### 129 Setting aside of proceedings when prohibited action brought
> [*\[Section 129 Amended by No. 9 of 2003, Sched. 1, Applied:16 Apr 2003\]*](/view/html/inforce/2003-04-16/act-2003-009#JS1@Ja29@GC4@EN) If an action is brought in the Supreme Court or Magistrates Court (Civil Division) against a justice which by this Act is declared to be not maintainable a judge or a magistrate of that Magistrates Court (Civil Division) may, upon the application of the defendant, and upon an affidavit of the facts, set aside the proceedings in the action, with or without costs.
