Land (Reservations and other Matters) Act 1997

This Act uses a set of land law mechanisms and administrative processes to change the reserved status and recorded interests in discrete parcels. The principal statutory concepts in the Act are reservation revocation, Crown grant revocation, cancellation of title, re‑reservation, strata (in the sense used by the Act), Orders in Council, the role of the Governor in Council, committee of management arrangements, and mandated registry amendments.

Reservation revocation: The Act revokes Orders in Council that had reserved Crown land for particular purposes (e.g. for public parks, water supply, recreation). For many items the revocation is absolute; for others it is limited to the extent shown on plans in the schedules (ss 3-17, Schedule 1). When reservations are revoked, the Act declares that such land becomes "unalienated land of the Crown" and is "freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 18(a); s 31(a)). That is a legislative extinguishment of prior reservation interests and related regulatory attachments to the land described.

Crown grant revocation and certificate cancellation: The Act expressly revokes specified Crown grants (see ss 4(2), 12(2), 13(2), 14(2), 16(2), 17(2)) and cancels one Certificate of Title (s 17(3)). Those provisions operate to remove recorded proprietary instruments from the public register, subject to the Registrar obligations in s 32.

Stratum concept: In Pt 6 the Act defines "stratum" as a spatial part of land,a bounded space above or below or partly above and below the surface, with finite dimensions (s 28). The Act allows revocation to be limited to such a stratum for Argyle Square, enabling the construction of an underground car park while other surface reservations remain.

Order in Council and Governor in Council process: For Argyle Square the procedure is ministerial recommendation to the Governor in Council after receiving a Surveyor‑General signed plan (s 29(2)-(3)), and the Governor in Council may make the recommended order (s 29(3)). Publication in the Government Gazette gives operative effect (s 29(5)). For other parcels the Act itself revokes specified Orders in Council.

Committee of management and trustees: The Act addresses management arrangements where revocations occur. On revocation, the appointment of any committee of management is revoked to the extent it applies to the land (s 18(b); s 31(b)). The Act also deems Ballarat City Council to be the committee of management for the Burrumbeet land following repeal of the special Act (s 23).

Leases and continuity: The Act preserves existing leases in certain contexts. Part 3 preserves the continued existence of leases in force immediately before an Order under s 19(5) (s 21(1)), and s 21(2) ensures the repeal of ss 19-20 does not affect the continued existence of those leases. For Burrumbeet, leases granted under the repealed special Act continue to have effect as if entered under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council as lessor (s 24(1)-(2)). For Argyle Square, a lessee under the Land Act 1958 may enter and use the Argyle Square reserve to construct and operate the car park, subject to written consent from the committee of management, trustees or minister (s 30(1)-(3)).

Re‑reservation: The Act can also re‑reserve land for a different purpose. For example, the land in Schedule 12 that is removed from the historic Albert Park reservation is immediately "deemed to be permanently reserved under section 4 of the Crown Land (Reserves) Act 1978 for education purposes" (s 26). That is a legislative reallocation of purpose with immediate effect once the specified revocation occurs.

Registry duties: The Act imposes express duties on the Registrar‑General and the Registrar of Titles to make necessary enrolment and register amendments resulting from the Act (s 32). That scheme recognises the need for the public records to reflect changes to reservation and title status.

Commencement staging: The Act stages commencement for various provisions and schedules, using proclamations and a legal backstop, unproclaimed provisions come into operation on 31 December 1998 (s 2(2)-(12)). The endnotes set out actual commencement dates for each provision, which practitioners must consult when determining the timing of effects.

In short, the Act combines extinguishment of prior reservation instruments and title instruments, limited re‑reservation, statutory reallocation of management roles, a bespoke stratum revocation route for Argyle Square, and administrative obligations to correct public records. Those concepts work together to alter both the regulatory status and the record state of the specified parcels.

The Act affects a concentrated set of actors: the Crown (as landowner/manager), committees of management and trustees, local government bodies (mentioned explicitly in several items), existing lessees of the affected land, the Registrar‑General and Registrar of Titles, and parties with recorded proprietary interests (owners of Crown grants, holders of the cancelled certificate). It also affects any person or entity that might seek to occupy or use the newly freed Crown land or the newly created subsurface rights at Argyle Square.

Crown and executive decision‑makers: The Crown is the central legal actor because the Act deals largely with Crown reserves and Crown grants. The Governor in Council is given a specific role in the Argyle Square process (s 29(3)), and the Minister administering the Crown Land (Reserves) Act 1978 has an active role in receiving Surveyor‑General plans and recommending Orders (s 29(2)). The Minister also must satisfy himself or herself that parts of the Argyle Square land are necessary for the car park and ancillary structures before recommending revocation (s 29(2)(b)).

Local government and committees of management: Local councils are affected where the schedule entries identify them (for example, the Ballarat City Council is expressly dealt with in Pt 4, ss 22-24). In the Burrumbeet context the Act revokes the prior committee appointment for the Corporation of the Shire of Ripon (s 23(a)) and deems Ballarat City Council to be the committee of management for the specified land (s 23(b)). Where reservations are revoked, the appointment of any committee of management of that land is revoked to the extent it relates to that land (s 18(b); s 31(b)), which directly alters the legal authority under the Crown Land (Reserves) Act 1978 and may change management and operational responsibilities.

Existing lessees: The Act preserves the continuity of some leases. Part 3 preserves leases existing immediately before publication of an Order (s 21(1)-(2)). The Burrumbeet repeal provision converts leases granted under the repealed Act into leases as if entered under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council (s 24(1)-(3)), and it says nothing effected by that conversion amounts to a breach or default under a lease (s 24(3)). For Argyle Square, a potential lessee of the car park land under the Land Act 1958 acquires specific entry and use rights subject to the consent requirements (s 30). The Act therefore protects some incumbent lessees and creates a path for future lessees in the Argyle Square case.

Private holders of Crown grants and titles: For parcels where Crown grants are expressly revoked, the persons or entities who had those grants or whose interests were registered (for example Crown grant Vol. 1717 Fol. 278 in s 4(2); Crown grant Vol. 5097 Fol. 226 and Certificate of Title Vol. 5697 Fol. 370 in s 17) are directly affected because their recorded proprietary instruments are revoked or cancelled. The Act does not set out compensation mechanisms; its text effects extinguishment and requires registrars to correct records (s 32). Parties with proprietary or regulatory interests in the land will therefore face an immediate legal change in their recorded status when the revocation is made operative.

Regulatory authorities and the land registries: The Registrar‑General and the Registrar of Titles have statutory obligations to implement the changes on the public records (s 32). In practice that will involve administrative work to amend enrolments, memorials and the Register under the Transfer of Land Act 1958.

Users of Albert Park and Australian Grands Prix arrangements: The Act removes a hatched parcel from the historic Albert Park reservation and immediately deems that hatched parcel permanently reserved for education (ss 25-26). It also amends the definition of "Albert Park" in the Australian Grands Prix Act 1994 so that the hatched land is excluded from that definition (s 27). Any person or entity regulated under the Grands Prix Act or otherwise relying on the prior Albert Park boundaries will therefore be affected by the changed spatial definition.

Members of the public and developers: The revocations free land from prior reservation restrictions (s 18(a); s 31(a)), which may create opportunities for new uses of Crown land, including potential leasing under existing land statutes (the Act itself does not authorise sales). For Argyle Square, the Act creates a specific pathway for development of an underground car park by allowing the lessee to enter and use the reserve for construction, ancillary works and ongoing operation, subject to consent (s 30). That directly affects developers interested in subterranean works under reserved land.

In summary, the Act primarily affects governmental actors and property holders directly linked to the specified parcels; it also affects registries, certain local councils, existing lessees, and prospective developers who might use the new legal mechanisms (particularly at Argyle Square). The impacts are concentrated geographically and by interest holder because the schedule lists discrete parcels rather than establishing a general rule applicable to a large category of land.

The Act creates procedural duties for Ministers, the Governor in Council, registrars, committees of management and lessees, and confers specified rights on lessees and local authorities. Those statutory duties and rights are primarily administrative and land‑use focused rather than criminal or regulatory in the conventional sense.

Ministerial and Governor in Council duties and discretions: For Argyle Square, the Minister administering the Crown Land (Reserves) Act 1978 must receive a plan of survey signed by the Surveyor‑General describing the stratum and any ancillary parts necessary for the car park and may recommend to the Governor in Council that the relevant Order in Council be revoked (s 29(2)). The Governor in Council "may" make the Order recommended (s 29(3)), which is a discretionary executive decision. An Order under s 29(3) must include a copy of the plan (s 29(4)). Publication in the Government Gazette is the trigger for effect (s 29(5)). These are duties and procedural steps rather than ministerial obligations to act in a particular way.

Registrar obligations: The Registrar‑General must make all entries on enrolment records and on any memorials necessary because of the operation of any provision of this Act (s 32(1)). The Registrar of Titles must make any amendments to the Register under the Transfer of Land Act 1958 necessary due to the Act (s 32(2)). Those provisions are mandatory duties: the registrars are required to change public records to reflect the statutory revocations, cancellations and revocations of Crown grants.

Committee of management and trustee consents: A lessee of car park land under the Land Act 1958 may enter and use the Argyle Square reserve for the construction, ancillary works and ongoing operation and maintenance of the car park in accordance with the lease (s 30(1)). However, this right to enter and use is conditional on obtaining written consent of, in order of preference, the committee of management of Argyle Square reserve; or if there is no committee of management, the Trustees of Argyle Square reserve; or if neither exists, the Minister administering the Crown Land (Reserves) Act 1978 (s 30(2)). That creates a three‑tiered consent requirement that attaches control to the existing management arrangements or ultimately to ministerial authority.

Ballarat City Council duties (Burrumbeet): On repeal of the Burrumbeet Act, Ballarat City Council is deemed to be the committee of management for the relevant land for the purposes of the Crown Land (Reserves) Act 1978 (s 23(b)). That devolution carries the duties associated with committee of management status under the Crown Land (Reserves) Act 1978, which the Act does not restate but imports by deeming.

Lease conversion obligations and protections: For Burrumbeet, leases previously granted under the repealed Act take effect from the commencement of s 22 as if entered into under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council as lessor (s 24(1)). Section 24(2) says this has effect despite anything contrary in the lease and s 24(3) clarifies that nothing effected by this section is to be regarded as placing anyone in breach of or as constituting a default under any provision of a lease, including assignment restrictions. Those provisions therefore protect lessees from technical defaults arising purely from the change in statutory underpinning.

Rights on revocation: When the Act revokes an Order in Council in relation to land, that land is "deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 18(a); s 31(a)). That statutory declaration operates as a right in the sense of clearing prior restrictions and enabling the Crown to treat the land as unalienated Crown land thereafter. The Act does not itself specify what the Crown may do next (for example, sell or lease), but the clearing of prior interests is a legal right or power conferred on the Crown's control of the land.

Re‑reservation duty/effect: For the Albert Park land, on revocation of the historic Order in Council in respect of the hatched plan, the land is "deemed to be permanently reserved under section 4 of the Crown Land (Reserves) Act 1978 for education purposes" (s 26). That is a substantive re‑reservation effect imposed by statute, changing the land's reserved purpose and creating a corresponding duty on the Crown to manage it under the Crown Land (Reserves) Act 1978 for that purpose.

Publication and commencement duties: The Act links operative effect to publication for some actions (s 29(5)) and stages commencement through s 2. Practitioners must therefore observe the timing rules in s 2 and the endnote commencement schedule when assessing when duties, rights and effects arise.

Absence of compensation or procedural rights: The Act does not create express compensation rights for persons whose Crown grants or certificates are revoked or cancelled, nor does it establish a dispute resolution process within the Act text for such revocations. It similarly does not specify additional rights of appeal from Governor in Council decisions under s 29. Parties affected must therefore rely on other statutory remedies or common law rights not described in the Act, or on administrative processes external to the Act.

In summary, the Act imposes mandatory administrative duties on registrars, sets out ministerial and executive procedures for revocations especially where a stratum is involved, creates conditional rights of entry and use for lessees at Argyle Square (with specified consent gates), reassigns committee of management duties in discrete cases, and contains protections preserving leases and preventing technical defaults due to statutory changes. The practical operation of these duties and rights depends on Gazette publication, surveyor plans, and consent processes described in the Act.

The Act contains no express criminal penalties, infringement regimes or monetary fines. Its enforcement architecture is administrative and declaratory rather than punitive. The primary mechanisms by which the Act's measures are enforced or given effect are statutory declaration, executive action (Orders in Council), registry amendment duties, and consent gating for specific uses.

Absence of penal provisions: Nowhere in the Act are offences, fines or civil penalty provisions specified. There are no express enforcement powers such as inspections with penalty consequences, administrative sanctions, or express authorisations for enforcement action within the Act. Consequently, enforcement in the sense of punishing non‑compliance is not a function of this Act’s text.

Administrative enforcement and effectuation: The Act gives concrete administrative steps which have legal effect. For revocations, Parliament itself revokes Orders in Council or authorises the Governor in Council, and declares the legal status of the land upon revocation (ss 3-17, 18, 31). These statutory declarations are self‑executing once the relevant condition (e.g. Gazette publication or commencement) occurs. The Registrar‑General and Registrar of Titles are mandated to give effect on the public records to those revocations and cancellations (s 32), and their compliance is the practical vehicle by which the public register and titles system reflect the Act's changes.

Consent as an enforcement gate: For Argyle Square, the Act makes a lessee’s right to enter and use the reserve conditional on written consent from the committee of management, trustees, or the Minister (s 30(2)). In practice, that consent function is an enforcement gate: without consent a lessee cannot lawfully exercise the rights the Act contemplates. The Act does not set temporal or procedural constraints on how the consenting body must exercise that power; those matters will be governed by the underlying Crown Land (Reserves) Act 1978 and any governance instruments that establish the committee’s functions.

Governor in Council discretion and procedural safeguards: The Governor in Council "may" make the recommended Order under s 29(3). That choice is a discretionary executive power; the Act does not set out a procedural right to have the recommendation accepted nor a statutory appeal process if the recommendation is not enacted. The lack of statutory procedural protections to review or challenge a Governor in Council decision is a notable feature of the Act’s enforcement framework.

Transitional protection for lessees: The Act provides explicit protections against creating technical defaults for leases when the Burrumbeet Act is repealed and leases are treated as if under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council (s 24(3)). That is a form of enforcement of lease continuity and a protection against enforcement of lease terms by a (new) lessor due solely to the statutory conversion.

Judicial enforcement: Because the Act itself does not establish a penalty regime, enforcement disputes (such as disagreements about the validity of a revocation, the proper effect on proprietary interests, or the adequacy of registry amendments) would proceed by way of ordinary civil litigation or judicial review under general administrative law, as relevant. The Act contains no express privative clause or ouster of judicial review; however the text in the source does not specify procedures or limits for judicial scrutiny.

Operational enforcement risks and obligations: The practical enforcement of the Act depends on accurate survey plans (s 29(2)), correct execution of Governor in Council instruments (s 29(3)-(5)) and timely registry amendments by the Registrar‑General and Registrar of Titles (s 32). Errors or delays at any of those operational points can create disputes over the legal position of land interests and may lead to litigation or administrative remediation, but the Act itself assigns those outcomes to the operation of the registries and executive rather than to a statutory penalty scheme.

In sum, the Act is enforced by executive administration,Orders, gazettal, registry updates and consent gates, rather than by discrete penal enforcement. Practitioners assessing risks should therefore focus on procedural compliance (gazettal, accurate surveys, registry amendments, consent processes) and the potential for civil or administrative law remedies where disputes arise.

The Act operates in close relation to the Crown Land (Reserves) Act 1978, the Land Act 1958, the Transfer of Land Act 1958, and, in the case of Albert Park, the Australian Grands Prix Act 1994, as well as the repealed Burrumbeet (Russell Reserve) Land Act 1982. It expressly states that certain parts operate despite anything to the contrary in the Crown Land (Reserves) Act 1978 or any other Act (s 29(1); s 30(3)), and it imports or relies upon other legislation for substantive effect in several places.

Relationship with the Crown Land (Reserves) Act 1978: The Act frequently cross‑references the Crown Land (Reserves) Act 1978. When a reservation is revoked the Act explicitly revokes any regulations under section 13 of the Crown Land (Reserves) Act 1978 insofar as they apply to the land (s 18(c); s 31(c)). The Act also extinguishes committee of management appointments to the extent they relate to revoked land (s 18(b); s 31(b)), which directly alters management arrangements under the Crown Land (Reserves) Act 1978. For Argyle Square the Act provides that it has effect "despite anything to the contrary in the Crown Land (Reserves) Act 1978 or any other Act or law" (s 29(1)), and s 30(3) repeats that protective language in relation to the power to enter and use the reserve. Those override statements indicate Parliament’s intent that the Argyle Square mechanism is to be effective notwithstanding potential inconsistencies with the Crown Land (Reserves) Act 1978.

Interaction with the Land Act 1958: The Act contemplates that the car park land will be leased under the Land Act 1958 (see definition of "car park land" at s 28 and s 30(1)). A lessee under the Land Act 1958 is granted specific statutory rights of entry and use over the Argyle Square reserve to build and operate the car park, subject to consent (s 30). The Act therefore creates a specific interface between a Land Act lease and reserve usage rights.

Transfer of Land Act 1958 and registries: The Act obliges the Registrar of Titles to amend the Register under the Transfer of Land Act 1958 as necessary because of this Act (s 32(2)). Where Crown grants or a certificate of title are revoked or cancelled (e.g. s 17(2)-(3)), those changes must be reflected in the Torrens register system under the Transfer of Land Act. The Act leaves the mechanics of updating the titles system to the registrar, but makes the duty explicit.

Australian Grands Prix Act 1994: Section 27 amends the definition of "Albert Park" in section 3(1) of the Australian Grands Prix Act 1994 by inserting that the definition does not include the land shown hatched on the plan in Schedule 12 of this Act. That is a direct cross‑statutory amendment which reduces the geographic scope of "Albert Park" for the Grands Prix Act’s purposes and thereby changes the interface between the two Acts.

Burrumbeet (Russell Reserve) Land Act 1982: The Act repeals the Burrumbeet Act (s 22) and sets out direct transitional effects,Ballarat City Council is deemed to be the committee of management of the land previously covered (s 23), and existing leases granted under the repealed Act are treated as if entered under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council as lessor (s 24). Those provisions thus convert a statutory regime under a special Act into management and leasing under the general Crown Land (Reserves) Act 1978.

Orders in Council and Governor in Council instruments: Several of the revocations operate by reference to specific Orders in Council identified in Schedule 1. For Argyle Square a ministerial recommendation to the Governor in Council and a Governor in Council order are part of the process (s 29(2)-(5)). Those interactions involve executive instruments as the mechanism to effect changes under or despite other statutes.

Surveyor‑General and plan requirements: The Act requires the Minister to receive a plan of survey signed by the Surveyor‑General for Argyle Square strata and ancillary parts (s 29(2)). That draws in surveying and cadastral procedures external to this Act but integral to implementing the revocation and to the obligations on the registrars under s 32.

Statutory primacy and override language: The Act contains explicit override language for Argyle Square (s 29(1); s 30(3)), which, to the extent valid and operative, confirms the Act’s provisions are intended to take precedence over inconsistent provisions of the Crown Land (Reserves) Act 1978 or other laws. Practitioners should note that such override clauses will determine the hierarchy in practice, but that their operation can interact with other statutes’ procedural or rights safeguards.

In practice, therefore, the Act is not self‑contained; it must be read and operated in conjunction with the Crown Land (Reserves) Act 1978, the Land Act 1958, the Transfer of Land Act 1958, the Australian Grands Prix Act 1994 (as amended by s 27), and the Burrumbeet Act as repealed and transitioned by Pt 4. The registries and surveying authorities play key operational roles. Disputes about how these interactions work will likely require reference to the text and structure of those other statutes and to administrative practice in the registries.

The Act as reproduced in the source incorporates amendments up to 18 December 2013. The endnotes identify one later amendment package relevant to this Act, namely the Parks and Crown Land Legislation Amendment Act 2013 (No. 79/2013), and identify specific consequential changes to this Act effected by that amending Act.

Parks and Crown Land Legislation Amendment Act 2013 (No. 79/2013): The endnote records that Ss 39-41 of the 2013 amending Act, which relate to amendments to the Land (Reservations and other Matters) Act 1997, received assent on 17 December 2013 and commenced on 18 December 2013 (endnote 2). The text of the Land Act itself records particular consequences of that amending Act:

• Sections 19 and 20 of the Land (Reservations and other Matters) Act 1997 were repealed by No. 79/2013 s 39 (see Part 3 note). The Act’s current text therefore notes that Ss 19 and 20 are repealed (the source includes the parenthetical "Ss 19, 20 repealed by No. 79/2013 s. 39").

• Section 21 was amended by No. 79/2013 s 40; specifically s 21(2) was inserted by that amending Act (s 21(2) inserted by No. 79/2013 s 40 (ILA s 39B(1))). The content of s 21(2) preserves the continued existence of any lease continued by s 21(1) and in force immediately before repeal (see s 21).

• Schedule 1 was amended by the 2013 Act (Sch. 1 amended by No. 79/2013 s 41(1)). The source does not set out the textual changes to Schedule 1 effected by s 41(1), but records that Schedule 11 was repealed by No. 79/2013 s 41(2) (Sch. 11 repealed by No. 79/2013 s 41(2)). The current printed Schedule in the source shows Schedules 1-13 with a note where Sch. 11 has been removed by the amending Act.

Commencement history of this Act: The endnotes to the Act give a detailed schedule of the original Act’s commencements. The Act’s own s 2 staggers commencement for different sections and schedules by proclamation, with a default date of 31 December 1998 for any unproclaimed provisions (s 2(2)-(12)). The endnotes then record actual commencement dates: e.g. most provisions and specific schedule items commenced on 16 December 1997; some provisions (ss 10, 13, 14 etc.) commenced on 2 April 1998; Part 5 (ss 25-27 relating to Albert Park) and relevant schedule items commenced on 8 May 1998; sections 6 and 16 and related Schedule items commenced on 12 August 1998; and other specified provisions and schedules commenced on 31 December 1998 via s 2(12). Practitioners should rely on the endnote commencement chart when determining when particular revocations took or take legal effect.

Other amendment notes internal to the source: The Act text itself includes a small number of in‑text amendment notations referencing the 2013 Act, e.g. s 21(2) insertion by No. 79/2013 s 40. There are no other recorded amendments in the printed Act text beyond the 2013 changes recorded in the endnotes.

Absent from the source are any later amendments beyond those identified in the endnotes. The Act as presented is therefore current to 18 December 2013, and users must consult later statute compilations or the government legislation database for any subsequent amendments.

Practical implications for practitioners: The amendment history matters for legal effect and transitional rights. The 2013 amendments repealed obsolete provisions (ss 19-20), inserted clarifying protections for the continuity of leases (s 21(2)), and made schedule adjustments. Where practitioners are dealing with historical titles, leases, or committee of management questions, they must check the precise version and commencement date of each relevant provision in order to assess which rules applied at a particular time and how transitional arrangements (for example, the Burrumbeet transitional rules at s 24) operate.

The source text contains no judicial authorities, cases, or litigation history relating to the Land (Reservations and other Matters) Act 1997. The Act’s endnotes include the Minister’s second reading speech dates and the Government Gazette commencement schedule, but they do not reference any litigation or decisions interpreting the Act. There are also no case citations within the Act text or endnotes.

What the Act itself discloses about potential litigation points: The Act makes significant changes to recorded proprietary instruments, revoking Crown grants, cancelling a certificate of title, and declaring land to be unalienated Crown land freed from encumbrances (see ss 4(2), 12(2), 13(2), 14(2), 17(2)-(3), 18(a), 31(a)). These sweeping statutory changes to recorded interests can, in other contexts, give rise to legal disputes about compensation, rights of third parties, or adequacy of procedural steps (for example, whether gazettal or registry processes were correctly performed). The Act itself does not outline dispute resolution or compensation frameworks. Accordingly, in practice one would expect any legal disputes arising from the Act’s operation to have been litigated under general principles of property law, administrative law or statutory interpretation, rather than under special enforcement or appeal provisions within the Act.

No cases are cited here because the source does not list or summarise any judicial decisions. Practitioners seeking litigation history will need to conduct an independent case law search in legal databases (e.g. AustLII, JADE, commercial services) for decisions referring to the Land (Reservations and other Matters) Act 1997, its amendments (notably by the Parks and Crown Land Legislation Amendment Act 2013), or decisions concerning the specific parcels listed in Schedule 1 (for example disputes over Albert Park boundaries, Argyle Square subterranean works, Burrumbeet committee of management changes, or the revocation of specific Crown grants).

Potential lines of litigation to consider, based on the Act’s content: (a) disputes about whether the statutory conditions for a revocation were satisfied (e.g. valid publication in the Government Gazette, proper survey plan), (b) claims relating to whether extinguishment of prior interests required compensation under other law, (c) disagreements over the scope of the Registrar‑General’s amendments required by s 32, and (d) challenges to the exercise or refusal of consent by a committee of management or minister where Argyle Square entry rights are at issue. The Act itself does not provide an internal dispute forum for these matters.

In short, the Act’s source text does not contain litigation history. Practitioners must perform an up‑to‑date external case law search for judicial interpretation or disputes arising from the Act or its amendments.

The Act contains specific drafting features and operational traps that practitioners should note before acting. These "gotchas" arise from overt extinguishment of recorded interests, the staging of commencements, limited procedural detail for executive decisions, and the Act’s explicit override of other statutes in particular contexts.

1. Extinguishment of existing interests without explicit compensation mechanism: The Act declares that revoked reserved land is "freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests" (s 18(a); s 31(a)). It revokes Crown grants and cancels a certificate of title in specified cases (ss 4(2), 12(2), 13(2), 14(2), 17(2)-(3)). The Act contains no express provision for compensation to the holders of those extinguished interests. If you advise a client with an interest recorded in a Crown grant or certificate specified in Schedule 1, note that the Act by its terms removes those recorded interests; any question of remedy would depend on principles external to this Act.

2. Limited procedural safeguards for Governor in Council decisions: For Argyle Square the Minister "may recommend" and the Governor in Council "may make" an Order (s 29(2)-(3)). The Act provides no statutory timetable, consultation requirement, or appeal mechanism for those executive choices. That creates uncertainty for parties preparing projects contingent on the Governor in Council making the Order.

3. Reliance on accurate surveys and Gazette publication: The Argyle Square mechanism depends on a plan of survey signed by the Surveyor‑General and the publication of the Order in the Government Gazette to trigger the revocation and the Crown grant revocation (s 29(2), (4)-(5)). Errors or delays in the surveying process or in Gazette publication can defer legal effect or produce contested title states. Practitioners should ensure survey plans are correct and track Gazette publication.

4. Consent gating for entering reserved land: A lessee’s right to enter and use the Argyle Square reserve for construction and ongoing use depends on written consent from the committee of management, or trustees, or failing those, the Minister (s 30(2)). This creates potential bargaining power for the committee or trustees and increases project risk where their consent is withheld or delayed. The Act does not set objective standards for consent, nor does it provide a statutory dispute resolution path where consent is refused.

5. Staged commencement can create temporal confusion: Section 2 stages specific provisions and schedules by proclamations and contains a fall back date of 31 December 1998 (s 2(2)-(12)). The endnotes provide actual commencement dates which vary by provision (see endnotes). Advisers must check the precise commencement date for the specific section or schedule affecting their client rather than assuming uniform commencement.

6. Deemed transfers of management and conversion of leases: The Burrumbeet repeal deems Ballarat City Council to be committee of management (s 23) and converts leases to have effect as if granted under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council as lessor (s 24(1)). While s 24(3) protects against treating the conversion as a lease breach or default, there may be unintended operational consequences for lease enforcement, assignment, or finance. For example, lenders will want clarity about the lessor and the statutory regime; assignments may be permissible under the new statutory form but the Act’s conversion should be carefully documented.

7. Re‑reservation for a different purpose: The Albert Park hatched land is revoked from its prior reservation and immediately deemed permanently reserved for education under s 4 of the Crown Land (Reserves) Act 1978 (s 26). That changes the land’s regulatory purpose and excludes it from the Australian Grands Prix Act 1994 definition of Albert Park (s 27). Parties relying on the prior scope of Albert Park must verify whether particular activities remain permissible.

8. Registrar action as practical gating: The registrars are mandated to correct records (s 32). Until these corrections are made, historical titles, memorials and enrolments might not reflect the Act’s legal changes, creating practical confusion in conveyancing and financing. Do not assume registries will instantly reflect statutory revocations; obtain certificates from registries confirming amendments have been made.

9. Schedules and "hatched" plans as determinative: Several revocations are limited "to the extent that it applies to the land shown hatched on the plan" in a schedule (e.g. ss 4(1), 7, 8(1), 9, 11, 12(1), 15, 16(1), 25(1)). The Act does not reproduce the plans in the printed text, and practitioners must inspect the physical or gazetted plan to determine the exact boundaries affected. Assume the schedule plans govern the spatial limits of revocation.

10. No express market or sale mechanism: The Act clears land of prior encumbrances but does not itself provide authorisation to sell. If a client wishes to acquire or use freed Crown land, they must identify the statutory or administrative pathway (for example under the Land Act 1958 or Crown Land (Reserves) Act 1978) that enables leasing or disposal. Do not assume the revocation equals an immediate marketable title for sale.

In short, the principal practical risks are extinguishment without an internal compensation framework; executive discretion without statutorily mandated process; survey and gazettal technicalities; consent requirements for reserved land entry; and timing/registry lag issues. Practitioners should verify plans, gazettal records, registry entries and any required consents before advising clients or proceeding with development.

Compliance with the Act requires attention to procedural triggers, claims on title, consent gates, and registrar processes. The Act is administrative and procedural rather than penal, so compliance means observing the steps that make revocations operative and ensuring public records reflect the effect.

1. Verify commencement and Gazette publication: Before acting on any purported revocation, check the commencement date applicable to the specific section or schedule (s 2). For Argyle Square revocation specifically, ensure the relevant Order in Council has been published in the Government Gazette (s 29(5)). The Act’s endnotes set out historical commencement dates; for any current work confirm whether the relevant section has been proclaimed or has come into force under the s 2(12) backstop.

2. Inspect and rely on the authorised plan: Many revocations are "to the extent that it applies to the land shown hatched" on a plan in a schedule (see Schedule 1 and Schedules 2-13). Practitioners should obtain the official plan (or the gazetted copy required by s 29(4) for Argyle Square) and rely on that plan to determine the exact land affected. For Argyle Square, the Minister must receive a Surveyor‑General signed plan (s 29(2)); obtain and verify that plan.

3. For Argyle Square development, obtain the Surveyor‑General plan and follow the ministerial/Governor in Council route: If seeking to create a car park stratum, procure a plan of survey signed by the Surveyor‑General that delineates the stratum and ancillary parts (s 29(2)). Submit that plan to the Minister administering the Crown Land (Reserves) Act 1978 and seek the Minister’s recommendation to the Governor in Council. Track whether an Order is made and ensure its copy and the plan are included as required (s 29(4)-(5)).

4. Secure the necessary consents for entry and use of reserve land: A lessee under the Land Act 1958 may enter and use the Argyle Square reserve only with written consent from the committee of management, or if no committee, the trustees, or if neither exists, the Minister (s 30(2)). Before commencing construction or works, obtain and retain the required written consent(s), and ensure the scope of consent aligns with the lease and the plan.

5. Check and, if necessary, update registries: The Registrar‑General and the Registrar of Titles must make the entries and amendments required by the Act (s 32). Practitioners should request and obtain written confirmation from the Registrar‑General/Registrar of Titles that the necessary amendments to Crown grant enrolments, memorials and the Register have been made. Do not rely solely on the statutory duty being fulfilled; obtain registry certification for conveyancing and financing purposes.

6. For existing leases affected by repeal/conversion, document status and rights: For Burrumbeet land, existing leases are to be treated as if entered under s 17D of the Crown Land (Reserves) Act 1978 by Ballarat City Council (s 24(1)). Practitioners acting for lessees or lessors should obtain documentary evidence of this conversion and ensure lease administration, assignment clauses and lender consents are revisited and recorded to avoid misinterpretation. Capitalise on s 24(3)’s protection against treating the conversion as a breach.

7. For Albert Park, reconcile Grands Prix boundaries and the re‑reservation: If your client’s activity is regulated under the Australian Grands Prix Act 1994 or involves Albert Park boundaries, confirm that the hatched land in Schedule 12 is excluded from the definition of Albert Park as amended by s 27. Where education re‑reservation (s 26) applies, verify the new purpose and any associated committee of management or usage restrictions under the Crown Land (Reserves) Act 1978.

8. For parties who previously held a Crown grant or title affected by revocation/cancellation, seek alternative legal remedies if appropriate: The Act revokes Crown grants and cancels a certificate of title in some cases (e.g. s 17). If a client claims loss or seeks compensation, advise they will need to pursue remedies, if any, under general law or other statutes. The Act itself contains no compensation provision.

9. Coordinate with local government and committees: Where the Act deems a local council to be the committee of management (s 23) or revokes existing committee appointments (s 18(b)), liaise with the council to determine current management authority and obtain any necessary permits or consents from the correct manager.

10. Document chain of authority for financing or sale: Because the Act clears reservations and may change lessor identities (e.g. Ballarat City Council deemed committee), lenders, purchasers and developers should insist on documented confirmation from registries and from the local management body that the legal status, lease form and relevant consents are in place. This will avoid reliance on an unchanged public record where s 32 amendments may be pending.

11. Plan for operational delays and risk allocation in contracts: Given the Act’s reliance on executive decisions, surveys and registry amendments, construction contracts and lease agreements dependent on revocation or re‑reservation should allocate risk for survey errors, delays in gazettal, and delay or refusal of consents. Include conditions precedent linked to the Governor in Council order and to registry confirmation.

12. If in doubt, search for judicial decisions and administrative practice: The Act’s text does not list litigation. For interpretive issues (for example the scope of "freed and discharged" in s 18(a)), search case law and administrative decisions to see how courts and tribunals have treated similar statutory extinguishment of land interests.

Following these steps will align actions with the Act’s procedural and recordkeeping obligations and will reduce the risk of exposure to title uncertainty, consent disputes, or administrative unpredictability created by survey and gazettal dependencies.
