Land Administration Regulations 1998

The regulations implement several core operational concepts that structure Crown land administration under the Act. These are: delegation and prescribed classes; prescribed services and persons; procedural gating for land acquisition, dedication and closure; pricing and valuation controls; joint venture rules; technical survey governance; advisory panel governance; fee and cost structures; site‑specific prescriptions; and statutory cross‑references to other Acts and technical standards.

• Delegation and prescribed classes: The Minister may delegate many powers under the Act. The regulations prescribe the classes of persons to whom particular delegations may be made, and identify named officeholders and agencies by reference to other Acts (reg 3A, reg 3B). Regulation 4 adds conditions to delegations that involve conveying or transferring fee simple in Crown land, requiring either Valuer‑General advice or sale by public process or other specified pricing safeguards (reg 4).

• Prescribed services and persons: The term public utility services in the Act is fleshed out by regulation 3 to include telecommunications network services, marine navigational aid services and geocentric datum services as provided by survey marks (reg 3). Regulation 17C prescribes particular species as authorised stock for pastoral lease provisions (sheep, cattle, horses, goats, and stock kept for domestic use) (reg 17C).

• Procedural gating for acquisition, dedication, closure and mall reserves: Local governments and management bodies face detailed documentary and advertising requirements when requesting acquisition of alienated land, private roads, townsite land, or when requesting dedication or closure of roads and mall reserve creation or cancellation. These include notice and advertising obligations, sketch plans, confirmations of resolutions and compliance with relevant Act sections, requirements to consult Heritage Council and National Trust in some townsite cases, and specific publication formats including website notices (regs 5-11).

• Pricing and valuation: The Minister must obtain and have regard to Valuer‑General advice when determining or altering prices or reserve prices for Crown land (reg 12(1)). The regulations narrowly exempt certain classes of land or sales from that rule where the sale meets specified conditions, permitting sale to adjoining landowners to enable amalgamation for crime reduction, or where the market value is assessed to be less than $1,000 (reg 12(2)-(4)).

• Joint ventures and sale process: Joint ventures for developing and selling Crown land are permitted with local governments, State instrumentalities, certain adjoining landholders whose financial circumstances and standing are satisfactory, or persons selected by public tender or similar processes (reg 13). Valuer‑General advice is required before such developed land is sold (reg 13(2)).

• Survey governance and Crown property: Departmental surveyors must report doubts, discrepancies and difficulties (reg 19). Their outputs are Crown property (reg 22). Authorised land officers may require amendments and recover costs from a surveyor at fault (reg 20). The regulations allow authorised land officers to authorise alternative surveying methodologies in special cases where standard Licensed Surveyors Regulations are impracticable or disproportionate (reg 21). Where inconsistencies exist between these regulations and the Licensed Surveyors (Guidance of Surveyors) Regulations 1961, these regulations prevail (reg 23).

• Advisory panels: The regulations set the composition, quorum, voting rules, remuneration framework (for non‑departmental members), confidentiality and conflict of interest duties for panels formed under section 73 of the Act, including penal consequences for providing false or misleading information, for failing to resign when having a material personal interest, and for breaches of confidentiality (regs 24-39).

• Fees and cost recovery: Schedule 1 fixes fees for preparing documents and services, sets an assessed fee regime up to the cost of provision for certain services, and allows the Minister to waive fees in defined circumstances (reg 17, Sch 1). The rate of interest for late payment under the Act is prescribed at 10% per annum calculated daily (reg 16).

• Site and transactional carve‑outs: The regulations include several site‑specific prescriptions and transactional permissions for particular leases and reserves, for example, City Arcade Sublease G362051 (reg 5A), Collier Park Retirement Complex within Reserve 38665 (reg 5B), Perth Convention and Exhibition Centre Lease I953026 (reg 5C), Old Swan Brewery Lease I219828 (reg 5D), and Reserve 26741 (reg 5E). These carve‑outs alter the usual requirement for Ministerial consent or impose specific consistency and approval conditions for subleases and dealings.

These concepts are presented in the regulations as administratively necessary details to implement the Act. Each introduces consequential incentives and burdens: delegation rules shift decision‑making authority downwards but attach conditions (reg 4); the valuation rules create administrative checks and narrow exceptions; survey and document ownership rules centralise technical intellectual property with the Crown (reg 22); and panel rules create procedural predictability while imposing penalties for conflicts or confidentiality breaches (regs 35, 38, 39). The rest of the note draws out who bears these duties and costs, the enforcement mechanisms and practical compliance steps.

The regulations allocate roles and obligations across a set of discrete actors. The principal affected parties identified in the instrument are the Minister (and delegated officers), the Department’s chief executive officer and departmental staff (including departmental surveyors and authorised land officers), local governments and management bodies, lessees and sublessees of Crown land, advisory panel members, licensed surveyors and private surveyors, adjoining landowners, public authorities (including prescribed Commonwealth agencies), and members of the public who interact with Crown land processes.

• The Minister and delegated decision makers: The Minister retains primary decision‑making power and may delegate powers under s 9 of the Act. The regulations prescribe both the classes of persons eligible to receive certain delegations (reg 3A) and specific persons (reg 3B), including Ministers responsible for the Transfer of Land Act, officers of Main Roads, officers designated under Transfer of Land Act, and officers of the Western Australian Land Information Authority (reg 3B). When delegating powers to convey or transfer fee simple, the Minister faces conditions such as obtaining Valuer‑General advice or ensuring sale by public process or meeting reserve price thresholds (reg 4). Those conditions affect how delegates decide pricing and sale mechanism.

• Departmental executives and surveyors: The chief executive officer receives fees (Sch 1) and is the organisational counterparty for many administrative tasks. Departmental surveyors carry out authorised surveys and must notify the chief executive officer of doubts, discrepancies or difficulties (reg 19). Their surveys and documents are Crown property (reg 22). Authorised land officers can require survey amendments and recover costs from surveyors at fault (reg 20). Thus departmental technical staff are subject to reporting obligations and potential financial liability for remedial surveying.

• Local governments and management bodies: These are heavily affected. Regulations set detailed documentary, advertising and procedural requirements before local governments may request acquisition of alienated land, private roads or townsite land (regs 5-7), before requesting dedication as a road (reg 8), and before requesting closure of a road (regs 9, 9A). Local governments must include written confirmations, sketch plans, copies of submissions, and in particular cases notify the Heritage Council and National Trust for townsite abolition requests (reg 7(d)). Management bodies must follow advertising rules and supply details of existing interests when cancelling mall reserves (reg 11).

• Lessees, sublessees and adjoining landowners: The regulations affect lessees by prescribing conditions for the grant, assignment or subletting of particular leases (regs 5A-5D). Regulation 14 requires leaseholders seeking to purchase fee simple to comply with lease terms, consult local government and ensure lawful access (reg 14). Adjoining landowners are a defined class in the joint venture and sale exceptions (reg 13, reg 12(2)-(3)), and can be the permitted purchaser for certain sales intended to allow amalgamation for crime reduction, subject to conditions.

• Panels and panel members: Advisory panels appointed under s 73 must operate under the composition, quorum and conduct rules in regs 24-39. Panel members who are not officers of the Department are entitled to remuneration and allowances set by the Minister on recommendation of the Public Sector Commissioner (reg 26). Panel members face conflict of interest rules and confidentiality obligations with penalties for breaches (regs 38, 39).

• Licensed surveyors and private sector advisers: Licensed Surveyors (Guidance of Surveyors) Regulations 1961 interplay with the regulations. Where inconsistent, the Land Administration Regulations prevail (reg 23). Authorised land officers can permit different survey methodologies in special cases (reg 21), which affects professional surveying practice. Surveyors engaged privately might face cost recovery if a departmental authorised land officer requires a remedial amendment and the departmental surveyor is considered at fault (reg 20).

• The public and interest groups: The public is the recipient of statutory consultation channels set by the regulations, such as the 35‑day submission period for road closure (reg 9(1)(b)), newspaper and signpost advertising requirements for mall reserves and road closures (regs 10, 11, 9(2)), and public hearings conducted by panels (reg 36). The regulations also refer to the Heritage Council and National Trust as consultees for certain townsite abolition requests (reg 7(d)), meaning heritage interests are explicitly recognised in procedure.

• Commonwealth agencies and other statutory bodies: Regulation 17F lists Commonwealth agencies considered "public authority" for s 275A(1) of the Act, including the Australian Electoral Commission, defence services established under the Defence Act, the Australian Bureau of Statistics, Centrelink as of the 2012 amendment, and certain Commonwealth departments concerned with primary industries, quarantine and export/import controls (reg 17F). This affects how those agencies interact with Crown land governance under the Act.

Costs and decision rights are therefore concentrated: the Minister and authorised delegates retain decisive powers but conditioned by valuation and procedural requirements. Compliance burdens are concentrated on local governments, departmental surveyors, lessees and panel members, who must prepare documentary confirmations, advertise, consult, produce sketch plans and, in some cases, bear assessed fees or liability for remedial survey costs (regs 5-11, reg 20, reg 17, Sch 1). The practical consequence is an administrative process that centralises technical control with the Department and Minister while embedding documentary and consultation obligations across local government and private actors.

The regulations turn statutory powers into concrete duties and rights for specified actors. Below are the principal duties, accompanied by the relevant regulation references, and the rights or discretions they create.

Duties on the Minister and delegates

• Obtain and have regard to Valuer‑General advice before determining or altering prices of Crown land (reg 12(1)). Right: the Minister retains discretion, but the regulation makes Valuer‑General advice a required input.
• When delegating powers to convey or transfer fee simple, ensure the delegation is subject to conditions: obtain Valuer‑General advice (reg 4(a)), sell by public process, ensure private treaty meets 90% of reserve price derived from a failed auction, or follow an advisory panel recommendation (reg 4(b)(i)-(iii)).
• Enter joint ventures only with prescribed classes of other joint venturers: local government or State instrumentalities, adjoining freehold holders with satisfactory financial and professional standing, or parties determined by public tender or public process (reg 13(1)). Duty: obtain and consider Valuer‑General advice before selling developed joint venture land (reg 13(2)).

Duties on local governments and management bodies

• Before requesting acquisition of alienated land designated for public purpose, provide the Minister with a written description of the proposed future disposition and confirm compliance with s 52(3) of the Act (reg 5).
• Before requesting acquisition of private roads, provide confirmations of resolution, reasons, sketch plans for future disposition, evidence of steps to identify persons to be notified, and copies of submissions and comments (reg 6(1)(a)-(f)).
• For townsite abolition acquisition requests, comply with advertising requirements within the townsite, provide the Minister with the proposed future disposition, and notify the Heritage Council and National Trust (reg 7).
• For dedication of land as road, include resolution confirmation, copies of applications where applicable, descriptions of public use and construction for private roads, submissions and comments, and other relevant information, and confirm compliance with s 56(2) (reg 8).
• For permanent road closure requests, publish notice of motion and invite submissions for a 35‑day submission period via newspaper or local government website, not pass the resolution until after the submission period ends and submissions considered, and include specified documentation with the Ministerial request (reg 9(1)-(5)). A modified regime applies where the road was reserved but never constructed (reg 9A).
• For mall reserve creation and cancellation, advertise in local newspaper and by notice on the land, include copies of advertisements, sketch plans, and details of interests granted in the mall reserve where applicable, and confirm compliance with Act sections (regs 10, 11).

Duties on departmental surveyors and authorised land officers

• Departmental surveyors must notify the chief executive officer of any doubts about the survey, discrepancies in existing surveys or plans, difficulties encountered, and matters adversely affecting the Crown as soon as practicable (reg 19).
• Authorised land officers may require amendments or additional information within two years after a survey was lodged, arrange remedial work if not provided, and require the surveyor at fault to pay the costs of remediation, and recover costs as a debt if unpaid (reg 20).
• Authorised land officers may authorise alternative surveying methodology where the standard Licensed Surveyors (Guidance) Regulations are disproportionate, impracticable or special circumstances exist (reg 21). The officer may vary or revoke that authorisation (reg 21(2)).

Duties on panel members and participants

• Panels must have at least three members, or more if the Minister thinks fit, with one member appointed chairperson (reg 25).
• A quorum is all members (reg 31). Decisions are by majority but the chair has the casting vote in the event of a tie (reg 32).
• Panels must take reasonable steps to notify persons who may have an interest and accept submissions, give reasonable opportunity to make submissions to those who notify the chairperson, and must not accept false or misleading information with a $1,000 penalty (reg 35).
• Members with a material personal interest must resign as soon as possible and take no further part; penalty $1,000 (reg 38). Confidentiality obligations apply to information obtained during membership, with a $1,000 penalty for unauthorised disclosure (reg 39). Public hearings must be publicised and disturbance during hearings attracts a $500 penalty (reg 36).

Duties on lessees seeking purchase and applicants for Crown land transactions

• An applicant to purchase fee simple under s 89 must comply with all lease terms (except those specified by the Minister), consult local government(s), and ensure lawful access to the land or amalgamated land (reg 14). These are preconditions to approval.

Duties on the Minister to provide fee relief or determination rights

• The Minister may waive certain fees, including survey fees where the survey is required for roads through Crown land, and other fees the Minister considers in the public interest to waive (reg 17(2)). For many services fees are assessed by the Minister but may not exceed the cost of providing the service (Sch 1 item 8).

Rights and discretions

• The Minister has discretion to determine procedures or to use advisory panels and to delegate powers to prescribed persons, subject to the conditions set out in the regulations (regs 3A, 3B, 4).
• Authorised land officers have discretionary power to permit alternative survey methods in prescribed circumstances (reg 21).
• The Minister may enter into joint ventures but only with prescribed partner categories or by public tender, and must obtain Valuer‑General advice before sale (reg 13).
• Panel chairs and panels have discretion over procedural matters subject to the regulations and ministerial directions (reg 37).

The regulations therefore create a framework of obligations that privilege technical valuation input, documentation, consultation and ministerial oversight, while giving authorised officers and the Minister discretion in how surveys are undertaken, to whom powers are delegated, and how fees are assessed or waived.

Enforcement mechanisms in the regulations are a mix of civil recovery, administrative sanctions, monetary penalties and procedural constraints. The key enforcement points and penalties are:

Monetary penalties and criminal liability

• False or misleading information to a panel: A person must not provide information to a panel that the person knows to be false or misleading in a material particular or likely to deceive in a material way. The penalty is $1,000 (reg 35(4)). This is framed as a statutory fine rather than a criminal conviction scheme in the text; the instrument sets the monetary amount but the enforcement route is not specified further in the regulations supplied.
• Disturbance at a public hearing: Persons must not cause a disturbance during a public hearing. Penalty: $500 (reg 36(3)). The chairperson may remove disturbance‑causing persons (reg 36(4)).
• Conflict of interest for panel members: A member who has a material personal interest must resign and abstain from proceedings; penalty for non‑compliance is $1,000 (reg 38).
• Confidentiality: A person who is or has been a member must not disclose or use information obtained in membership except for permitted purposes; penalty is $1,000 (reg 39).

Civil recovery and debt actions

• Costs of remedial survey work: If a departmental surveyor is required to amend a survey and does not do so within the required time, the authorised land officer may arrange for another surveyor to make the amendment and require the surveyor at fault to pay the costs (reg 20(2)(b)). If the surveyor fails to pay, the authorised land officer may recover the costs as a debt due to the Crown by action in a court of competent jurisdiction (reg 20(3)). This is a direct civil enforcement mechanism that creates professional and financial exposure for surveyors.

Administrative sanctions and removal from office

• The Minister may remove a panel member for neglect or incapacity to perform functions properly (reg 27(4)). This is an administrative sanction on panel membership.
• The Minister may waive fees or choose not to, thereby exercising administrative control over financial burdens (reg 17(2)).

Procedural enforcement

• The regulations prescribe mandatory procedural steps: for example, local governments must not pass a resolution to request road closure until the submission period has ended and submissions considered (reg 9(3)). This creates an enforceable procedural precondition to Ministerial requests. While the regulations do not specify a penalty for non‑compliance with this precondition, failure to comply would implicate the validity of subsequent Ministerial action and could be challenged through administrative review or litigation under avenues outside these regulations.

Other enforcement mechanisms implicit in the instrument

• The Minister and authorised land officers are empowered to require information, to issue notices and to make decisions conditioned upon documentary confirmations. Non‑compliance with required documentary inputs can result in refusal to process a request or referral back to the local government or applicant. The regulations specify what must be included in Ministerial requests (regs 5-11), and omission of required documents will likely prevent the Minister from exercising the relevant powers lawfully.
• Fees are payable to the chief executive officer and the Schedule lists amounts that must be paid for specified services (reg 17, Sch 1). Non‑payment mechanisms are not set out in the regulations beyond the ability to recover survey remedial costs as a debt (reg 20(3)), but non‑payment of required fees in practice will impede transactional processing.

Distribution of enforcement burdens

• Penalties specified in the regulations fall principally on individuals providing false information to panels and on panel members who breach conflict or confidentiality duties (regs 35, 38, 39). Professional surveyors have a distinct civil exposure for the costs of remediation if found at fault (reg 20).
• Local governments bear procedural compliance burdens with specified documentary and advertising steps; failure to follow them will impede the Minister’s acceptance of a request and could lead to administrative rejection rather than a monetary fine, according to the text of the regulations.

In sum, enforcement is a mixture of financial penalties for specified conduct in panel contexts, civil debt recovery where remedial survey costs are payable, administrative removal for non‑performing panel members, and procedural preconditions that can functionally block or delay requests from local governments and applicants. The regulations centralise technical control and create direct professional liability exposure for departmental surveyors while relying primarily on administrative rather than criminal enforcement for procedural breaches.

The regulations expressly reference a network of other statutes and instruments. These cross‑references either identify other offices and agencies for delegation and consultation, incorporate technical standards, or establish precedence where regulatory conflict may arise. The principal interactions recorded in the text are:

Commonwealth Acts and national standards

• Telecommunications Act 1997 (Cth): The term telecommunications network used in regulation 3(1) is given the same meaning as under the Telecommunications Act 1997 (reg 3(1)). This ties the definition of public utility services in the Act to Commonwealth law where telecommunications services are concerned (reg 3(2)(a)).
• National Measurement (Recognized‑Value Standard of Measurement of Position) Determination 2017 (the 2017 Determination): Regulation 17A(1) defines the Geocentric Datum of Australia 2020 by reference to that Commonwealth Determination and prescribes the Geocentric Datum of Australia 2020 for the purposes of s 5A(1) of the Act (reg 17A). This aligns Crown land positional measurement standards with the national geodetic reference frame.

State Acts and bodies

• Transfer of Land Act 1893: Regulation 3B prescribes the Minister responsible for the Transfer of Land Act and officers designated under Part I of that Act as persons for the purposes of s 9(1)(d) delegations (reg 3B).
• Main Roads Act 1930: The Commissioner and officers of Main Roads are prescribed persons for delegation purposes (reg 3B).
• Conservation and Land Management Act 1984: The Minister responsible for that Act and relevant public service officers are prescribed for delegation purposes (reg 3B).
• Land Information Authority Act 2006: Officers of the Western Australian Land Information Authority are prescribed (reg 3B).
• Town Planning and Development Act 1928: Regulation 12(3)(a) excludes certain right of way or pedestrian access way land that was vested under s 20A of the Town Planning and Development Act 1928 from the general Valuer‑General requirement where specific sale conditions apply (reg 12(3)(a)). The note indicates this Act was repealed by the Planning and Development (Consequential and Transitional Provisions) Act 2005, which the compilation notes reflect, but the regulation continues to refer to the historical framework for certain lands.
• Retirement Villages Act 1992: Regulation 5B defines “residential premises under a retirement village scheme” by reference to s 3(1) of the Retirement Villages Act when prescribing conditions for Reserve 38665 transactions (reg 5B).
• Heritage of Western Australia Act 1990 and National Trust of Australia (W.A.) Act 1964: Regulation 7 requires written notice to these bodies when a local government seeks acquisition of alienated townsite land proposed for abolition (reg 7(d)).
• Transfer of Land Act 1893 (again): Regulation 12(3)(b) references s 167A(2)(b) of the Transfer of Land Act in excluding certain land from the Valuer‑General requirement under specified sales conditions (reg 12(3)(b)).

Survey and licensing instruments

• Licensed Surveyors Act 1909 and Licensed Surveyors (Guidance of Surveyors) Regulations 1961: The Part 3 definitions rely on the Licensed Surveyors Act 1909 for the meaning of authorised survey (reg 18). Regulation 23 provides that where there is inconsistency between these regulations and the Licensed Surveyors (Guidance of Surveyors) Regulations 1961 in relation to how a survey is to be carried out, these regulations prevail (reg 23). Regulation 21 allows authorised land officers to authorise alternative methodologies to those required by the Licensed Surveyors (Guidance) Regulations in special cases (reg 21).

Other Acts prescribed for s 18(8)(b)(ii)

• The regulations expressly prescribe the Carbon Rights Act 2003, Local Government Act 1995, and Tree Plantation Agreements Act 2003 for the purposes of s 18(8)(b)(ii) of the Act (reg 17B). That determines which Acts the Minister may consider when deciding particular Crown land transaction approvals under s 18(8)(b)(ii).

Interaction modalities and hierarchy

• Precedence of the regulations over the Licensed Surveyors guidance: reg 23 explicitly resolves conflict by giving these regulations primacy where the method for carrying out surveys differs.
• Conditional carve‑outs and exceptions: Several provisions create exceptions to general rules set by the Act. For example, reg 12(1) requires Valuer‑General advice, but regs 12(2)-(4) carve out narrowly defined categories where that requirement does not apply. Those exceptions refer to circumstances and terms in other Acts (Transfer of Land Act and Town Planning Act contexts) and to specific policy rationales such as amalgamation for the purpose of reducing crime or antisocial behaviour (reg 12(2)(b), (3)(e)).
• Consultation and heritage obligations: reg 7(d) mandates notification to specific heritage bodies, creating a statutory overlay of heritage consultation for townsite acquisitions that interacts with the Heritage of Western Australia Act and National Trust roles.

Overall, the regulations embed cross‑legal technical standards (geodetic datum), align definitions with Commonwealth legislation for telecommunications, incorporate licensing rules for surveying but reserve the right to depart where necessary, and prescribe a set of other State Acts whose administrative regimes must be taken into account for certain Crown land decisions. The practical effect is an administrative architecture that requires officers and applicants to be attentive to a lattice of external statutory standards and local heritage consultative duties in addition to the Act and these regulations.

The regulations have been subject to numerous amendments since their original publication, many of which add new regulatory instruments, define new prescribed persons, incorporate technical standards and adjust fees. The compilation table and marginal notes supply the sequence and timing of those amendments. Key chronological milestones and notable insertions from the provided source are:

• Original instrument: Land Administration Regulations 1998, published 27 March 1998, commenced 30 March 1998 (r 2 and Gazette references). This established the base regulatory framework.

• 1998 amendment: Land Administration Amendment Regulations 1998 (20 Nov 1998) inserted regulation 3A prescribing classes of persons for delegations under s 9(1)(d) (reg 3A).

• 2000-2004 series: Multiple amendment regulations in 2000, 2001, 2002 and 2004 adjusted fees, inserted and revised procedural rules, and addressed administrative details. Regulation 4 had an amendment in 2001 (Gazette 10 Apr 2001) that adjusted delegation conditions. Regulation 17D (longer period with final day 17 December 2004) was inserted by an amendment (24 Nov 2004).

• 2003-2007 updates: Regulation 3B was inserted in 2003 and subsequently amended in 2004, 2006 and 2013 to update the list of prescribed persons for delegation purposes, adding officers from Main Roads, Transfer of Land and the Land Information Authority (reg 3B). Amendments in 2007 and 2008 updated fees (Schedule 1) and other administrative provisions.

• 2009 targeted updates: A batch of site‑specific transactional prescriptions were added by the Land Administration Amendment Regulations (No. 3) 2009 (Gazette 18 Sep 2009), which inserted regs 5A through 5D and 5E prescribing certain sublease and transaction conditions for named leases and Reserve 26741 (regs 5A-5E). These are narrow, parcel‑specific regulations concerning City Arcade, Collier Park Retirement Complex, Perth Convention and Exhibition Centre, Old Swan Brewery, and Reserve 26741.

• 2011-2013 and 2015 amendments: The regulations were amended to reflect Public Sector Reform consequential changes (2011), updates to fees and procedural changes up to 2015.

• 2016 amendments: Regulation 17E (circumstances prescribed, including Jolimont land, Knutsford land, Mosman Park land, Narrogin land) inserted 6 Sep 2016, authorising the Minister to exercise section 75(7a) powers for applications by named applicants in respect of specified lands.

• 2019 insertions: Regulation 15 was inserted 28 June 2019 to prescribe phasing in of increased rents for pastoral leases determined in 2019 relative to 2014, specifying stepped increases if the 2019 determined rent exceeded specified percentages of the 2014 rent (reg 15). Several Schedule 1 fee updates occurred around the same period.

• 2020 update: Regulation 17A prescribing the Geocentric Datum of Australia 2020 was inserted (SL 2020/64) and commenced 1 July 2020, aligning Crown land positional reference to the national datum.

• 2021-2023 amendments: Series of amendments updated fee items, prescribed persons, and added operational clarifications. Regulation 17E and 17F (Commonwealth agencies) were amended or inserted in this period. Reprints and amendments in 2021 and 2022 adjusted various administrative details.

• 2024 targeted amendments: SL 2024/119 (26 June 2024) amended or inserted multiple provisions, including updating regulation 3A (amended r 4), expanding reg 3B (amended r 5), and adding regs 9, 9A and 9B inserted as part of SL 2024/119 r 6, which prescribe detailed requirements for road closure requests by local governments and Ministerial initiative advertising (regs 9, 9A, 9B). These 2024 insertions materially raise procedural detail for road closure and advertising (notably the 35‑day submission period requirement in reg 9(1)(b)). SL 2024/115 also amended Schedule 1 and other items.

• 2025 change: SL 2025/108 (25 Jun 2025) appears in the compilation table as an amendment to Schedule 1 and commenced 1 July 2025 for regulations other than r 1 and 2. The Schedule shows continuous fee updates through to that date.

The amendments reveal recurring themes:

• technical modernisation (Geocentric Datum 2020, survey methodology flexibility),
• parcel‑specific transactional exceptions (regs 5A-5E, 17E),
• administrative clarification of delegation pathways and prescribed persons (regs 3A, 3B),
• more detailed public notification and consultation procedures for road closures and mall reserves (regs 9, 9A, 9B, 10, 11),
• periodic fee adjustments and the shift towards assessed, cost‑capped fees for certain services (Sch 1 item 8).

The compilation table included in the source provides a full chronological list of amendment instruments, publication details and commencements. Practitioners should consult that table for precise commencement dates of specific amendments when assessing the regulatory regime applicable to past transactions.

The provided legislative text and compilation notes do not cite any judicial decisions, administrative tribunal determinations or case law construing the Land Administration Regulations 1998 or its provisions. The instrument’s text names no cases. Therefore, within the materials supplied, there is no litigation history to summarise.

Practitioners seeking case law on how courts have interpreted provisions of the Land Administration Act 1997 or these Regulations will need to consult legal databases, court judgements and administrative review decisions outside the provided text. The absence of cases in the regulation document itself means that interpretive guidance must be drawn from external authorities where disputes about valuation requirements, procedural compliance by local governments, ministerial delegations or surveyor liabilities have arisen.

The regulations contain several specific features that can cause operational or legal surprises if not noted. These are concrete procedural, evidentiary and liability risks, and narrow exceptions that depart from general expectations under the Act. Below are the salient “gotchas” with precise references.

1. Valuer‑General requirement with narrowly drawn exceptions (reg 12)

• General rule: the Minister must obtain and have regard to Valuer‑General advice when determining or altering prices or reserve prices (reg 12(1)).
• Exceptions: narrow classes of land such as a former private road, rights of way vested under the Town Planning and Development Act or certain pedestrian accessways can be sold to an adjoining owner without Valuer‑General advice if the sale is to allow amalgamation for reduction of crime or antisocial behaviour and other strict conditions are met (reg 12(2)-(3)). Practice risk: users expecting a uniform valuation safeguard may be surprised that sales aimed at crime reduction are exempted from standard valuation oversight; ensure each element of the exception is clearly satisfied and documented before bypassing Valuer‑General advice.

2. Delegations of fee simple conveyances subject to valuation or public process (reg 4)

• If the Minister delegates conveyance powers, the delegation must be subject to conditions including obtaining Valuer‑General advice, sale by public auction/tender, private treaty at not less than 90% of a failed auction reserve price, or by advisory panel recommendation (reg 4). Gotcha: delegates cannot act freely to dispose of fee simple without having these conditions met; a delegate’s sale that departs from these constraints risks invalidity or administrative challenge.

3. Local government procedural strictness and documentary checklist (regs 5-9, 10-11)

• Many Ministerial requests from local governments require specific documents: written confirmation of resolutions, dates of resolutions, sketch plans, copies of submissions and comments, confirmations of compliance with relevant Act provisions, and in townsite abolition cases, notices to the Heritage Council and National Trust (regs 5-8, 11). Gotcha: omission of a single listed item may render a request non‑compliant and delay or prevent Ministerial action.

4. Mandatory advertisement formats and timing, including a 35‑day submission period for road closure (reg 9)

• The local government must publish notice of motion and invite submissions for 35 days, and cannot pass the resolution to request closure until the submission period has ended and submissions considered (reg 9(1)-(3)). Gotcha: differing end dates for multi‑platform publication default to the latest end date (reg 9(4)). Failure to follow this exact timing will invalidate the precondition.

5. Road closures with special treatment when land never had a road (reg 9A)

• A modified, lighter documentation regime applies for roads that were reserved or dedicated but never used or constructed as roads (reg 9A). Gotcha: local governments must confirm the land is of that category; there is no automatic waiver , evidence will be required.

6. Departmental surveyor reporting and Crown ownership of survey outputs (regs 19, 22)

• Departmental surveyors must report doubts and discrepancies promptly (reg 19). All documents created by departmental surveyors are Crown property (reg 22). Gotcha: surveyors (including departmental employees) do not retain intellectual property rights to their surveys and notes created in the course of surveys, which affects commercial reuse, archiving and client expectations.

7. Liability for survey remediation costs (reg 20)

• If a departmental surveyor is at fault and does not amend a survey within the time specified, an authorised land officer may commission another surveyor and require the surveyor at fault to pay remediation costs; if unpaid, costs may be recovered as a debt due to the Crown (reg 20(2)-(3)). Gotcha: this creates direct financial risk for surveyors employed or engaged by the Department and could impact professional indemnity considerations.

8. Authorised land officer’s power to relax standard survey methods (reg 21)

• Alternative methodologies can be authorised where the Licensed Surveyors guidance is disproportionate or impracticable (reg 21). Gotcha: departures from standard practice may invite challenge from third parties who rely on conventional survey accuracy; make sure reasons for the alternative are documented.

9. Panel quorum is all members (reg 31)

• A quorum is defined as all members of the panel, not a simple majority. Gotcha: if a panel has three members and one is absent, no meeting can lawfully proceed. This is a practical procedural bottleneck. While voting requires a majority and the chair has a casting vote in ties, that mechanism is only relevant when a meeting has a quorum, meaning full attendance is required.

10. Conflict of interest and confidentiality penalties (regs 38, 39)

• Panel members must resign on acquiring a material personal interest and must not disclose information obtained during membership except in limited circumstances, both breaches attracting $1,000 penalties. Gotcha: the threshold for “material personal interest” is strict and immediate resignation is required once facts come to the member’s knowledge.

11. Fees and assessed cost cap (reg 17, Sch 1)

• Some services are charged at set amounts (e.g., a simple document $214, moderate $824, complex $1,505), while other services are assessed by the Minister but capped at the cost of providing the service (Sch 1 item 8). Gotcha: applicants should budget for assessed fees and note the Minister’s discretion to waive fees in the public interest or for surveys required for roads through Crown land (reg 17(2)). Fee schedules change frequently; consult the latest Schedule when preparing applications.

12. Phased pastoral rent increases (reg 15)

• Pastoral leases with 2019 determined rents exceeding 120% of the 2014 rent are subject to phased increases across 2019-2021, with different steps depending on the percentage increase. Gotcha: leaseholders facing substantial rent increases need to check which bracket applies and note that the regulation fixes the timetable.

13. Narrow site‑specific permissions (regs 5A-5D, 17E)

• Several regulations apply only to named leases, reserves or land parcels. Gotcha: these carve‑outs are narrow; check the precise identifiers (e.g., Sublease G362051, Lease I953026, Lease I219828) and the consistency requirements for subleases. Misidentifying a site may lead to incorrect assumptions about the need for Ministerial consent.

14. Survey rules prevail over Licensed Surveyors guidance (reg 23)

• Where inconsistency exists, these regulations override the Licensed Surveyors (Guidance of Surveyors) Regulations 1961. Gotcha: surveyors should reconcile directives across instruments and document why a particular regulatory mandate was followed.

These pitfalls point to documentary discipline, strict timing, and attention to the narrow text of exceptions as essential to avoiding procedural invalidity and unexpected financial liability. Practitioners should use checklists keyed to the relevant regulation numbers when preparing Ministerial requests, survey lodgements and panel materials.

Below is a practical, regulation‑numbered compliance checklist and tactical guidance for the key actors identified in the regulations: the Minister/delegates, authorised land officers and departmental surveyors, local governments and management bodies, lessees and applicants, panel members, and surveyors. Follow the cited provisions; where discretion is permitted, document why it was exercised.

For Ministers and delegates

• Delegations: If delegating any power to convey or transfer the fee simple, ensure the delegation document records the required conditions in reg 4. Either secure Valuer‑General advice on market value (reg 4(a)) or document the sale method (public auction, public tender, other public process) or demonstrate that a private treaty meets the 90% reserve threshold or follows an advisory panel recommendation (reg 4(b)(i)-(iii)).
• Valuation: Before determining or altering Crown land prices, request Valuer‑General advice and retain written evidence of having received and considered it (reg 12(1)). If you intend to rely on an exemption in regs 12(2)-(4), create a compliance memorandum that sets out how each element of the exception is satisfied (e.g., confirmation of local government request, purpose of sale, identity of purchaser, and the less‑than‑$1,000 market value threshold where invoked).
• Joint ventures: When proposing a joint venture, confirm the counterparty fits reg 13(1)(a), (b) or (c) and assess an adjoining owner’s financial circumstances and professional standing in a documented due diligence file (reg 13(1)(b)). Before sale of jointly developed land, obtain and record Valuer‑General advice (reg 13(2)).

For authorised land officers and departmental surveyors

• Survey reporting: Departmental surveyors must file written notice with the chief executive officer promptly on any doubts, discrepancies, difficulties or matters adversely affecting the Crown (reg 19). Keep contemporaneous field notes and a traceable chain of custody for all survey outputs, these are Crown property (reg 22).
• Amendments and cost recovery: If an authorised land officer issues a written notice under reg 20(1) requiring amendments or additional information, set a clear deadline and document the surveyor’s response. If a surveyor does not comply, the authorised land officer may commission remedial work and require the surveyor at fault to pay; document steps for cost recovery and preserve evidence to support a debt claim if necessary (reg 20(2)-(3)).
• Alternative methodology: Where a different survey method is warranted under reg 21, issue a written authorisation recording the factual basis (value considerations, impracticability, or special circumstances), the scope of the deviation, and any conditions. Record review and revocation rights (reg 21(2)).

For local governments and management bodies

• Acquisition, dedication and closure requests: Use the regulation checklists as filing templates. For acquisition of alienated land (reg 5), include a written description of the proposed future disposition and confirmation of compliance with s 52(3) of the Act. For private roads (reg 6), include resolution confirmation with dates, reasons, sketch plans of proposed disposition, evidence of steps to identify persons to be notified, submissions and comments, and confirmation of compliance with s 52(3). For townsite acquisitions (reg 7), follow reg 6’s document list plus local advertising inside the townsite and send written notice to the Heritage Council and National Trust (reg 7(b), (d)).
• Road closure requests: Publish a notice of motion and invite submissions for a 35‑day period in a newspaper circulating in the district and/or on the local government’s website (reg 9(1)-(2)). Do not pass a resolution to request closure until the submission period has ended and submissions have been considered (reg 9(3)). Where the land was reserved but never used as a road, use the modified regime in reg 9A and include statutory confirmations about the land’s status.
• Mall reserves: Advertise as required in a newspaper and by notice on the land, include copies of the advertisement, provide a sketch plan and confirm regulatory compliance when sending requests to the Minister (reg 10(1)-(2)). For cancel‑mall requests, also include written details of any leases, subleases, licences or mortgages over the mall reserve (reg 11(2)(c)).

For lessees and applicants to purchase fee simple or obtain options under s 89

• Comply fully with lease terms except those waived by the Minister, consult the local government within whose district the land sits (reg 14(d)), and document lawful access arrangements (reg 14(e)(i)-(ii)). File all consultation minutes and evidence of access rights as part of the Ministerial application package.

For panel members and participants

• Membership procedures: Ensure panel appointments specify term of office and whether the term expires when the panel finishes advising (reg 27(1)-(2)). Non‑departmental members should seek clarity on remuneration and allowances, which the Minister sets on recommendation from the Public Sector Commissioner (reg 26).
• Quorum and meetings: Recognise that quorum is all members (reg 31). Plan for full attendance well in advance. Use telephone or video links only when every member can communicate instantaneously at all times during the meeting (reg 34).
• Conflict of interest and confidentiality: If a material personal interest arises, resign promptly and do not participate further to avoid the $1,000 penalty (reg 38). Treat all panel business information as confidential save for authorised uses (reg 39). For submissions, verify material accuracy because providing false or misleading information carries a $1,000 penalty (reg 35(4)).

For licensed surveyors and private sector advisers

• Licensing interaction: Be aware that these regulations prevail over the Licensed Surveyors (Guidance of Surveyors) Regulations where inconsistent (reg 23). If authorised land officers permit alternative methodologies, document the factual justification (reg 21).
• Professional exposure: Understand the remediation cost risk under reg 20, particularly where departmental surveys are involved. Consider professional indemnity coverage and documentation practices to record compliance with survey instructions and notices.

For anyone preparing fee payments and documents

• Fees and waivers: Check Schedule 1 for current fees (Sch 1). For services that are assessed by the Minister, expect fees up to the cost of providing the service and request a fee estimate where possible (Sch 1 item 8). If public interest grounds apply, consider seeking a Ministerial waiver (reg 17(2)). Retain receipts and fee waiver requests in the file.

Record‑keeping and operational practices common to all actors

• Use regulation‑by‑regulation checklists when assembling Ministerial requests and survey lodgements. Keep dated copies of newspaper advertisements, website notices and signpost placements for the required statutory periods (regs 9, 10, 11).
• Where discretion is exercised (e.g., alternative survey method, Valuer‑General exemption, fee waiver), prepare a short, evidence‑based decision memorandum that cites the relevant regulation and articulates the factual basis for the decision. This supports administrative review and defends against later challenges.
• For site‑specific rules (regs 5A-5D, 17E), verify the exact identifiers (sublease/lease numbers, lot and plan numbers, Certificate of Title references) before assuming applicability. Transactions involving these sites require compliance with the special conditions in those regulations.

Following these steps, with the specified citations kept in the working file, will materially reduce risks of procedural rejection, administrative reversal or civil recovery actions under the regulations.
