> > (1) An attempt to commit an offence mentioned in [section 71](#GS71@EN) [(1)](#GS71@Gs1@EN) or [section 72](#GS72@EN) [(1)](#GS72@Gs1@EN) is an offence triable and punishable in the same way as the offence attempted.

> > (2) On a complaint of an offence referred to in [subsection (1)](#GS72A@Gs1@EN) , the defendant may, where the evidence so requires, be convicted of an attempt to commit the offence.

> > (3) On a complaint of attempting to commit an offence referred to in [subsection (1)](#GS72A@Gs1@EN) , the defendant may, where the evidence so requires, be convicted of the offence that he is alleged to have attempted to commit.
