Land (Revocation of Reservations) Act 2012

The Act repeatedly uses three legal devices to change land status: revocation of Orders in Council that created reservations, revocation of Crown grants, and statutory re-classification of land under other Acts. Those devices produce specific, identifiable legal consequences.

1. Revocation of a reservation or Crown grant. Each revocation provision is parcel-specific and either revokes (a) an Order in Council (for reservations), (b) a Crown grant (for granted land), or (c) both. Example text appears in s 3(1) and s 19(1) (Orders in Council), and s 3(2) and s 19(2) (Crown grants). After revocation, the Act typically states that the land is "taken to be unalienated land of the Crown" and is "freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (common formulation in ss 4(a), 8(a), 11(a), 14(a), 16(a), 18(a), 20(a)). Mechanically, that extinguishes prior trust arrangements, limitations and private interests (subject only to explicit preservation provisions such as s 9).

2. Conversion to another reserve status or appointment of management. The Act performs two kinds of conversion:

   • Temporary reservation for municipal purposes: St Kilda land is taken to be temporarily reserved under s 4(1) of the Crown Land (Reserves) Act 1978 (see s 5), and the City of Port Phillip is taken to be the committee of management (s 6). The Act therefore transforms the parcel from whatever historic reservation or grant applied into a reserve under the Crown Land (Reserves) Act regime.
   • Reserved forest: the Toolangi hatched land is taken to be reserved forest under s 42 of the Forests Act 1958 (s 12). That transposes the parcel into the Forests Act regime.

3. Preservation of existing statutory leases and licences (limited carve-out). For the former Fitzroy Gasworks land, s 9(1) expressly preserves any lease or licence granted under s 54P of the Financial Management Act 1994 that existed immediately before commencement, but only while the land remains Crown land (s 9(2)). This is a narrowly framed continuity rule, tied to particular statutory instruments and to the retained Crown land status.

4. Registrar of Titles' administrative duty. Section 21 obliges the Registrar of Titles to make any recordings or amendments to the Register under the Transfer of Land Act 1958 necessary because of the Act. The Act does not set out a timetable or fee authority; it imposes the duty without funding or procedural detail.

5. Plan and schedule specificity. Many revocations are defined by reference to plan numbers lodged in the Central Plan Office of the Department of Sustainability and Environment (e.g. LEGL./11‑069 for Toolangi, LEGL./11‑023 for Sneydes Road) or by Government Gazette references and Crown grant particulars (Schedule 1 items). The Act therefore depends on cadastral and historical instruments to identify the affected parcels.

6. Revocation of secondary appointments and regulations. The Act repeatedly revokes appointment of committees of management or trustees "to the extent that" those appointments relate to the specified land (e.g. ss 4(b)-(c), 8(b)-(c), 11(b), 14(b), 16(b), 18(b), 20(b)). It also revokes any regulations under s 13 of the Crown Land (Reserves) Act 1978 to the extent they applied to the land (common in multiple Parts). Those revocations remove instruments that previously regulated management or use.

7. Commencement mechanics. Section 2 permits proclamation and contains a fallback commencement date of 1 January 2013, but the Endnotes record that the Act came into operation on 31 October 2012 via Special Gazette. The Act therefore anticipated variable commencement and permitted the executive to bring parts into force by proclamation.

Collectively, these concepts convert identified parcels into new legal statuses (unalienated Crown land, temporary reserve, reserved forest) and alter management arrangements via transfer or revocation of committee/trustee appointments. The only provision that preserves prior private interests is the narrow s 9 lease/licence continuity for Fitzroy and it is conditional on continued Crown land status.

The Act alters legal status and management obligations for a compact set of stakeholders identified by parcel:

• The Crown (State of Victoria): decision-maker and owner in title, whose legal capacity to reclassify Crown lands is exercised by the Act. The Crown gains or regains "unalienated" title to parcels once reserved or granted; the Act places duties on the Registrar to reflect those changes on the Transfer of Land Register (s 21).

• Committees of management and trustees previously appointed in respect of the affected reserves: the Act revokes appointments to the extent they relate to the specified land (multiple provisions, e.g. ss 4(b), 8(b), 11(b), 14(b), 16(b), 18(b), 20(b)). Those bodies lose statutory powers and obligations in relation to the hatched areas, unless re-appointed under a new reserve regime.

• Local government: City of Port Phillip is expressly taken to be committee of management for the St Kilda land on commencement of Part 2 (s 6). The City therefore gains statutory management responsibilities under the Crown Land (Reserves) Act 1978 for that land; the Act does not include funding or service-level detail.

• Lessees and licensees: most existing private rights are extinguished when land is taken to be "unalienated land of the Crown ... freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (e.g. s 4(a)). The sole exception expressly preserved by the Act is for leases or licences over the Fitzroy Gasworks land that were granted under s 54P of the Financial Management Act 1994; those continue in force after commencement provided the land remains Crown land (s 9(1)-(2)). That means other existing leases or licences not within that specific category may be extinguished by this Act for the relevant parcels.

• Holders of Crown grants and anyone claiming under a revoked Crown grant: where a Crown grant is revoked (St Kilda, s 3(2); South Melbourne, s 19(2)), the grant particulars listed in Schedule 1 are revoked by statute and any interests flowing from those grants are extinguished to the extent the Act provides (see ss 4(a), 20(a)).

• Agencies that administer the referenced statutes: Department of Sustainability and Environment (plans lodged in the Central Plan Office are relied upon), the Registrar of Titles (s 21), bodies administering the Crown Land (Reserves) Act 1978 and the Forests Act 1958 (the Act converts parcels into those regimes, see ss 5, 12).

• The public and potential developers: the change from trust or reserve status to unalienated Crown land or a new reserve type may open or foreclose development opportunities, tenure offers, or management options. The Act itself creates the legal preconditions for new dealings by the Crown over the freed parcels (subject to other statutes).

Who pays: the Act does not appropriate funds or direct payment. Management responsibilities assigned (for example to the City of Port Phillip under s 6) are conferred without accompanying funding provisions; the Act therefore shifts administrative obligations to entities without explicit budgetary directions in the statute.

Who decides going forward: the Crown (through executive instruments and agencies) will determine subsequent dealings, transactions or re-reservation of the unalienated Crown land, except where the Act itself creates a new reserve and committee (St Kilda and Toolangi reserved forest). The Registrar decides the mechanical amendments to titles required by s 21.

What behaviour changes: pre-existing committees, trustees and holders of interests may no longer exercise rights over the hatched areas; the City of Port Phillip must assume committee responsibilities for St Kilda; lessees at Fitzroy holding s 54P instruments retain their agreements subject to future changes in Crown status; authorities must update the land registers and cadastral records per schedule and plan references.

The Act is sparse in creating new duties or rights beyond reclassification, but it does establish a few explicit statutory duties and rights by reference to other Acts. The key operative rights and obligations are:

• Rights conferred by reclassification into reserve regimes. Where the Act takes land to be temporarily reserved for municipal purposes under s 4(1) of the Crown Land (Reserves) Act 1978 (s 5), the land attracts whatever rights and obligations attach to that temporary reserve classification under the Crown Land (Reserves) Act. The Act itself does not detail those rights or duties; it effects a legal conversion and leaves the substantive content to the Crown Land (Reserves) Act.

• Reserved forest classification. Section 12 takes the Toolangi hatched land to be reserved forest under section 42 of the Forests Act 1958. That means the land will be governed by the Forests Act in place of the earlier reservation. The Act creates the right for the Crown (and the administering body under the Forests Act) to manage the land under that regime.

• Committee of management appointment. Section 6 takes the City of Port Phillip to be the committee of management of the St Kilda hatched land under the Crown Land (Reserves) Act 1978. That creates a statutory management role for the City of Port Phillip and connects it to the duties and powers of committees under the Crown Land (Reserves) Act.

• Preservation of specified leases and licences. Section 9(1) preserves any lease or licence granted under s 54P of the Financial Management Act 1994 that existed immediately before commencement over the Fitzroy land, taking it to continue in force on and after commencement. This is a limited right for those lessees and licensees. Section 9(2) cuts that right off if the land ceases to be Crown land. That makes the lessee's retained interest contingent and dependent on future tenure changes.

• Registrar's duty to amend the Register. Section 21 imposes a statutory obligation on the Registrar of Titles to make necessary recordings or amendments in the Register under the Transfer of Land Act 1958 that arise because of the Act. This is an administrative duty conferred on the Registrar to give effect to the statutory reclassifications.

• Revocation of prior appointments and regulations. Multiple parts of the Act revoke committee or trustee appointments "to the extent that" they relate to the land (e.g. ss 4(b)-(c), 8(b)-(c), 11(b), 14(b), 16(b), 18(b), 20(b)). Those revocations withdraw earlier statutory management rights and responsibilities from the previously appointed bodies.

Notable absences and limits:

• The Act does not create new offence provisions or civil penalties; it does not set out enforcement sanctions or an enforcement agency. It relies on administrative consequences and cross-references to other statutes for management regimes.

• The Act does not specify any compensation scheme or acquisition procedure for extinguished private interests; the only statutory protection for private occupiers is the narrow preservation in s 9 for s 54P instruments.

• The Act does not contain explicit funding or resource allocation for bodies that acquire management responsibilities (for example the City of Port Phillip under s 6); duties are conferred without appropriation language.

In practice, rights and duties created by the Act frequently operate by reference to other statutes. The statutory text therefore creates the right to be governed by those other Acts (Crown Land (Reserves) Act 1978, Forests Act 1958, Financial Management Act 1994), but it does not restate the substantive obligations contained therein.

The Land (Revocation of Reservations) Act 2012 contains no express criminal offence provisions, fines, civil penalties, or administrative sanctioning mechanisms. Its operative content is declaratory, registrational and classificatory rather than penal. The Act's enforcement and compliance mechanisms are administrative and indirect, flowing from linked statutes and public records:

• Registrar activity as implementation mechanism: Section 21 requires the Registrar of Titles to make recordings or amendments in the Register under the Transfer of Land Act 1958 necessary because of the Act. The Registrar's compliance with that duty will determine whether title records, dealings and encumbrances in the Torrens register reflect the statutory changes. Any practical enforcement of accurate registration will therefore be handled under the Transfer of Land Act regime and the Registrar's established processes rather than by a penalty in this Act.

• Management and compliance through applicable regimes: where land is made subject to another statute the enforcement mechanisms of that statute become relevant. For example, St Kilda land taken to be temporarily reserved for municipal purposes (s 5) becomes subject to the Crown Land (Reserves) Act 1978; any enforcement of management standards or obligations will be undertaken under that Act, not under the revocation Act. Similarly, Toolangi land declared reserved forest (s 12) becomes enforceable under the Forests Act 1958.

• Continuity of statutory leases as a protection, not a penalty. The Act protects certain lessees at Fitzroy by providing continuation in s 9(1). Conversely, the absence of statutory protection for other lessees and interests effectively extinguishes their instruments without award of compensation or the creation of a right to challenge under this Act; any remedy would need to be pursued under other laws or general legal doctrines.

• Revocations of appointments and regulations. The Act revokes appointments of committees of management and trustees and regulations under s 13 of the Crown Land (Reserves) Act 1978 to the extent they applied to affected land (see multiple Parts). Those revocations remove the statutory foundations for prior management and regulation, with any enforcement of new boundaries or management duties arising from the replacement legal status.

Potential practical enforcement risks and implementation costs:

• Title and dealing uncertainty until the Registrar completes the required amendments under s 21. The Act imposes a duty but not an operational timetable; delays or administrative errors in registration could create interim uncertainty for purchasers, potential developers, or statutory lessees whose instruments are preserved only while land remains Crown land (s 9).

• Absence of funding or transitional administration. Where local government becomes committee of management (s 6) or where land is converted to a different regime, enforcement of management standards will depend on the administering body and its resources; the Act does not allocate funding.

In short, enforcement is implemented through the administrative machinery of registration and the statutes into which land is converted rather than by penalty provisions within the revocation Act itself.

The Act explicitly cross-references and modifies the operation of several statutes; its legal effect must be read in that statutory network.

1. Crown Land (Reserves) Act 1978:

   • The Act uses the Crown Land (Reserves) Act to give legal effect to temporary reservation and committee-of-management appointments. St Kilda land is taken to be temporarily reserved for municipal purposes under s 4(1) of the Crown Land (Reserves) Act 1978 (s 5 of this Act). Section 6 takes the City of Port Phillip to be committee of management under that Act. Multiple Parts revoke any regulations under s 13 of the Crown Land (Reserves) Act 1978 to the extent they apply to the land (e.g. ss 4(d), 8(d), 11(c), 14(c), 16(c), 18(c), 20(d)). Thus the Act both disapplies some subordinate regulations and reassigns land to the Crown Land (Reserves) Act regime.

2. Financial Management Act 1994:

   • Section 9 preserves leases or licences granted under s 54P of the Financial Management Act 1994 in respect of the Fitzroy Gasworks land, continuing them in force on and after commencement, but only while the land remains Crown land (s 9(1)-(2)). This is an explicit temporal and conditional cross-reference. It protects a discrete class of statutory instruments but does not shelter other contractual or proprietary interests.

3. Forests Act 1958:

   • Section 12 takes part of the Toolangi land to be reserved forest under s 42 of the Forests Act 1958. The effect is to transpose the land into the Forests Act framework; the substantive rights, management powers and obligations will therefore be those contained in the Forests Act.

4. Transfer of Land Act 1958:

   • Section 21 imposes a statutory duty on the Registrar of Titles to make any recordings in or amendments to the Register required because of this Act. That is the mechanism by which the Torrens register will be updated to reflect revocations and new classifications. The Act does not itself alter the substantive registration principles in the Transfer of Land Act, but it mandates registry action under that Act.

5. Historical Orders in Council and Crown grants:

   • The Act revokes specific Orders in Council and named Crown grants listed in Schedule 1. Those historical instruments derive their original effect from older statutes and executive actions; this Act expressly nullifies them to the extent identified. The schedules provide Government Gazette references and plan numbers, creating a bridge between historical instruments and the present legal reclassification.

6. Absence of statutory protection for some interests:

   • Apart from the specific preservation for s 54P lease/licence holders in s 9, the Act contains a general sweep extinguishing trusts, limitations and interests when land is taken to be unalienated Crown land (e.g. ss 4(a), 8(a), 11(a), 14(a), 16(a), 18(a), 20(a)). That interacts with the Transfer of Land Act via s 21 (which requires the Registrar to record changes); it may also interact with any other statute that confers property or compensation rights, but the Act contains no express compensation or acquisition process.

7. Practical interactions not re-stated:

   • The Act often places land into other regimes (Crown Land (Reserves) Act, Forests Act) without restating the obligations of those Acts. Practitioners must consult the relevant statutes to determine the detailed rights and duties that arise from the new classification. The revocation Act provides the reclassification trigger; the detailed legal consequences flow from the referenced statutes.

In short, the Act functions as a statutory instrument that reassigns parcels among existing statutory frameworks and requires administrative corrections in the title registry. Its substantive operational consequences are carried out by the statutes into which land is transferred and by the Registrar's duties under the Transfer of Land Act.

The Act's own Endnotes record no amendments. The table of amendments in the provided text states: "There are no amendments made to the Land (Revocation of Reservations) Act 2012 by Acts and subordinate instruments." The Act was assented to on 8 May 2012 (Endnotes) and, per the Endnotes, brought into operation on 31 October 2012 via Special Gazette (No. 366) 30 October 2012 page 1. The internal commencement provision (s 2) allowed proclamation and provided a default commencement of 1 January 2013 if not proclaimed earlier; in practice the Endnotes show an earlier commencement.

Because there are no recorded amendments since passage, the version provided (Version No. 001) is the operative legislative text as at 31 October 2012. There are no amendment entries in the Endnotes' "Table of Amendments" and no subordinate instruments cited as having modified the Act. The schedule and operative provisions are therefore those enacted in 2012.

Practical consequence for research and compliance: users should rely on the Schedule and plan references in the original enactment as authoritative for the parcels affected. If undertaking due diligence or transactional work, practitioners should verify the current status in the Register of Titles and the Central Plan Office since the Act obliges the Registrar to make amendments (s 21), and the Endnotes indicate that proclamation and commencement occurred in 2012. Because the Act is parcel-specific and final in its revocation language, an absence of later amendments suggests the statutory changes remain as enacted. However, parties should confirm that no subsequent administrative reclassifications or disposals have occurred after the Registrar updated registers.

The Act itself contains no case references and the text provides no litigation history. The schedules and endnotes list the legislative history (dates of introduction, second reading speeches, assent and commencement) but do not cite judicial decisions that interpret the Act. The Endnotes include the minister's second reading speech dates (Legislative Assembly: 28 March 2012; Legislative Council: 19 April 2012) and the assent date (8 May 2012), but there are no notes of judicial determination or litigation arising out of the Act in the provided materials.

Because the Act changes title and extinguishes prior trusteeships and other interests, disputes could theoretically arise in relation to interpretation of the revocation wording, the scope of extinguished interests, the continuity of leases (s 9), or errors in the Registrar's implementation. None of those disputes are recorded in the instrument as provided here. This document does not undertake a search of court records; it reports only what the Act and its Endnotes record. Practitioners needing to know whether litigation has subsequently contested the operation of the Act should run external case-law and administrative tribunal searches; such searches fall outside the text of the Act supplied here.

Notably, the Act’s language which takes land to be “freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests” could be a focal point for litigation if parties claim that their interest ought not to have been extinguished or that statutory protection (other than s 9) should apply. The Act itself does not offer dispute-resolution mechanisms or transitional compensation; any litigation would proceed under general legal principles and the relevant property and administrative law.

This Act is compact and parcel-specific but contains a number of practical pitfalls that frequently trip up practitioners, custodians and affected parties. The main "gotchas" to watch for are:

1. Broad extinguishment language. Multiple provisions take land to be "unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (e.g. ss 4(a), 8(a), 11(a), 14(a), 16(a), 18(a), 20(a)). That language is wide-ranging and operates to extinguish a variety of pre-existing legal relationships unless the Act expressly preserves them. Do not assume common-law, contractual or equitable rights survived unless they fall within the narrow preservation (s 9) or remain in force under another applicable statute.

2. Very limited protection for existing occupiers. The only explicit preservation is s 9(1) for leases or licences under s 54P of the Financial Management Act 1994 over the Fitzroy Gasworks land. All other occupants, licensees, lessees or parties claiming under revoked Crown grants are likely to find their interests extinguished unless some other statute or recorded right survives. The Act does not provide a compensation mechanism.

3. Conditional continuation of s 54P instruments. Even where s 9 preserves an instrument, continuation depends on the land remaining Crown land (s 9(2)). If the Crown subsequently disposes of or reclassifies the Fitzroy land so it ceases to be Crown land, those statutory leases or licences fall away.

4. Registrar actions are necessary but timing is uncertain. Section 21 obliges the Registrar of Titles to make necessary recordings and amendments, but the Act imposes no timetable or administrative process, nor does it create a fee or funding mechanism. In practice, delay or administrative error in the Register could create transactional uncertainty.

5. Plan reference reliance. Several revocations and reclassifications are defined by reference to plan numbers lodged in the Central Plan Office (e.g. LEGL./11‑069, LEGL./11‑023) or to hatchings on schedule plans. Litigation or boundary disputes could arise if those plans are inaccurate or if physical occupation differs from plan references. Verification in the Central Plan Office and the Register is essential.

6. Transfer of management without funding detail. Appointing the City of Port Phillip as committee of management for St Kilda (s 6) confers management obligations but the Act contains no appropriation or funding. Practitioners and councils must verify whether budgets or service arrangements have been made outside the Act.

7. Revocation of historical Crown grants. Revocation of Crown grants (St Kilda, South Melbourne Temperance Hall) extinguishes whatever proprietary interests those grants created. Where those grants have underpinned title or long-standing use, practitioners should check whether successor rights or compensatory arrangements apply under other law.

8. Mixed outcomes within single parcels. Barwon Heads is an example: s 18(a) frees most of the hatched area from prior reservations but preserves a temporary reservation for the land identified as "B" on the plan in Schedule 4. That creates a mixed tenure within the same schedule item and requires careful map-based analysis.

9. Absence of penalty or enforcement detail. Because the Act operates administratively rather than by imposing offences, enforcement of new management standards will rely on the regimes of the Crown Land (Reserves) Act 1978 or the Forests Act 1958. Practitioners must consult those Acts for compliance obligations and enforcement tools.

10. Historical instruments may not reflect current physical reality. Some Orders in Council and Gazette notices date back to the 19th and early 20th centuries (examples in Schedule 1). Historical descriptions may use old parish, county and allotment nomenclature that requires modern cadastral translation; errors in translation could create ambiguity.

11. No express transitional arrangements. The Act revokes trustees and committee appointments "to the extent that" they relate to the land, but it provides no express transitional staffing, asset transfer, or liability allocation measures. Those questions will have to be handled administratively.

12. Interaction with other statutes is one-way. The Act moves land into other statutory regimes but does not amend those regimes. Parties must consult the Crown Land (Reserves) Act 1978 or Forests Act 1958 to understand management powers, revenue rights, or disposal processes post-reclassification.

In short, the principal surprises are the breadth of extinguishment, the narrowness of statutory protection for existing private rights, the administrative reliance on registrarial action and the absence of fiscal or transitional detail. If you represent an affected party, verify the Register, inspect the Central Plan Office plans, and check for any supplementary administrative instruments implementing the reclassifications.

This section outlines practical compliance steps and risk mitigation measures for likely affected actors: land managers, local government, lessees/licensees, purchasers, and the Registrar. The Act is administrative; compliance largely consists of confirming registrations, checking plan references, and aligning management practices with the statute's reclassifications.

For committees of management, trustees and local government (e.g. City of Port Phillip):

• Confirm status: For St Kilda, note s 6 takes the City to be committee of management for the hatched area. The City should obtain certified copies of the plan in Schedule 2 and ensure its internal records identify the area and the legal basis for committee responsibilities.
• Review duties under the Crown Land (Reserves) Act 1978: Because the Act transfers the land into that regime (s 5), the City must consult the Crown Land (Reserves) Act to determine its statutory obligations and any applicable operational requirements (licencing, maintenance, public access).
• Budget and operational planning: The Act confers management without funding. The City should quantify maintenance or liability exposures and seek budget authorisation or administrative directions from the relevant state department if necessary.
• Registry reconciliation: Work with the Registrar of Titles and the Department of Sustainability and Environment to confirm that the Register and cadastral plans have been updated to reflect the committee appointment.

For lessees, licensees and occupiers:

• Identify whether your instrument is preserved by s 9. Only leases/licences under s 54P of the Financial Management Act 1994 over the Fitzroy Gasworks land are expressly preserved (s 9(1)). If you hold such an instrument, document the instrument and confirm it existed immediately prior to commencement.
• Confirm Crown status: s 9(1) preserves continuation "on and after" commencement but s 9(2) states the preservation ceases if the land ceases to be Crown land. Therefore, monitor any future disposals or reclassifications. Seek written confirmation from the relevant Crown agency about current Crown status and any planned disposals.
• Check for extinguishment. For other parcels where land is taken to be unalienated Crown land and interests are declared extinguished (e.g. ss 4(a), 20(a)), determine whether any preserved statutory right or other statutory protection exists. If your interest appears extinguished, urgent legal advice is recommended to evaluate remedies.

For purchasers, occupiers and potential developers:

• Inspect the Register and Central Plan Office plans referenced in Schedule 1. The Act relies on plan numbers (e.g. LEGL./11‑069) and hatchings; those documents must guide any transaction due diligence.
• Confirm current tenure: s 21 requires Registrar amendments, but registration may lag. Obtain up-to-date title searches and written confirmation from the Registrar that the Register reflects the Act's changes before any purchase.
• Consider residual encumbrances: although the Act purports to free land from encumbrances, check the Register for any lingering interests and for any annotations recorded by the Registrar under s 21.

For the Registrar of Titles:

• Implement s 21: The Registrar must make any recordings or amendments to the Register necessary because of the Act. Prepare administrative schedules to deal with each Schedule 1 item and its plan references, confirm plan numbers in the Central Plan Office, and ensure consistent notation on Torrens certificates.
• Public notice and transparency: consider publishing notices or certificates of amendment to assist stakeholders who rely on the Register for certainty.

For Crown agencies and departments:

• Asset management: review records for the affected land and arrange for transfer of management responsibilities where the Act confers them (e.g. for Toolangi under the Forests Act per s 12, and for St Kilda under the Crown Land (Reserves) Act per s 5).
• Liaise with local government and the Registrar regarding practical implementation, mapping, and funding arrangements.
• Ensure any regulations under s 13 of the Crown Land (Reserves) Act 1978 that are revoked to the extent they applied (multiple Parts) are identified and administrative references updated.

General recommended steps for all affected parties:

1. Obtain certified copies of the plans and schedule items in Schedule 1 and the Central Plan Office plans referred to in the Act.
2. Conduct title searches and confirm that the Registrar has effected the changes required by s 21; request written confirmation or obtain updated Certificates of Title.
3. If you hold occupier rights, identify whether they fall within s 9 protection; if not, obtain legal advice quickly concerning the extinguishment language.
4. For local authorities and bodies appointed as committees, identify statutory duties under the Crown Land (Reserves) Act 1978 or relevant statute (Forests Act) and secure budgetary or administrative arrangements to meet those duties.
5. For any proposed dealings or development, verify the current legislative regime that now governs the parcel (unalienated Crown land, temporary municipal reserve, reserved forest) and consult the relevant statute for consent, licence and disposal processes.
6. Document communications with the Registrar and the Department of Sustainability and Environment, especially in relation to plan identification and cadastral boundaries.

The Act creates legal effects by classification; compliance therefore means ensuring administrative records, registers and management responsibilities match those statutory classifications, and that those who claim rights check whether those rights fall into the narrow exception preserved by s 9.
