Land (Revocation of Reservations) Act 2016

The Act repeatedly uses a small number of statutory mechanisms to achieve its effects. Understanding these concepts is essential to apply the Act to practice.

Revocation of Order in Council: Each Part commences with revocation of the Order in Council specified in Schedule 1, either wholly or to the specified extent (eg s 3, s 7, s 10, s 14, s 16, s 18, s 20). The Schedule supplies the identification and original instrument details for each reservation to be revoked.

Taken to be unalienated land of the Crown, freed and discharged: Following revocation the Act takes the affected land to be unalienated Crown land and expressly frees it from "all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (repeated in s 4(a), s 8(a), s 11(a), s 15(a), s 17(a), s 19(a), s 21(a)). That is a statutory extinguishment clause with broad language. The text does not define exceptions within that clause except where the Act later preserves particular leases (s 6, s 9) or creates new reservations.

Revocation/revoking of committee or trustee appointments and regulations: Each Part specifies that appointments of committees of management or trustees are revoked to the extent they relate to the land (eg s 4(b)-(c), s 8(b)-(c), etc). The Act also revokes any regulations made under s 13 of the Crown Land (Reserves) Act 1978 as they apply to the land (eg s 4(d), s 8(d), etc). Those provisions eject existing management arrangements and any applicable specific regulations tied to the previous reservation.

Re‑reservation under the Crown Land (Reserves) Act 1978: For selected parcels the Act immediately re‑creates a reservation under s 4(1) of the Crown Land (Reserves) Act 1978 for stated purposes (s 5 for Albert Park, s 12 for Caulfield, s 22 for Wedderburn where the reservation is temporary). These sections do not create new regulatory detail; they declare the reservation and identify the statutory head of power under which it is taken to be reserved.

Preservation and conversion of particular leases: Two Parts preserve specific existing leases and treat them "as if" they were granted by a Minister under statutory leasing powers. Section 6 preserves a lease at Albert Park held by Parks Victoria and State Orchestra of Victoria and treats it from commencement as if granted under s 5.2.5 of the Education and Training Reform Act 2006 by the Minister administering that section, and as if the lease referred to that Minister instead of Parks Victoria. Section 9 contains analogous treatment for the North Ballarat Football Club lease, to be taken as a lease under s 134 of the Land Act 1958 by the Minister administering that section and as if the lease referred to that Minister instead of the City of Ballarat. These are mechanisms to maintain lease continuity while changing the legal landlord and statutory basis for the lease.

Registrar of Titles obligations: Section 24 imposes a mandatory duty on the Registrar of Titles to make any recordings or amendments to the Transfer of Land Register that are necessary because of the operation of any provision of the Act. This is the statutory hook for adjusting Torrens register entries to reflect the new reservation status, extinguishments and ministerial leases.

Protection against breach and unintended contractual consequences: Section 25 provides a protective rule that nothing done by s 6 or s 9 is to be regarded as placing any person in breach of, or constituting default under, any provision of the preserved leases; nor is it to be regarded as fulfilling any condition that allows a party to exercise a remedial right such as termination; and it does not release the obligor from obligations. In short, s 25 seeks to limit the contractual consequences flowing from statutory preservation and conversion of the specified leases.

Statutory interaction: The Act expressly relies on, and interacts with, other statutes. It references the Crown Land (Reserves) Act 1978 for the form and effect of new permanent or temporary reservations and for committee of management appointment provisions (eg s 5, s 12, s 13, s 22, s 23, and repeated references to regulations under s 13 and committees under s 14(2)). It also draws on the Education and Training Reform Act 2006 and Land Act 1958 only to specify how particular leases are to be treated once preserved (s 6(2), s 9(2)). Finally, the Transfer of Land Act 1958 is invoked via s 24 for register changes.

Parcel specificity and extent language: The Schedule is explicit. Each item names the parish, allotment, area and the original Order in Council instrument and date, the purpose of the reservation and the exact extent of revocation (either "the entire reserve" or "the reserve so far as it relates to [specified allotment]"). That precision is the Act’s design: it does not create a broad delegation to executive actors to pick or vary parcels beyond the Schedule.

Commencement mechanics: Section 2 provides for staggered commencement. Parts 2 and 6 and items 1 and 5 of Schedule 1 are to come into operation by proclamation or, failing proclamation, on 1 September 2016 (s 2(2)-(4)). The Endnotes supply the actual dates of commencement for different Parts (see Endnotes). Those commencement rules have operational consequences for when extinguishment and reservation changes take legal effect.

These concepts are the building blocks of the Act and determine how ownership, management and lease relationships shift for each listed parcel.

The Act affects a defined set of stakeholders by name, statutory position, or functional role. The primary affected actors are the Crown as landowner, current committees of management and trustees, local councils identified as committees of management for particular reserves, certain named lessees, Parks Victoria, Ministers who administer specified leasing powers, the Registrar of Titles, and members of the public who use land re‑reserved for public purposes.

Crown and Ministerial role: The Act takes listed land to be "unalienated land of the Crown" once the reservation is revoked (eg s 4(a), s 8(a), etc). That moves title and land‑management control squarely within Crown control and, for the preserved leases, effectively substitutes Ministerial ownership or landlordship by treating those leases as if granted by the Minister (s 6(2), s 9(2)). The Minister(s) administering the Education and Training Reform Act 2006 and the Land Act 1958 are therefore directly affected as assumed landlords in relation to the preserved leases.

Committees of management, trustees and local government: Where the Act revokes appointments of committees of management and trustees relating to the land, those bodies lose statutory authority over the land (eg s 4(b)-(c)). In two instances the Act appoints local councils as the committee of management (Glen Eira City Council for the Caulfield land in s 13; Loddon Shire Council for the Wedderburn land in s 23). Those councils acquire the statutory status of committee under s 14(2) of the Crown Land (Reserves) Act 1978 as of the commencement of those provisions, which will bring duties and decision‑making responsibilities under that Act.

Lessees and occupiers: The Act explicitly preserves two existing leases. At Albert Park the lease between Parks Victoria and State Orchestra of Victoria is preserved (s 6(1)-(2)); at Ballarat North the lease between the City of Ballarat and North Ballarat Football Club Inc is preserved (s 9(1)-(2)). Those lessees remain in occupation and have continuity of lease status; the Act also protects them from the preserved change being treated as a breach or trigger for remedies (s 25). Other occupiers, users or third parties with interests in the affected land are affected indirectly because the Act extinguishes "all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" in respect of the revived Crown ownership (eg s 4(a) etc). Unless preserved by the Act, their interests may be statutorily removed.

Parks Victoria and municipal landlords: Parks Victoria is specifically mentioned in s 6 as having been a party to the Albert Park lease; following the Act the lease is treated as if it were granted by the Minister rather than Parks Victoria. The City of Ballarat is displaced in a similar manner by s 9 for the Ballarat lease. These changes transfer legal landlord responsibilities from those statutory bodies to the relevant Minister.

Registrar of Titles: Section 24 imposes an operational duty on the Registrar of Titles to make necessary recordings or amendments to the Transfer of Land register. The Registrar’s decisions and timings will determine the practical effect on Torrens certificates and registered interests. Stakeholders who register caveats, mortgages, easements or other interests should expect consequential dealings at the registry.

Public users and beneficiaries: For parcels declared permanently or temporarily reserved for public purposes (s 5, s 12, s 22), the public is an intended beneficiary in terms of the specified reservation purposes. The Act thus affects access and permissible uses for those parcels by defining the permitted reservation purposes.

Regulatory agencies and statutory planners: Although the Act does not itself amend planning controls, planners and agencies that administer the Crown Land (Reserves) Act 1978, the Education and Training Reform Act 2006, and the Land Act 1958 will be affected by the change in statutory basis for management and leasing of the parcels. The revocations of regulations made under s 13 of the Crown Land (Reserves) Act 1978 (eg s 4(d), s 8(d), etc) also alter the regulatory framework that agencies may apply to a site.

Third‑party creditors and interest holders: The Act’s broad extinguishment language potentially affects creditors, easement holders, covenant beneficiaries and other third parties whose statutory interest might have depended on the reservation. The Act preserves only the two expressly mentioned leases; it does not preserve other interests in Schedule 1. That creates legal risk for those third parties unless they fall within an express preservation.

In short, the Act targets specific parcels and named or functionally defined actors. The people and organisations who most directly lose or acquire statutory roles are committees of management, trustees, specific lessees, local councils appointed as committees, Parks Victoria and municipal lessors, Ministers with leasing powers under the referenced Acts, and the Registrar of Titles. Others with interests in the listed parcels are indirectly affected because the Act alters the statutory architecture that supported those interests.

The Act creates, alters or clarifies a narrow set of duties and rights. These are primarily administrative and property‑law effects rather than criminal or penalty rules.

Registrar of Titles duties: The Registrar must make any recordings in, or amendments to, the Transfer of Land register necessary because of the operation of any provision of the Act (s 24). That is a positive, mandatory duty. The Act does not specify the procedure, timescale or who bears any costs associated with registry amendments; it simply imposes the obligation to effect the necessary entries.

Committees of management and councils: Where councils are expressly taken to be the committee of management under s 14(2) of the Crown Land (Reserves) Act 1978, they step into the statutory role and associated duties under that Act (s 13 for Glen Eira, s 23 for Loddon Shire Council). The Act does not restate those duties; instead it prescribes the identity of the committee. Conversely, where the Act revokes the appointment of any committee of management or trustee to the extent it relates to the land (eg s 4(b)-(c), s 8(b)-(c), etc), the revoked body loses those statutory duties and powers in respect of the affected land.

Ministerial lease‑granting role: By treating particular existing leases as if they were granted by the Minister under the Education and Training Reform Act 2006 s 5.2.5 (s 6(2)) or by the Minister under the Land Act 1958 s 134 (s 9(2)), the Act confers on the Minister the statutory position of lessor and associated rights and duties that attach to a lease granted under those Acts. Those statutory rights and duties will be governed by the referenced Acts and any relevant statutory lease terms.

Preserved lease rights: The two preserved lessees have an express statutory protection of status and continuity (s 6(1)-(2), s 9(1)-(2)). Section 25 extends protection by declaring that nothing done by virtue of s 6 or s 9 is to be taken to place any person in breach of or to constitute a default under any provision of the preserved leases, nor to be regarded as fulfilling any condition enabling termination or remedy, nor to release an obligor from obligations (s 25(a)-(c)). Practically, that affords lessees continuity of occupation and shields them from triggers linked solely to the statutory effect of the Act.

Right to public use linked to reservation purpose: Where the Act re‑reserves land for public purposes under s 4(1) of the Crown Land (Reserves) Act 1978 (s 5, s 12, s 22), the public or the community generally gains the statutory protection of the land being permanently or temporarily reserved for the named purposes (education, public park/gardens/recreation, public purposes). Specific rights of access or use will be governed by the Crown Land (Reserves) Act 1978 and any conditions or management plans that a committee adopts under that Act.

Extinguishment of prior interests: The Act takes the land to be freed and discharged of "all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (eg s 4(a)). That statutory extinguishment transfers a duty or power to reconstitute or restore any interest to the Crown or to some statutory mechanism if required, but the Act itself does not set out a mechanism for compensation where third‑party interests are extinguished. The Act does, however, preserve two leases and protect those lessees from breach consequences.

Revocation of regulations under Crown Land (Reserves) Act 1978 s 13: The Act revokes any regulations made under s 13 of that Act that apply to the land to the extent they apply (eg s 4(d), s 8(d), etc). That imposes a duty on executive agencies to recognise that prior site‑specific regulations under s 13 no longer have effect, and it gives rise to a corresponding right for stakeholders to rely on the absence of those regulations post‑notice.

No express civil penalties or criminal offences: The Act contains no penalty provisions or criminal offences. Enforcement is administrative: reclassification of land, Registrar recordings and the assumed duties under the Crown Land (Reserves) Act 1978 or the referenced leasing Acts (Education and Training Reform Act 2006; Land Act 1958). Any remedies for non‑compliance with duties arising under those other Acts should be sought under their enforcement regimes.

Operational obligations on statutory and local bodies: The Act imposes obligations by deeming identities and statutory statuses to be in force on commencement. For example, Glen Eira City Council and Loddon Shire Council are "taken to be the committee of management" under s 14(2) of the Crown Land (Reserves) Act 1978 for the land described in items 3 and 7 respectively (s 13, s 23). Those councils therefore acquire the procedural and substantive duties specified by the Crown Land (Reserves) Act to manage the reserve consistent with the declared reservation purpose.

In sum, the Act creates and adjusts rights and duties primarily through statutory shifts in proprietorship and management status, creates obligations on the Registrar to update titles, and provides protections to preserve specified lease rights while extinguishing other prior encumbrances absent express preservation.

The Act does not create a novel penal enforcement regime. It contains no express fines, criminal offences, or administrative penalty schedules. The operational effect is achieved through declaratory and administrative provisions, registry actions and statutory appointments. Enforcement therefore proceeds through ordinary administrative and property law mechanisms, and, where relevant, through the enforcement frameworks of the statutes the Act references.

Administrative implementation and registry enforcement: The principal enforcement action required by the Act is administrative. Section 24 places a mandatory duty on the Registrar of Titles to make any recordings or amendments to the Transfer of Land Register necessary because of the Act. The Registrar’s performance of that duty converts the Act’s declarations into registered record. The Act does not specify timeframe or priority for those amendments; the practical enforcement of the Act thus depends on registry processes and executive resourcing.

Enforcement through other statutes: For parcels newly reserved under the Crown Land (Reserves) Act 1978 (s 5, s 12, s 22) enforcement of rules about authorised use, management duties and offences will be conducted under that Act and its regulations, not under the present Act. Similarly, where leases are treated as ministerial grants under the Education and Training Reform Act 2006 s 5.2.5 or Land Act 1958 s 134 (s 6(2), s 9(2)), any enforcement of lease terms or remedies for breach will be governed by those Acts and the contractual terms of the leases. The Act’s s 25 protects lessees from being treated as in breach by virtue of the statutory change, but it does not displace ordinary enforcement remedies for other contractual or statutory defaults.

No penalties in the Act itself: Because the Act contains no penalty provisions, there is no direct statutory deterrent or enforcement sanction included in this instrument. That means compliance and enforcement rely on existing frameworks under other statutes and on registry mechanics to reflect the new legal status of the land.

Potential enforcement consequences arising from extinguishment: The Act’s broad extinguishment language (eg s 4(a), s 8(a) etc) may remove or alter third‑party rights which could have enforcement or compensation implications. The Act does not specify an administrative compensation mechanism for extinguished interests. Any claim for compensation or remedy in respect of rights extinguished by the revocation would need to be pursued under whatever compensation regimes are available under other applicable laws, or by private legal action, subject to statutory immunities and the content of the Act. The Act itself neither creates nor prescribes a compensation process.

Safeguards for lease continuity and remedial limitations: Section 25 limits enforcement consequences flowing from the preserved lease conversions by specifying that nothing done under s 6 or s 9 is to be regarded as placing a person in breach or as constituting a default under the preserved leases or fulfilling any condition that allows a remedy or termination. That provision reduces the risk of administrative enforcement actions being taken against lessees purely because their landlord changed by operation of the Act.

Practical enforcement path: In practice enforcement of the Act’s effects will be realised by administrative actors performing their obligations: the Registrar updating titles (s 24); Ministers administering the referenced statutes acting as landlords or reserve authorities; and committees of management (including newly appointed councils) exercising their statutory duties under the Crown Land (Reserves) Act 1978. Any dispute about the correctness or timing of registry amendments, the continuity of leases, or whether particular interests survive should be litigated or administratively reviewed under the relevant statutory regimes rather than under the Act’s own enforcement provisions.

In short, the Act is an administrative instrument that effects property and management changes, it contains no direct penalties, and enforcement is realised through registry action and the operation of related statutes under which penalties or remedies may already exist.

The Act is explicitly interwoven with several other Victorian statutes and the Transfer of Land register. Its operative design is to change reservation status while invoking statutory mechanisms of other Acts to preserve continuity and management.

Crown Land (Reserves) Act 1978: The Act repeatedly uses the Crown Land (Reserves) Act 1978 as the statutory destination or management regime for re‑reservations and committee appointments. Sections 5, 12 and 22 each take land to be reserved under section 4(1) of the Crown Land (Reserves) Act 1978 for specified purposes (educational purposes, public park/gardens/recreation, public purposes temporarily). Sections 13 and 23 take specified local councils to be the committee of management under s 14(2) of that Act for particular lands. Additionally, each Part revokes regulations made under s 13 of that Act insofar as they applied to the land being dealt with (eg s 4(d), s 8(d) etc). Practitioners must therefore read the Act alongside the Crown Land (Reserves) Act to understand management duties, permitted uses, and enforcement powers that apply after reservation.

Education and Training Reform Act 2006: Section 6(2) treats the preserved Albert Park lease as if it were granted under section 5.2.5 of the Education and Training Reform Act 2006 by the Minister administering that section. This mechanism substitutes the Minister as the statutory lessor and re‑frames the lease as a lease under that Act, with rights and obligations under that Act applying as of the Act’s commencement. Legal consequences tied to that Act, including statutory leasing terms or ministerial discretions under s 5.2.5, will therefore govern the preserved lease going forward.

Land Act 1958: Section 9(2) performs an analogous function for the Ballarat North lease by treating it as if granted under s 134 of the Land Act 1958 by the Minister administering that section. That changes the legal basis of the lease and the identity of the lessor, bringing the lease under the statutory framework of the Land Act and any s 134 powers, conditions or obligations.

Transfer of Land Act 1958: Section 24 requires the Registrar of Titles to make any recordings or amendments necessary in the register kept under the Transfer of Land Act 1958. The Act therefore assumes the Torrens register will be updated to reflect the revocations, extinguishments and new reservations, ties, or lease foundations effected by the Act. That interaction is fundamental to giving the statutory changes practical effect in registered dealings.

Regulations under Crown Land (Reserves) Act: The Act expressly revokes any regulations made under s 13 of the Crown Land (Reserves) Act 1978 to the extent they applied to the land being revoked (eg s 4(d), s 8(d), etc). Those revocations remove any site‑specific regulatory overlay formerly imposed via regulation under that Act and mean that the relevant regulatory detail needs to be re‑established, if desired, under the Crown Land (Reserves) Act or other appropriate authority.

Statutory continuity of leases and contractual law: By treating preserved leases as if granted by Ministers under the cited Acts (s 6(2), s 9(2)) the Act bridges the reservation revocation and the lease regime in the referenced statutes. Section 25 then tempers contractual consequences by stating that nothing done by s 6 or s 9 is to be regarded as placing a person in breach or constituting default under the preserved lease, nor to fulfil conditions that would activate remedies or release obligations. This is an internal statutory rule that operates alongside common law and equitable principles governing contract and property rights.

Commensurate statutory silence on compensation and easements: The Act’s general extinguishment clause (eg s 4(a) etc) removes "all...encumbrances, estates and interests" without specifying a compensation mechanism. The Act does not state how claims for extinguished easements, covenants, mortgage interests or other proprietary rights should be treated. Any remedy or compensation must therefore be sought under other statutory schemes or private law (for example, through compensation regimes in other Acts, or by litigation), assuming such remedies are available. The Act itself provides no procedural or remediation framework for extinguished third‑party rights.

ILA interpretation rules and Endnotes: The Endnotes and references to the Interpretation of Legislation Act 1984 (ILA) affect the Act’s interpretation. The Endnotes record commencement details and that there are no amendments at the date of publication. The ILA interpretative rules referenced in the Endnotes (headings forming part of the Act, examples and notes forming part of the Act, etc) influence how this Act’s content is read in context with other legislation and in legal interpretation more generally.

Overall, the Act operates as a targeted instrument that reconfigures the statutory foundations of land status and management, but the actual scope of duties, powers, enforcement and remedies after the Act are governed by the Crown Land (Reserves) Act 1978, the Education and Training Reform Act 2006, the Land Act 1958 and the Transfer of Land Act 1958. Practitioners must therefore work across these statutes to understand full legal consequences.

The Act as printed contains an endnote table addressing amendments and operation. At the date shown in the Act’s endnotes there are no amendments recorded. The Endnotes state explicitly that "There are no amendments made to the Land (Revocation of Reservations) Act 2016 by Acts and subordinate instruments" and that "There are no amendments which were Not in Operation at the date of this publication" (Endnotes, Table of Amendments and Amendments Not in Operation). The Explanatory details section similarly contains "No entries at date of publication" (Endnotes, Explanatory details). This source‑text therefore records no subsequent legislative amendments to the Act.

Commencement details are explicit in both the Act and the Endnotes. Section 2 sets out the intended commencement regime, providing immediate commencement for parts except Parts 2 and 6 and items 1 and 5 of Schedule 1, which are to commence by proclamation or, failing that, on 1 September 2016 (s 2(1)-(4)). The Endnotes then set out the actual commencement chronology the Act followed: Parts 1, 3, 4, 5, 7-9 and items 2-4, 6 and 7 of Schedule 1 commenced on 6 April 2016 (per s 2(1)); Parts 2 and 6 and items 1 and 5 of Schedule 1 commenced on 1 September 2016 (per s 2(4)). Those dates convert the Act's intentions into practical effect and are the operative commencement history recorded with the Act.

Because the Act is narrow and parcel‑specific, it would be unusual to see frequent or omnibus amendments; however, the printed version confirms that no amendments were made up to the date of the published version. Any later changes would be recorded in later consolidated versions and should be checked on the official legislation site cited in the Endnotes.

There are no transitional amendments in the Act other than the preservation provisions for specific leases and the Registrar’s duty to update the register. The Lease preservation mechanisms (s 6 and s 9) and the safeguarding clause (s 25) operate as the Act’s built‑in transitional treatments for lessees whose landlord or statutory basis would otherwise be displaced.

The Act cross‑references other statutes rather than amending them. It does not purport to amend the Crown Land (Reserves) Act 1978, the Education and Training Reform Act 2006, the Land Act 1958 or the Transfer of Land Act 1958; instead it changes the status of particular parcels and declares that certain leases are to be treated as if they were granted under relevant sections of those Acts. Any amendments to those other Acts that impact the operation of these deeming provisions would be made in their own amending instruments and would need to be consulted separately.

Finally, the Act’s narrow scope and the Endnotes’ explicit statement of "no amendments" mean that the current text stands as enacted, and practitioners should rely on it subject to checking for any subsequent amendments published after the date in the printed endnotes.

The text of the Act and its Endnotes do not report any litigation arising from this statute. The Endnotes include the Minister’s second reading speech dates and the Parliament dates for consideration (Legislative Assembly 21 October 2015; Legislative Council 10 December 2015) and record the assent date of 5 April 2016 and commencement dates for different Parts (Endnotes). No cases, tribunal decisions, disputes or judicial reviews are mentioned in the Act itself or in the Endnotes.

Because the Act is an enactment that effects property title and management changes, potential litigation could hypothetically concern the correctness of register amendments, claims for compensation for extinguished interests, disputes about committee of management powers, or contractual disputes tied to preserved or converted leases. The Act makes no provision in its text regarding an exclusive judicial route or specific statutory dispute resolution mechanism for such claims. Any litigation that might arise would therefore be conducted in the ordinary courts or administrative review channels, invoking the relevant substantive and procedural law (for example, claims under property law, contract law, administrative law, or compensation provisions in other statutes) consistent with the Act’s declared changes.

The Act does state in section 25 that "Nothing done by virtue of section 6 or 9 is to be regarded as placing any person in breach of, or as constituting a default under, any provision of a lease referred to in those sections" and that such action is not to be "regarded as fulfilling any condition which allows a person to exercise a right or remedy in respect of, or to terminate, any agreement or obligation" (s 25(a)-(b)). That provision will be a statutory argument in any litigation where a party attempts to rely on the change in statutory status as a trigger for remedies under those leases. In other words, s 25 is drafted to reduce the litigation risk of lease termination claims directly caused by the Act’s reclassification.

If a practitioner is preparing for potential litigation or advising clients with interests affected by the extinguishment language, the Act does not provide guidance on compensation or procedures. Any legal challenge about extinguished easements or other encumbrances would require litigants to identify an alternative statutory or common law basis for remedy. The Act itself gives no litigation history and no cases are named in the text. Users of this instrument should therefore check subsequent consolidations, judicial databases and administrative lists for any litigation commenced after the date recorded in the printed Endnotes.

The Act is tightly drafted but contains features that can produce unexpected legal and practical consequences if not watched closely. The following are concrete items and the statutory mechanism by which each arises.

Broad extinguishment language is sweeping: The recurring clause that affected land is "taken to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (examples: s 4(a), s 8(a), s 11(a), s 15(a), s 17(a), s 19(a), s 21(a)). Absent express preservation, that language may extinguish rights that stakeholders assumed would remain, such as easements, covenants, unregistered interests, or other instruments tied to the former reservation. Only two specific leases are preserved by the Act (s 6 and s 9). If a practitioner assumes that standard easements, licences or other third‑party rights survive a reservation revocation, they must confirm whether those rights are expressly protected or otherwise re‑established.

Limited preservation of leases: The Act preserves only the Albert Park lease and the Ballarat North lease (s 6, s 9). If other lessees or occupiers remain, they are not preserved by this Act and may be vulnerable to extinguishment if their interest is construed as an encumbrance extinguished by the Act. The preservation clauses are narrowly targeted and convert those leases into leases "as if" granted by particular Ministers under specified statutory sections; they do not create broad protection for other contractual rights.

Deemed substitution of landlord and legal basis: For the two preserved leases the Act substitutes the Minister as if he or she had granted the lease under the Education and Training Reform Act 2006 s 5.2.5 (Albert Park) or the Land Act 1958 s 134 (Ballarat) (s 6(2), s 9(2)). This has practical consequences for governance and approvals attaching to the lease post‑conversion, since the statutory lease powers in the referenced Acts may carry different conditions or ministerial discretions than the lessor previously exercised. Section 25 attempts to blunt adverse contractual outcomes, but the legal basis of the lease changes. Practitioners must check how the referenced Acts regulate ministerial leases and what compliance obligations or statutory conditions then apply.

Registry timing and evidentiary gaps: Section 24 requires the Registrar to make necessary register amendments, but the Act does not provide timing or priority frameworks. Until the Transfer of Land Register is amended, there may be an evidentiary or transactional gap between statutory effect and registered reality. Parties relying on the register for financing, sale, or security should verify completion of registry amendments before assuming they have the benefit of the Act’s declarations.

Revocation of regulations without replacement detail: The Act revokes any regulations made under s 13 of the Crown Land (Reserves) Act 1978 as they apply to the land (eg s 4(d)). That may remove site‑specific regulation that previously governed use or access. Unless new regulations or management plans are put in place under the Crown Land (Reserves) Act 1978 or another instrument, there may be regulatory vacuums affecting permitted activities. Where councils are newly appointed as committee of management, they will need to adopt management instruments; until then the scope of permitted activities may be uncertain.

Committee of management removal and re‑appointment timing risk: The Act revokes committee or trustee appointments but only in two cases expressly appoints a new committee (Glen Eira City Council for Caulfield, Loddon Shire Council for Wedderburn) (s 13, s 23). For other parcels the revocation may mean there is no immediate committee of management designated in the Act. That raises practical questions about who may lawfully grant licences, permits, or manage the land while the Crown (or relevant Minister) determines new arrangements. Practitioners should check whether the Crown has administrative arrangements in place to manage the interim period.

No express compensation mechanism for extinguished interests: The Act extinguishes a broad set of interests but contains no provision for compensation for holders of extinguished rights. Any person who loses an easement, covenant, licence or unpreserved lease may need to pursue compensation under other legislation or by private claim. This absence is a procedural and financial risk that affected parties need to evaluate.

Interaction with planning and local government instruments: The Act itself does not alter planning overlays or local government instruments, but re‑reservation and committee appointments will affect how land is managed under the Crown Land (Reserves) Act 1978. Practitioners should not assume the same planning or council approvals will apply after re‑reservation; cross‑checking with planning authorities and local councils is necessary.

Commencement complexity: The Act contains staged commencement (s 2). Parts 2 and 6 and particular Schedule items were to be brought into force by proclamation or on a fallback date. The Endnotes provide actual commencement dates. Care is needed to determine the operative date for a given parcel because earlier or later commencement affects rights and duties during the interregnum.

Statutory protection against contractual triggers limited: Section 25 protects lessees from being treated as in breach solely because of the Act’s actions under s 6 or s 9, and it states the conversions do not automatically permit termination rights. However, s 25 does not immunise a lessee from the consequences of unrelated defaults or new statutory conditions that may apply under the Acts to which the lease is deemed to belong. Practitioners should not over‑read s 25 as an insurance against all contractual risk.

In short, the key "gotchas" arise from the Act’s broad extinguishment language paired with narrow express preservations, the timing and practicalities of registry amendments, the substitution of ministerial lease foundations, and the absence of an explicit compensation or transitional regulatory regime for other affected interests.

For lawyers, land managers and local authorities advising clients affected by the Act, the following concrete compliance checklist sets out practical steps grounded in the Act’s provisions.

1. Identify affected parcels precisely against Schedule 1: Match the property description on title to the Schedule item (Schedule 1 items 1-7). The Act operates by reference to the Schedule, which identifies parish, allotment, area, instrument and date, purpose and the extent of revocation. Confirm the exact allotment and extent (for example, Ballarat Allotments 2005 and 2007 only to the extent they are included, or Flinders only Crown Allotment 2034) (Schedule 1).

2. Check commencement date for the relevant Part or Schedule item: Use s 2 and the Endnotes to determine the operative commencement date for the parcel. Some Parts (eg Parts 2 and 6 and items 1 and 5) commenced by proclamation or on 1 September 2016 under s 2(2)-(4); the Endnotes indicate when different Parts actually commenced. Compliance obligations and registration actions follow from the operative commencement date.

3. Verify current registered interests and prepare for registry amendments: Because s 24 requires the Registrar to make necessary recordings or amendments to the Transfer of Land register, obtain current title searches and identify registered encumbrances, easements, covenants, mortgages or caveats. Liaise with the Registrar early to understand the timing and process for the amendments required by the Act, and plan to lodge or respond to any registry dealings affected by the change of reservation status.

4. For lessees named in the Act, confirm legal continuity and landlord identity: For the Albert Park lease (s 6) and the Ballarat North lease (s 9) confirm the exact lease instrument, commencement dates and whether the lease was indeed in force immediately before the beginning of the relevant Part. Advise lessees that their leases are preserved and are to be treated as if granted by the relevant Minister under the specified Acts (s 6(2), s 9(2)), and explain how s 25 limits using the statutory change as a contractual breach or termination trigger. Nevertheless, confirm any new ministerial conditions that may apply under the Education and Training Reform Act 2006 or the Land Act 1958.

5. For councils appointed as committees of management, plan for management duties under the Crown Land (Reserves) Act 1978: If advising Glen Eira City Council or Loddon Shire Council, confirm they are taken to be the committee of management under s 14(2) of the Crown Land (Reserves) Act 1978 as of the relevant commencement (s 13, s 23). Advise these councils to: (a) review management responsibilities under the Crown Land (Reserves) Act; (b) prepare or update management plans or policies appropriate to the reservation purpose; (c) check any insurance, maintenance or liability issues; and (d) coordinate with the Registrar and the Department responsible for crown land administration.

6. Review any site‑specific regulations formerly in force under s 13 of the Crown Land (Reserves) Act 1978: The Act revokes such regulations as they applied to the land (eg s 4(d), s 8(d), etc). Identify what regulatory instruments were revoked and whether replacement regulation or management instruments are needed to govern uses, safety requirements, or community access.

7. Advise third‑party interest holders regarding extinguishment risk: Where clients hold easements, covenants, licences or other interests not expressly preserved by the Act, notify them of the risk their interest may have been extinguished by the Act’s language (eg s 4(a)). Assess avenues for remedy or compensation under other applicable laws, and consider provisional protective measures such as lodging caveats or engaging with the Registrar or department to seek preservation of interests where appropriate.

8. Coordinate with the Ministerial offices for ministerial leases and approvals: For affected leases, confirm which Minister is identified by the Act as granting the lease under the applicable section of the Education and Training Reform Act 2006 or the Land Act 1958. Establish contact to clarify any additional approvals or statutory conditions that may be applied or required to be satisfied under those Acts.

9. Update client documentation and contractual templates: For lessees whose lease identity or landlord has changed by operation of the Act, update the client’s internal records and any consent or assignment processes so that future dealings correctly reflect the Minister as lessor and the lease as a statutory lease under the referenced Act. Note that s 25 preserves anti‑assignment clauses protections so the act of statutory substitution should not be treated as an assignment from the lessee’s perspective.

10. For land‑use planners and developers, consult Crown Land (Reserves) Act implications: For parcels now permanently or temporarily reserved for public purposes (s 5, s 12, s 22), identify how the reservation purpose interacts with local planning instruments and development approvals. Where management authority is newly assigned to a committee (including a local council), consult with that body about planning, permitted uses and any requirement for approvals for events, construction or maintenance.

11. Document and communicate transition arrangements: Because the Act revokes management appointments and potentially creates a gap, advise clients to document any practical transitional arrangements for maintenance, safety, public access and liabilities. This may include coordinating with the department that administers Crown lands to confirm interim management responsibilities until a committee of management is fully operative.

12. Preserve evidence of pre‑Act rights and dealings: For stakeholders concerned about extinguishment, keep complete records of prior registrations, leases, licences, and communications. In the event of a dispute about extinguishment or compensation, such records will be essential.

13. Monitor for subsequent regulations, management plans and any compensation schemes: Because the Act itself does not provide compensation or replacement regulations for extinguished interests, monitor for subsequent administrative instruments that might be issued under the Crown Land (Reserves) Act or other legislation to address compensation, re‑establishment of regulatory controls or management frameworks.

14. Seek statutory and expert review where stakes are material: If the affected interest is material in value or importance, consider obtaining a specialist property law opinion, liaising with Crown land administrators, or seeking relief by negotiation, and only then consider administrative review or litigation if no administrative remedy is available.

These steps ground compliance in the Act’s concrete provisions , identify the affected parcel(s) against Schedule 1, confirm commencement, obtain and update registry entries, protect preserved lessees, check committee appointments, manage the practical transition, and be alert to extinguishment exposures for other third parties. The Act supplies the statutory foundations; compliance requires coordinating registry, ministerial and local government actions to reflect the new legal architecture.
