17 Payment into trust fund by promoter
[Section 17 Amended by No. 31 of 2019, s. 10, Applied:01 Jan 2020] If a notice to treat has been served on an owner of subject land by an acquiring authority that is a promoter and that authority is proposing to take that land, or a part of the land, the acquiring authority must, before gazetting a notice of acquisition in respect of that land or part, as the case may be –
(a) [Section 17 Amended by No. 31 of 2019, s. 10, Applied:01 Jan 2020] obtain from the Valuer-General an estimate of the amount of compensation that is likely to be payable in respect of that land or part; and
(b) [Section 17 Amended by No. 4 of 2017, Sched. 1, Applied:01 Jul 2019] deposit that amount with the Treasurer to be kept in an account in the Public Account.
