Justices of the Peace Act 2005

Appointment and discretion: The Attorney‑General appoints ordinary justices by Gazette notice (s 4(1)). Appointments are for terms not exceeding 10 years, with reappointment eligibility (s 4(2)). The Attorney‑General sets the conditions of appointment and may specify or limit the official powers exercised by the justice (s 4(2)-(3)). For persons who are Members of Parliament or principal members of a council, the Attorney‑General will appoint them on application for the duration of the office they occupy (s 5(1)-(2)). Special justices are appointed by the Governor on the Attorney‑General’s recommendation, for terms not exceeding 5 years (s 7(1)-(2)).

Vetting and minimum qualifications: Applicants must apply in the form approved by the Attorney‑General and supply identity, age and address evidence, and any other information the Attorney‑General requires (s 4(4)). The Attorney‑General may require statutory declaration verification (s 4(5)). The Commissioner of Police must be given each application and must provide information about criminal convictions and may provide other relevant information to the Attorney‑General (s 4(6)-(7)). Statutory minimum eligibility criteria are set out: at least 18 years old, Australian citizen resident in South Australia, of good character, and any prescribed regulatory requirements (s 4(8)).

Oaths and capacity to act: A justice may not exercise official powers until the oaths required under the Oaths Act 1936 are taken before an approved officer within 3 months of appointment, and attested (s 6(1)-(2)). Re-appointments are exempt from repeating the oaths (s 6(3)). Special justices, in addition to powers of ordinary justices, may be given judicial or quasi-judicial powers by other Acts while being subject to the conditions of their appointment (s 8(1)-(2)).

Discipline, suspension and removal: Ordinary justices are subject to disciplinary action for breaches of the Act, conditions of appointment or prescribed provisions of a code of conduct (s 11(1)). The Attorney‑General may reprimand, impose or alter conditions, suspend for up to 2 years or remove and publish a removal in the Gazette under various triggers including incapacity, conviction or bankruptcy (s 11(2), (3), (5)). Special justices have a distinct process involving the Governor and advice of the Chief Magistrate for suspension (s 10A(1)-(2)), automatic suspension if charged with an offence other than an expiable offence (s 10A(4)), and automatic removal on conviction of such an offence (s 10A(7)), with specified rights to apply for cancellation of suspension or reinstatement by the Attorney‑General (s 10A(5), (8)).

Roll and public information: The Attorney‑General must maintain a roll recording specified details for each justice, including name, town or suburb of residence or work, telephone contact details, special justice status, conditions limiting powers and term expiry date (s 13(1)-(2)). Information about deceased, suspended or removed justices must be removed (s 13(3)). The roll must be available for inspection without fee at public offices or via a website as determined by the Attorney‑General (s 13(5)-(6)).

Titles, immunities and offences: The Act defines the significance of JP, SJ and JP (Retired) as signifying justice, special justice and retired justice respectively (s 14). A justice has immunity from civil or criminal liability for an honest act or omission in carrying out official functions (s 15). The Act creates criminal liability for persons who hold themselves out as a justice or special justice when they are not, and for improper use of JP (Retired), with maximum fines and imprisonment set out (s 16). It also criminalises materially false or misleading statements in information provided under the Act, with divided penalties for knowing falsehoods and other cases (s 16A).

Regulation and codes: The Governor may make regulations necessary or expedient for the Act (s 17(1)). Regulations can require compliance with a code of conduct, conditionally or unconditionally exempt persons from specified provisions, and incorporate a specified code by reference (s 17(2)-(3)). If a code is incorporated, a copy must be publicly available and evidence may be given by producing a document certified by the Attorney‑General (s 17(4)).

Delegation and administration: The Attorney‑General may delegate powers under the Act to the Commissioner for Consumer Affairs, with delegations being absolute or conditional, revocable at will and not derogating from the Attorney‑General’s power to act (s 16B).

Transitional and amendment scaffolding: The schedule contains transitional provisions enabling justices in office immediately before commencement to continue in office for a prescribed period and to apply for appointment under the new Act (Schedule 1, cl 2). The legislative history records amendments and their dates, including links to the Judicial Conduct Commissioner Act 2015 which inserted s 10A and to later amendments affecting appointment and disciplinary provisions.

Directly affected individuals and offices

• Applicants for appointment as justices of the peace: persons who apply under s 4(4) and must meet the eligibility thresholds in s 4(8). The Attorney‑General may require applicants to verify application material by statutory declaration (s 4(5)). Applicants’ identities and applications are sent to the Commissioner of Police for vetting (s 4(6)-(7)). Applicants who are Members of Parliament or principal members of councils fall under the special application/appointment route in s 5.

• Appointed justices and special justices: once appointed, justices are affected by the conditions of appointment, the need to take oaths within the timeframe in s 6(2), obligations under any code of conduct in the regulations (s 17(2)(a)), recording on the roll (s 13) and by disciplinary, suspension and removal processes set out in ss 10, 10A and 11. Special justices face a distinct statutory regime for appointment, training, remuneration and suspension/removal (s 7, s 10A).

• Retired justices: persons who served as justices and who may wish to use the title JP (Retired) are affected by s 12 and s 16(4), which prescribe the circumstances in which the retired title may be used and permit the Attorney‑General to prohibit use following disciplinary findings (s 12(2)).

• Attorney‑General: central decision‑maker for appointments, setting conditions of appointment, requiring statutory declarations, imposing discipline including suspension and removal for ordinary justices, and publishing removals in the Gazette (ss 4, 6, 10-11, 12, 13). The Attorney‑General may also delegate functions to the Commissioner for Consumer Affairs (s 16B).

• Governor and Chief Magistrate: the Governor appoints special justices on the Attorney‑General’s recommendation and may suspend special justices on advice of the Chief Magistrate (s 7(1), s 10A(1)). The Governor determines remuneration for special justices (s 7(5)).

• Commissioner of Police: must be provided with copies of applications and must make available information about criminal convictions and may provide other relevant information to the Attorney‑General (s 4(6)-(7)). Thus police provide a vetting function for prospective justices.

• Commissioner for Consumer Affairs: potential administrative delegate for the Attorney‑General’s powers under the Act (s 16B). A delegation moves operational responsibilities while remaining revocable at will and subject to conditions in the instrument of delegation (s 16B(2)).

Indirectly affected entities and the public

• Courts and tribunals and statutory officers relying on JPs: other Acts confer powers on JPs and special justices; the Act clarifies that references in other Acts should be read to apply only to those JPs who, under their appointment conditions, can exercise the power (s 8(3)). Entities that expect JPs to perform certain functions must check the roll and conditions of appointment to confirm capacity.

• Businesses and community organisations that require JP witnessing, attestations and declarations: the Act contains a territorial rule for acts done outside the State for documents intended to take effect in the State, making such acts valid unless law requires the act to be done in the State (s 8(4)). That affects how businesses relying on extraterritorial JP acts can accept documents.

• The Attorney‑General’s office and the public service: administrative costs of maintaining the roll, publishing Gazettes for appointments and removals, handling statutory declaration verifications, and engaging with police for vetting. If the Attorney‑General delegates to the Commissioner for Consumer Affairs, that office will take on administrative functions (s 16B).

• Members of the public subject to false or misleading information: s 16A criminalises material falsehoods in information provided under the Act, with higher penalties where the person knew the statement was false.

Who pays and who decides

• Payment of remuneration to special justices is by determination of the Governor (s 7(5)). Other administrative costs (application processing, maintenance of the roll, gazette notices, regulation development) are met from public funds administered by the Attorney‑General’s department and, if delegation occurs, the Commissioner for Consumer Affairs.

• Decision-making power is concentrated in the Attorney‑General for ordinary justices (appointments, conditions, suspensions up to 2 years, reprimands and removals, s 4, s 10, s 11). For special justices, the Governor (on AG recommendation) appoints and the Governor may suspend on advice of the Chief Magistrate, with cross-reference to the Judicial Conduct Commissioner Act 2015 for action determining proper cause for removal (s 7, s 10A(1)-(2), (10)).

Behavioural effects and likely responses

• Prospective appointees will need to supply verifiable identity and character evidence and expect police vetting; the application cost includes time to assemble documents and possibly a statutory declaration (s 4(4)-(5), (6)-(7)).

• Special-justice candidates will need to complete an approved training course, which is a gate for higher-level powers (s 7(3)(a)). That selection pressure will shape the applicant pool toward those willing to undertake training and abide by conditions.

• Sitting justices face compliance obligations under a code of conduct subject to the regulations and risk of reprimand, conditions, suspension or removal for non-compliance (s 11; s 17(2)(a)).

• Persons tempted to hold themselves out as a justice, special justice or retired justice face statutory criminal penalties (s 16), thereby creating deterrent incentives, subject to enforcement.

Duties imposed on applicants and justices

• Application and verification duties: Applicants must apply in the manner and form approved by the Attorney‑General and accompany applications with identity, age and address evidence and any other information required; the Attorney‑General may require that information be verified by statutory declaration (s 4(4)-(5)). The Attorney‑General must give the Commissioner of Police a copy of each application, triggering police disclosure obligations (s 4(6)-(7)).

• Oath-taking duty: A justice must take the oaths required under the Oaths Act 1936 before exercising official powers, before a specified judicial officer or commissioner and within 3 months of appointment; the oaths must be signed by the person taking them and attested (s 6(1)-(2)). This duty is waived for re-appointed justices who complied on first appointment (s 6(3)).

• Compliance with appointment conditions: A justice must comply with any conditions of appointment imposed by the Attorney‑General. Conditions may specify or limit the official powers exercised (s 4(2)-(3), s 7(4)).

• Compliance with code of conduct: Regulations may require justices and special justices to comply with a code of conduct, which may be incorporated by reference into the regulations (s 17(2)(a), (3)). Prescribed breaches of the code are grounds for disciplinary action (s 11(1)(c)).

• Roll maintenance duties: The Attorney‑General records specified details on the roll for each justice; while the Act does not impose a direct statutory duty on the justice to supply the information, the roll records contact information and conditions which are inherently reliant on the justice providing accurate details. The Act also criminalises false or misleading statements in information provided under the Act (s 16A).

Rights and protections of justices

• Right to be appointed for a term with reappointment eligibility: Ordinary justices are appointed for terms not exceeding 10 years and are eligible for reappointment at expiration (s 4(2)). Special justices have terms not exceeding 5 years and are eligible for reappointment (s 7(2)).

• Right to remuneration for special justices: A special justice is entitled to remuneration as determined by the Governor for judicial duties performed (s 7(5)).

• Immunity for honest official acts: A justice is immune from civil or criminal liability for an honest act or omission in carrying out or purportedly carrying out official functions (s 15). The immunity is qualified by the word honest; the Act does not define the boundary of dishonest or bad-faith acts.

• Procedural protections in suspension and removal: Special justices subject to suspension and removal have a statutory structure involving the Governor and the Chief Magistrate, automatic suspension when charged with non-expiable offences, and a statutory opportunity to apply to the Attorney‑General for cancellation of suspension or reinstatement under specified circumstances (s 10A(1)-(5), (8)). Ordinary justices may be suspended if charged with an offence where the Attorney‑General is of the opinion that conviction would show the justice to be unfit to hold office, and suspensions may be revoked by further notice (s 11(3)-(4)). Removal of ordinary justices is effected by Gazette notice (s 11(5)).

Disciplinary powers and limits

• Attorney‑General’s disciplinary options for ordinary justices: reprimand, impose or vary conditions, suspend from office for specified periods up to 2 years, and removal from office published in the Gazette (s 11(2), (5)). Grounds include breach of the Act, breach of appointment conditions, and prescribed code of conduct provisions (s 11(1)). A person removed is barred from reapplying for 5 years or longer if prescribed (s 11(6)).

• Special justices’ separate regime: The Governor may suspend on advice of the Chief Magistrate (s 10A(1)-(2)). If charged with an offence (other than an expiable offence) automatic suspension follows until proceedings conclude (s 10A(4)). Conviction results in automatic removal (s 10A(7)), with limited avenues to apply for reinstatement or cancellation of suspension by the Attorney‑General (s 10A(5), (8)). The Act explicitly states that action under the Judicial Conduct Commissioner Act 2015 is not affected (s 10A(10)), indicating that overlap between regimes is contemplated.

Obligations relating to titles and false representation

• Use of titles: The Act sets the legal meaning of JP, SJ and JP (Retired) when used with a name or signature (s 14).

• Offences related to holding out: Persons who are not JPs or SJs may not hold themselves out as such, nor permit others to do so, nor use associated titles; penalty levels are set out, including fines and imprisonment for the most serious contraventions (s 16(1)-(3)). Use of JP (Retired) is restricted to those who served for a prescribed period, were not removed and have not been prohibited by the Attorney‑General; improper use carries a lower maximum penalty (s 16(4)).

• False statements in statutory information: Making materially false or misleading statements in information provided under the Act attracts criminal penalties, heavier where the falsehood is known (s 16A).

Delegation and administrative duties

• The Attorney‑General may delegate powers under the Act to the Commissioner for Consumer Affairs and specify conditions or limitations in the instrument of delegation (s 16B(1)-(2)). Delegations are revocable at will and do not prevent the Attorney‑General acting directly.

Regulatory duties

• The Governor may make regulations to require compliance with a code of conduct, allow exemptions, and incorporate codes by reference; obligations are created to make incorporated codes available for public inspection and to permit copy certification for evidentiary purposes (s 17(1)-(4)).

Criminal penalties and monetary fines

• Holding out and use of titles: The Act prescribes criminal penalties for misrepresenting oneself as a justice or special justice, or permitting another to misrepresent (s 16(1)-(3)). The maximum penalty for these offences is $10 000 or imprisonment for 2 years. For improper use of JP (Retired), the maximum penalty is $2 500 (s 16(4)).

• False statements in information provided under the Act: Section 16A creates an offence for making materially false or misleading statements in any information provided under the Act. The maximum penalty is tiered: where the person knew the statement was false or misleading, the penalty is $10 000 or imprisonment for 2 years; in other cases, $5 000 (s 16A).

Disciplinary enforcement powers

• Administrative sanctions: For ordinary justices, the Attorney‑General has a range of disciplinary tools short of criminal sanction: reprimand, imposing conditions, suspending a justice from office for a specified period or until conditions are fulfilled or until further notice, up to 2 years (s 11(2)). The Attorney‑General may also remove a justice by Gazette notice where specified grounds exist, including incapacity, conviction of an offence showing unfitness to hold office, bankruptcy, or other reasons in the Attorney‑General’s opinion (s 11(5)-(6)).

• Special justices: Suspension and removal follow a different pathway involving the Governor, Chief Magistrate and the Attorney‑General. The Governor may suspend a special justice on the advice of the Chief Magistrate (s 10A(1)). Automatic suspension follows if charged with an offence other than an expiable offence until proceedings conclude (s 10A(4)). Conviction of an offence other than an expiable offence results in automatic removal by force of s 10A(7). The Attorney‑General retains power to cancel suspensions or reinstate a special justice in specified circumstances (s 10A(5), (8)).

Procedural features and evidentiary rules

• Publication and public record: Removal of an ordinary justice must be made by Gazette notice (s 11(5)), and the roll is to be maintained and available for inspection without fee (s 13(1), (5)-(6)). The roll must remove entries for those who die, are suspended or are removed (s 13(3)).

• Evidence of incorporated codes: Regulations may incorporate codes by reference. If a code is referred to or incorporated, a copy must be kept available for public inspection and a document apparently certified by the Attorney‑General is admissible as evidence of the code’s contents in legal proceedings (s 17(4)(a)-(b)). This creates a streamlined evidentiary path for enforcement based on the code.

Protections that limit enforcement outcomes

• Immunity for honest acts: A justice is protected from civil or criminal liability for honest acts or omissions in carrying out official functions (s 15). That immunity affects enforcement outcomes by narrowing civil and criminal exposure for bona fide performance of duties.

• Non-invalidity of acts by suspended special justices: Section 10A(6) states a purported exercise of power by a suspended special justice is not rendered invalid solely because of suspension. That protects the validity of actions taken while suspended, limiting grounds for collateral attack based solely on suspension.

Enforcement actors and sources of information

• Commissioner of Police: Plays an enforcement and vetting role in the appointment stage by providing information about applicants’ criminal convictions and potentially other relevant information to the Attorney‑General (s 4(6)-(7)). The police are thus a source of enforcement intelligence during selection.

• Attorney‑General: Exercises primary administrative enforcement under the Act for ordinary justices, including suspension, condition setting, reprimands and removal (s 11). The Attorney‑General may also prohibit use of retired titles (s 12(2)(b)).

• Governor and Chief Magistrate: For special justices, the Governor and Chief Magistrate have enforcement roles under s 10A, including suspension on advice of the Chief Magistrate and automatic suspension and removal where criminal charges and convictions occur.

• Courts: Criminal offences under ss 16 and 16A are enforced through the criminal process, with courts determining guilt and imposing the statutory maximum penalties. The Act itself does not specify prosecutorial discretion or who brings prosecutions, but ordinary criminal processes apply.

Practical enforcement considerations

• Proof and certification: The Act provides a mechanism for proving the contents of an incorporated code by producing a copy certified by the Attorney‑General (s 17(4)(b)). For false statement offences under s 16A, the prosecution will need to prove material falsity and, for the higher penalty, knowledge.

• Interaction with other oversight regimes: Section 10A(10) expressly preserves the operation of the Judicial Conduct Commissioner Act 2015, indicating that complaints and determinations about special justices may be processed under that Act in parallel or in coordination. This creates a multi-track enforcement environment for special justices where independent oversight bodies may be involved.

Express cross-references in the Act

• Oaths Act 1936: The Act requires that a justice must take the oaths required of a justice under the Oaths Act 1936 before exercising official powers (s 6(1)). The Act prescribes who may witness the oaths and the three month timeframe for doing so (s 6(2)).

• Judicial Conduct Commissioner Act 2015: The Act explicitly cross-references this Act in s 10A(10). Section 10A addresses suspension and removal of special justices and provides that nothing in s 10A affects the operation of the Judicial Conduct Commissioner Act 2015. The legislative history shows the insertion of s 10A occurred via that 2015 Act, indicating integrated disciplinary machinery for judicial conduct and special justices.

• Other Acts conferring powers on justices and special justices: Section 8(1)-(3) states that a justice has powers conferred on a justice by or under this Act, the Oaths Act 1936 or any other Act, and that a special justice may have additional judicial or quasi-judicial powers conferred by other Acts. The Act directs that references in other Acts to a justice or special justice are to be read as references only to justices authorised under the conditions of their appointment to exercise the power (s 8(3)). That requires a cross-check with other statutes before relying on a particular JP to perform a function.

• Local Government Act 1999: The Act imports the definition of principal member of a council from the Local Government Act 1999 for the purposes of s 5, which prescribes a route for appointment of Members of Parliament and principal members of councils as justices (s 3).

Amendments affecting interplay with other regimes

• The legislative history lists numerous amending Acts that altered provisions and cross-links. Notably the Judicial Conduct Commissioner Act 2015 inserted s 10A and other amendments from 2012, 2016 and 2017 modified disciplinary and appointment provisions. Those amendments change how disciplinary jurisdiction over certain categories of justices intersects with separate oversight mechanisms.

Evidence rules and regulation incorporation

• Section 17(4)(b) expressly allows evidence of the contents of a code incorporated by regulation to be given in proceedings by production of a document apparently certified by the Attorney‑General as a true copy. This creates a direct statutory evidentiary link between the regulations under this Act and their force in litigation under other laws, simplifying proof issues in court when conduct under a code is in dispute.

Administrative interaction and delegation

• Delegation to Commissioner for Consumer Affairs: Section 16B allows the Attorney‑General to delegate functions under this Act to the Commissioner for Consumer Affairs. A delegation is revocable and may be conditional, and does not preclude the Attorney‑General acting in the matter. The practical effect is potential administrative devolution of responsibilities, which will interact with the administrative law framework applying to that office.

Territorial and extraterritorial validity

• Acts done outside the State: Section 8(4) validates acts done outside South Australia by a justice for taking a declaration or attesting an instrument intended to take effect in the State, unless the law requires the act be done in the State. That provision governs the interaction between extraterritorial JP acts and South Australian legal requirements for documents.

Regulatory exemptions and code incorporation

• The regulations may exempt persons conditionally or unconditionally from specified provisions (s 17(2)(b)). That allows the regulations to tailor interactions with other laws or classes of persons, for example exempting certain public servants or particular functions, subject to the statutory regulation-making process.

Potential points of friction and practical cross‑checks

• When a statutory function elsewhere is expressed to be exercisable by a "justice", administrators and lawyers must review both the other statute and the roll/conditions under this Act to ensure the nominated individual is authorised to exercise that function in their particular circumstances (s 8(3)). Failure to confirm could produce errors of authority, though s 10A(6) limits invalidity concerns for acts of suspended special justices by providing that suspension alone does not render acts invalid.

• Changes in related oversight legislation, for example amendments to the Judicial Conduct Commissioner Act 2015 or to the Oaths Act 1936, will affect the operation of provisions here, because the Act relies on those statutes for procedural and disciplinary frameworks.

• The Notes in the legislative history caution that references in legislation to other legislation or instruments or to offices may not be automatically updated, so users must verify current cross-references when relying on the Act in conjunction with other laws.

Principal Act and commencement

• The Justices of the Peace Act 2005 received assent on 17 November 2005 and commenced on 1 July 2006 (Gazette reference provided) as the principal Act replacing the Justices of the Peace Act 1991 (legislative history). The 2005 Act’s long title and certain sections were subject to editorial amendments under the Legislation Revision and Publication Act 2002 with effect 18 January 2007.

Subsequent amending Acts and key insertions

• Statutes Amendment (Justice Portfolio) Act 2006 (No 44 of 2006): commenced 18 January 2007 and made amendments listed in the legislative history. One recorded change is to s 13(2), with the amendment date given as 18 January 2007.

• Statutes Amendment (Attorney‑General's Portfolio) Act 2012 (No 17 of 2012): assent 24 May 2012, with relevant parts commencing 5 August 2012 (Gazette ref). This 2012 Act inserted several provisions and amendments within s 11, including adding subsections (4a)-(4c) originally, and other technical changes that were later deleted or modified by later amending Acts. The legislative history identifies multiple amendments to s 11 across the 2012 instrument.

• Judicial Conduct Commissioner Act 2015 (No 34 of 2015): assent 5 November 2015; Schedule 1 clauses 9-11 commenced 5 December 2016 (Gazette ref). This Act inserted s 10A into the Justices of the Peace Act 2005, creating a distinct suspension and removal regime for special justices and expressly preserving the operation of the Judicial Conduct Commissioner Act 2015 in relation to special justices (s 10A(10)). The introduction of s 10A is the major structural change affecting special-justice discipline.

• Justices of the Peace (Miscellaneous) Amendment Act 2016 as amended by 41/2017: assent 29 September 2016 with commencement 19 December 2017 (Gazette reference). The 2016/2017 amendments substantially revised appointment procedures, oath rules, and other operational provisions. The legislative history shows s 4(1), s 4(2), s 4(5), s 4(8), s 5(1)-(2), s 6(2) and (3), s 10(1), s 10(2a), s 11 and s 16(4) among the provisions amended or substituted by these Acts. The 2016/2017 package appears to have consolidated and modernised appointment and disciplinary mechanisms.

• Statutes Amendment (Attorney‑General's Portfolio) (No 2) Act 2017: assent 24 October 2017. The 2017 Act made consequential changes, including substitution of certain subsections of s 8 as amended by the 2016 Act.

Specific provision amendments

• Section 4: s 4(1) substituted by 41/2016 s 4(1) and further amendments to (2), (5) and (8) effected by 41/2016 with commencement 19 December 2017. These alterations affect the appointment mechanism, term length and conditions of appointment.

• Section 6: s 6(2) amended and s 6(3) inserted by 41/2016, affecting oath-taking requirements and the exemption for re-appointments.

• Section 9: amended by the Judicial Conduct Commissioner Act 2015 (Sch 1 cl 9).

• Section 10 and 10A: s 10(1) amended by 41/2016 s 7(1); s 10(2a) inserted by 41/2016 s 7(2); s 10A was inserted by the Judicial Conduct Commissioner Act 2015 (Sch 1 cl 10) to deal specifically with special justices. The amendments create separate pathways for personal suspensions (s 10) and special-justice disciplinary measures (s 10A).

• Section 11: has a complicated amendment history across 2012, 2015 and 2016 amendments. The legislative history records insertions, deletions and substitutions to s 11, reflecting changing approaches to disciplinary processes for ordinary justices and the addition of s 11(a1) to clarify applicability to justices other than special justices (inserted by 34/2015 Sch 1 cl 11(1)).

• Section 16 and new offences: s 16(4) was amended by 41/2016 s 10; ss 16A and 16B were inserted by 41/2016 s 11 on 19 December 2017. Those insertions added the offence of making false or misleading statements in information provided under the Act and an express delegation power to the Commissioner for Consumer Affairs.

Transitional provisions and historical versions

• Schedule 1 contains transitional provisions allowing existing justices to continue in office for a period prescribed by the Minister, and to apply for appointment under the new Act (Schedule 1 cl 2). Historical versions are made available for previous speeches and versions, with the legislative history noting versions as at 18 January 2007, 5 August 2012 and 5 December 2016.

Notes on the revision trail

• The legislative history lists each amendment, the commencement date, and the specific clauses changed. It also cautions that references to other legislation or instruments may not be automatically updated and therefore may be obsolete. Users relying on historical or cross-referenced provisions must consult the end-to-end legislative database and subsequent amendments for currency.

Statutory record and absence of cases in the Act

• The text of the Act and its legislative history, as provided, do not list any reported judicial decisions interpreting the Justices of the Peace Act 2005. The statute itself does not name cases and the legislative history is a catalogue of amending statutes and commencement dates. There is no litigation record embedded in the Act text supplied.

Potential litigation vectors based on the Act’s provisions

• Questions likely to generate litigation, if they arise, include: the scope and limits of the Attorney‑General’s discretionary powers under ss 4 and 11, particularly where conditions of appointment are imposed or varied; the interaction between s 10A and the Judicial Conduct Commissioner Act 2015 where special justices face disciplinary proceedings under both statutory regimes; the meaning and application of “honest act or omission” immunity in s 15; the validity of acts performed by suspended special justices notwithstanding suspension, under s 10A(6); and evidentiary questions about codes incorporated by reference under s 17(4)(b).

• Disputes about automatic suspension on charge (s 10A(4)) and automatic removal on conviction (s 10A(7)) for special justices could generate judicial review litigation concerning the lawfulness of administrative steps taken by the Governor on advice of the Chief Magistrate or the Attorney‑General’s exercise of discretion in cancelling suspensions or reinstating removed persons (s 10A(5), (8)).

• Issues concerning the roll and public access to information (s 13) may lead to disputes where a person alleges incorrect particulars or where the roll is used to determine the authority of a justice to act in a particular function in another statutory instrument (s 8(3)).

Administrative law and review

• Challenges under administrative law principles are feasible: for example, applicants or sitting justices might seek judicial review of an adverse administrative decision under the Act, such as refusal to appoint, imposition of conditions, suspension or removal. Because the Attorney‑General has broad statutory powers, a litigant might argue error of law, procedural unfairness, failure to consider relevant factors or improper purpose in the exercise of those powers. The Act does not itself specify appeal routes for appointment refusals or disciplinary actions, so judicial review in the Supreme Court would be the general remedy for judicial oversight of administrative acts by the Attorney‑General or the Governor.

Evidence and procedural questions

• The Act’s provision allowing certified copies of an incorporated code to be used as evidence (s 17(4)(b)) reduces certain evidentiary frictions, but disputes could still arise about whether a code was correctly incorporated at a given time and whether an alleged breach of that code occurred. Litigation could concern the temporal application of regulations or a code as incorporated.

Interaction with other oversight bodies

• Because s 10A(10) preserves the Judicial Conduct Commissioner Act 2015, there is room for multi-agency proceedings and overlap which could lead to conflicts about jurisdiction or appropriate forum. Litigation could clarify boundaries between disciplinary processes under this Act and the Judicial Conduct Commissioner Act 2015 for special justices.

Current absence of reported determinations in the text

• The supplied material does not contain reported litigation, decisions, or examples of enforcement under the Act. Practitioners should check contemporary case law databases and the Supreme Court of South Australia’s decisions for any judicial pronouncements that have occurred since the date of the latest legislative history entry.

Discretion concentrated in the Attorney‑General

• The Attorney‑General controls appointment, conditions, verification requirements, suspension and removal for ordinary justices, and has de facto influence over special justices through recommendation to the Governor and power to cancel suspensions or reinstate (ss 4, 5, 10, 11, 10A(5), (8)). That concentration creates variable outcomes depending on incumbency and practice. The Act provides few statutory constraints or detailed procedures for exercising those discretions. Practitioners should note the potential for non-uniform conditions and the need to seek records or reasons if an AG decision is contested.

Oath timing and re-appointment wrinkle

• A justice cannot exercise official powers until the oaths are taken within 3 months of appointment before specified judicial officers and properly attested (s 6(2)). Failure to comply would bar exercising functions, but s 6(3) waives this for re-appointments. If a practitioner relies on a newly appointed JP, confirm that the oaths were taken within the statutory period.

Police vetting and privacy concerns

• Applicants’ applications must be given to the Commissioner of Police and police must provide conviction information and may provide other information relevant to the appointment decision (s 4(6)-(7)). Applicants should be aware that non-conviction information may be shared at the Commissioner’s discretion. This raises confidentiality and privacy considerations for applicants; counsel and applicants should anticipate and, if appropriate, obtain early disclosure of what police provided to the Attorney‑General in adverse decisions.

Automatic suspension for special justices on charge, and non-invalidity of acts

• Section 10A(4) automatically suspends a special justice charged with an offence other than an expiable offence until proceedings conclude. Section 10A(6) then states a purported exercise of power by a special justice suspended from office is not rendered invalid by reason only of the suspension. That combination means that a special justice may be suspended yet actions taken while suspended may still be valid, complicating challenges to the validity of decisions made during suspension. Lawyers seeking to challenge an act of a suspended special justice should be prepared to argue reasons beyond suspension that would render an act invalid.

Removal and re-application bars

• A person removed from office as a special justice or as an ordinary justice is barred from applying for reappointment for 5 years from the date of removal, or a longer period specified in the removal notice (s 10A(9), s 11(6)). Removal notices may therefore have a multi-year exclusion consequence, and a notice could specify a longer period. Applications for reappointment during that window will be statutorily barred.

Use of JP (Retired) and automatic prohibitions

• A person must have served as a justice for at least a prescribed period, must not have been removed, and must not have been prohibited by the Attorney‑General to use JP (Retired) (s 16(4)). Section 12 creates separate disciplinary exposure for use of that title in contravention of a code of conduct, including prohibition on using the retired title (s 12(2)). Practitioners should confirm retirement eligibility before using such descriptions.

False statements offence scope

• Section 16A makes it an offence to give materially false or misleading information under the Act, with substantial penalties for knowing falsehoods. Because applications and roll information are covered, clerical errors or omissions could attract scrutiny. Applicants are exposed to a criminal offence if they knowingly misstate material particulars. Legal advisers preparing applications should ensure controls for accuracy and statutory declarations where required.

Roll content and public availability

• The roll must record contact numbers and places of residence or work for each justice (s 13(2)(b)-(c)). The roll is publicly inspectable without fee at public offices and may be available online as the Attorney‑General determines (s 13(5)-(6)). This imposes a privacy trade-off for justices who must balance public accessibility with personal security and privacy. Practitioners should confirm what information will be published and advise clients accordingly.

Delegation to Commissioner for Consumer Affairs is revocable

• If the Attorney‑General delegates administrative powers to the Commissioner for Consumer Affairs, that delegation is revocable at will and may be conditional (s 16B(2)). Delegations do not remove the Attorney‑General’s ultimate authority. Administrative arrangements under a delegation should be documented and clients should be aware that the Attorney‑General may act directly in a matter despite delegation.

Regulations by reference and evidentiary convenience

• Codes can be incorporated by reference in regulations (s 17(3)). While incorporation by reference reduces legislative drafting burdens, it can make it less straightforward for members of the public to know disciplinary standards unless a copy is readily available and certified by the Attorney‑General as contemplated in s 17(4). Practitioners should confirm which iteration of a code applies at a given time, because incorporation may be to a code “as in force at a specified time or as in force from time to time” (s 17(3)).

Bankruptcy and insolvency ground for removal

• Bankruptcy or applying for the benefit of an insolvency law is an express ground for removal of an ordinary justice (s 11(5)(c)). That is a non-criminal ground with removal published in the Gazette. Justices approaching insolvency should receive advice because removal is a statutory possibility.

Expiable offences distinction

• Several provisions distinguish offences that are expiable from other offences, notably s 10A(4). Practitioners need to be aware whether an alleged offence is expiable to identify whether the automatic suspension rule applies for special justices.

For applicants seeking appointment

• Assess eligibility: Confirm you are at least 18 years old, an Australian citizen resident in South Australia, of good character and that you meet any regulatory requirements prescribed under the regulations (s 4(8)). Check any regulations for further qualifying criteria.

• Prepare the application: Submit an application in the manner and form approved by the Attorney‑General and include evidence of identity, age and address, and any other information requested (s 4(4)). If asked, be ready to verify information by statutory declaration (s 4(5)). Ensure accuracy because material falsehoods in information provided under the Act attract penalties under s 16A.

• Expect police vetting: The Attorney‑General will give the Commissioner of Police a copy of your application and police will provide information about criminal convictions and may provide other relevant information to the Attorney‑General (s 4(6)-(7)). Anticipate requests to explain adverse records or provide rehabilitation evidence.

• If you are a Member of Parliament or principal member of a council: Apply under s 5 so that the Attorney‑General may appoint you for the period you hold that office. Your appointment will expire when you cease to hold the office unless reappointed under s 4.

• Timing and oath: If appointed, take the required oaths under the Oaths Act 1936 before a Judge or Master of the Supreme Court, a Judge or Master of the District Court, a Magistrate, or a commissioner for taking affidavits in the Supreme Court within 3 months of appointment; ensure the oaths are signed and attested as required (s 6(1)-(2)). If you are being reappointed and complied on the first appointment, you are not required to retake the oaths (s 6(3)).

For special-justice candidates

• Training requirement: Ensure you have successfully completed a course of training approved by the Attorney‑General after consultation with the Chief Justice of the Supreme Court, because the Attorney‑General will not recommend appointment as a special justice unless satisfied as to training completion and suitability (s 7(3)(a)-(b)). Plan for time and cost to undertake approved training.

• Understand the terms: Special-justice appointments are for terms not exceeding 5 years and will have conditions that may limit powers. Special justices are entitled to remuneration determined by the Governor (s 7(2), (4)-(5)).

For current justices

• Keep personal details current on the roll: Although the Act places the roll and its maintenance within the Attorney‑General’s responsibility, the roll records a justice’s name, town or suburb of residence or work, telephone contact details, special-justice status, conditions limiting powers and term expiry date (s 13(2)). Ensure the Attorney‑General has accurate details to avoid removals or miscommunications.

• Comply with conditions and codes: Read and comply with any appointment conditions and any code of conduct incorporated by regulation (s 4(3), s 17(2)(a)). Non-compliance is a ground for reprimand, imposition of conditions, suspension or removal (s 11(1)-(2), (5)).

• Respond to charges and criminal proceedings: If charged with an offence, expect potential suspension. For ordinary justices, the Attorney‑General may suspend if of the opinion conviction would show unfitness to hold office, and for special justices automatic suspension follows if charged with an offence other than an expiable offence (s 11(3), s 10A(4)). If charged or convicted, seek legal advice promptly and consider applying for cancellation of suspension or reinstatement where the Act permits (s 10A(5), (8)).

• Honor title rules on retirement: Do not use JP (Retired) unless you have served the prescribed period, were not removed from office and are not prohibited from using the title by the Attorney‑General (s 16(4)). The Attorney‑General may take disciplinary action against retired justices who use the retired title contrary to a code of conduct (s 12).

For administrators and delegations

• If delegating powers, document the instrument: The Attorney‑General may delegate powers to the Commissioner for Consumer Affairs, and delegations may be absolute or conditional and are revocable at will (s 16B(1)-(2)). Record the scope, conditions and revocation terms in the delegation instrument to avoid uncertainty.

• Maintain and publish the roll: Ensure the roll contains required particulars and is available for inspection without fee at determinate public offices or on a website as the Attorney‑General directs (s 13(4)-(6)). Remove entries for deceased, suspended or removed justices promptly (s 13(3)).

• Make codes accessible: If a code of conduct is incorporated by regulation, keep a copy available for public inspection during normal office hours and prepare to certify copies for evidentiary use in proceedings as provided by s 17(4).

Practical tips to avoid contraventions

• Verify accuracy in applications: Because s 16A criminalises materially false or misleading statements in information provided under the Act with substantial penalties, take care with representations and use statutory declarations where verification is required (s 4(5), s 16A).

• Document compliance with conditions and training: Keep records proving completion of training for special-justice eligibility, evidence of compliance with any conditions and any instructions received from the Attorney‑General to demonstrate bona fides in the event of disciplinary scrutiny (s 7(3)(a), s 11).

• Seek prompt legal advice if disciplinary action is threatened: The Act gives the Attorney‑General wide remedial powers, including suspension for up to 2 years and removal posted in the Gazette (s 11(2), (5)). Early advice will be necessary to respond to notices and to pursue applications for cancellation of suspension or reinstatement where the Act permits.

• For those relying on JPs: Check the roll and conditions before relying on a justice to perform a statutory function in another Act, because s 8(3) limits references to a justice to those justices with power to exercise the particular authority under their terms of appointment.

By following these concrete procedural steps, applicants, sitting justices and administrators can reduce the risk of errors that attract administrative or criminal sanctions under the Act.
