction. Do not assume that a parcel will be sold or leased simply because it is no longer reserved.

Crown grants revoked may have knock‑on consequences. Where Crown grants are revoked (s 13(2), s 14(2), s 15(2), s 16(2), s 28(2), s 30(2)) the registered certificate of title entries and Volume/Folio references will change. Mortgagees, title insurers and anyone relying on title must obtain the Registrar’s updated entries (s 37) and check whether the revocation has extinguished or altered their security. The Act does not set out compensation mechanisms for extinguished private rights except in the limited preserved lease situations; affected parties should review register amendments and consider administrative or judicial remedies where loss occurs.

Specific leases are preserved, but the protection is narrow. The Act protects identified leases under s 17D of the Crown Land (Reserves) Act 1978 in two locations and provides non‑breach clauses (s 9-10 and s 26-27). However the saving language is expressly limited to the leases described in those sections. Other leases or informal occupancies that are not specifically preserved may be extinguished by the general "freed and discharged" language. Parties with any occupancy or interest not expressly preserved must verify status with the Registrar and responsible Minister.

Wombelano corporate dissolution may create governance transfers. Section 20(b) dissolves the Wombelano Fire Shed Committee of Management’s incorporation and declares that members go out of office. That creates immediate governance change. Any property, equipment, insurance, or contractual obligations that were held by that corporate body may need administrative attention to transfer, wind up, or otherwise manage continuity of services. The Act does not set out transfer mechanisms or transitional governance arrangements for assets previously held by the corporation.

Plan numbers and Central Plan Office references matter. The Schedule identifies each parcel by Crown Allotment and plan reference (for example OP125137, OP122949, LEGL./23‑025). Errors in matching plan references to physical boundaries could generate disputes over which land the statute reaches. Practitioners must confirm plan numbers and dimensions with the Central Plan Office and the Transfer of Land register before advising clients on precise boundaries.

Road status preservation is parcel‑specific. Although the Act frequently extinguishes reservations it expressly preserves road status and rights for the Port of Geelong parcel (s 23) and for specified Walhalla parcels (s 35). Advisers should not generalise the preservation of roads beyond the parcels and subparagraphs expressly listed. Confusion about whether a particular lot remains a road under the Land Act 1958 could affect public access and development options.

Reserved forest reclassification carries a different regulatory regime. The Haunted Stream parcel is taken to be a reserved forest "as if it had been dedicated as a reserved forest under section 45" of the Forests Act 1958 (s 18). Reserved forest status imposes statutory obligations, restrictions and administrative oversight that differ materially from other reserve types or from unalienated Crown land. Anyone planning activities on or near Haunted Stream must engage with the Forests Act 1958 regime rather than treat the change as a simple removal of reservation.

Repeal of prior statute provisions may remove transitional expectations. Section 36 repeals Part 4 and item 7 of the Land (Reservations and other Matters) Act 1999. If parties were relying upon provisions there for transitional rights or processes, those expectations are removed. Check whether any prior machinery or transitional provisions that were invoked in practice are affected by that repeal.

No express compensation mechanism. The Act contains no provision for compensation for extinguishment of prior interests outside the targeted savings. Where a private interest is extinguished by the Act, the text does not provide an express compensation entitlement. Affected parties would need to explore remedies under broader principles and other statutes, but the Act itself provides no direct compensation clause.

Registrar’s administrative burden and timing risk. Section 37 requires the Registrar of Titles to make necessary amendments, but the Act does not specify timeframes or sequencing. Delay or errors in the Registrar’s office will create commercial and legal uncertainty. Stakeholders should assume there may be a lag between the statutory effect and the public record reflecting that effect.

This section is a practical compliance checklist for public agencies, committees of management, leaseholders, conveyancers, surveyors and other professionals affected by the Act. Each entry is grounded in the Act’s operative clauses and Schedule.

1. Confirm which provisions have commenced and their effect. Consult s 2 and the endnotes: sections 1-6 and 11-37 commenced on 1 June 2024; sections 7-10 commenced on 1 November 2024 (see s 2 and the endnotes). Actions depend on the operative date for the relevant parcel.

2. For the Registrar of Titles. Execute the duty under s 37: identify all register entries and titles affected by the revocations and Crown grant revocations identified in Schedule 1. Amend, record or cancel entries as necessary to reflect that land has become unalienated Crown land and to show revocations of Crown grants "to the extent that they relate" to a listed allotment (for example s 13(2), s 28(2), s 30(2)). Ensure plan references (Central Plan Office numbers such as OP125137, OP122949, LEGL./23‑025) are reconciled. Notify interested parties where required by practice.

3. For Greater Shepparton City Council. Take on committee of management responsibilities for the Shepparton parcel as the Act treats the council as appointed under s 14(2) of the Crown Land (Reserves) Act 1978 (s 6), and manage the temporary reservation for public purposes (s 5). Review the Crown Land (Reserves) Act 1978 for statutory management duties and ensure budgets, maintenance and public access arrangements align with temporary reservation status.

4. For the Wombelano Fire Shed Committee and its members. Note the dissolution under s 20(b). Arrange for transfer or winding up of assets, contracts, utilities and insurances previously held by the incorporated body. Consult the responsible Crown agency about the transfer of any infrastructure and to obtain instructions for liability and asset administration.

5. For preserved lessees (Toolangi and Clunes leases). Review the specific lease documents and check that the lease is the one described in s 9 (Toolangi) or s 26 (Clunes). Confirm that the protections in ss 10 and 27 apply: the revocation is not to be regarded as a breach or default, does not allow termination for that reason, and does not release obligors from obligations. Continue to perform obligations as before and engage with the Minister or the administering agency regarding any future dealings.

6. For owners/holders of Crown grants that are revoked. If your title or Crown grant (Volume/Folio listed in Schedule 1) is revoked (for example Crown grant Volume 3042 Folio 245 for Haunted Stream, s 13(2)), immediately consult your conveyancer and monitor the Registrar’s amendments under s 37. If your interest appears to be extinguished, obtain legal advice about remedies or compensation, recognising the Act contains no express compensation clause for most extinguishments.

7. For Port of Geelong and Walhalla road users and local authorities. Note the preservation of road status and public rights under s 23 and s 35. Do not act as if road status has been extinguished. Manage and maintain access consistent with the Land Act 1958 and confirm the Registrar’s entries reflect road status as preserved.

8. For foresters and land managers regarding Haunted Stream. Treat the parcel taken to be reserved forest under s 18 as subject to the Forests Act 1958 "as if it had been dedicated as a reserved forest under section 45." Consult the Forests Act for management, harvesting and any approval regimes.

9. For conveyancers, surveyors and purchasers. Always obtain the up‑to‑date Transfer of Land Register entries after s 37 amendments are made. Verify plan and allotment references in Schedule 1 with the Central Plan Office to confirm boundaries. Do not assume marketability until records show the legal effect you require. Where mortgages or encumbrances existed, confirm whether they remain or have been extinguished under the Act’s "freed and discharged" language.

10. For local communities and mechanics institute stakeholders. Where a Mechanics’ Institute Crown grant is revoked (items 5-9, ss 13-16 and s 17), identify whether any local building, community trust, or service relies on that grant. If so, consult the administering agency immediately about future arrangements and access rights.

11. Document everything and communicate with the responsible Minister. Where assets, leases or rights are affected, prepare written records of interactions with the Registrar, the responsible Minister’s department, and local government. Where preservation clauses apply, obtain confirmatory written guidance from the administering agency where possible to limit disputes.

12. For risk management and insurance. Organisations with assets or infrastructure previously associated with a reserve should review insurance policies and contractual obligations to ensure continuity during any register amendments and administrative transitions.

13. Seek early legal advice where significant investments or encumbrances might be affected. The Act’s statutory extinguishment language may significantly affect security interests and development proposals; legal advice can evaluate whether judicial or administrative remedies are available.

14. Monitor Gazette and public notices. The Act’s commencement and related administrative steps have been publicly notified in the Special Gazette identified in the endnotes; continue to monitor government gazettes for any follow‑up instruments, ministerial decisions or proclamations that will determine future disposition rights.

Following these steps will not create new statutory rights beyond those preserved in the Act, but they will manage legal and administrative risk, ensure register accuracy as required by s 37, and protect ongoing operations where leases or public rights have been expressly preserved.
