sec.103 Approved application for limited rent discount

This section applies if— before the commencement, the Minister approved, under the repealed regulation, section 40C(3), a former discount application for a lease; and immediately before the commencement— the 5 years for which the discount applied under the repealed regulation, section 40C(4), had not ended; and the discount had not ended under the repealed regulation, section 40C(5). This section also applies if, on or after the commencement, the Minister decides to approve a former discount application for a lease under the repealed regulation, section 40C(3), as applied under section 102(2) of this regulation. The repealed regulation, section 40C continues to apply in relation to the approval and the discount as if this regulation had not been made and the repealed regulation had continued in force. In this section— former discount application means an application for a discount on the rent payable for a lease under the repealed regulation, section 40C(2). (sec.103-ssec.1) This section applies if— before the commencement, the Minister approved, under the repealed regulation, section 40C(3), a former discount application for a lease; and immediately before the commencement— the 5 years for which the discount applied under the repealed regulation, section 40C(4), had not ended; and the discount had not ended under the repealed regulation, section 40C(5). (sec.103-ssec.2) This section also applies if, on or after the commencement, the Minister decides to approve a former discount application for a lease under the repealed regulation, section 40C(3), as applied under section 102(2) of this regulation. (sec.103-ssec.3) The repealed regulation, section 40C continues to apply in relation to the approval and the discount as if this regulation had not been made and the repealed regulation had continued in force. (sec.103-ssec.4) In this section— former discount application means an application for a discount on the rent payable for a lease under the repealed regulation, section 40C(2).

• (a) before the commencement, the Minister approved, under the repealed regulation, section 40C(3), a former discount application for a lease; and
• (b) immediately before the commencement— (i) the 5 years for which the discount applied under the repealed regulation, section 40C(4), had not ended; and (ii) the discount had not ended under the repealed regulation, section 40C(5).
