Land Boundaries Act 1841

The statute rests on a few core legal concepts that determine how boundary uncertainty is resolved and enforced.

• Centralised surveying and marking: The Government may direct an authorised land officer to ascertain and mark boundaries in respect of grants where the deed descriptions (by marks, compass measurements or assumed distances) may be unreliable (Preamble; s 1). The authorised land officer is the operative functionary empowered to carry the process out (s 1, s 3, s 6), with the term defined by reference to the Land Administration Act 1997 (s 10).
• Public notification and administrative approval: The Act mandates three successive Gazettes for notice of intended surveys (s 2) and for notice of each record-book entry once approved (s 3). The Governor-in-Council is the approving decision-maker for the reported marked boundaries (s 3). The Act therefore embeds a two-stage administrative check: operational surveying by authorised officers, followed by executive approval and public notification.
• Evidence and conclusiveness of recorded boundaries: Once entries are made and signed as required, those recorded boundaries are "deemed and taken to be the true boundaries" for the relevant lands, overriding former deed descriptions (s 4). The record-book or a certified copy signed by the Surveyor-General or an authorised land officer "shall and may be given in evidence of the boundaries" in any suit affecting the land (s 4). The Act thus transforms an administrative record into conclusive evidentiary material.
• Entry and erection powers: Authorised land officers and assistants may enter any lands for the Act’s purposes, take materials and erect landmarks (s 6). These powers are not limited by express procedural warrants in the text; the Act prescribes civil forfeiture for wilful obstruction (s 6) and criminal liability for wilfully injuring landmarks (s 7).
• Localised historical accommodation: Section 5 creates a binding continuity rule for the Avon District by specifying that previously assumed distances on the Avon Base Line are to be taken as the distances originally assumed in the earlier survey, for that base line and parallel boundary lines (s 5). The provision ties present surveys to historical assumptions for that district, making past survey assumptions determinative in future surveys.

These concepts together make boundary marking both an administrative exercise (surveys, Gazette notices, record-keeping) and a legal mechanism that can alter the effective boundary relied on in property disputes (s 3-4). The Act references the administrative architecture through which authorised officers act, and cross-references later statutes that define the authorised officer role and Land Information Authority concepts (s 5; s 10).

The Act identifies and changes legal relations among discrete groups; the text names several classes directly and implies others by function.

• Land grantees whose deeds rely on marks, compass measurements, or assumed distances. The Preamble states the Act targets grants "in which the land has been described, either by marks or measurements which on more accurate survey are likely to prove in some degree erroneous, or by measurements to be made of certain distances in certain directions, according to the compass". Section 1 expresses the Government power to direct marking for "every grant heretofore made or hereafter to be made ... of which the description contained in the deed of grant shall be such as hereinbefore stated" (Preamble; s 1). Section 4 makes recorded boundaries binding on the original owner, heir or assignee, explicitly bringing successors and assigns into the affected class (s 4).
• Authorised land officers and the Surveyor‑General. The Act empowers "an authorised land officer" to carry out surveys and mark boundaries (s 1, s 3). The record-book entry must be signed by the officer and by the Governor-in-Council; s 4 contemplates the Surveyor‑General's signature (or an authorised land officer where applicable after amendments). Section 10 cross‑refers to the Land Administration Act 1997 for the meaning of "authorised land officer."
• The Governor‑in‑Council, as approver and signatory. The Governor-in-Council approves the reported landmarks and signs the recorded descriptions which then attain statutory consequence (s 3).
• Persons in possession of land, including original owners, their heirs and assignees. Section 4 expressly applies the recorded boundaries "notwithstanding" former descriptions and "whether such lands be in possession of the original owner or owners, or of his, her or their heir or assignee" (s 4).
• Members of the public, land professionals and litigants who rely on recorded boundaries as evidence. Section 4 makes the record-book or certified copy admissible as evidence in any suit or cause affecting boundaries (s 4). The Act also obliges public notification by Gazette (s 2; s 3).
• Persons whose access to land may be required for surveys: authorised land officers and their assistants may enter any lands and take materials and erect landmarks (s 6). Conversely, persons who wilfully obstruct such entry face a specified penalty (s 6). Persons who wilfully injure or deface landmarks commit an offence under s 7 with an identified penalty range.
• Administrative agencies referenced by cross‑statute definitions, notably the Western Australian Land Information Authority and Land Administration Act 1997. Section 5 references the "Avon District" as marked in the books of the Land Information Authority established by the Land Information Authority Act 2006 s 5, and s 10 gives the definition link to the Land Administration Act 1997.

Collectively the Act affects land title holders and their successors, those who operate the surveying and recording system, and third parties who may rely on the record as conclusive evidence in disputes. The procedural obligations (Gazette notices, Governor-in-Council sign-off) create administrative actors who decide and publish the changes; the substantive effect (s 4) directly alters the legal boundary positions of landholders covered by the process.

The Act allocates specific duties to public officers and creates legal rights and evidentiary positions for landholders and third parties.

Duties

• Government direction: The Government has the power to direct an authorised land officer to ascertain and mark boundaries for relevant grants (s 1). That is a procedural duty of the executive to initiate the surveying process where it chooses to do so.
• Notice publication: There is a duty to publish notice of intended surveys in three successive Gazettes (s 2). After approval and entry of recorded boundaries, there is a further duty to publish notice of each such entry in three successive Gazettes (s 3).
• Reporting and record‑keeping: The authorised land officer must report marked boundaries to the Governor-in-Council, accompanied by a map or plan and a description of landmarks (s 3). Once approved, the officer must enter the surveyed descriptions in a record-book kept for the purpose, and sign each such description (s 3).
• Governor-in-Council approval: The Governor‑in‑Council must approve the reported entries before they are recorded and Gazette-notified (s 3).
• Evidence provision at no fee: The record-book "or a certified copy to be made and issued on demand without fee, of any entry in such book signed by the Surveyor‑General or ... by an authorised land officer" must be made available as evidence (s 4). That creates a statutory duty on the record-keeping officer or office to supply certified copies free of charge when demanded.
• Entry and marking operations: Authorised land officers have the operational duty to enter land, take materials and erect landmarks to carry out the Act’s purpose (s 6).

Rights and legal effects

• Conclusive boundary effect: All boundaries entered and signed as required "shall be deemed and taken to be the true boundaries of such lands respectively" (s 4). This statutorily displaces prior descriptive methods in title deeds and makes the recorded description the operative boundary.
• Evidentiary right: The record-book or certified copy "shall and may be given in evidence" in any suit affecting boundaries (s 4). This gives parties relying on the record statutory evidentiary access and presumptive weight.
• Right of access for authorised officers: The authorised land officer and assistants have the right to enter any lands for the Act's purposes and to take materials and erect landmarks (s 6). That right is exercisable notwithstanding private possession, subject to liabilities for obstruction (s 6) and injury to landmarks (s 7).
• Special continuity for Avon District: For the Avon District, distances on the Avon Base Line are to be taken as the distances originally assumed in the earlier survey, and this applies in all subsequent surveys under the Act for that base line and parallel boundary lines (s 5). This grants a substantive continuity right to surveys in that district based on historical distances.

Sanctions and procedural rights link tightly: the recorded boundary confers rights in disputes, while officers have statutory rights to access and mark land. The duty to issue certified copies free of fee reduces transactional friction for parties seeking to rely on recorded boundaries (s 4). However, the Governor‑in‑Council’s approval duty is a gatekeeping function that centralises the final decision on whether the recorded descriptions attain statutory consequence (s 3).

The Act provides specified monetary penalties and an offence provision, establishes procedural requirements that enable evidentiary enforcement in litigation, and creates administrative enforcement pathways via recordation and Gazette notice.

Monetary forfeitures and offences

• Obstruction: Section 6 prescribes that any person who wilfully obstructs or hinders an authorised land officer or persons assisting him "in the execution of such duty shall forfeit and pay a sum not less than $2 nor exceeding $10." This is expressed as a pecuniary forfeiture. The provision also stipulates the authorised officer’s right to enter land and take materials for the Act’s purposes (s 6).
• Injuring landmarks: Section 7 makes it an offence for a person who wilfully injures or defaces any landmark erected under the Act, with a penalty "Not less than $20 and not more than $100." The text frames this as an offence rather than a forfeiture.
• Evidence of boundaries: Section 4 allows the record-book or a certified copy (signed by the Surveyor‑General or an authorised land officer) to be given in evidence of boundaries in any suit or cause affecting the same. That creates an evidentiary enforcement mechanism: parties can rely on the record in court, and the statutory wording sets the record as authoritative by making recorded boundaries "deemed and taken to be the true boundaries" (s 4).

Administrative enforcement mechanics

• Governor‑in‑Council approval: The requirement that reported marked boundaries be submitted to and approved by the Governor-in-Council before recordation (s 3) places a centralised administrative filter between survey results and their legal effect. Enforcement of the Act’s effects therefore depends on the administrative process being completed according to s 3.
• Gazette publication: The twin Gazette requirements , notice of intended surveys (s 2) and notice of entries (s 3) , create public record and constructive notice to third parties. Publication in three successive Gazettes is an explicit procedural requirement and thus a compliance checkpoint that can be relied upon in disputes.
• Free certified copies: The duty to issue certified copies "on demand without fee" (s 4) reduces transactional barriers for litigants and administrators to obtain official evidence of recorded boundaries, enabling more ready enforcement of the record in courts.

Limitations and observables in the text

• The Act specifies penalty amounts in dollar terms as printed (s 6; s 7). The compilation table indicates amendments by later Acts (for example, the Decimal Currency Act 1965, and several subsequent Acts with 1987, 1997, 2004 and 2006 entries), so the nominal penalty figures in the current text reflect those statutory updates. The Act does not in its text provide additional enforcement tools such as imprisonment, injunctive powers, or an express civil cause of action beyond the admissibility and conclusiveness of the record-book entry (s 4).
• Sections 8 and 9 have been deleted (the text notes their deletion), so any enforcement or procedural provisions formerly in those sections are not present in the current text.

In practical terms the Act’s enforcement rests on relatively modest pecuniary sanctions for obstruction and landmark injury, the administrative gatekeeping and publication requirements, and the statutory evidentiary and conclusive effect of recorded boundaries in litigation (s 3-4, s 6-7).

The Act cross-references and has been amended by multiple later statutes; its operation depends on definitions and institutional arrangements provided elsewhere.

Key statutory interactions stated in the text

• Land Administration Act 1997: Section 10 defines "authorised land officer" by reference to the Land Administration Act 1997. That means the substantive capacity in which officers act under the Land Boundaries Act is determined by the separate statutory regime governing land administration, which supplies the personnel who conduct surveys, make entries and issue certified copies (s 10).
• Land Information Authority Act 2006: Section 5 expressly ties the "Avon District" to the books of the Western Australian Land Information Authority established by the Land Information Authority Act 2006 s 5. The Avon Base Line continuity rule therefore depends on the Land Information Authority's mapping and record-keeping conventions and its designation of the district (s 5).
• Acts Amendment (Land Administration) Act 1987 and related amendments: Several sections have been amended or inserted by the Acts Amendment (Land Administration) Act 1987 (see notes to ss 1, 3, 4, 5, 6, 10). The compilation table records further amendments and insertions across multiple instruments. Two specific cross-effects appear in the text:
  • Section 4 contemplates that the record-book or certified copy may be signed by the Surveyor‑General or, after the operation of s 6 of the Acts Amendment (Land Administration) Act 1987, by an authorised land officer. That indicates the Acts Amendment altered who may sign certified copies for evidentiary purposes (s 4).
  • Section 5’s reference to the Land Information Authority and its books reflects a later statutory layering that locates the Avon District within the records of that Authority (s 5).

Procedural cross-dependencies

• Gazette publication: The Act requires notices in three successive "Gazettes" (ss 2, 3). Those publication mechanisms operate through government publication laws and practices. The timing and legal effect of Gazette publication therefore interact with statutory rules or administrative practice governing the Government Gazette.
• Evidence rules and courts legislation: Section 4’s provision that the record-book or certified copy "shall and may be given in evidence" interfaces with the procedural rules of courts as to admissibility, authentication and weight of evidence. The Act creates a statutory basis for admissibility but leaves the courts, under their procedural rules, to receive and weigh the evidence.

Amendment and repeal interactions noted in compilation table

• The compilation table lists a series of amending laws and reprints affecting the Act: the Criminal Code Act 1902, Decimal Currency Act 1965, Statute Law Revision Act 1970, Acts Amendment (Land Administration) Act 1987, Criminal Law Amendment Act (No. 2) 1992, Sentencing (Consequential Provisions) Act 1995, Acts Amendment (Land Administration) Act 1997, Courts Legislation Amendment and Repeal Act 2004, and the Land Information Authority Act 2006. Each is recorded with assent and commencement particulars in the table. The Act’s text carries marginal notes indicating where specific sections were amended or inserted by those later Acts (for example, s 7 was inserted by No. 59 of 2004 s 141; s 5 was amended by No. 60 of 2006 s 140, among others). Those amending statutes therefore shape the modern operation of the Act.
• Deletions: Sections 8 and 9 were deleted by earlier legislation (the text records deletion references). The explicit deletions show the Act has been pruned and that earlier provisions no longer form part of the operating regime.

Practical implications of these interactions

• The definition of "authorised land officer" outside the Act means that who may physically exercise powers under ss 1, 3 and 6 is determined by the Land Administration Act 1997. Lawyers and practitioners must therefore consult that Act to determine statutory authority, delegation, and limits on the officer’s powers.
• The Avon District rule (s 5) links to the Land Information Authority’s records, so survey practice, map layers and historical distances as maintained by that Authority have statutory force for surveys under the Act.
• The evidentiary effect in s 4 will be applied within the broader framework of evidence and civil procedure statutes and court rules, which will determine how the record-book or certified copy is presented, authenticated, and contested in litigation.

All of the foregoing flows from explicit cross-references and the compilation table in the Act’s text; the Act does not itself elaborate detailed procedural machinery beyond the Gazette publication and record-book requirements, instead relying on and interacting with other statutes and administrative practices.

The Act as printed is a compilation reflecting numerous amendments and insertions made since 1841. The text itself identifies amendments to particular sections and the compilation table lists the amending statutes with assent and commencement details. Principal annotation points in the Act’s text and compilation table are:

• Original enactment: The Act was originally enacted as Untitled 4 & 5 Vict. No. 20 with assent and commencement on 30 September 1841 (compilation table).
• Decimal Currency Act 1965 (113 of 1965): The compilation table records amendments associated with the transition to decimal currency; the notes to s 6 indicate an amendment by No. 113 of 1965 s 8(1). That amendment appears to have modernised monetary penalty expressions in the Act.
• Statute Law Revision Act 1970 (10 of 1970): The short title provision (s 11) was inserted by No. 10 of 1970 s 3, as noted in the marginal note to s 11 and the compilation table entry for 1970.
• Acts Amendment (Land Administration) Act 1987 (126 of 1987): Numerous changes are attributed to this Act in the marginal notes:
  • Section 1 amended by No. 126 of 1987 s 4.
  • Section 3 amended by No. 126 of 1987 s 5.
  • Section 4 amended by No. 126 of 1987 s 6.
  • Section 5 amended by No. 126 of 1987 s 6.
  • Section 6 amended by No. 126 of 1987 s 7.
  • Section 10 inserted by No. 126 of 1987 s 9. The compilation table records commencement for these amendments as 16 September 1988 (see s 2 and Gazette reference).
• Criminal Code Act 1902 (1 & 2 Edw. VII No. 14): The compilation table records this as affecting the Act in 1902; a later note indicates deletion of section 8 by this instrument (the text marks section 8 deleted: 1 and 2 Edw. VII No. 14 s 3(2)).
• Criminal Law Amendment Act (No. 2) 1992 (51 of 1992) and Sentencing (Consequential Provisions) Act 1995 (78 of 1995): The compilation table records these Acts as part of the Act’s legislative history with respective dates and commencements (1992 assent 9 Dec 1992; 1995 assent 16 Jan 1996 with commencement 4 Nov 1996 for s 63), indicating the Act’s penalty and offence provisions were considered in the course of criminal law reform.
• Acts Amendment (Land Administration) Act 1997 (31 of 1997): Section 5 and section 10 were subsequently amended by No. 31 of 1997 s 141, with commencement recorded as 30 March 1998 (Gazette reference). The marginal notes to s 5 and s 10 show these amendments.
• Courts Legislation Amendment and Repeal Act 2004 (59 of 2004): Section 7 (injuring landmarks offence) was inserted by No. 59 of 2004 s 141, with commencement 1 May 2005 (s 2 and Gazette reference).
• Land Information Authority Act 2006 (60 of 2006): Section 5 was amended to refer to the "books of the Western Australian Land Information Authority established by the Land Information Authority Act 2006 section 5 as the ‘Avon District’" (s 5 amended: No. 60 of 2006 s 140), with commencement 1 January 2007 (Gazette reference).
• Deletions: The Act notes the deletion of sections 8 and 9 (section 8 deleted by 1 and 2 Edw. VII No. 14 s 3(2); section 9 deleted by No. 78 of 1995 s 63). The compilation table records the history of those deletions.

The compilation table stages the Act’s evolution and lists the dates of assent and commencement for the listed amending Acts and reprints, providing the statutory trail for practitioners to trace how specific sections have been modernised, inserted or deleted. Where the Act’s marginal notes say a section was "inserted" or "amended" with specific Act numbers and sections, the compilation table supplies formal assent and commencement references. The current operative text therefore reflects the cumulative effect of these amending Acts and the institutional reassignments they effected (for example, moving signature authority or linking district definitions to the Land Information Authority).

The Act’s text and compilation materials do not supply case law or reported litigation arising under the Land Boundaries Act 1841. The statute itself is explicit about evidentiary use of the record-book in suits (s 4), but the source material provided contains no judgments, authorities or references to court decisions applying or construing the Act.

What the Act does supply that bears on litigation

• Conclusive statutory evidence: Section 4 states that recorded boundaries "shall be deemed and taken to be the true boundaries" and that the record-book or a certified copy "shall and may be given in evidence of the boundaries of such lands in any suit or cause affecting the same." That statutory language creates a clear textual basis for litigants to rely upon record-book entries as authoritative evidence in boundary disputes.
• Administrative prerequisites for evidence: Because the Act conditions the legal effect on the administrative process , survey and marking, reporting, Governor-in-Council approval, signing, and Gazette publication (s 1-4) , litigation over boundaries will likely turn on whether those administrative steps were lawfully completed. Disputes in court would, on the face of the Act, hinge on facts such as whether the entry was properly signed, whether the map/plan accompanied the report, whether the Governor-in-Council approved, and whether the required Gazette notices were published (s 2-3).
• Certification and authentication: The Act provides that a record-book or certified copy signed by the Surveyor‑General or authorised land officer may be supplied "on demand without fee" and "shall and may be given in evidence" (s 4). In practice, courts would apply rules of evidence to such certified documents; the Act gives statutory backing for admissibility and for the claim that recorded boundaries are to be taken as true in suits.

Absence of reported cases in the supplied source

• The compilation table and marginal notes record amendments and deletions but do not reference any judicial decisions interpreting the Act. The supplied text therefore contains no litigation history to summarise or cite.
• Users relying on this deep dive for litigation strategy should consult external primary sources (reported cases, court databases and legal treatises) to identify any judicial authority applying or interpreting the Act; that material is not contained in the Act or in the compilation table supplied here.

In short, while the Act creates statutory evidentiary and conclusive effects for recorded boundaries and establishes administrative preconditions that would be material in litigation, the provided source does not include any case law history or examples of judicial application.

The Act contains several provisions and structural features that can lead to practical and legal pitfalls if left unexamined.

Recorded boundaries override deeds (s 4)

• The Act makes an administrative record determinative: once a boundary is entered and signed as required, it "shall be deemed and taken to be the true boundaries" regardless of former descriptions in title deeds (s 4). For landholders, this can mean that historical deed descriptions (by marks, compass bearings or assumed distances) will be superseded by the recorded description, potentially altering the practical footprint of a grant without a conventional conveyancing process. The statutory language covers original owners, heirs and assignees explicitly (s 4), so transferees are affected.

Administrative gatekeeping and timing risks (s 2-3)

• Gazette timing: The Act requires notice of intended surveys and notice of record-book entries to be published in three successive Gazettes (s 2; s 3). Practitioners must monitor Gazette publication closely; failure to comply with the three-Gazette requirement could be a ground for challenging the legal effect of a recordation.
• Approval bottleneck: The Governor-in-Council’s approval is a required precondition to recordation (s 3). That centralised approval step can create delay and concentrate discretion in the executive; the Act does not prescribe timeframes for consideration or appeals against administrative decisions.

Access and physical intervention on land (s 6)

• Authorised land officers and assistants may enter any land and take materials and erect landmarks (s 6). Landholders should note that the Act authorises physical works on land to establish landmarks. The Act provides a narrow penalty for wilful obstruction ($2-$10) which is modest on its face (s 6), and does not include express compensation or restitution mechanisms for damage to land arising from lawful entry and materials removal under the Act. If material interference occurs there may be residual civil actions outside this Act, but those are not addressed by the text.

Nominal penalty levels and enforcement scope (s 6-7)

• The monetary ranges for obstruction ($2-$10) and for injuring landmarks ($20-$100) are stated in the Act (s 6; s 7). Those amounts may appear low relative to contemporary valuations and might limit deterrence or the economic incentives for compliance. The compilation table shows amendments by currency and sentencing Acts, but the text itself retains these numerical ranges. Practitioners should confirm current penalty amounts and enforcement practice against updated statute law and regulatory practice beyond the printed text.

Avon Base Line carries historical assumptions (s 5)

• Section 5 requires that distances on the Avon Base Line be taken as the distances "originally assumed to express and contain" in the prior survey. This binds current surveys to historical assumptions, which may perpetuate past inaccuracies or misalignments rather than correcting them. For parcels in the Avon District, surveyors and purchasers must account for that statutory continuity rule when checking titles and maps.

Reliance on definitions outside the Act (s 10)

• The Act defines "authorised land officer" by reference to the Land Administration Act 1997 (s 10). That means the identity, powers and limits of the operative officer depend on a separate statute; practitioners must not assume the term’s meaning from this Act alone.

Deleted provisions (sections 8 and 9)

• Sections 8 and 9 have been deleted. If older titles or historical advice referenced those sections, their deletion may affect old expectations about remedies or processes. The compilation table indicates where deletions occurred, but the present Act does not contain those provisions.

Evidence vs absolute indefeasibility (s 4)

• The Act gives the record-book evidentiary force and declares recorded boundaries to be the true boundaries (s 4). The text does not address exceptions, errors in the survey, or mechanisms for correction of the record once entered and signed. Practitioners should note that while the Act provides conclusive language, courts may still confront factual or jurisdictional challenges (for example, if the procedural prerequisites were not met) , but any such challenges and their outcomes are not contained in the Act’s text.

No express compensation regime

• The Act authorises entry, the taking of materials and erection of landmarks but does not set out a statutory compensation scheme for landowners affected by such works (s 6). Any compensation claims would have to be pursued under general law or other statutes, which are not supplied in the Act.

These features create specific compliance and risk-management tasks for landowners, surveyors and lawyers: monitor Gazette notices, obtain certified copies of records, confirm Governor-in-Council approval, check the definition and authority of authorised land officers in the Land Administration Act 1997, and pay particular attention to parcels in the Avon District.

The Act prescribes a combination of actions for public officers and steps landowners and advisors should follow to protect rights and ensure legal compliance.

For authorised land officers and government administrators

• Follow the statutory sequence for surveys and recordation. Initiate the process by ensuring the Government direction to undertake a survey is documented (s 1), publish notice of the intended survey in three successive Gazettes (s 2), complete the marking and prepare the required map or plan and landmark descriptions, report to the Governor-in-Council for approval (s 3), and once approved enter the surveyed descriptions in the record-book and ensure both the authorised land officer and the Governor-in-Council sign the entry (s 3).
• Ensure documentary completeness and authentication. The report accompanying the entry should include the map or plan and a description of landmarks as the Act requires (s 3). Certified copies of entries must be signed by the Surveyor‑General or an authorised land officer for evidentiary effect and be issued on demand without fee (s 4).
• Observe Gazette publication requirements. Publish required notices in three successive Gazettes for both intended surveys (s 2) and recorded entries (s 3). Keep records of Gazette publication dates to show procedural compliance.
• Exercise entry powers lawfully. When entering lands under s 6 to erect landmarks or take materials, record the basis for entry and the persons assisting, and document any materials taken and works done. The Act prescribes modest penalties for obstruction, but administrative practice and other laws may influence how entry is conducted.
• For Avon District surveys, apply the historical distance rule. Ensure survey work on the Avon Base Line and parallel lines uses the formerly assumed distances as the statutory guide (s 5), and document reliance on the Land Information Authority’s books as the Act instructs.

For landowners, owners’ legal advisors and purchasers

• Monitor the Gazette. Check Government Gazettes for notices of intended surveys and notices of recorded entries in the district(s) where you hold or intend to buy land (s 2; s 3). The three‑Gazette requirement is an explicit statutory step that gives constructive notice.
• Obtain certified copies of relevant record-book entries. Section 4 requires certified copies to be issued on demand without fee. Get and retain certified copies of any entries affecting your land to verify how boundaries are recorded and to establish proof in any dispute (s 4).
• Check whether boundaries have been recorded and signed. Confirm that any recorded boundary relevant to you has been properly approved by the Governor-in-Council, entered in the record-book and signed by the authorised land officer and the Governor-in-Council as the Act requires (s 3-4). If the formalities are incomplete, the statutory conclusiveness may be challengeable on procedural grounds.
• Prepare for authorised land officer entry. If a survey is to be conducted, expect authorised land officers and assistants to enter the land, take materials and erect landmarks under s 6. Avoid wilful obstruction to the officer’s duties to prevent exposure to the forfeiture specified in s 6. Document interactions and any damage or materials taken.
• If a landmark is damaged or threatened, act promptly. Section 7 makes wilful injury or defacement of a landmark an offence with a specified penalty; report damage and seek prompt replacement or recordation of defects in the survey records where appropriate.
• For properties in the Avon District, align expectations with historical distances. If your land or intended purchase lies in the Avon District, be aware that the statute instructs surveyors to use formerly assumed distances for the Avon Base Line in subsequent surveys (s 5). That can have practical effects on parcel extent and should be checked against title expectations.
• Review the definition of "authorised land officer" in the Land Administration Act 1997. Because the Act relies on that external definition (s 10), confirm who is authorised and whether the person acting has statutory authority under the Land Administration Act 1997 before relying on their actions.

Administrative and litigation preparation

• Maintain documentary trails. For both administrators and landholders, keep copies of reports, maps, plans, Gazette notices and certified copies of record-book entries. These are the documents the Act calls out and that will be central to enforcement or challenge (s 2-4).
• Seek correction routes if procedural defects occur. The Act does not specify a correction process for erroneous recorded boundaries once signed and published; where procedural defects are apparent (for example, missing Governor-in-Council approval or Gazette publication), legal counsel should consider administrative review, judicial review or civil remedies outside this Act.
• Coordinate with the Land Information Authority and Land Administration Act frameworks. Because several operative definitions and district designations are supplied by later statutes (s 5; s 10), liaise with the relevant authorities and consult those Acts to determine the correct institutional contacts and record-keeping practices.

Following these steps will align actions with the statutory requirements set out in the Act: initiate and publicise surveys properly (s 1-3), secure formal approval and recordation (s 3-4), obtain certified copies free of fee (s 4), allow lawful entry for marking (s 6), and respect the criminal prohibition on wilful injury to landmarks (s 7).
