37 Application to Court for order for destruction (1) At any time after the seizure of kava under this Act, the Director or an authorised officer may apply to the Court for an order for the forfeiture to the Territory and the destruction of the kava. (2) On hearing the application, the Court may make an order that the kava is to be retained or that the kava is forfeited to the Territory and is to be destroyed.
