sec.170 Production or display of identity card

In exercising a power under this Act in relation to a person, an inspector must— produce the inspector’s identity card for the person’s inspection before exercising the power; or have the identity card displayed so it is clearly visible to the person when exercising the power. However, if it is not practicable to comply with subsection (1) , the inspector must produce the identity card for the person’s inspection at the first reasonable opportunity. For subsection (1) , an inspector does not exercise a power in relation to a person only because the inspector has entered a place as mentioned in section 172 (a) or (c) . s 170 (prev s 171A) ins 2004 No. 21 s 81 renum 2005 No. 12 s 88 sch (sec.170-ssec.1) In exercising a power under this Act in relation to a person, an inspector must— produce the inspector’s identity card for the person’s inspection before exercising the power; or have the identity card displayed so it is clearly visible to the person when exercising the power. (sec.170-ssec.2) However, if it is not practicable to comply with subsection (1) , the inspector must produce the identity card for the person’s inspection at the first reasonable opportunity. (sec.170-ssec.3) For subsection (1) , an inspector does not exercise a power in relation to a person only because the inspector has entered a place as mentioned in section 172 (a) or (c) .

• (a) produce the inspector’s identity card for the person’s inspection before exercising the power; or
• (b) have the identity card displayed so it is clearly visible to the person when exercising the power.
