97 Valuer to make declaration S. 97(1) amended by Nos 91/1994 s. 36(5)(b), 94/2009 s. 32(4), 38/2017 s. 38. (1) Before a person who holds the qualifications or experience specified under section 13DA(2) of the **Valuation of Land Act 1960** enters upon the duties of making a valuation for the Tribunal or the Court under section 96(1) the person who holds the qualifications or experience specified under section 13DA(2) of the **Valuation of Land Act 1960** must make and subscribe a statutory declaration that the person who holds the qualifications or experience specified under section 13DA(2) of the **Valuation of Land Act 1960** has no interest directly or indirectly in the land in question and that the person who holds the qualifications or experience specified under section 13DA(2) of the **Valuation of Land Act 1960** will personally make an impartial and true valuation. S. 97(2) repealed by No. 6/2018 s. 68(Sch. 2 item 76). (3) The nomination under section 96, and the declaration under this section, must be annexed to the valuation. (4) All the expenses of and incidental to a valuation under this section must be borne by the Authority. S. 98 amended by No. 91/1994 s. 21(a), substituted by No. 52/1998 s. 311(Sch. 1 item 47.17).
