sec.46 Rent adjustment for change of area of lease or licence
This section applies if a designated set rent has been set for a lease or licence, and the area of land subject to the lease or licence is changed. The amount of the rent payable for the lease or licence must be adjusted— in accordance with the offer, or the conditions of approval, for the lease or licence; or if a rent adjustment was not stated in the offer or approval—proportionately. (sec.46-ssec.1) This section applies if a designated set rent has been set for a lease or licence, and the area of land subject to the lease or licence is changed. (sec.46-ssec.2) The amount of the rent payable for the lease or licence must be adjusted— in accordance with the offer, or the conditions of approval, for the lease or licence; or if a rent adjustment was not stated in the offer or approval—proportionately.
- (a) in accordance with the offer, or the conditions of approval, for the lease or licence; or
