#### 46 Claim for compensation by person not offered compensation 46 Claim for compensation by person not offered compensation > > (1) A person who has not been given a compensation notice may nevertheless lodge with an authority of the State a claim for compensation under this Part. > > > (2) If the authority of the State considers that the person is entitled to compensation, the authority is to give the person a compensation notice. Otherwise, the authority is to reject the claim by notice in writing given to the person. > > > (3) A claim for compensation under this section is taken to have been rejected if the authority of the State has not dealt with the claim within 60 days after receiving the claim. However, the authority of the State is not precluded from giving the person a compensation notice after that time.
