Justices of the Peace Act 1991

Justice of the peace is defined as a person appointed under s 5 or a person who holds an office specified in Schedule 1 (s 3). This creates two distinct classes: appointed JPs and ex officio JPs. Appointed JPs must satisfy a statutory fitness test introduced in 2025; ex officio JPs do not need to meet that test because their underlying office already carries its own appointment standards. The fit and proper person test in s 5(1B) requires the Administrator to consider whether the person has been convicted of an offence in Australia or a foreign country, the nature of the offence, how long ago it was committed, and the person’s age at the time, plus any other matter the Administrator considers relevant. The test is not exhaustive and leaves considerable discretion. Oath of office is mandatory before a JP appointed under s 5 may exercise any power or discharge any duty (s 7(1)). The form of oath is set out in Schedule 2 and references the Oaths, Affidavits and Declarations Act 2010; a JP who has once taken oath need not do so again for a subsequent appointment (s 7(2)). Clerk of the peace is the official responsible for maintaining the roll of JPs and receiving address change notifications and resignations (s 13). The Chief Executive Officer (presumably of the relevant department) appoints the clerk. Roll of justices of the peace is a register the clerk must maintain; JPs must notify any change of address within 28 days (s 13(3)). Protection and immunity under s 10 gives a JP the same immunity as a Local Court Judge when performing judicial duties. This is not unlimited: it only covers acts done in the performance of judicial duties, not administrative or personal acts. The term ‘judicial duties’ is not defined in the Act, which creates interpretive risk. Authority under s 11(2) is broad: a JP may exercise any power conferred on a JP by the common law or any Act, including Commonwealth, State, Territory or foreign legislation. The Act does not restrict those powers to Territory law; it specifically includes Acts of other jurisdictions, enacted before or after the Act’s commencement. Section 12 allows a JP to exercise powers outside the Territory if the power arises under a law in force in the Territory, and also permits a judge of the place where the power is exercised to act. That provision appears designed for cross-border document execution, such as administering an oath for NT purposes while overseas. Termination and vacation of office are separate concepts: termination is an Administrator act under s 8(1) by Gazette notice, while vacation occurs automatically on termination, resignation, failure of a condition, or expiry of a term (s 9). Resignation is by written notice to the clerk (s 8(3)). The Act does not specify grounds for termination, giving the Administrator essentially at-will power except where condition or term limits apply.

The Act affects: (1) persons appointed as JPs under s 5, who must meet the fit and proper test and take the oath; (2) holders of offices listed in Schedule 1, who become JPs automatically without individual assessment under s 5(1A) - these include Supreme Court and Local Court judges, registrars, and mayors; (3) the Administrator, who has appointment and termination power; (4) the Chief Executive Officer, who appoints the clerk of the peace; (5) the clerk of the peace, who administers the roll, receives address changes and resignations, and is the point of contact; (6) the broader public, who rely on JPs to witness affidavits, administer oaths, and attest documents for Territory legal purposes; (7) legal practitioners and courts, who interact with JPs as part of the document verification and certification process; (8) persons who use JPs to execute documents under NT law, including but not limited to statutory declarations, affidavits, and powers of attorney - this includes individuals, businesses, and government agencies; (9) persons resident or located outside the Territory who need a JP to perform an act for NT law purposes, since s 12 permits JPs to act extraterritorially; and (10) potential JPs who may be deterred by the fit and proper test or by the requirement to notify address changes within 28 days. The Act does not impose a fee or application cost on applicants, but the Administrator’s resources are used to assess fitness. The cost of maintaining the roll falls on the department. Ex officio JPs incur no additional compliance burden from the Act itself, but they must resign as JP if they wish to cease that role while retaining their underlying office - a potential loophole because the Act does not require the underlying office to be vacated upon resignation as JP (see s 6(2) which only covers ceasing to hold office or Administrator termination). For mayors, who are elected, the Act means they automatically hold JP status without any individual vetting, which could be a concern if a mayor lacks integrity or is facing criminal charges. The 2025 amendment tightened standards for appointed JPs but left ex officio JPs untouched, creating a two-tier system of accountability.

The Act imposes relatively few explicit duties on JPs. The primary duty is to take the oath of office before exercising any power or discharging any duty (s 7(1)). This applies only to JPs appointed under s 5; ex officio JPs are not expressly required to take an oath, though the Act does not exempt them from s 7. Read strictly, s 7 says “a justice of the peace appointed under section 5 must … take an oath”. Ex officio JPs are not appointed under s 5, so arguably they need not take the oath. However, if they exercise powers under s 11, the oath requirement might be implied by the common law. Another duty is to notify the clerk of the peace of any change of address within 28 days (s 13(3)). There is no penalty for non-compliance, but persistent failure could be a ground for termination under the Administrator’s general discretion. A JP must also comply with any conditions attached to their appointment, such as a locality condition; breach causes automatic vacation of office (s 9(c)).

The rights of JPs are more extensive. They are entitled to use the title “Justice of the Peace” or “JP” (s 11(1)), which carries social status but also potential liability if misused. They may exercise any power conferred on a JP by the common law or any Act, including from other jurisdictions (s 11(2)). Specifically, they may administer an oath, witness an affidavit, and attest the execution of a document for Territory law purposes (s 11(3)). They have the same protection and immunity as a Local Court Judge in the performance of their judicial duties (s 10). That covers defamation suits, criminal prosecution for judicial acts (unless malicious or outside jurisdiction), and civil liability. They may exercise powers outside the Territory under s 12, which is a significant right for a volunteer office. They may resign at any time by writing to the clerk (s 8(3)). They are not, however, entitled to remuneration: the Act is silent on payment, consistent with the historical volunteer nature of the office. A JP whose appointment is terminated by the Administrator has no statutory right of review or appeal; termination is by Gazette notice and is effective on the day specified (s 8(2)). There is no requirement for the Administrator to give reasons. For ex officio JPs, the right to hold office as JP is contingent on holding the underlying office; if that office is lost, JP status ceases automatically (s 6(2)(a)). However, as noted, an ex officio JP may resign as JP under s 8(3) while retaining the underlying office - the Act does not prevent that, which creates a curious asymmetry.

The Act contains no criminal penalties for misconduct by JPs. Breach of the address notification requirement is a statutory duty but carries no fine or imprisonment. The principal enforcement mechanism is termination of appointment by the Administrator under s 8(1). That section gives the Administrator an unfettered discretion to terminate “by notice in the Gazette”. There is no requirement for cause, procedural fairness, or hearing. This means a JP can be removed without explanation, which is a departure from usual protections for judicial-like officers. In practice, such termination might be used for misconduct, but it could also be used for administrative convenience or political reasons. The Act does not provide for suspension, only termination. A JP who resigns under s 8(3) avoids termination, but resignation is irrevocable upon writing to the clerk.

For ex officio JPs, termination under s 8(1) is also possible, but s 6(2) provides that they cease to be JPs if they cease to hold the underlying office or if terminated under s 8(1). So the Administrator could terminate the JP status of a Mayor without affecting the Mayor’s elected office - but that would require a Gazette notice and presumably reasons would become public. There is no statutory provision for internal complaints, appeals, or review of termination decisions. The only possible avenue for challenge would be judicial review under the Administrative Decisions (Judicial Review) Act (NT) or the common law, but the source does not mention that. Given the Administrator’s broad discretion, such review would be difficult.

The Act also provides no enforcement mechanism for the clerk of the peace to compel address updates. The roll is maintained but its accuracy depends on JPs’ voluntary compliance. Non-notification may cause JPs to miss correspondence, including notices of termination. The Act does not require the clerk to verify addresses independently.

In terms of liability, s 10 provides immunity for judicial acts, but that immunity is only as broad as that of a Local Court Judge. If a JP acts outside their jurisdiction (e.g., beyond what s 11 allows) or in bad faith, immunity may be lost. A JP could be sued personally for actions that are not judicial duties, such as offering legal advice or certifying documents they are not authorised to attest. The Act does not provide any professional indemnity insurance; JPs bear the risk themselves.

The Act is enabling rather than prescriptive and interacts with a wide range of other laws. Section 11(2) explicitly permits a JP to exercise any power conferred by the common law or any Act, including Commonwealth, State, Territory, or foreign legislation, whether enacted before or after the Act. This means that any law in Australia that refers to a “justice of the peace” may be exercised by an NT JP, subject to the specific provisions of that other law. For example, the Commonwealth Crimes Act 1914 or Oaths Act 1901 may confer powers on JPs for issuing warrants or taking affidavits. The Act does not purport to grant those powers; it merely confirms that an NT JP can exercise them if the other law allows. Section 12 similarly allows extraterritorial exercise of powers for NT law purposes, but also permits a judge of the place where the power is exercised to act. This interacts with the law of the foreign jurisdiction: a person serving as a JP in another country may not be recognised unless that country’s law permits. The Act does not create extraterritorial recognition; it only says the NT JP may act.

The protection provision in s 10 ties to the immunity of a Local Court Judge, which is defined by the Local Court Act 2016 (NT) and common law. That means changes to judicial immunity in NT law automatically flow through to JPs.

The oath in Schedule 2 references the Oaths, Affidavits and Declarations Act 2010 (NT) for the form of promise or swear. That Act governs the manner of taking an oath, which must be followed. The Schedule also acknowledges the succession of the Crown (as amended in 2023 by the Statute Law Amendment (Succession of the Crown) Act 2023), so the oath now refers to “their heirs and successors” rather than specific regnal names.

The transitional provision in s 14 interacts with the repealed Justices Act 1928 (NT) and the Transfer of Powers (Further Provisions) Act 1977, preserving old appointments for a fixed period that has long expired. The Act also repeals earlier legislation (not expressly stated but implicit from s 1’s consolidating purpose). The endnotes show that Schedule 1 has been amended over time to reflect changes in court names, such as the replacement of the Local Court (formerly Court of Summary Jurisdiction) and the introduction of Associate Judges.

The Act does not address fees, so it interacts with any instrument that may prescribe fees for JP services. In practice, JPs are volunteer and cannot charge, but the Act is silent.

The Act was originally passed as Act No. 42 of 1991, assented 26 September 1991, and commenced on 1 January 1992 (Gazette G50, 18 December 1991). It has been amended eight times. The Statute Law Revision Act 1993 (No. 6) made minor formal amendments to Schedule 1. The Statute Law Revision Act 1997 (No. 17) amended s 7, likely to update the oath form. The Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 (No. 40) made significant changes: it amended ss 7 and 11 to refer to the new Oaths, Affidavits and Declarations Act 2010 and updated Schedule 2 accordingly. The Local Court (Related Amendments) Act 2016 (No. 8) replaced references to the old local court with the new Local Court regime, amending Schedule 1 to reflect the renamed Local Court Judge and Registrar. The Supreme Court Amendment (Associate Judges) Act 2017 (No. 18) added Associate Judge to Schedule 1. The Statute Law Amendment (Succession of the Crown) Act 2023 (No. 10) amended Schedule 2 to modernise the oath for the succession of the Crown, replacing specific regnal names. The most recent amendments are from the Attorney-General Legislation Amendment Act 2025 (No. 14), which commenced on 1 August 2025. This Act inserted the new ss 5(1A) and (1B) establishing a statutory fit and proper person test for appointment, and amended s 13 to change the appointing authority for the clerk of the peace from the Clerk of the Legislative Assembly to the Chief Executive Officer. The endnotes indicate that general formal amendments were also made by the Interpretation Legislation Amendment Act 2018, but these are not listed in the table of amendments.

The 2025 amendments are the most substantive. Before them, the Act did not specify criteria for appointment; the Administrator could appoint anyone. The addition of the fit and proper test imposes a duty on the Administrator to consider criminal convictions and other matters. This reduces the risk of unsuitable appointments but also increases the administrative burden on the Administrator and may deter appointees with minor or old convictions. The change to the clerk’s appointment removes the involvement of the Legislative Assembly, centralising control in the executive.

The endnotes also show that s 5 was only amended in 2025; earlier versions had no fitness criteria. The transitional provisions from 1991 are now entirely historical.

The source text provides no case law references. The Act itself does not name any judicial decisions, and the endnotes contain only legislative history. Without external sources, it is impossible to state whether any litigation has arisen under the Act. Given the Act’s limited scope and the non-judicial nature of most JP functions, litigation is likely rare. The immunity provision in s 10 may be pleaded in civil proceedings against JPs, but no such case is cited. The broad discretion of the Administrator to terminate without reasons could theoretically be challenged under administrative law, but again no cases appear in the source. The Act’s interaction with other laws (e.g., whether a JP exceeded powers under another Act) could ground litigation, but it is not part of the public record in this text. A cautious approach is to note that the Act does not contain any reference to litigation and that, in the absence of imposed legal consequences, the liability of JPs is largely governed by the general law of torts and judicial immunity, which has been developed by courts in other contexts but not specifically under this Act.

Several provisions contain traps for the unwary. First, the oath requirement in s 7(1) applies only to JPs appointed under s 5. Ex officio JPs are not required to take the oath by the text of the Act. However, if an ex officio JP administers an oath or witnesses an affidavit without having taken the oath, the validity of that act could be challenged on the basis that they have not “proceeded to exercise the powers … of the office” in accordance with the Act. The Act is ambiguous: it says “a justice of the peace appointed under section 5 must … take an oath”. This implies that ex officio JPs do not need to take oath, but that seems inconsistent with the responsibilities of the office. A court might imply a common law requirement. JPs should err on the side of taking the oath, but ex officio JPs may not know this risk.

Second, the phrase “in the performance of his or her judicial duties” in s 10 limits protection. Not all JP functions are judicial. Witnessing an affidavit is arguably ministerial or administrative, not judicial. If a JP erroneously witnesses a document without the deponent being present, that may be a non-judicial act, and immunity might not apply. The term is not defined, leaving JPs exposed to uncertainty.

Third, s 11(2) says a JP may exercise any power conferred by the common law or any Act. This sounds broad, but many Acts define “justice of the peace” by reference to the jurisdiction; a NT JP may not be recognised under a Commonwealth Act that defines JP as a person holding office under a State law. Even if recognised, the power may require the JP to be acting in the state. The extraterritorial provision in s 12 only permits exercise for NT law purposes; it does not grant recognition under the law of the place where the act occurs. A NT JP administering an oath in Queensland for a NT document may be fine under NT law, but if the Queensland law requires the person to be a Queensland JP, the act could be invalid there.

Fourth, condition-based appointments under s 5(2) can include a locality condition. If a JP moves out of that locality, they automatically vacate office under s 9(c). There is no grace period. The JP must notify the clerk of the address change under s 13(3), but doing so may reveal the breach and trigger vacation. JPs should check their appointment terms carefully.

Fifth, the Administrator’s termination power under s 8(1) is at-will and without stated grounds. A JP could be removed for any reason, including political ones. There is no right to be heard. This makes the office precarious, despite the protections of s 10. For ex officio JPs, termination as JP does not affect their underlying office, but if the Administrator terminates a Mayor’s JP status without cause, it could become a political issue.

Sixth, resignation under s 8(3) is presumed to be voluntary, but if a JP resigns under pressure, the resignation is still valid. There is no cooling-off period.

Seventh, the 28-day address notification requirement under s 13(3) is easy to overlook, especially for JPs who change address frequently. Failure may not be penalised, but it could result in the clerk being unable to contact the JP about important matters such as term expiry or Administrator actions. The Act does not require the clerk to attempt contact via other means.

Eighth, transitional appointments under s 14(1) were limited to 5 years after 1 January 1992. Any person still claiming JP status under the old Act is long out of office. Only current appointments matter.

Ninth, the fit and proper test in s 5(1B) is not exhaustive; the Administrator may consider “any other matter”. This introduces discretion and potential for inconsistent decisions. A person with no criminal history may still be deemed unfit based on unspecified grounds, with no right of review.

Tenth, the roll of JPs is not publicly accessible under the Act; JPs must notify address changes, but the roll’s confidentiality is not stated. JPs may be concerned about privacy.

For a person seeking appointment as a JP under s 5, compliance begins with ensuring they meet the fit and proper person standard. They should be prepared to disclose any criminal convictions, including foreign ones, and provide details of age at offence, nature, and time elapsed. The Administrator will assess these. There is no formal application process set out in the Act, so potential JPs should contact the clerk of the peace (appointed by the Chief Executive Officer) to inquire. Once appointed, if the appointment is limited to a term or locality, the JP must abide by those conditions. Before exercising any power, the JP must take the oath in accordance with Schedule 2 (s 7(1)). The oath must be taken before a person authorised to administer oaths (e.g., another JP or a commissioner). The JP should keep a record of having taken the oath, as the Act does not require the clerk to record it. For ex officio JPs, no action is needed to become a JP; they hold the office automatically upon assuming the underlying role. However, to avoid the gotcha regarding the oath, an ex officio JP should voluntarily take the oath to ensure their acts are valid, even if the Act does not require it.

Once acting as a JP, compliance involves: (a) only exercising powers that are properly conferred by law; (b) not exceeding the limits of s 11(3) - administering oaths, witnessing affidavits, attesting documents for Territory law - without ensuring that the specific power is granted by another Act; (c) performing only judicial or quasi-judicial functions when relying on the protection of s 10; (d) not charging fees unless authorised by other law; (e) notifying the clerk of the peace of any change of address within 28 days (s 13(3)); (f) monitoring their term of appointment and conditions; (g) if they wish to resign, writing to the clerk of the peace; (h) if they are an ex officio JP and wish to resign as JP only, resigning by writing to the clerk (s 8(3)) - but they should check whether their underlying office permits them to continue holding it after resigning as JP. The Act does not prohibit this, but the underlying office’s own rules might.

The clerk of the peace must maintain the roll and must update it upon receiving address changes. The Chief Executive Officer must ensure a clerk is appointed. The Administrator must apply the fit and proper test when appointing JPs, considering the mandatory factors in s 5(1B). There is no requirement to publish reasons or consult the public.

In terms of record-keeping, JPs should maintain their own log of acts performed, especially for documents that may be litigated later. The roll kept by the clerk is only a register, not a record of JP actions.

Compliance with the Act is relatively simple because the Act imposes few duties. The main risk points are: (1) acting without taking the oath (for appointed JPs); (2) exercising a power not conferred by law; (3) breaching conditions; (4) failing to notify address change; (5) inadvertently falling outside judicial duties and losing immunity. JPs should familiarise themselves with the common law and other Acts that grant JP powers, as the Act itself does not list them. Legal advice may be prudent for complex matters. There is no training requirement in the Act, but in practice the Department may provide guidance.

The Act does not provide for continuing professional development, so JPs must self-educate. The lack of a statutory code of conduct means that standards are derived from common law and judicial expectations. A JP who follows the implied duties of impartiality, confidentiality, and honesty will likely stay within the law.
