Land (Revocation of Reservations) Act 2008

The central concept is a permanent reservation of Crown land. Under the Crown Land (Reserves) Act 1978, the Governor in Council may, by Order in Council, reserve Crown land for a public purpose such as a site for public purposes, a free library, or public recreation. Such a reservation permanently dedicates the land to that purpose and typically places it under the control of a committee of management or trustees. The reservation is an enduring restriction on the Crown’s title, and the land cannot be alienated or used inconsistently with the purpose while the reservation remains in force. Revoking the reservation removes that public purpose dedication.

The Act revokes the Order in Council that created the reservation, but only to the extent it applies to the hatched area on the plan referenced in the relevant schedule. This means the revocation is spatially limited: only the hatched portion of the originally reserved land is freed from the reservation. The plans themselves (in Schedules 2 through 6, and for Marlo the plan lodged at the Central Plan Office numbered LEGL/07-035) are incorporated by reference but not reproduced in the legislative text, so precise boundary identification requires consulting those external documents.

Unalienated land of the Crown is a key concept in section 10(a). It means land that has never been granted or sold by the Crown and remains in Crown ownership, available for future disposal under the Land Act 1958. Because the land is deemed unalienated and freed and discharged from all prior interests, any prior trusts, leases (except the saved Marlo lease), easements, or other encumbrances are extinguished by force of statute. This is a radical vesting: the Crown takes the land free of any burdens that previously attached.

The revocation of a Crown grant for the Talbot Free Library (section 5(2)) is a separate concept. A Crown grant is a formal instrument by which the Crown conveys freehold title to a person. Revocation of a Crown grant is an unusual step; it effectively extinguishes the freehold estate and re-vests the land in the Crown as unalienated land. The Act does not provide for any compensation or saving of third-party interests in relation to that grant.

The lease saving in section 6(2) recognises that a lease granted by the Minister over the Marlo land before the Act commenced continues in force, but its legal basis shifts: it is deemed a lease under the Land Act 1958 rather than under the former reservation regime. This prevents the lease from being extinguished by the broad “freed and discharged” provision, protecting the lessee’s possessory rights.

Appointment revocation (sections 10(b) and (c)) means any committee of management or trustee that previously had control or fiduciary duties over the reserved land is automatically discharged, with no further steps required. Likewise, any regulations made under section 13 of the Crown Land (Reserves) Act 1978 that applied to the land are revoked (section 10(d)).

The Act directly affects a small number of identifiable parties. First, committees of management and trustees appointed to manage or hold the reserved land for the public purpose lose their appointments wholly to the extent they relate to the revoked land. These might include local community groups, councils, or individuals who had statutory responsibilities for the reserves. They have no further authority over the land and must cease any activities, potentially including handing over records or assets.

Second, Ian Cameron McKeown, the lessee of the Marlo land under a lease commencing 1 September 2007, is directly affected. The lease’s continued existence is preserved, but its governing legislation shifts from whatever regime applied (presumably under the Crown Land (Reserves) Act 1978 or a lease directly from the Minister) to the Land Act 1958. The lease terms themselves appear unchanged, but the statutory framework under which any disputes or renewals would be handled changes.

Third, the Registrar of Titles has a mandatory duty under section 11 to make recordings or amendments in the Register kept under the Transfer of Land Act 1958. This includes updating titles to reflect the revocation of reservations and, in the Talbot case, the revocation of the Crown grant. This is a compliance cost for the registrar’s office.

Fourth, the Crown itself is affected as owner. The land becomes unalienated Crown land, which means the Crown can now deal with it under the Land Act 1958 - for example, by selling it, leasing it, or reserving it for a different purpose. This represents a potential asset for the state, but also a loss of public open space or community facility, depending on what the reserve was used for.

Fifth, members of the public who used the reserved land for recreation, library services, or other public purposes lose access rights that attached to the reservation. At Yarrawonga, Marlo, Boorhaman, Brimin, and Mount Duneed, the public purposes were “site for public purposes” or “site for public recreation”; the revocation ends the dedication for those purposes, though the land remains Crown land and could be used for other public or private purposes in the future. The Talbot Free Library revocation removes the specific reservation for a free library and revokes the Crown grant, which may affect the operation of the library building on that land (the library itself may be on the land or adjacent; the Act only revokes the reservation and grant over the hatched area).

Sixth, local councils and the Department of Sustainability and Environment (now part of the Department of Energy, Environment and Climate Action) may have had management roles. They lose those functions for the revoked land.

Seventh, any holders of other interests that were not saved - such as informal licenses, permits, or easements - are extinguished by section 10(a). They are not parties to the saving in section 6(2) and therefore lose any rights they may have had.

The Act creates one explicit duty: the Registrar of Titles must make any recordings or amendments to the Register kept under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of the Act (section 11). This is a mandatory duty with no discretion; the Registrar has no choice but to update the title records to reflect the revocations and the freeing of the land from prior interests. The duty is triggered automatically upon the Act coming into operation.

The Act confers on the Crown the right to treat the revoked land as unalienated land, freed from all prior interests (section 10(a)). This includes the right to dispose of the land under the Land Act 1958, to grant leases, or to reserve it for a new purpose. The Crown also has the right to have the Register updated unilaterally, without needing consent from any former interest holders.

The Act preserves one specific right: the lease granted to Ian Cameron McKeown over the Marlo land continues in force as if it were a lease under the Land Act 1958 (section 6(2)). This means the lessee retains the right to possession and use of the land under the same terms as the original lease, but with the governing statute changed. The lessee also has the right to have the lease recognised in the Register, though the Act does not explicitly require the Registrar to record that lease; the lease’s validity is statutory.

The Act extinguishes all rights that depended on the reservation or on any trusts, limitations, restrictions, encumbrances, estates, or interests that are caught by section 10(a). This includes any right of the public to use the land for the reserved purpose, any right of a committee of management to control the land, any right of a trustee to hold the land on trust, and any right under regulations made under section 13 of the Crown Land (Reserves) Act 1978. No compensation is provided for the loss of these rights. The Act does not confer on any private person a right to challenge the revocation or to seek compensation. The only potential remedy would be under general administrative law (e.g., judicial review of the decision to enact the legislation), but the Act itself creates no such right.

The Act does not impose duties on any other person. Committees of management and trustees are automatically revoked (sections 10(b) and (c)), so they have no ongoing duty to manage the land. They may, however, have obligations under other laws (e.g., accounting for funds or property) that are not addressed by this Act.

The Act creates no penalties, offences, or civil penalties. It does not provide for fines, imprisonment, or any punitive sanctions for non-compliance. Enforcement is therefore not through punitive measures but through the automatic operation of the law and the mandatory duty on the Registrar of Titles.

The primary enforcement mechanism is section 11, which compels the Registrar of Titles to make necessary recordings or amendments. If the Registrar failed to comply, a person with sufficient interest (such as the Crown or potentially a party affected by the failure to update the Register) could seek an order for mandamus - a writ compelling the Registrar to perform the statutory duty. However, the Act does not specify a timeframe for compliance or any consequence for delay.

The revocation itself is self-executing: the moment the Act came into operation (4 June 2008), the Orders in Council were revoked, the land became unalienated Crown land, committees and trustees were revoked, and regulations were repealed. No further administrative action was required for those legal effects to take place. The only subsequent step is the Registrar’s recording, which is declaratory of the change in legal status rather than constitutive.

If any person continued to assert rights over the land inconsistent with the revocation - for example, a former trustee claiming still to hold the land on trust - that assertion would be legally baseless. The Act does not create an offence for such continued assertion, but the Crown could take action under general law (e.g., trespass, ejectment) to enforce its ownership. The Act’s “freed and discharged” language in section 10(a) operates as a statutory extinguishment, so a court would give effect to that directly.

The lease saving in section 6(2) is also self-executing. The lessee does not need to apply to have the lease continued; it continues by force of the Act. If the Crown or any third party disputed the lease, the lessee could rely on section 6(2) as a complete defence.

There is no enforcement body designated in the Act. The Department of Sustainability and Environment (or its successor) would likely be the agency responsible for implementing the change in land status on the ground, but the Act itself does not assign that role. The Minister for Environment and Climate Change is only mentioned in connection with the Marlo lease (section 6(2)), not as an enforcer of the Act generally.

The absence of penalties does not mean the Act lacks teeth; the legal consequences are drastic and automatic. The real enforcement risk is that a person whose interests are extinguished may challenge the Act’s validity or scope in court, seeking a declaration that their interest was not caught by section 10(a) or that the Act is unconstitutional. But the Act itself provides no remedy for such challenges - it merely declares the consequences.

The Act interacts primarily with three Victorian statutes. First, the Crown Land (Reserves) Act 1978 is the parent statute under which the Orders in Council were made and the permanent reservations existed. The Act revokes those Orders in Council and also revokes any regulations made under section 13 of the 1978 Act that applied to the land (section 10(d)). This means the 1978 Act no longer governs the revoked parcels; they fall outside its regime entirely. The revocation does not, however, affect any other parts of the 1978 Act or other reservations.

Second, the Land Act 1958 governs the disposal and management of unalienated Crown land. Because section 10(a) deems the revoked land to be unalienated land of the Crown, the Land Act 1958 now applies to it. This is significant: the Land Act 1958 allows the Crown to sell, lease, or license the land, or to reserve it for a new purpose. The saved Marlo lease is expressly deemed to be a lease under the Land Act 1958, which imports the provisions of that Act into the lease relationship - possibly affecting renewal rights, rent, and termination. For the other parcels, the Land Act 1958 now provides the statutory framework for any dealings.

Third, the Transfer of Land Act 1958 governs the Torrens title register. Section 11 of this Act imposes a duty on the Registrar of Titles to amend the Register to reflect the revocations. The interaction is procedural: the Act overrides the usual requirement for a dealing or court order to change the Register - the Registrar acts on the statute alone. For the Talbot land, the revocation of the Crown grant (section 5(2)) means that the freehold estate recorded in Volume 2560 Folio 511951 is extinguished, and the Register must be amended to show the Crown as owner of unalienated land.

The Act may also interact with the Local Government Act 1989 if any of the land was under council management. The revocation of committee of management appointments (section 10(b)) severs any municipal involvement.

The Act does not explicitly repeal or amend any other statutes. It operates by its own force to extinguish interests, but it does not, for example, amend the Crown Land (Reserves) Act 1978 to remove the reservation entries for these parcels. That is left to the Registrar’s recording and the practical effect of revocation.

There is no interaction with federal law, except possibly if the land was subject to native title or other Commonwealth interests. The Act makes no mention of native title or the Native Title Act 1993 (Cth). Revoking a reservation and deeming the land unalienated might affect native title rights if any existed, but the Act provides no saving provision for native title. This could create an interaction with the Commonwealth regime, though the Act is silent.

The lease saving provision (section 6(2)) ensures that the Marlo lease is not frustrated by the change in governing legislation. That provision displaces any argument that a lease under the Crown Land (Reserves) Act 1978 could not survive the revocation.

The Land (Revocation of Reservations) Act 2008 has no amendments. The table of amendments in the endnotes (page 13 of the version as at 4 June 2008) states: “There are no amendments made to the Land (Revocation of Reservations) Act 2008 by Acts and subordinate instruments.” This means the Act has remained in its original form since it received Royal Assent on 3 June 2008 and came into operation on 4 June 2008. There have been no amending Acts, no regulations made under it, and no subsequent legislative changes to the parcels covered or the consequences. The Act is a one-time, self-contained piece of legislation that has not been revisited by the Victorian Parliament. This is consistent with its nature as a statute that revokes specific historical reservations - once those revocations have taken effect, there is no ongoing need for amendment.

The Act’s text and endnotes do not mention any litigation. The explanatory details at the date of publication (4 June 2008) state “There are no entries at date of publication.” There is no reference to any court cases that challenged or interpreted the Act. This is unsurprising given the Act’s narrow scope and the fact that it was passed to resolve specific land administration issues - presumably with the consent or acquiescence of affected parties (if any). The absence of reported litigation suggests that the revocations were implemented without dispute, that the lease saving provision sufficiently protected the sole known private interest, and that no aggrieved party sought judicial review. However, the Act’s sweeping extinguishment of interests could theoretically have been challenged by a party whose trust or encumbrance was not saved, but no such challenge appears in the source. The lack of litigation history does not mean the Act is immune to future challenge; a person whose interest was purportedly extinguished might later discover the Act’s effect and seek a declaration, but the limitation period for such claims may now have expired.

Several features of the Act could catch parties unawares. First, the boundary uncertainty: the revocation applies only to the land “shown hatched” on plans in Schedules 2-6 and, for Marlo, a plan lodged at the Central Plan Office numbered LEGL/07-035. Those plans are not reproduced in the legislative text. Anyone wanting to know exactly which part of the original reserve is revoked must locate those plans at the Central Plan Office or in the Parliamentary archive. Without the plans, it is impossible to determine the precise boundaries from the Act alone.

Second, the broad extinguishment in section 10(a) is absolute. The land is “deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests.” This catches not only the reservation itself but any other rights that existed on the land - including easements, profits a prendre, licenses, or rights of way that may have been created unofficially. Only the Marlo lease is explicitly saved. If anyone held an unregistered easement or a permissive occupancy, it is extinguished without compensation. The phrase “freed and discharged” is not qualified by a “reasonably necessary” or “good faith” proviso.

Third, the revocation of the Crown grant for Talbot Free Library (section 5(2)) is unusually potent. A Crown grant is a freehold title; revoking it means the land reverts to the Crown as unalienated land. This could affect the ownership of the library building itself if the building was owned by a separate entity. The Act does not say what happens to improvements on the land - presumably they vest in the Crown.

Fourth, the lease saving only applies to one specific lease to Ian Cameron McKeown over the Marlo land. If there were any other leases, licenses, or tenancies over any of the other parcels (including perhaps informal arrangements at the library or recreation reserves), they are not saved and are extinguished.

Fifth, no compensation is provided for the loss of committee of management or trustee appointments. Bodies that had invested time or money in managing the reserves lose their role with no transition period. Similarly, any public user of the reserves loses access without any alternative provision.

Sixth, the Act commenced the day after Royal Assent (section 2), meaning there was no grace period. The moment the Act came into force, committees, trustees, and regulations were revoked. Any actions taken by a committee after that date (e.g., incurring expenses) would be void.

Seventh, the Registrar of Titles’ duty is to make “necessary” recordings or amendments. What is necessary is left to the Registrar’s judgment. A failure to record the revocation could cause reliance problems for third parties searching title.

Eighth, the Act does not address native title. If any of the parcels were subject to native title rights not extinguished by the original reservation, the revocation and deeming as unalienated Crown land could either revive native title or be inconsistent with the Native Title Act 1993 (Cth). The Act is silent on this.

Because the Act is self-executing, most compliance is automatic. However, specific steps should be taken by affected parties.

For the Registrar of Titles, the duty under section 11 is mandatory. The Registrar must identify each title affected - in particular, any folio covering the land described in Schedule 1 and referenced in the plans - and make recordings to show that the reservation is revoked, that the land is now unalienated Crown land, and that the Talbot Crown grant is cancelled. The Registrar should also record the saved Marlo lease as a lease under the Land Act 1958 if it was not already recorded, to ensure the register reflects the lessee’s interest.

For committees of management and trustees whose appointments are revoked by sections 10(b) and (c), compliance means ceasing all management or trust activities over the land immediately upon the Act coming into operation. They should not enter into any new contracts, spend any funds, or exercise any powers in relation to the land. They should also arrange to hand over any records, keys, or assets to the relevant department (likely the Department of Sustainability and Environment, now part of the Department of Energy, Environment and Climate Action). If the committee held funds in trust for the reserve, they should seek advice on how to transfer those funds.

For the lessee Ian Cameron McKeown, no action is required to preserve the lease; it continues by force of section 6(2). However, the lessee should confirm that the Registrar has recorded the lease under the Land Act 1958, and should note that the statutory basis for the lease has changed. Any future dealings (e.g., renewal, assignment) will be governed by the Land Act 1958 rather than the Crown Land (Reserves) Act 1978. The lessee should also ensure that any rental payments are made to the correct authority under the new regime.

For any person who held an interest that is not saved (e.g., an easement, license, or permissive occupancy), there is no compliance step because the interest is extinguished. The person must stop asserting any right over the land. If they continue to use the land, they risk being treated as a trespasser. They should seek legal advice if they believe their interest might survive the extinguishment clause.

For the Crown departments (Department of Sustainability and Environment, or successor), compliance involves accepting the land back into Crown ownership and management under the Land Act 1958. They should update their records, conduct any necessary environmental or heritage assessments on the newly unalienated land, and decide whether to sell, lease, or re-reserve the parcels.

For local councils that may have had management roles, compliance means ceasing any maintenance or services on the land unless they enter into a new arrangement with the Crown.

There are no reporting requirements, no forms to file (other than the Registrar’s internal processes), and no ongoing compliance obligations under the Act. The Act is effectively spent once the Registrar has made the necessary recordings. However, any later dealing with the land (such as a sale) must comply with the Land Act 1958 procedures.
