sec.96 Grounds for termination
Each of the following is a ground for directing the termination of an agency agreement or the appointment of a keno subagent— the appointed agent is not, or is no longer, a suitable person to be an appointed agent; a business or executive associate of the appointed agent is not, or is no longer, a suitable person to be associated with an appointed agent’s operations; the appointed agent has been convicted of an offence against this Act or a gaming Act; the appointed agent has been convicted of an indictable offence; the appointed agent has contravened a provision of this Act (being a provision a contravention of which does not constitute an offence against this Act). Also, it is a ground for directing the termination of an agency agreement if the keno agent is not, or is no longer, a person who is eligible to be a keno agent. For forming a belief that the ground mentioned in subsection (1) (a) exists, the chief executive may have regard to the following issues— the appointed agent’s character; the appointed agent’s financial position and background; the appointed agent’s general suitability to act as an appointed agent. For forming a belief that the ground mentioned in subsection (1) (b) exists, the chief executive may have regard to the business or executive associate’s character and financial position and background.
