What it does
This regulation prescribes specific procedural requirements for applications to pay land rent for leases under the Land Rent Act 2008. The regulation has three operative provisions. Section 1 gives the regulation its name. Section 3 prescribes the requirements for an application to pay land rent under the Act, s 7(2). Section 4 prescribes parallel requirements for an application by an eligible former owner under the Act, s 7A(2). Both provisions require attendance at a land rent information session conducted by the Canberra Institute of Technology and require that evidence of attendance be given to the authority before the lease is granted (s 3(a)-(b); s 4(a)-(b)).
Mechanically, the regulation makes attendance at an information session a precondition for a compliant application to pay land rent where the Act refers to the prescribed requirements. The attendance must occur before the lease is granted and the applicant must give evidence of that attendance to the authority (s 3(a)-(b); s 4(a)-(b)). The regulation does not specify the form of evidence, the content of the information session, how frequently sessions are to be run, whether electronic attendance qualifies, or any fees for the sessions. The authorising Act is the Land Rent Act 2008; the regulation is identified as the Land Rent Regulation 2008 (s 1) and is a subordinate instrument made under that Act.
The republication materials accompanying the regulation record the context and administrative details relevant to its force and currency. The republished law includes an explanation that editorial changes under the Legislation Act 2001, part 11.3 may be applied when preparing a law for republication, but this republication does not include amendments made under part 11.3 (see the Endnotes material). The republication date and amendment history are recorded up to 13 November 2015. At that republication date, the materials state the value of a penalty unit for offences against this law is $150 for an individual and $750 for a corporation, per Legislation Act 2001, s 133, as noted in the front matter. The instrument has been amended since its initial notification, with s 3 amended by the Land Rent Amendment Act 2013 and s 4 inserted by the Building (Loose-fill Asbestos Eradication) Legislation Amendment Act 2015 (see the legislation and amendment history in the endnotes).
