#### 67 Appeal against failure to entertain claim for compensation 67 Appeal against failure to entertain claim for compensation > > (1) A person who has not been given a compensation notice and whose claim for compensation under this Part is rejected (or taken to be rejected) may appeal to the Land and Environment Court against the rejection of the claim. > > > (2) Any such appeal must be lodged within 90 days after the rejection of the claim. > > > (3) If any such appeal is duly lodged, the Land and Environment Court is to hear and dispose of the person’s claim for compensation. > > > (4) A person who does not lodge an appeal within the 90-day period may nevertheless lodge an appeal under this section, but the Land and Environment Court is not to hear and dispose of the person’s claim for compensation unless satisfied that there is good cause for the person’s failure to lodge the appeal within that period.
