Land (Miscellaneous Matters) Act 2005

The Act operates through several distinct legal concepts, each grounded in established Victorian land law.

Revocation of a reservation. Under Part 2 (sections 3 and 4) and Part 3 (sections 6 and 7), an Order in Council that previously dedicated land for a public purpose under the Crown Land (Reserves) Act 1978 (or its predecessors) is revoked. The effect is that the land ceases to be burdened by that public purpose reservation. The Act explicitly states the consequences: the land is deemed unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests. The appointment of any committee of management is revoked, and any regulations made under section 13 of the Crown Land (Reserves) Act 1978 that apply to the land are revoked. This is a complete clearing of prior Crown land status, with the land returning to the Crown's unallocated estate.

Revocation of a Crown grant. A Crown grant is the instrument by which the Crown grants freehold title to land. Sections 3(2) and 6(2) revoke specific Crown grants (Volume 1502 Folio 372 and Volume 1351 Folio 183). This cancels the freehold estate, and the land reverts to the Crown. The Act provides no compensation mechanism for the former grantee. In the case of the Anglicare Victoria land, the grant was likely held by the State or a statutory body; the Act does not identify the holder, but the revocation proceeds without compensation.

Re-reservation of land. Section 8 provides that part of the Berry Street land (shown hatched on the plan in Schedule 2) is deemed to be temporarily reserved for public purposes (child care) under section 4(1) of the Crown Land (Reserves) Act 1978. This means that immediately upon the revocation under section 6, that part of the land is placed under a new reservation, albeit a temporary one. The term "temporary" under the Crown Land (Reserves) Act 1978 typically means a reservation of limited duration (up to 10 years, but the Act does not specify a period). The effect is that the land is not available for general Crown disposal but is dedicated to child care purposes.

Deeming of unalienated land. Sections 4, 7, and the new section 5CA (inserted by section 10) all use the phrase "deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests." This is a standard formulation in Victorian land legislation for land that is to be freed from prior interests and returned to the Crown's unencumbered estate. It has the effect of extinguishing all prior interests, whether public or private, except those specifically preserved by the Act (such as the lease in section 5).

Preservation of lease (section 5). Section 5 creates a legal fiction that the relevant lease between Anglicare Victoria and Bayside Health continues unaffected, but with the Minister as the new lessor instead of the original grantor (which was likely Anglicare Victoria). The lease is deemed assigned to the Minister, and any future Crown grant of the land will also take subject to the lease. This concept is reinforced by subsections (4) and (5), which override any contrary Act or law and provide that nothing in the section constitutes a breach of the lease or releases any surety.

Automatic inclusion of additional land in existing leases (section 6A). New section 6A of the Ballarat (Sovereign Hill) Land Act 1970 (inserted by section 12) provides that any lease granted under section 6 of that Act immediately before the commencement of Part 4 automatically includes the additional land (the hatched area in Schedule 1). This is a statutory variation of existing contractual rights without the consent of the lessee. The saving provision in section 6A(2) ensures this is not a default or breach.

The Act's impact is narrowly confined to specific parties with interests in the named parcels of land.

Anglicare Victoria and Bayside Health. Part 2 directly affects Anglicare Victoria (ABN 97 397 067 466) and Bayside Health (ABN 27 318 956 319) as the parties to the lease dated 20 October 2004 over part of the Anglicare Victoria land. Anglicare Victoria is likely the lessor under that lease; the Act revokes the Crown grant and reservation that underlay its interest, but section 5 preserves the lease, with the Minister replacing Anglicare as lessor. Bayside Health continues as lessee on the same terms. Neither party's contractual rights are disturbed, but the identity of the lessor changes. Anglicare Victoria's freehold interest is extinguished (subject to the lease preservation), and any residual equity in the land is lost.

Berry Street Child and Family Care Centre. The Berry Street land is the subject of Part 3. The revocation of the reservation and Crown grant removes any existing legal status of the centre as a reservation holder. However, section 8 immediately re-reserves part of the land for child care, so the centre (or the relevant government agency) can continue to use that area. The centre may need to formalise its management role under the new temporary reservation. The part of the land not re-reserved reverts to unalienated Crown land, potentially affecting the centre's ability to use that portion.

Sovereign Hill museum. Part 4 expands the museum site land under the Ballarat (Sovereign Hill) Land Act 1970 to include additional land shown on the new Schedule 1. The Sovereign Hill museum, which operates as an open-air museum, benefits from the additional land for its activities. The amendment also extends the leasing power under section 6 of that Act to the additional land, and existing leases automatically include the additional land. This effectively gives the museum (or the Minister) control over the additional land without any separate acquisition process.

Minister for the time being administering the Crown Land (Reserves) Act 1978. Under section 5(2), the Minister becomes the lessor under the Anglicare Victoria lease. This imposes administrative responsibilities: the Minister must manage the lease, receive rent, and deal with lessee obligations. The Act does not appropriate additional funds for this role.

Registrar of Titles. Section 14 imposes a mandatory duty on the Registrar of Titles to make recordings or amendments to the Register under the Transfer of Land Act 1958 to reflect the changes wrought by the Act. This is a ministerial task but may involve administrative costs.

Members of the public using any road on the additional Sovereign Hill land. Section 10(d) (new section 5CA(d)) provides that if any part of the additional Sovereign Hill land is or is being used as a road, that part ceases to be a road and all rights, easements and privileges cease. This directly affects public access rights, any local council's road management responsibilities, and utility providers' easements.

Local residents and businesses. The East Melbourne parcels are in a built-up area. The revocation of the social welfare reservation may affect neighbourhood character, but the Act does not specify any public consultation or compensation for neighbours whose expectations relied on the continued use of the land for social welfare purposes.

State government as beneficiary. The Crown gains two parcels (Anglicare and Berry Street) as unalienated land, minus the lease and re-reservation. This adds to the Crown's land portfolio.

The Act imposes few ongoing duties but creates certain statutory rights and protections.

Duty on the Registrar of Titles (section 14). The Registrar of Titles must make any recordings or amendments to the Register under the Transfer of Land Act 1958 necessary because of the operation of any provision of this Act. This is a mandatory duty with no discretion. Failure to comply could lead to challenges in land dealings. The duty arises automatically upon the Act's operation; the Registrar does not need a court order.

Right of the lessee (Bayside Health) to continued lease (section 5). The lessee under the relevant lease has a statutory right to continue the lease on the same terms, with the Minister as lessor. The lease is deemed not to have been assigned in a way that triggers any prohibition on assignment. The lessee also has the benefit of section 5(5)(c), which provides that no surety or obligor is released. This right overrides any contrary Act or law or any Crown grant.

Right of the lessor (originally Anglicare Victoria) to have the lease respected. While Anglicare Victoria loses its freehold, it retains the benefit of the lease (now administered by the Minister). However, the Act does not provide for any compensation to Anglicare for the extinguishment of its reversionary interest.

Right of the lessee under the Ballarat Act (section 12). The lessee of any lease granted under section 6 of the Ballarat (Sovereign Hill) Land Act 1970 existing immediately before the commencement of Part 4 has the right to have the additional land automatically included in the lease area, without any amendment to the lease. This is a statutory expansion of the lessee's rights (and likely correspondingly increases the lessee's obligations, such as rent or maintenance, though the Act is silent on rent adjustment).

Right of the Sovereign Hill museum to use the additional land as museum site land. The new section 5CA(e) deems the additional land permanently reserved for the purposes set out in section 5C of the Ballarat Act. This gives the museum (or the Minister) the right to use the land for museum, tourist, and related purposes, and to grant leases under section 6 (as amended).

No right to compensation for loss of road rights. Section 10(d) extinguishes all rights, easements and privileges in relation to roads on the additional Sovereign Hill land. There is no provision for compensation for anyone who held an interest in that road, such as utility providers or adjoining landowners. This is a notable absence.

No right to compensation for revocation of Crown grant. The revocation of Crown grants under sections 3(2) and 6(2) extinguishes the freehold title without any statutory compensation. The Act does not refer to any implied or express right to purchase new grants.

No duty to notify holders of extinguished interests. The Act does not require the Minister or the Registrar to notify former holders of trusts, limitations, reservations, restrictions, encumbrances, estates or interests that these have been extinguished. The burden falls on those parties to discover the change through the Register or the Act itself.

The Land (Miscellaneous Matters) Act 2005 contains no offence provisions, no monetary penalties, and no grant of enforcement powers to any body. It is not a regulatory statute but a land-administration instrument. The only enforcement mechanism is through the legal consequences of the Act's operation and the general law.

Non-compliance by the Registrar of Titles. If the Registrar fails to make the necessary recordings or amendments under section 14, a person affected could seek a mandatory order from the Supreme Court of Victoria compelling compliance. The Act does not specify a timeframe for compliance, but the duty is immediate. The Registrar is a public officer; failure might also expose the State to an action for breach of statutory duty, though this is untested.

Lease preservation enforcement. Section 5 overrides any contrary Act or law and any Crown grant. If a third party (including a future Crown grantee) attempts to disregard the lease, the lessee (Bayside Health) could enforce its statutory right through the courts. The section expressly provides that nothing in it is to be regarded as a breach of the lease, so the lessor cannot use the change of lessor as grounds to terminate. The lessee's remedies are the same as under the original lease (e.g., specific performance, injunction, damages).

Road cessation enforcement. The cessation of road rights under section 10(d) is automatic. If any person continues to assert a right of way or easement over the former road, the owner of the additional Sovereign Hill land (the Crown or the museum) could apply for declaratory relief to confirm the cessation. The Act does not create any criminal penalty for unauthorised use of the former road.

Re-reservation for child care. The temporary reservation under section 8 for child care purposes does not carry its own penalty regime. Instead, it subjects the land to the Crown Land (Reserves) Act 1978 enforcement provisions. That Act contains penalties for unauthorised use or occupation of reserved land (e.g., section 13). But those are general provisions, not specific to this Act.

No fines or imprisonment. A search of the entire Act reveals no references to fines, penalties, imprisonment, infringement notices, or enforcement officers. The Act depends entirely on the operation of law and the general availability of court orders for its effect.

Enforcement by the Crown. The Crown, as the owner of the unalienated land, could take action for trespass against anyone who occupies the Anglicare or Berry Street land without authority. For the Anglicare land, the lease to Bayside Health provides that authority for that part. For the Berry Street land, the re-reservation gives the relevant committee of management (if any) control.

Practical enforcement gap. The Act's silence on penalties means that any legal consequences flow from the underlying general land law, not from the Act itself. This lowers the enforcement risk for private parties but also means that there are no quick administrative remedies for non-compliance with the Act's directions (such as failure to update the Register). A party seeking to enforce the Act's provisions must resort to civil litigation, which is costly.

The Act explicitly interacts with several Victorian statutes and implicitly with the general law.

Crown Land (Reserves) Act 1978. This is the most significant interaction. Sections 4 and 7 of the Act revoke regulations made under section 13 of the Crown Land (Reserves) Act 1978. Section 8 deems part of the Berry Street land to be temporarily reserved under section 4(1) of that Act. The new section 5CA(e)(i) deems the additional Sovereign Hill land permanently reserved for purposes set out in section 5C of the Ballarat Act, but that reservation is under the Ballarat Act, not the Crown Land (Reserves) Act. The interaction means that the Crown Land (Reserves) Act 1978's general framework for management of reserves applies to the re-reserved Berry Street land.

Ballarat (Sovereign Hill) Land Act 1970. Part 4 amends this Act directly. It inserts a definition of "museum site land" (section 9), adds new section 5CA (section 10), amends section 6(1) (section 11), and inserts new section 6A (section 12). The Ballarat Act now operates as if the additional land were always part of the museum site land. Existing leases under that Act are statutorily varied to include the additional land. The Ballarat Act's leasing power (section 6) now extends to the new land.

East Melbourne Land Act 1970. Section 3(3) provides that the land specified in item 1 of Schedule 1 ceases to be subject to the reservation imposed by virtue of section 2 of the East Melbourne Land Act 1970. This Act is referenced only for the purpose of removing that reservation. No other provision of the East Melbourne Land Act is affected.

Transfer of Land Act 1958. Section 14 directs the Registrar of Titles to make recordings or amendments to the Register under the Transfer of Land Act 1958. This is the mechanism by which the changes to land status are recorded against titles. The Act overrides any procedural requirements in the Transfer of Land Act 1958 that might otherwise require applications, consents, or evidence to amend the Register.

General law of contract and property. Section 5(4) provides that the lease preservation provisions have effect despite anything to the contrary in any Act or law or in a Crown grant. This overrides any general law that would otherwise treat the revocation of the Crown grant as terminating the lease (e.g., the doctrine of merger or frustration). Section 5(5) ensures that the statutory novation does not constitute a breach or default under the lease. New section 6A(2) has a similar effect for the amended Ballarat Act leases.

Local government road management powers. Section 10(d) (new section 5CA(d)) extinguishes road rights on the additional Sovereign Hill land. This interacts with any local council's management powers under the Local Government Act 1989 or the Road Management Act 2004. After the cessation, the land is no longer a road, and council responsibilities under those Acts cease. No provision is made for the transfer of road infrastructure or utilities.

No interaction with planning or environment laws. The Act does not mention the Planning and Environment Act 1987 or any environmental legislation. The revocation and re-reservation may have implications for land use, but the Act does not address planning approvals. Consultation with relevant planning authorities is not mandated.

No interaction with native title. The Act makes no reference to the Native Title Act 1993 (Cth). Given the land parcels are in urban East Melbourne and Ballarat, native title is unlikely, but the Act does not contain a provision to ensure consistency with the Commonwealth Act.

The Land (Miscellaneous Matters) Act 2005 (Act No. 59/2005) is a relatively simple statute with a short legislative history.

Assent and commencement. The Act received Royal Assent on 20 September 2005. Sections 1, 2, 6-14 and Schedules 1 and 2 came into operation on 21 September 2005 (the day after Royal Assent), as provided by section 2(1). Part 2 (sections 3-5) came into operation on 21 October 2005, as proclaimed by the Governor in Council and published in the Government Gazette on 20 October 2005 page 2308. This delay allowed time for administrative arrangements for the lease preservation. Section 2(3) provided a fallback: if Part 2 had not commenced by 31 December 2006, it would commence automatically on that day. This fallback was not needed.

Version 002. The endnotes indicate a version number of 002, meaning there is at least one earlier version (version 001). The table of amendments at the end of the Act states: "There are no amendments made to the Land (Miscellaneous Matters) Act 2005 by Acts and subordinate instruments." This seems to contradict the existence of version 002. However, version numbers in the Victorian legislation database often change due to re-publication, commencement of different parts, or editorial corrections, not necessarily substantive amendments. The text of the Act as at 21 October 2005 (the version provided) includes all parts. Therefore, version 002 likely reflects the commencement of Part 2 on that date (the Act was originally as at Royal Assent, then updated). No substantive amendments have been made to the Act.

No subsequent amendment Acts. As of the version date (21 October 2005), no other Act had amended this Act. The Act has no amendment history beyond its own commencement.

No repeal. The Act remains in force as part of the statute book, though its operative provisions were largely self-executing (revocations, re-reservations, amendments to the Ballarat Act). The only ongoing provision is the lease preservation in section 5, which affects the lease as long as it exists.

Future amendments possible. The Act is a "miscellaneous matters" statute, so future amendments could be made by similar Acts, but none are recorded. Its narrow scope means it is unlikely to be amended unless the lease preservation requires adjustment or the Sovereign Hill land changes further.

No subordinate legislation. The Act does not authorise the making of regulations, orders, or other instruments beyond the Order in Council for commencement of Part 2. The revocations and re-reservations are all set out in the Act itself and the schedules.

The Act's text and endnotes contain no references to any litigation. The Act is not a subject of litigation in any publicly available decision cited. Given the specific, transactional nature of the Act (three discrete land matters with saving provisions), litigation would be unlikely unless a party affected by the revocation of a Crown grant or the extinguishment of road rights sought to challenge the validity of the Act or claim compensation. However, the Act is a validly enacted Victorian statute, and unless a constitutional challenge were mounted (e.g., for acquisition of property without just terms under section 51(xxxi) of the Australian Constitution for Commonwealth purposes, or under the Victorian Constitution), it is likely immune from challenge on its face. The revocation of a Crown grant without compensation might raise issues under the property rights guarantee in the Victorian Constitution (if any), but that is an unresolved area.

Potential for litigation. The most likely source of litigation would be if the lease preservation in section 5 were disputed. For example, if a future Crown grantee of the Anglicare Victoria land attempted to ignore the lease, Bayside Health would need to seek a declaration and specific performance. Alternatively, if the Minister failed to honour lease terms (e.g., repair obligations), the lessee could sue. But section 5(4) gives the lease override effect, so a court would likely uphold it.

No reported cases. A search of Victorian case law databases would likely reveal no judgments citing the Act. The Act's narrow scope and administrative nature make it invisible to most litigation. The only reported case might be a land valuation or property law case that mentions the Act in passing, but none are referenced in the source.

Interpretation disputes. The Act uses standard Victorian land law language (e.g., "unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests"). These terms have been interpreted in the context of the Crown Land (Reserves) Act 1978 and the Transfer of Land Act 1958. No novel interpretative issues arise from the Act's text.

Application for compensation. If any party believed they had a compensable interest (e.g., the holder of an easement extinguished under section 10(d)), they could seek compensation under the general law for the acquisition of property, but the Act provides no compensation mechanism, and a court would likely hold that the legislature intended no compensation (given the absence of a provision). The Supreme Court of Victoria could be asked to determine whether the Act effects an acquisition of property otherwise than on just terms, but this would be a novel claim.

In summary, there is no known litigation history for this Act. The source provides no case citations or references to disputes. The Act is a candidate for being one of the least litigated Victorian statutes.

Lease preservation overrides everything (section 5(4)). This subsection provides that the lease preservation provisions have effect despite anything to the contrary in any Act or law or in a Crown grant of the land. This means that even if the Crown later issues a new Crown grant over the Anglicare Victoria land, the grant will not defeat the lease. A purchaser or mortgagee inspecting the title would need to be aware of the statutory overlay. The Register may show the lease only after the Registrar acts under section 14, but until then, the title may appear unencumbered. Reliance on a clean title search could be misleading.

No compensation for extinguished road rights (section 10(d)). The additional Sovereign Hill land may have included a road with utility services. The Act extinguishes all rights, easements and privileges, but does not provide for compensation to utility providers or adjoining landowners. This could strand infrastructure without any requirement for the State to pay. A water or power authority that had an easement over the road loses it without notice or payment.

Automatic inclusion of additional land in existing leases (section 12). New section 6A provides that an existing lease under the Ballarat (Sovereign Hill) Land Act 1970 immediately includes the additional land. This is a statutory variation of the lease contract. The lessee may benefit from more space, but the lease terms (including rent, outgoings, and maintenance obligations) may not be adjusted. If the existing lease did not require the lessee to maintain additional land, the lessee now has that obligation without negotiation. Conversely, the lessor (the Minister) may have lost the opportunity to grant a separate lease of the additional land for additional rent.

Temporary re-reservation of Berry Street land (section 8). The re-reservation is "temporary" under the Crown Land (Reserves) Act 1978, section 4(1). That Act typically imposes a maximum period of 10 years for temporary reservations (though the Act does not specify). The operator of the child care centre may face uncertainty when the reservation expires. The Act does not provide any mechanism for permanent reservation or renewal. At the end of the temporary period, the land becomes unalienated Crown land, and the centre may lose its right to use the site.

No transitional provision for other interests on the Berry Street land . The Act revokes the Crown grant and reservation for the Berry Street land in full. The re-reservation under section 8 applies only to the hatched part in Schedule 2. The unhatched part becomes unalienated Crown land without any ongoing use rights. If other parties had informal permission to use that part, their rights are extinguished.

No requirement to notify holders of extinguished trusts, limitations or encumbrances. Sections 4, 7, and 5CA deem land freed from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests. The Act does not require the Minister or Registrar to inform the holders of those interests (e.g., a charitable trust, a utility easement, a restrictive covenant). These parties must discover the extinguishment themselves, perhaps only when they try to rely on the interest.

The lease preservation does not provide for rent review or assignment. The lease continues as if assigned to the Minister. But if the lease originally contained a prohibition on assignment, section 5(5)(a) provides that the statutory change is not a breach. However, any future voluntary assignment by Bayside Health would still be subject to the lease's original terms. The Minister becomes the lessor, but the Act does not clarify whether the Minister can assign the reversion.

Section 5(2) deems the lease to refer to the Minister as lessor, but does not specify which Minister. In practice, it would be the Minister administering the Crown Land (Reserves) Act 1978, but the Act does not say so explicitly. This could create confusion if the portfolio changes.

Road cessation includes all privileges "by user or operation of law or otherwise" (section 10(d)). This is extremely broad. Even a prescriptive easement acquired by long use over the road is extinguished. A neighbour who used the road for access for 20 years loses that right without compensation.

Compliance with the Land (Miscellaneous Matters) Act 2005 is largely automatic and passive, but affected parties should take specific steps to formalise their positions.

For the Registrar of Titles. The mandatory duty under section 14 is to make recordings or amendments to the Register. The Registrar should: (a) identify the titles affected (Volume 1502 Folio 372, Volume 1351 Folio 183, and any titles relating to the additional Sovereign Hill land); (b) record the revocation of those Crown grants, removing the titles from the Register; (c) for the Anglicare Victoria land, note the preservation of the lease on the Register (perhaps as a caveat or annotation); (d) for the Berry Street land, record the re-reservation as a new interest; (e) for the additional Sovereign Hill land, record the cessation of any road and the permanent reservation; and (f) update any derivative titles. The Registrar should also ensure that the Register reflects the new definition of "museum site land" for the Ballarat Act. Without this, a third party relying on the Register may be misled.

For the Minister (as new lessor under section 5). The Minister should: (a) formally accept the statutory assignment of the lease; (b) notify the lessee (Bayside Health) in writing that the Minister is now lessor; (c) arrange for rent to be paid to the appropriate government account; (d) manage the lease according to its terms (maintenance, insurance, repair); (e) consider whether to enter into a new formal lease to replace the statutory one, to avoid ambiguity; (f) ensure that any future Crown grant of the land includes an acknowledgment of the lease. The Minister should also liaise with the Registrar to ensure the lease is noted on the Register.

For Bayside Health (lessee). The lessee should: (a) confirm receipt of notification from the Minister; (b) continue paying rent to the new lessor; (c) update its internal records for the lease; (d) verify that the lease covenants (such as quiet enjoyment) are still effective; (e) if the lessee plans to assign or sublet, obtain the Minister's consent as required by the lease. Bayside Health does not need to do anything to perfect its statutory right, but it would be prudent to obtain a copy of the Register showing the lease annotation.

For the Berry Street Child and Family Care Centre. The centre should: (a) ascertain which part of the land is hatched in Schedule 2; (b) confirm that the centre has a valid management agreement (or can obtain one) for the temporary reservation under the Crown Land (Reserves) Act 1978; (c) apply to the Minister for a lease or licence over the hatched land if the Act requires such arrangement; (d) plan for the temporary duration of the reservation; (e) cease any use of the unhatched land (which is now unalienated Crown land). The centre should also monitor the Register for any changes.

For Sovereign Hill museum (or the Minister under the Ballarat Act). The museum should: (a) confirm that the additional land is now part of the museum site land; (b) if the museum holds a lease, check whether the lease automatically includes the additional land (section 6A); (c) if the museum wishes to grant new leases, use the amended section 6(1) which refers to "museum site land"; (d) ensure that any road on the additional land is physically closed and that public notices are given (though not required by the Act); (e) negotiate with utility providers whose easements may have been extinguished.

For any person who held an interest in the extinguished road. Such persons should: (a) identify their interest (easement, right of way, permit); (b) recognise that the interest is extinguished under section 10(d); (c) consider whether to seek compensation from the Crown, though the Act does not provide for it; (d) apply for a new easement over the land or alternative access.

For the general public. No active compliance steps. Those using the former road for access must find alternative routes. The Act does not require any applications, permits, or fees. All changes happen by force of law. The only risk is reliance on outdated title searches: a prudent purchaser of any of the affected land should obtain a current search that reflects the Registrar's amendments.

No reporting obligations. No returns, forms, or notifications to any government body are required. The Act is self-executing, subject only to the Registrar's ministerial action.
