Justices of the Peace Act 2004

The Act introduces several core concepts that structure the office of JP. A JP is defined as a Justice of the Peace (s 3). The term “JP” includes both appointed JPs (Part 3 Division 1) and ex officio JPs (s 12). Ex officio JPs include judges of the Supreme, District, Family and Children’s Courts, magistrates of the Magistrates Court, the State Coroner and Deputy State Coroner, and members of the Executive Council. These persons are JPs by virtue of holding their office; they are not subject to the oath requirement (s 11), the resignation provisions (s 13), or the termination provisions (s 14) , see s 12(2). This creates a two-tier system: appointed JPs are subject to ongoing regulation and oversight, while ex officio JPs are not.

The concept of “functions” is central. Section 4(1) provides that a JP has and may perform the functions conferred on a JP by laws that apply in WA, including the Act itself and other written laws, as well as functions conferred by the commission. This is an enabling provision: it does not enumerate functions but incorporates the wide range of functions scattered across WA legislation (e.g., witnessing affidavits, issuing search warrants, granting bail, hearing minor matters in the Magistrates Court when authorised). The commission may limit where or in what circumstances those functions may be performed (s 10(5)), creating individualised restrictions.

The age restrictions in s 5 are significant. They are structured as prohibitions: a JP who has reached 70 must not constitute the Magistrates Court or Children’s Court or perform visiting justice functions under the Prisons Act unless the Minister grants written permission. A JP who has reached 75 must not perform functions under the specified Acts or issue any warrant or document authorising arrest, detention, entry, search or seizure. The Minister may permit a JP aged 70-74 to perform some or all of the s 5(1) functions (s 5(3)), but there is no equivalent permission for the s 5(2) restrictions. This means that from age 75, all JPs are effectively barred from exercising the most coercive judicial powers. The Act does not remove the office at age 75; the JP remains a JP but with drastically reduced functions.

The register concept (s 15) is intended to maintain a public record of appointed JPs, with an identification number and such other details as prescribed. Only “public information” , information prescribed as such , is available for inspection by any person on payment of a prescribed fee (s 15(5)). The Act does not define what is “public information” beyond saying it is prescribed (s 15(1)). The CEO must keep the register accurate and up to date (s 15(7)). Section 16 imposes a duty on JPs to inform the CEO within 30 days of any change of name or address, any conviction of an offence, or becoming an insolvent under administration. The CEO may also request proof of change of name/address or any information for administration of the Act (s 16(2)). Non-compliance with s 16 is not an offence (s 20), but could be a factor in termination.

The protection from personal liability in s 19 is broad: an action in tort does not lie against a person for anything the person does as a JP in the performance or purported performance of a function of a JP, unless the person acts corruptly or maliciously. This applies to both acts and omissions (s 19(1)). Subsection (3) goes further: the Crown is relieved of any liability it might otherwise have had vicariously. This means that even if a JP is not personally liable (because not corrupt or malicious), the victim cannot sue the Crown instead. The policy choice is to leave the victim without a remedy unless corruption or malice is proven.

The provision that breach of the Act by a JP is not punishable (s 20) is unusual. It means that any duty imposed on a JP by the Act , such as the duty to refrain from exercising functions after age 70/75 (s 5), or the duty to inform the CEO of changes (s 16) , is not backed by a criminal penalty. The only potential consequence is termination under s 14, which is entirely discretionary and subject to no specified grounds. This significantly weakens the enforceability of the Act’s requirements.

The Act directly affects four categories of persons. First, prospective appointees: Australian citizens who are enrolled to vote for the Legislative Assembly (under the Electoral Act 1907) or for the House of Representatives (under the Commonwealth Electoral Act 1918) are qualified for appointment (s 8). The qualification is minimal; there is no requirement of legal training, good character (beyond the ability to be enrolled), residence (a person ordinarily resident outside the State may be appointed - s 10(3)), or any fitness assessment. The Minister may recommend any qualified person to the Governor (s 9), and the Governor may appoint as many as necessary to assist in the administration of justice (s 10(2)). In practice, this means JPs are typically community volunteers recommended by local MPs, but the Act does not require any vetting beyond the citizenship/enrolment criteria.

Second, appointed JPs themselves: once appointed, they must take the oath or affirmation of office (s 11) and are then subject to the duties and restrictions in the Act. They must keep the CEO informed of name/address changes, convictions, and insolvency (s 16). They must cease certain functions at age 70 and 75 (s 5). They may resign at any time (s 13) or have their appointment terminated by the Governor on the Minister’s recommendation (s 14). They receive no remuneration under the Act. They are entitled to use the titles “Justice of the Peace” and “JP” (s 17).

Third, ex officio JPs: judges, magistrates, coroners, and Executive Council members are JPs by virtue of office (s 12). They are not required to take the oath under s 11, are not subject to resignation or termination under Division 3, and are not recorded on the register (s 15(2) requires a register of all JPs “other than those referred to in section 12”). Their functions as JPs are automatic, and the age restrictions in s 5 presumably apply to them as well (nothing exempts them from s 5), though in practice most judges and magistrates retire or are removed by other processes before age 75.

Fourth, persons who interact with JPs: individuals who have documents witnessed, oaths administered, warrants issued, or bail decided by a JP are affected by the validity provisions (ss 6 and 7) and the evidentiary presumptions (s 18). Section 6 provides that the validity of a warrant, summons or other document issued by a JP, or an act done by a JP, is not affected by the JP reaching an age limit, ceasing office, or dying. Section 7 validates acts done outside WA in respect of documents intended to take effect inside WA, unless the law requires the act to be done in the State. This protects persons receiving such documents from challenges based on the JP’s status.

Fifth, the public generally: persons who are not JPs are affected by the impersonation offence (s 21). Falsely pretending to be a JP or using the title “Justice of the Peace” or “JP” knowing they are not is an offence carrying up to 12 months imprisonment. This creates a deterrent against fraud.

Sixth, the CEO and the Department: the CEO is responsible for keeping the register (s 15), receiving information from JPs (s 16), issuing certificates of JP status (s 18), and publishing notices of resignation (s 13(3)) and presumably of termination (s 14(2) provides for publication in the Gazette but does not specify by whom). The Minister is responsible for recommending appointments (s 9) and terminations (s 14), and for granting permissions under s 5(3). The Governor appoints JPs and terminates appointments on the Minister’s recommendation.

The Act imposes few explicit duties on appointed JPs, and those duties are enforceable only through the termination power, not through penal sanctions (s 20). The principal duties are:

Duty to take oath or affirmation before performing functions (s 11). This is a precondition to acting. A person appointed as JP cannot exercise any function until the oath or affirmation is taken before the Governor, a judge of the Supreme or District Court, a magistrate, or a person authorised by the Governor. There is no time limit specified, so a person could be appointed but never take the oath and thus never become an active JP.

Duty to inform the CEO of certain events within 30 days: change of name or address, conviction of any offence, or becoming an insolvent under administration (s 16(1)). The CEO may also request proof of change of name/address or any information needed for administration of the Act (s 16(2)). The duty is to “inform” and “provide” , but there is no penalty for non-compliance.

Duty to cease certain functions at age 70 and 75 (s 5). The Act uses the language “must not”, which imposes a legal duty. Breach is not an offence (s 20) but could justify termination. Notably, the Act does not require the JP to notify the CEO when reaching these ages; the CEO presumably relies on the birth date provided by the JP in the register.

Duty to perform functions conscientiously, responsibly and in accordance with the law, as stated in the commission form (Schedule 1 paragraph 3). The commission itself is not the Act, but it is incorporated into the appointment. Whether the commission imposes a legal duty enforceable by termination is arguable; the Act does not explicitly make commission conditions binding in the way that s 4(1)(b) refers to functions conferred by the commission.

The rights conferred on JPs include:

Right to use titles “Justice of the Peace” and “JP” (s 17). This is a statutory entitlement.

Right to perform functions anywhere in the State unless the commission states otherwise (s 4(2)). This creates a default of wide territorial authority.

Right to protection from personal liability (s 19). A JP is not liable in tort for anything done in the performance or purported performance of a JP function, unless the JP acted corruptly or maliciously. This is a broad immunity; “purported performance” covers acts that may be outside the JP’s actual authority, as long as they were ostensibly done in the course of trying to perform a JP function. The immunity does not extend to criminal liability (only tort), and the carve-out for corruption or malice leaves JPs exposed if they act deliberately wrongfully.

Right to have acts validated despite later change of status (s 6) and despite being done outside WA (s 7). This protects the JP from later challenge, but also protects those who relied on the JP’s act.

Right to resign (s 13). The resignation is by signed letter to the Minister; it takes effect on receipt or later stated date. The CEO must publish a notice in the Gazette.

Persons who are not JPs have the right to inspect the public information in the register on payment of any prescribed fee (s 15(5)). They also have the right to rely on the evidentiary presumptions in s 18: a signature followed by a JP title is proof the signatory was a JP at the time, and a CEO’s certificate certifying JP status or non-status is proof of its contents. These presumptions are rebuttable (“unless the contrary is proved”), placing the evidentiary burden on the challenger.

The Act contains only one criminal penalty: s 21 provides a maximum penalty of 12 months imprisonment for impersonating a JP or using the title “Justice of the Peace” or “JP” knowing that one is not a JP. The penalty is moderate compared to other impersonation offences, likely reflecting the relatively low-level but serious potential for fraud in witnessing documents or issuing warrants.

Critically, s 20 states: “Contravention of this Act by a JP is not an offence.” This means that a JP who performs functions after age 75 in breach of s 5, fails to inform the CEO of a name change in breach of s 16, or even takes the oath improperly cannot be prosecuted under the Act. The only formal enforcement mechanism is termination of appointment by the Governor on the Minister’s recommendation (s 14). However, s 14 does not specify any grounds for termination, nor any procedural safeguards such as notice, hearing, or right of appeal. The Minister may recommend termination for any reason or no reason; the Governor may then terminate. The person ceases to hold office on publication of a notice in the Gazette (s 14(2)). This is an entirely discretionary, non‑appealable administrative process. There is no requirement for the Minister to have received a complaint, conducted an investigation, or established wrongdoing. This creates a regime of low legal accountability for JPs: they face no criminal sanction for non-compliance with the Act’s duties, but they can be removed without explanation at any time.

The evidentiary provisions in s 18 assist in enforcement of other laws indirectly. A certificate from the CEO that a person is or is not a JP (or was or was not on a specified date or period) is proof of that fact, unless the contrary is proved. This is useful for prosecutions under s 21 (impersonation) or for any proceeding where JP status is relevant. Similarly, a signature followed by a JP title is proof the signatory was a JP at the time. These presumptions place the burden of rebuttal on the party challenging the document.

There are no other penalties in the Act. No provision enables the CEO to issue infringement notices, suspend a JP, or impose conditions on a JP’s functions. The only tool short of termination is the Minister’s power to limit where or in what circumstances a JP may perform functions under s 10(5). That power is exercised at the time of appointment; there is no power to vary a commission after appointment (other than terminating and reappointing with new limits).

The absence of penalties for JPs themselves raises a question of real enforcement of the age restrictions. If a 75‑year‑old JP continues to issue warrants, no criminal liability attaches. The only risk is termination. But if the CEO is unaware of the JP’s age (because the JP did not inform and the register may not contain date of birth unless prescribed), the restriction may be effectively unenforceable. The Act does not require the JP to notify the CEO of reaching age 70 or 75, nor does it authorise the CEO to demand proof of age.

The Act operates as a framework statute, referencing numerous other WA Acts that confer specific functions on JPs. Section 4(1)(a) provides that a JP has the functions conferred by laws that apply in WA, including this Act and other written laws. The Act does not itself list those functions; they are scattered across the statute book. The age restrictions in s 5 explicitly cross-reference several Acts: Bail Act 1982, Criminal Investigation (Identifying People) Act 2002, Criminal Property Confiscation Act 2000, Misuse of Drugs Act 1981, and Prisons Act 1981. A JP over 75 cannot perform functions under those Acts, but those Acts themselves may also contain requirements about who may exercise their powers. The effect is that at age 75, a JP loses statutory authority under those Acts, though ss 6 and 7 provide that any acts done before the age limit are not invalidated by later reaching that age.

The definition of “insolvent under administration” borrows from s 9 of the Corporations Act 2001 (Cth). This imports a Commonwealth concept into the WA JP framework. A JP who becomes insolvent under administration must inform the CEO (s 16(1)(c)). This is relevant to fitness for office, though insolvency alone does not automatically disqualify; termination is at the Minister’s discretion.

The oath or affirmation requirement (s 11) and the form in Schedule 2 are subject to the Oaths, Affidavits and Statutory Declarations Act 2005 (WA), as amended by s 63 of that Act. The form references an oath or affirmation according to that Act.

The Act interacts with the Magistrates Court Act 2004 (WA) both in commencement (s 2 ties commencement to that Act) and in function: a JP may constitute the Magistrates Court in certain circumstances (subject to age limits under s 5). The definition of “JP” in other Acts may adopt this Act’s definition. Section 18 evidentiary presumptions are likely to be relied on in proceedings under other Acts where a document bearing a JP’s signature is tendered.

The protection from personal liability in s 19 interacts with the tort law generally. It excludes the Crown from vicarious liability for JP actions (s 19(3)). This means that a person injured by a JP’s negligent act (e.g., a wrongful arrest authorised by a JP without malice) has no tort remedy against either the JP (protected) or the Crown (relieved). The Act does not provide any alternative compensation mechanism. This is a deliberate policy choice to limit state liability for errors by volunteer JPs, but it leaves victims without redress unless they can prove corruption or malice, which is a high bar.

The impersonation offence in s 21 interacts with general criminal law offences such as false pretences or fraud, but provides a specific, simpler offence with a maximum penalty of 12 months. It does not require proof of any intent to cause loss or gain, only knowledge of not being a JP.

The Justices of the Peace Act 2004 (WA) received assent on 15 September 2004 and commenced on 1 May 2005, by operation of s 2 (which linked commencement to the Magistrates Court Act 2004) and a gazette notice of 31 December 2004. The Act has been amended three times, all in its early years. The first amendment was by the Courts Legislation Amendment and Repeal Act 2004 (No. 59 of 2004), s 141, which amended s 2 (the commencement provision). This amendment was assented to on 23 November 2004 and also commenced on 1 May 2005. The second amendment was by the Oaths, Affidavits and Statutory Declarations (Consequential Provisions) Act 2005 (No. 24 of 2005), s 63, which amended Schedule 2 (the oath/affirmation form) to reflect the Oaths, Affidavits and Statutory Declarations Act 2005. That amendment commenced on 1 January 2006. The third amendment is not a legislative change but a reprint: Reprint 1 was prepared on 17 July 2009, incorporating the amendments. Since 2009, no further amendments are recorded in the source. The Act appears to be stable and lightly amended, which may indicate that it is fit for purpose or that reform is not a government priority. The compilation table does not include any amendments after 2009, though it is possible later amendments exist in later reprints not provided. Given the source is a 2009 reprint, users should check for subsequent amendments. The absence of amendment history after 2009 over 14 years suggests either low political attention or widespread satisfaction with the scheme.

The source text , the Act itself and its compilation notes , does not name any cases. Litigation under the Act is likely rare. The key provision that might generate case law is s 19 (protection from liability). Questions could arise as to what constitutes “corruptly or maliciously” in the context of a JP’s decision, particularly in issuing a warrant or granting bail. The onus would be on the plaintiff to prove corruption or malice. A challenge to termination under s 14 might arise if a JP sought judicial review of the Minister’s recommendation or the Governor’s decision. Since s 14 does not require reasons or a hearing, a terminated JP might argue procedural unfairness, though the source does not indicate this has been tested. The evidentiary presumptions in s 18 might be litigated in criminal cases where identification of the JP is relevant (e.g., in challenging a warrant’s validity). The impersonation offence (s 21) may be prosecuted from time to time, but such prosecutions are unlikely to generate appellate interpretation of the Act itself. The validity provisions in ss 6 and 7 might be raised in defence to proceedings where a document issued by a JP is challenged on the ground the JP exceeded territorial or age restrictions. Section 6 appears designed to prevent such challenges, but it does not say the act is valid if the JP lacked authority (e.g., if the JP was never properly appointed or was disqualified by court order). Because the source contains no litigation references, it is reasonable to conclude that the Act has not been the subject of significant judicial interpretation in the period covered by the reprint. Practitioners should not assume this remains the case and should conduct their own case law searches.

Several features of the Act could catch out the unwary, whether they are JPs, persons dealing with JPs, or legal practitioners. The first is the broad protection from liability in s 19 combined with the Crown relief in s 19(3). A person who suffers loss due to a JP’s act (e.g., a wrongful arrest following a warrant issued negligently but without malice) has no tort remedy against the JP or the state. The only exception is if the JP acted corruptly or maliciously, which requires proof of a deliberate wrongful purpose. This effectively immunises negligent or mistaken acts by JPs. It is not obvious from the text that the victim is left entirely without compensation.

Second, the absence of any penalty for JP non-compliance with the Act (s 20) means that a JP who wilfully ignores the age restrictions in s 5 faces no criminal sanction. The only consequence is possible termination under s 14, which is discretionary and requires the Minister to act. A JP who continues to exercise functions after 75 may be committing an offence under other laws if those functions require a validly appointed JP, but the Act itself does not punish. The reliance on a purely administrative remedy with no defined grounds creates uncertainty for both JPs and those affected by their actions.

Third, the ability to appoint a person ordinarily resident outside the State (s 10(3)) means a JP need not be a Western Australian resident. This could be used for convenience (e.g., a resident of the Northern Territory who crosses the border frequently) but could also lead to issues of accountability and knowledge of local laws.

Fourth, the register provisions are weaker than they appear. Only “public information” (information prescribed as public) is available for inspection (s 15(5)). If no information has been prescribed as public, the register may contain nothing available to the public. The Act does not mandate that basic details like the JP’s name, identification number, or date of appointment are public. This could hinder a person’s ability to verify a JP’s identity.

Fifth, the requirement that a JP inform the CEO of any conviction (s 16(1)(b)) is extremely broad: “convicted of any offence” includes any offence, from traffic infractions to minor regulatory matters. But because breach is not an offence, a JP could simply not comply. The CEO has no power to demand the information unless a request is made under s 16(2), which may be triggered only after the CEO suspects something.

Sixth, the commission form in Schedule 1 includes a statement that the JP is to “perform conscientiously, responsibly, and in accordance with the law” and to “assist in the administration of justice and in the maintenance of peace, order and good government in the State.” This is aspirational language. It is not clear whether failure to meet this standard is a breach of the Act or merely a commission condition. The Act does not say that the commission conditions are enforceable, and s 20 would likely preclude treating a failure as an offence. Termination could be based on such failure, but the lack of defined criteria makes it unpredictable.

Seventh, the Act does not provide for a cooling-off period after resignation. A JP who resigns under s 13 ceases to be a JP on receipt of the letter or later date. There is no mechanism to suspend the resignation or require Ministerial acceptance. This could be used to avoid termination proceedings or to evade liability, though ss 6 and 7 preserve validity of prior acts.

Eighth, the extra-territorial validity provision in s 7(1) states that an act done outside WA in respect of a document intended to take effect inside WA is as valid as if done inside WA, unless the law requires the act to be done in the State. This could create conflict with other jurisdictions’ laws if, for example, a JP in the Northern Territory witnesses an affidavit for use in WA. The provision does not address whether the JP had legal authority under the foreign jurisdiction’s laws to perform the act. It only says WA law will treat the act as valid. The JP may be acting outside their legal authority under the foreign jurisdiction’s law, exposing themselves to potential liability there, but WA law does not address that.

For a person seeking appointment as a JP, the pathway under the Act is minimal. The person must be an Australian citizen and enrolled as an elector for the Legislative Assembly of WA or for the House of Representatives (s 8). The person should approach the Minister (likely through the Department and a local MP) to be recommended to the Governor (s 9). The Governor’s appointment is formalised by a commission under the Public Seal (s 10(4)). Before performing any functions, the JP must take an oath or affirmation of office before the Governor, a judge of the Supreme or District Court, a magistrate, or a person authorised (s 11). The oath/affirmation is in the form set out in Schedule 2, referencing the Oaths, Affidavits and Statutory Declarations Act 2005. The JP should keep a copy of the commission and the oath/affirmation certificate.

For an appointed JP after taking office, the ongoing compliance obligations are:

• Within 30 days of any change of name or address, any conviction of any offence, or becoming an insolvent under administration, inform the CEO in writing (s 16(1)). There is no prescribed form, but a letter is prudent. The JP should keep records of the notification.

• If the CEO requests, provide proof of change of name or address, or any information for administration of the Act (s 16(2)). Failure to respond could lead to termination.

• Cease performing functions under the specified Acts upon reaching age 70 (s 5(1)) unless the Minister grants written permission (s 5(3)). At age 75, cease all functions listed in s 5(2) and cease issuing warrants for arrest, detention, entry, search, or seizure. The JP need not resign, but should be aware that performing those functions after the age limit could be grounds for termination. The JP may continue to perform other functions such as witnessing affidavits (unless those are impacted by other laws).

• When performing functions, act without corruption or malice to maintain the protection from personal liability (s 19). The JP should ensure that any decision to issue a warrant or grant bail is based on proper application of the law, not personal bias or improper purpose.

• Notify the CEO if the JP wishes to resign (s 13). Resignation is by signed letter to the Minister; it takes effect on receipt or a later stated date. The CEO will publish a notice in the Gazette.

For persons dealing with a JP (e.g., having a document witnessed or receiving a warrant), compliance is straightforward: rely on the s 18 evidentiary presumptions. If the document bears a signature followed by “Justice of the Peace” or “JP”, it is presumed the signatory was a JP at that time. The register can be checked for verification, but only “public information” is available (s 15(5)). The CEO’s certificate under s 18(2) is definitive unless rebutted.

For legal practitioners challenging a JP’s act, the Act’s limitations must be noted: the act is not invalidated by the JP’s age, subsequent removal, or death (s 6), nor by the act being done outside WA (s 7(2)). The only grounds to challenge the act would be if the JP acted without any authority (e.g., never took the oath, or the commission limited the function and the JP exceeded it) or if the JP’s authorising law required a specific qualification (e.g., the JP was under 70 but the commission limited the function to a specific court). However, s 7(2)(a) provides that an act is not invalid merely because it was not done where or in circumstances in which the JP may perform functions. This is a strong saving provision.

For the CEO and Department, compliance requires: maintaining the register (s 15), ensuring public information is accessible (s 15(4)), publishing notices of resignation (s 13(3)), and issuing certificates under s 18. The CEO should also ensure that the identification number is unique to each JP (s 3 definition). There is no requirement to proactively verify information provided by JPs, but the CEO may request information (s 16(2)).
