Land Conservation (Vehicle Control) Regulations 2024

The Regulations are structured around a few core legal constructs: the set aside determination, categories of restricted public access, specified offences tied to vehicle movement and parking, operator onus treatment, authorised officer powers, and a broad set of defined terms that align the Regulations with other statutes.

Set aside determination (reg 9). The Minister may, on recommendation of the public land manager, set aside land as a restricted access area, prohibited access area, or parking area (reg 9(1)). A determination must be in writing, identify the area, and be published in both the Government Gazette and on the public land manager’s internet site (reg 9(2)). A determination may be limited to specified days, times or periods, specified classes of persons or vehicles, and may include conditions and restrictions such as permitted directions of travel and maximum speeds (reg 9(4)-(5). The Minister must be satisfied that the determination addresses matters concerning public safety and is appropriate for the nature of the land (reg 9(3)).

Categories of areas. The Regulations distinguish three regulatory zones: restricted access areas (public access restricted in specified circumstances), prohibited access areas (public access prohibited), and parking areas (areas for parking vehicles where not a road or adjacent to a road) (reg 5 defns; reg 9(1)). Each category carries different legal consequences under the offences provisions (regs 11-14).

Vehicle and motor vehicle. The text separates “vehicle” (very broadly defined to include bicycles and pedal-powered vehicles but excluding prams, wheelchairs and motorised wheelchairs) from “motor vehicle” which imports the definition in section 3(1) of the Road Safety Act 1986 (reg 5). That distinction matters because reg 11 targets motor vehicles in particular while regs 12-14 apply to vehicles more generally.

Operator onus offences. Several offences are expressly stated to be operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), 12(4), 13(3), 14(3)). The Regulations therefore import an evidentiary regime anchored in the Road Safety Act where liability may shift to the operator in specified circumstances; the instrument itself does not recast Part 6AA.

Authorised officers and limits on direction. “Authorised officer” is defined by reference to appointments under specified Acts (Conservation, Forests and Lands Act 1987 and Victorian Fisheries Authority Act 2016) (reg 5). An authorised officer may direct operators to move, park or remove vehicles and may specify routes and maximum speeds (reg 15(1)-(2)). The officer’s power is constrained by a reasonableness-like statutory test: the officer must consider the direction reasonably necessary to prevent contraventions, protect safety, or care for or manage public land (reg 15(3)). Compliance by the operator is mandatory “as soon as it is safe to do so” (reg 15(4)).

Exemptions and disapplication. The Regulations carve out a broad class of exemptions for persons acting in the course of particular duties, including public land managers and their employees, contractors acting under instructions, certain emergency services personnel and police, authorised officers themselves, and other public sector employees acting under specified laws (reg 6(1)). A separate statutory route permits conduct authorised under leases, licences, permits or agreements granted under a relevant land Act (reg 7). Traditional owner group entities are treated specially: members bound by a traditional owner group agreement may carry out agreed activities without being subject to most offence provisions, but certain offences remain applicable (reg 8(1)-(2)).

Interconnection with other laws. The Regulations operate as a subordinate instrument to the Land Conservation (Vehicle Control) Act 1972 (reg 2) and rely on definitions and appointment powers in other Acts (Road Safety Act 1986; Conservation, Forests and Lands Act 1987; Traditional Owner Settlement Act 2010; Parks Victoria Act 2018; Fisheries Act 1995, among others) to allocate roles and import meanings (reg 5). The parking-area concept also imports the Road Safety Road Rules 2017 and other Acts that establish parking areas (reg 5 defn).

Signage and publication. The Regulations impose a publication requirement on the Minister and an operational signage duty on the public land manager (reg 9(2)(c), reg 10). That creates an administrative compliance pathway: the practical legal effect of any determination relies on publication and signage.

Penalty unit architecture. Penalties are expressed in penalty units; the endnotes set out how penalty-unit values are determined and give the values for the financial years commencing 1 July 2023 and 1 July 2024 (endnotes). The instrument therefore uses a dynamic monetary anchor set by other statute and the Treasurer rather than fixed dollar figures.

Public: The broadest class affected is any member of the public who uses or operates vehicles on public land. The core prohibitions target operators of motor vehicles and vehicles generally (reg 11-14). Ordinary recreational users, cyclists, people driving motor vehicles to access beaches or trails, and pedestrians who park vehicles are within the Regulations’ reach to the extent their conduct falls within the definitions and the designated areas.

Vehicle operators: Motor vehicle drivers are directly constrained by reg 11, which prescribes where motor vehicles may lawfully be used or operated on public land. Operators of non-motor vehicles (bicycles, trailers, trams, air-cushion vehicles) are subject to the damage and obstruction provisions in reg 12 and to conditions and prohibitions in set aside determinations under regs 13-14 where a determination applies to classes of vehicles.

Public land managers and the Minister: Public land managers are named decision participants. The Minister makes set aside determinations on the recommendation of the public land manager (reg 9(1)). The Regulations define who is a public land manager for different land categories (reg 5), assigning duties such as publishing determinations on their websites and displaying signs where a determination applies (reg 9(2)(c), reg 10(1)). The Minister’s statutory satisfaction that a determination addresses public safety and is appropriate for the land (reg 9(3)) constrains the Minister’s exercise, but the policies and procedures for meeting that test will fall to both the Minister’s office and the public land manager.

Authorised officers and enforcement bodies: People appointed as authorised officers under specified Acts (Conservation, Forests and Lands Act 1987; Victorian Fisheries Authority Act 2016) can direct vehicle operators under reg 15(1). Police and protective services officers are explicitly listed among those to whom regs 11-15 do not apply when acting in the course of duties (reg 6(1)(e)-(f)). Emergency services personnel and certain public sector employees are also covered by reg 6(1), meaning enforcement against them is disapplied while they perform official duties.

Leasees, licencees and permit holders: A person may carry out an activity otherwise prohibited by the Regulations if acting in accordance with the terms of a lease, licence, permit or other authority granted under a relevant land Act, or under an agreement entered into under a relevant land Act (reg 7). That creates a legal channel for commercial users, lessees, tour operators and event organisers to continue authorised activities, provided those activities are authorised in the underlying instrument.

Traditional owner groups: Members of traditional owner group entities who are bound by a traditional owner group agreement may be exempt from many offence provisions in carrying out agreed activities on land to which the agreement applies (reg 8(1)). However, the Regulations carve out specific provisions that still apply to traditional owners: certain subsections of regs 12, 13, 14 and 15 are expressly preserved (reg 8(2)). Practically, traditional owner agreements will govern a class of permitted conduct, subject to the preserved offences.

Contractors and volunteers: The Regulations disapply regs 11-15 to contractors, agents, volunteers or other persons carrying out work “for or acting on the authority or instruction” of a public land manager (reg 6(1)(c)). That means contractors engaged by a public land manager to undertake works in public land can lawfully operate vehicles that would otherwise breach the offence provisions, while acting under instruction.

Event organisers, commercial operators and private land users: These groups are indirectly affected. The power to set aside parking areas and to attach time, class and speed conditions to determinations (reg 9(4)-(5)) alters how commercial activities may be staged on public land. Businesses that rely on vehicular access to public land will need to monitor determinations and signage and secure relevant permits or leases under the relevant land Acts if their activities would otherwise be prohibited (reg 7).

Insurance and liability actors: Insurers, operators of vehicle fleets, and businesses that take customers onto public land will observe a changed risk profile: failure to check determinations or to obey authorised officer directions can lead to administrative penalties expressed in penalty units (regs 11-15; reg 15(4)). The Regulations create a compliance and enforcement regime that private risk managers must consider when operating on public land.

Collectively, the Regulations create obligations and exemptions that allocate decision rights to Ministers, public land managers and authorised officers, while shaping the behaviour of a wide set of private actors who use public land for transport, recreation or business.

Duties imposed on vehicle operators. The Regulations impose several specific duties on operators. Motor vehicle operators must confine vehicle use on public land to designated locations: roads, parking areas, immediately adjacent places to roads where parking is not prohibited, or restricted access areas where that class of motor vehicle is permitted (reg 11(1)). All vehicle operators must not use or operate a vehicle in a manner that damages public land (reg 12(1)), must not stop, park or leave a vehicle in a manner that damages land (reg 12(2)), and must not stop, park or leave a vehicle if it obstructs access to a road or parking area (reg 12(3)). Operators of vehicles permitted by a set aside determination must comply with any conditions attached to the determination, whether about times, classes, directions or speed, and must not leave vehicles in contravention of those conditions (reg 13(1)-(2)). Operators must also obey determinations that prohibit access: they may not use, operate or leave vehicles in prohibited access areas contrary to a determination (reg 14(1)-(2)). Finally, operators must comply “as soon as it is safe to do so” with directions from authorised officers ordering movement, parking or removal of vehicles (reg 15(4)).

Duties on public land managers and the Minister. The public land manager has a duty to recommend to the Minister when a set aside determination is sought to be made (reg 9(1)) and must ensure that signs informing the public of the determination are displayed at affected areas (reg 10(1)). The Minister must ensure any set aside determination is in writing, identifies the area, and is published in the Government Gazette and on the public land manager’s internet site as soon as practicable (reg 9(2)). The Minister must also be satisfied that the determination addresses public safety and is appropriate given the nature of the land and the vehicles or classes of vehicles to be permitted (reg 9(3)).

Authorised officer powers and constraints. Authorised officers may direct operators to move, park or remove vehicles, to park where directed, and may specify passage and maximum speeds when giving such directions (reg 15(1)-(2)). The Regulations restrict authorised officers to exercising this power only when the officer considers the direction reasonably necessary for limited statutory purposes: to prevent contraventions, to prevent continuance of contraventions, for the safety of persons on public land, or for the care, protection or management of public land (reg 15(3)). That restriction is a statutory condition on the officer’s power; failure by the operator to comply with a lawful direction is a separate offence (reg 15(4)).

Rights and exemptions. The Regulations set out several classes with legal exemptions from the offences. People having management or control of public land, employees acting in the course of duties, contractors or volunteers acting on authority or instruction of a public land manager, authorised officers acting in the course of duties, police and protective services officers acting in course of duties, and a range of public sector employees are exempt from contravening regs 11-15 while acting in the course of their duties (reg 6(1)). Persons acting under a valid lease, licence, permit or other authority granted under a relevant land Act, or under agreements entered into under a relevant land Act, are permitted to engage in activities otherwise prohibited if they are acting in accordance with the terms and conditions of that authority or agreement (reg 7). Traditional owner group members bound by a traditional owner group agreement are exempt from most offence provisions while carrying out agreed activities on applicable land, subject to explicit preserved offences (reg 8(1)-(2)).

Procedural rights: publication and signage. The Minister and public land managers have procedural obligations that create notice rights for the public. Determinations must be published in the Gazette and on the public land manager website and signs must be displayed at affected areas (reg 9(2)(c), reg 10(1)-(2)). Those publication and signage duties confer an informational right to potential operators and form part of legal notice.

Interplay with other statutory rights. The Regulations explicitly incorporate and rely on other statutes for definitional and appointment frameworks. For example, the meaning of “motor vehicle” is imported from the Road Safety Act 1986 (reg 5), authorised officers are those appointed under other Acts (reg 5), and relevant land Acts remain a source of authority to conduct otherwise prohibited activity (reg 7). Those cross-references confer rights under other instruments (for instance under leases or permits) that displace the general prohibitions in these Regulations where the underlying authority permits an activity.

Burden of proof adjustments. Several offences are declared operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), 12(4), 13(3), 14(3)), which adjusts evidentiary burdens for enforcement. While the Regulations do not define Part 6AA, the labels indicate a statutory shift in evidentiary responsibility that affects defendants and prosecutors in enforcement proceedings.

Recordkeeping and compliance duties. While not stated as an express duty for private actors, the publication and signage obligations on public bodies and the conditional nature of many permissions create an implied compliance burden on operators to check published determinations and posted signs before using vehicles on public land (reg 9(2), reg 10).

Penalties: the Regulations attach specific penalty-unit penalties to each offence and to failure to comply with an authorised officer’s direction. The schedule of penalties provided in the instrument is explicit:

• Use or operation of a motor vehicle on public land contrary to reg 11(1): 10 penalty units (reg 11(1)).
• Use or operation of any vehicle on public land in a manner that damages that land: 20 penalty units (reg 12(1)).
• Stopping, parking or leaving a vehicle on public land in a manner that damages land: 20 penalty units (reg 12(2)).
• Stopping, parking or leaving a vehicle on public land so as to obstruct entry to or exit from a road or parking area: 10 penalty units (reg 12(3)).
• Using or operating a vehicle of a class permitted by a set aside determination but in contravention of any conditions of that determination: 5 penalty units (reg 13(1)).
• Leaving such a vehicle in contravention of those conditions: 5 penalty units (reg 13(2)).
• Use or operation of a vehicle in a prohibited access area in contravention of the determination: 10 penalty units (reg 14(1)).
• Leaving a vehicle in a prohibited access area contrary to the determination: 10 penalty units (reg 14(2)).
• Failure to comply with a direction of an authorised officer under reg 15(1) as soon as safe to do so: 20 penalty units (reg 15(4)).

Monetary conversion of penalty units is governed by other statutes. The endnotes record the mechanism: penalties are calculated by multiplying the number of penalty units by the value of a penalty unit under the Sentencing Act 1991 and the Monetary Units Act 2004 (endnotes). The value of a penalty unit for the financial year commencing 1 July 2023 is $192.31 and for 1 July 2024 is $197.59, with future values fixed by the Treasurer under the Monetary Units Act 2004 and published in the Gazette and a newspaper (endnotes). The Regulations therefore produce penalties that vary year on year and are expressed as penalty units rather than fixed dollars to preserve temporal parity with other monetary statutory instruments.

Operator onus enforcement. The Regulations designate many offences as “operator onus offences” for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), reg 12(4), reg 13(3), reg 14(3)). That label imports the evidentiary architecture of Part 6AA into enforcement of these Regulations. The instrument itself does not state the precise operation of Part 6AA; practitioners must look to the Road Safety Act to determine the nature of the onus shift and the presumptions that attach.

Authorised officers’ enforcement powers. Enforcement is partly administrative: authorised officers, as defined, may direct movement, parking or removal of vehicles and may specify routes and maximum speeds when doing so (reg 15(1)-(2)). The statutory gate for using those powers is reg 15(3), which limits directions to situations where the authorised officer considers the direction reasonably necessary for preventing contraventions, addressing continuing contraventions, protecting safety, or for care/management of public land. Failure to comply with a lawful direction is itself an offence carrying 20 penalty units (reg 15(4)). The Regulations therefore enable immediate on-site enforcement via authorised officers, with criminal penalties for non-compliance.

Administrative and procedural enforcement context. Enforcement will be influenced by the publication and signage duties tied to determinations (reg 9(2), reg 10). The Minister must publish determinations and the public land manager must display signage “as soon as practicable” after a determination is made (reg 9(2)(c), reg 10(1)). Effective prosecution may therefore require showing compliance with publication and signage obligations as part of proving notice to an alleged offender. Conversely, the Regulations do not expressly create an administrative infringement regime separate from criminal penalties; compliance is enforced through the offences, operator onus provisions and authorised officer powers set out in the text.

Exemptions that limit enforcement. The Regulations expressly disapply regs 11-15 to a range of persons acting in certain capacities (reg 6(1)). A court or enforcement agency must therefore assess whether an alleged offender falls within one of those exemptions. Similarly, persons who are acting in accordance with a lease, licence, permit or other authority granted under a relevant land Act, or under an agreement entered into under a relevant land Act, may lawfully engage in activities otherwise prohibited (reg 7). Traditional owner group agreements provide another pathway that excludes many offences for members bound by the agreement carrying out agreed activities on the applicable land (reg 8(1)); however, certain offences remain applicable to traditional owners (reg 8(2)).

Temporal limits on enforcement. The Regulations are subject to a sunset provision under the Subordinate Legislation Act 1994: the instrument will sunset ten years after the day of making (endnotes). That temporal limit may affect long-term enforcement strategies and the policy continuity of the vehicle-control regime.

The Regulations operate as a subordinate instrument under the Land Conservation (Vehicle Control) Act 1972 (reg 2). They rely on and cross‑reference a number of other statutes for definitions, appointment of authorised officers, and enforcement architecture.

Road Safety Act 1986. The term “motor vehicle” is imported from section 3(1) of the Road Safety Act 1986 (reg 5). Critically, several offences are declared to be operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), 12(4), 13(3), 14(3)), which imports the Road Safety Act’s evidentiary regime into prosecutions under these Regulations. Practitioners therefore need to cross-reference Part 6AA to understand the evidentiary consequences, presumptions and defences that will apply.

Relevant land Acts and leases. Regulation 7 makes clear that activities authorised by leases, licences, permits or other authorities granted under a relevant land Act, or by agreements entered into under a relevant land Act, are not prohibited by these Regulations if undertaken in accordance with their terms (reg 7). The Regulations list the relevant land Acts in the definition in reg 5 (Crown Land (Reserves) Act 1978; Forests Act 1958; Land Act 1958; National Parks Act 1975; Wildlife Act 1975; Fisheries Act 1995; and other Acts that provide for use or management of reserved land). That design preserves the primacy of statutory permissions granted under land‑management instruments and creates an interaction where the underlying land instrument can authorise otherwise prohibited conduct.

Appointment and powers of authorised officers. The definition of “authorised officer” is limited to persons appointed under Part 9 of the Conservation, Forests and Lands Act 1987 or Part 3 of the Victorian Fisheries Authority Act 2016 (reg 5). That means the power to direct vehicle movement under reg 15 is exercised by officers whose appointment and disciplinary frameworks are governed by other statutory regimes. Practically, the scope of enforcement activity is therefore shaped by appointment rules in those Acts.

Traditional Owner Settlement Act 2010. The Regulations incorporate the Traditional Owner Settlement Act 2010 by reference. The definitions "agreed activity", "traditional owner group", "traditional owner group agreement", and "traditional owner group entity" have the same meanings as in that Act (reg 5). Regulation 8 provides that, where a traditional owner group entity has entered into a traditional owner group agreement, most offence provisions do not apply to members of that traditional owner group when carrying out agreed activities on applicable land; however, certain regulation provisions remain in force against traditional owner members (reg 8(1)-(2)). This creates a co‑operative interaction with statutory native title‑settlement instruments, preserving agreed cultural activities within the vehicle-control framework.

Parks Victoria Act 2018 and other land management legislation. The Regulations import definitions and managerial arrangements from the Parks Victoria Act 2018, Conservation, Forests and Lands Act 1987, Crown Land (Reserves) Act 1978, Fisheries Act 1995 and others to determine who the public land manager is in relation to specific reserves and land types (reg 5). That allocation of managerial responsibility directly links where determinations are made, who must display signage, and which internet sites must carry determinations (reg 9(2)(c), reg 10(1)).

Road Safety Road Rules 2017 and parking areas. The definition of “parking area” in reg 5 expressly includes parking areas within the meaning of the Road Safety Road Rules 2017 (reg 5 defn) and parking areas established by or under any other Act or regulations. That means traffic rules and parking definitions under the Road Safety Road Rules remain applicable where the parking area definition overlaps, coordinating traffic-rule enforcement with the vehicle-control framework.

Monetary Units and Sentencing statutes. Penalties are expressed in penalty units, and the endnotes refer to the Sentencing Act 1991 and the Monetary Units Act 2004 for conversion and annual valuation (endnotes). That interaction ensures penalties remain in step with the statutory penalty-unit regime and the Treasurer’s determinations.

Subordinate Legislation Act 1994. The instrument is subject to the Subordinate Legislation Act 1994 sunset rule and will cease ten years after making, unless remade or extended (endnotes). That procedural interaction frames the term of the Regulations.

Administrative law and judicial review. While the Regulations do not reference judicial review procedurally, the Minister’s power to make set aside determinations is conditioned on satisfaction about public safety and appropriateness to the land (reg 9(3)). Those satisfaction predicates and the procedural requirements for publication and signage (reg 9(2), reg 10(1)) create administrative actions that may be subject to review under general administrative law principles. The Regulations’ text itself does not specify appeal routes against determinations.

In summary, the Regulations function as a node in a network of land, safety and administrative statutes. They rely on other Acts for key definitions and appointment frameworks, they preserve the authority of leases and statutory agreements under other land Acts, and they import evidentiary adjustments from the Road Safety Act. Practitioners will therefore need to consult the referred Acts routinely when applying or defending these Regulations.

Formal provenance. The Regulations were made on 26 March 2024 by the Governor in Council under section 3 of the Land Conservation (Vehicle Control) Act 1972 and commenced on 30 March 2024 (reg 2-3; endnotes). The instrument revokes the Land Conservation (Vehicle Control) Interim Regulations 2023 (reg 4). The published version is “Version No. 002” and incorporates amendments as at 30 June 2024, according to the front-matter.

Notable changes recorded in the instrument. The text itself records one express amendment within the body of the Regulations: subregulation 6(1)(k) was revoked by S.R. No. 19/2024 reg 6(2) and that subregulation (1)(k) itself was revoked on 30 June 2024 (reg 6(1) text notes that reg 6(1)(k) is revoked by reg 6(2), and reg 6(2) states the revocation occurs on 30 June 2024). The Table of Amendments and the endnotes refer to that action (Table of Amendments entry and explanatory details).

Style changes and technical amendments. The endnotes note that style changes are in accordance with the Interpretation of Legislation Act 1984. The Explanatory Details list earlier instruments that affected the definition of “parking area” (Reg 5 defn), citing a series of S.R. numbers that have amended that definition over time. The endnotes also set out the mechanism for penalty‑unit valuation and refer to the statutory regime that fixes the penalty unit value annually (endnotes).

Sunset rule. The endnotes also record that the Regulations will sunset ten years after the day of making pursuant to section 5 of the Subordinate Legislation Act 1994; that is, the instrument will sunset on 26 March 2034 unless remade or extended (endnotes).

No recorded consolidated amendments beyond the revocation of the interim 2023 instrument and the revocation of reg 6(1)(k). The printed Table of Amendments lists the date of making and commencement details and specifically notes that reg 6(2) revoked reg 6(1)(k) on 30 June 2024. The Version control information on the front pages indicates the version incorporates amendments to 30 June 2024; no other amendments are recorded in the text provided.

Implication for practitioners. Because the instrument is new and the Table of Amendments lists only the revocation of the interim instrument and the reg 6(1)(k) revocation, any later changes must be checked against the official legislation database (legislation.vic.gov.au) and the Government Gazette. The endnotes expressly point readers to that site for up-to-date legislative information (endnotes).

Limitations of the recorded history. The Regulations’ own endnotes include prior S.R. references for the parking-area definition and the revoked interim Regulations, but they do not list a history of judicial interpretations or other amendments beyond those recorded. Practitioners should treat the Table of Amendments and endnotes as the instrument’s internal amendment record, while confirming external Gazettal notices for any further changes post 30 June 2024.

The statutory instrument as printed contains no reference to any judicial decisions, authorities or litigation concerning these specific Regulations. The text includes no citations to cases and no recorded litigation history in the endnotes. Accordingly, the instrument itself does not record any litigation history to date.

Potential litigation topics implicit in the text. The Regulations create several points at which legal disputes might reasonably arise, based on the statutory design:

• Validity of set aside determinations: The Minister’s power to make a determination is subject to the requirement that the Minister be satisfied the determination “addresses any matters concerning public safety” and “is appropriate based on the nature of the land” having regard to the vehicles or classes of vehicles to be permitted (reg 9(3)). Those statutory predicates create potential grounds for judicial review litigation about whether the Minister reached the required state of satisfaction or correctly applied statutory criteria when making a determination. Procedural adequacy (publication and signage obligations in reg 9(2) and reg 10) may also be challenged where an affected person alleges lack of notice.

• Interpretation of exemptions and application to specific actors: Reg 6 disapplies regs 11-15 to a range of persons acting in the course of their duties, and reg 7 preserves the operation of leases, licences and agreements under relevant land Acts. Disputes may arise about whether a particular operator fell within an exemption, whether conduct stayed within the terms of a lease or permit, or whether a traditional owner agreement gives rise to an exemption under reg 8(1) in a particular case. Litigation could therefore centre on statutory interpretation and factual characterisation of activities relative to those instruments.

• Operator onus prosecutions: The Regulations designate a number of offences as operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), reg 12(4), reg 13(3), reg 14(3)). Challenges in criminal proceedings may therefore focus on the evidentiary implications of Part 6AA, the sufficiency of evidence to shift the burden, and the availability of statutory defences as framed by the Road Safety Act. Defence and prosecution strategies will need to be informed by Part 6AA case law under the Road Safety Act rather than decisions under these Regulations alone.

• Lawfulness and limits of authorised officer directions: Reg 15 gives authorised officers a statutory power to direct vehicle movement, subject to the officer considering the direction reasonably necessary for identified purposes (reg 15(3)). Litigation could arise where an operator challenges the lawfulness or reasonableness of a particular direction, or where an authorised officer is alleged to have exceeded statutory powers. Such disputes are likely to engage both administrative law review principles and criminal law defences in proceedings for breach of reg 15(4).

• Notice and signage disputes affecting prosecutions: The Regulations impose publication and signage duties (reg 9(2)(c) and reg 10(1)-(2)). Prosecutions for contravening determinations may involve factual disputes as to whether adequate signage was in place or whether determinations were published as required. Courts may be asked to decide whether a failure to publish or sign vitiates liability in individual cases.

No recorded precedents or litigation outcomes are supplied in the instrument, so practitioners must look to broader administrative law and Road Safety Act jurisprudence when assessing litigation risks under these Regulations. For any contested enforcement action or challenge to a determination, the relevant materials to consult include the text of the Regulations, the underlying Land Conservation (Vehicle Control) Act 1972, Part 6AA of the Road Safety Act 1986, and the statutes governing the appointment and function of authorised officers, as those cross-references define the legal framework for disputes.

Several technical and practical traps are embedded in the Regulations’ structure that will generate compliance and enforcement pitfalls unless actively managed.

Operator onus label. Multiple offences are declared operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986 (reg 11(2), 12(4), 13(3), 14(3)). The instrument itself does not explain Part 6AA; the practical consequence is that alleged operators may face an evidentiary regime where certain presumptions or burdens shift against them. Practitioners must not assume ordinary prosecutorial burdens apply; instead they must cross‑check Part 6AA’s mechanics in the Road Safety Act to understand defences, procedural requirements and evidentiary thresholds.

Broad definition of “vehicle”. The statutory definition of “vehicle” encompasses a wide set of conveyances, including bicycles and pedal-powered vehicles, trailers and air-cushion vehicles, but excludes prams, wheelchairs, motorised wheelchairs and devices for conveying children (reg 5). That breadth means cyclists and other non‑motorised users can be caught by damage and obstruction offences in reg 12, even though reg 11 targets motor vehicles. Operators may incorrectly assume the Regulations only target cars and 4WDs; the text expressly reaches wider classes.

“Road” narrowly defined. The Regulations define “road” as a “road that is open to the public and that is formed for the passage of motor vehicles having four or more wheels” (reg 5). That definition can produce counterintuitive results: a formed track used by 4WDs may qualify, but other formed ways used by lighter vehicles might not. Operators using tracks on public land should not assume the public land is a “road” simply because vehicles pass over it; the statutory test requires formation for four‑wheel motor vehicles and openness to the public.

Publication and on‑site signage timing. A set aside determination must be published in the Gazette and on the public land manager's internet site and a sign must be displayed “as soon as practicable” (reg 9(2)(c), reg 10(1)). The phrase “as soon as practicable” is not defined and creates timing risk: operators could be prosecuted in circumstances where publication or signage lags. Compliance proof may depend on contemporaneous records of posting and Gazettal; lack of such records can complicate prosecutions or defences.

Exemptions are qualified and limited. Reg 6 disapplies regs 11-15 for a long list of official actors (public land managers, employees, contractors acting under instruction, authorised officers, police, protective services officers, emergency services staff, and certain public sector employees) (reg 6(1)). However, those exemptions apply only when individuals act “in the course of their duties” or “on authority or instruction”. Operators relying on an exemption must be able to prove the factual basis that their conduct was authorised and in the course of duty. The revocation of reg 6(1)(k) on 30 June 2024 indicates the exemption list can change, so parties should confirm the current text (reg 6 and Table of Amendments).

Traditional owner agreement carve-outs have exclusions. Reg 8 provides that members of traditional owner groups bound by a traditional owner group agreement are exempt from many offence provisions when carrying out agreed activities on applicable land (reg 8(1)). But reg 8(2) names specific provisions that remain applicable to traditional owner members (reg 12(1)-(3), reg 13(1)-(2), reg 14(1)-(2), reg 15(4)). Practitioners should not assume blanket immunity; traditional owner activities remain subject to certain damage, obstruction and authorised-officer compliance rules.

Interplay with leases and permits. Reg 7 allows conduct authorised by a lease, licence, permit or agreement under a relevant land Act. Practically, that privilege is conditional on strict compliance with the terms of the underlying lease or permit. A common error will be to assume that any written permission from a public land manager suffices; the instrument requires the grant to be under a relevant land Act or an agreement entered into under a relevant land Act (reg 7). Private agreements outside those statutory mechanisms may not avail.

Directions from authorised officers can specify route and maximum speed. Under reg 15(2) an authorised officer can specify both the direction/passage and the maximum speed at which the vehicle may be moved. Operators might mistakenly think simple relocation directives cannot include speed controls; the Regulation permits that, and failure to comply with a direction is penalised at 20 penalty units (reg 15(4)).

Parking-area creation off roads. A parking area may be set aside on land that is not a road and is not adjacent to a road (reg 9(1)(c)). That means a new statutory parking area can be created in locations where drivers would not expect formal parking regulation to apply, and operators must verify posted determinations before assuming a place is an informal parking spot.

Penalty units vary year to year. The monetary value of a penalty unit is set annually under statute and published (endnotes). Users who evaluate compliance costs in dollar terms must convert penalty units to dollars for the relevant financial year; failure to do so will misstate potential fines in practice.

Operator confusion risk between “motor vehicle” and “vehicle” offences. Because reg 11 refers to motor vehicles, while regs 12-14 apply to vehicles generally, operators of non-motorised conveyances (for example, pedal cycles) may be surprised to find themselves subject to damaging/obstruction offences even where motor vehicles are the primary regulatory focus. That cross‑category exposure is a compliance trap.

Sunset of the instrument. The Regulations will sunset ten years after the day of making (endnotes). Organisations making long-term investments or operational plans based on the Regulations should take into account that the statutory regime is time-limited unless remade.

Check published determinations and signage before operating vehicles on public land. The Regulations make compliance contingent on published set aside determinations and on-site signage (reg 9(2)(c), reg 10(1)-(2)). Practitioners and operators should routinely consult the relevant public land manager’s internet site for current set aside determinations and confirm on-site signage before using or leaving vehicles on public land. Maintain contemporaneous records (screenshots of web pages, photographs of on-site signs and timestamps) to evidence notice and compliance.

Understand whether the conveyance is a “motor vehicle” or “vehicle” under the Regulations. Different provisions apply to motor vehicles (reg 11) and to vehicles generally (regs 12-14). Confirm whether your conveyance is captured by the definitions in reg 5 and whether any statutory exclusions (prams, wheelchairs, motorised wheelchairs) apply.

If undertaking activities under a lease, licence or permit, ensure the authority is granted under a relevant land Act and you comply strictly with the terms. Regulation 7 permits otherwise prohibited activities where authorised under a relevant land Act; the safe route is to secure explicit written authority under such an Act and to document the terms that authorise your conduct (reg 7). Keep a copy of the authority on site and adhere to all conditions.

For traditional owner groups: verify the scope of your traditional owner group agreement and whether the activity is an “agreed activity” within the agreement. Reg 8 exempts members bound by a traditional owner group agreement from many offences for agreed activities but explicit exclusions apply (reg 8(1)-(2)). Maintain proof that activities fall within the agreement and that the operator is a member bound by the agreement.

Comply with conditions in set aside determinations. Determinations may specify days, times, classes of vehicles, specified classes of persons, conditions, directions of travel and maximum speeds (reg 9(4)-(5)). Before entering a set-aside area, confirm any conditions and plan operations to comply. For events or commercial uses, factor these conditions into movement plans, schedules and signage.

Train staff and contractors about authorised officer directions and the requirement to comply “as soon as it is safe to do so.” Authorised officers can direct operators to move, park or remove vehicles and to specify direction and maximum speeds (reg 15(1)-(2)). Non-compliance is penalised (reg 15(4)). Operators should train drivers to comply with lawful directions promptly while preserving safety.

Avoid damaging or obstructing land. The Regulations criminalise use or operation that damages public land and parking that damages land or obstructs access (reg 12(1)-(3)). Operational plans for vehicle use on public land should include route selection, minimisation of off‑track driving, surface protection measures (where relevant), and parking plans that avoid obstruction to roads and parking areas.

Document authorisations and decision paths. If you are a public land manager recommending a determination, keep written records of the recommendation, the assessment that addresses public safety and the land’s nature as required by reg 9(3), and copies of the determination and publication. If you are a lessee or permit-holder, keep copies of the authorising instrument and clear evidence that you are acting in accordance with it. These records are useful for both compliance management and defending any enforcement action.

Monitor signage maintenance and publication compliance if you are a public land manager. The public land manager must publish determinations on its website and display signs “as soon as practicable” (reg 9(2)(c), reg 10(1)). Keep photographic records of signs, dates of installation and the content of signs that state any conditions (reg 10(2)(b)). Ensure signage is placed “in a place and manner likely to be seen” by affected persons (reg 10(2)(a)).

Factor operator onus into compliance posture and evidentiary planning. Because several offences are operator onus offences for the purposes of Part 6AA of the Road Safety Act 1986, defendants and businesses should anticipate different evidentiary burdens in prosecutions. Collect and preserve objective evidence of compliance: logs, GPS tracks, photographs, witness statements and licenses or permits.

Plan for penalties and financial exposure. The Regulations specify penalties in penalty units. Convert penalty units to dollar amounts relevant to the applicable financial year using the Monetary Units Act 2004 and the Treasurer’s published value (endnotes). Budget for potential compliance costs and fines, and consider insurance coverage for regulatory fines and legal defence where appropriate.

Engage early with the public land manager for event or commercial operations. If an activity requires vehicular access not normally permitted, seek a lease, licence or permit under a relevant land Act or negotiate an agreement that authorises the activity (reg 7). Early engagement reduces risk of non‑compliance and clarifies whether the activity will be permitted under an existing instrument.

If directed by an authorised officer and safety permits, comply immediately but retain evidence. If an authorised officer gives a direction, comply “as soon as it is safe to do so” (reg 15(4)). Photograph or record the direction, note the officer’s name and badge/ID, and, where appropriate, make contemporaneous notes explaining compliance steps. Those records can be critical if compliance is later challenged.

Review insurance and contractual allocation of risk. For businesses and event organisers operating on public land, ensure contracts with clients and contractors allocate responsibilities for compliance and liability with respect to public land rules, signage compliance, and possible directions from authorised officers.

Keep regulatory monitoring procedures up to date. Because the Regulations can be amended and the Table of Amendments records at least one change (reg 6(1)(k) revocation), subscribe to the official legislation sources (legislation.vic.gov.au) and the Government Gazette to receive notices of changes, new determinations and amendments.
