S. 96(1) amended by No. 38/2017 s. 37(2).
(1) Upon application by the Authority to the Tribunal or the Court and upon such proof as is satisfactory that any person interested in land—
(a) is by reason of absence from Victoria prevented from entering into negotiations with the Authority; or
(b) cannot after diligent inquiry be found—
the Tribunal or the Court—

(c) must nominate a person who holds the qualifications or experience specified under section 13DA(2) of the **Valuation of Land Act 1960** to determine the amount of compensation due to that person in respect of that person's interest; or
(d) may make such order or give such other directions as to the manner in which the compensation is to be determined as it thinks fit.
(2) The compensation must be determined in accordance with this Act.
