Juries Regulations 2021

The Regulations are built around a small set of concepts and actors recorded in their text: the pool supervisor, the Juries Commissioner, persons summoned to attend for jury service, the court, and the panel from which juries are struck. The main regulatory mechanisms are confirmation of attendance, record-keeping of non-confirmation, enquiry and reporting of non-attendance, priority allocation of panels, and rules governing the return or reconstitution of juries and panels.

"Pool supervisor" is the operational actor placed in control of the pool; the pool supervisor has both procedural duties and operational discretion. Duties include providing a reasonable opportunity for each person summoned to confirm attendance and recording the names of those who do not confirm (reg 5(1)(a), (b)). Discretionary powers include determining any question of priority in providing panels to courts (reg 5(5)) and directing returned jurors to the pool where they may be selected for another trial (reg 6(2)).

The "Juries Commissioner" is an oversight actor with investigatory duties. The Commissioner must be advised of non-confirmers by the pool supervisor (reg 5(2)) and must institute enquiries about non-attendance (reg 5(3)). If the Commissioner determines there is no reasonable excuse for failure to comply with a summons, the Commissioner must advise a judge (reg 5(4)). The Regulations therefore create a two-step administrative-to-judicial escalation: recording and reporting by the pool supervisor, and fact-finding and escalation by the Commissioner.

"Panel" and "jury" are operational groupings. The Regulations distinguish between a person selected or allocated to a panel and a person who is empanelled and sworn on a jury. If a person was selected or allocated to the panel but not empanelled, they must return to the pool and may be selected for another trial unless the court orders otherwise (reg 6(1)). Where an empanelled jury is discharged on the same day or the following day, the members must report to the pool supervisor, who may direct their return to the pool for selection in another trial (reg 6(2)). The court retains the power to order that jurors again form part of the panel for that trial or a further trial, and to require panel members who were not empanelled to again form part of the panel (reg 6(3)).

The Regulations repeatedly hedge operational rules with the clause "unless the court otherwise orders" (regs 5(5) and 6(1)). That language places courts as the ultimate override to the administrative scheme, reserving judicial control over panel priority and the allocation or reuse of jurors. The Interpretation of Legislation Act 1984 material in the Endnotes identifies that headings, examples, notes, punctuation and provision numbers form part of a Statutory Rule made after 1 January 2001; this affects statutory construction and reading of these Regulations where headings and notes are relied upon (Endnotes, Interpretation).

Taken together, the concepts create a programme for managing attendance and utilisation of jurors, centred on the duties of recording and communication between pool supervisors and the Juries Commissioner, and subject to judicial supervision at stages defined by the Regulations.

Directly named parties

• Persons summoned to attend for jury service. The Regulations prescribe that the pool supervisor must provide them a reasonable opportunity to confirm attendance and that their names must be recorded if they do not confirm (reg 5(1)). The Juries Commissioner will be notified of non-confirmers and must investigate non-attendance (regs 5(2)-(3)). Where the Commissioner finds no reasonable excuse, the Commissioner must advise a judge (reg 5(4)).

• Pool supervisors. The person "in charge or in control of a pool" is given concrete statutory responsibilities to provide a reasonable opportunity to confirm attendance, to record non-confirmers, to advise the Juries Commissioner of non-confirmers, and to determine priority in supplying panels to courts unless a court orders otherwise (reg 5(1)-(2), (5)). The pool supervisor also has the operational power to direct jurors who have been discharged to return to the pool (reg 6(2)).

• The Juries Commissioner. The Commissioner must institute enquiries about non-attendance and must advise a judge if a person has not provided a reasonable excuse for failing to comply with a summons (regs 5(3)-(4)). The Regulations thereby create an administrative investigatory role that typically sits between pool supervisors and judicial decision-makers.

• Courts and judges. Courts are given a supervisory override; they can order otherwise in respect of priority in panel provision (reg 5(5)) and can order jurors to re-form part of panels or to reconstitute panels in specified circumstances (reg 6(3)). A judge is the recipient of the Juries Commissioner’s advice under reg 5(4).

Indirectly affected parties and stakeholders

• Parties to criminal and civil trials and their legal representatives. The Regulations affect how panels and juries are provided to courts, which, in practice, can influence trial scheduling, the composition of panels, and availability of jurors.

• Court administration units. The pool supervisor function is typically an administrative role within court infrastructure; compliance requires processes, record systems and staff time. The Juries Commissioner’s investigatory role likewise requires administrative resources to carry out enquiries.

• Employers of persons summoned for jury service. The Regulations potentially affect employers where jurors are directed back to the pool or re-used for subsequent trials on the same day or the following day (reg 6(2)). Such reuse will have employer-facing implications in relation to employee availability for work, although the Regulations do not address employer obligations; they focus on pool management.

• The public and juror-support services. Any operational changes to how jurors are managed will have downstream effects on juror communication, logistical arrangements, and possibly costs borne by support providers.

Who pays and who decides

• The Regulations allocate tasks to government actors: pool supervisors and the Juries Commissioner. The cost of compliance, recording, advising, enquiring, and reporting, will fall on the public bodies that employ those officials. Courts retain decision authority and can override administrative directions, which means judicial time and discretion are part of the decision-cost structure (regs 5(4), 5(5), 6(3)).

• Persons summoned to jury service carry the behavioural obligation to respond to the reasonable opportunity to confirm attendance; failure to do so triggers administrative enquiry and possible judicial consideration (regs 5(1)-(4)). The Regulations do not themselves impose fines or specific sanctions, but they create a pathway for judicial consideration of non-attendance.

In sum, the Regulations primarily affect administrative actors within the jury system and persons summoned to attend for jury service, with secondary effects on trial parties, employers and court logistics.

Duties expressly imposed

• Pool supervisor duties. The person in charge or in control of a pool must: (a) provide a reasonable opportunity for each person summoned to attend for jury service to confirm attendance; and (b) record the name of each person who does not confirm their attendance (reg 5(1)(a), (b)). The pool supervisor must also, unless otherwise ordered by a court, determine questions of priority in relation to the provision of panels to courts (reg 5(5)). Under reg 6(2) the pool supervisor may direct jurors who report after a jury has been discharged to return to the pool.

• Juries Commissioner duties. The Commissioner must be advised by the pool supervisor of each person who does not confirm attendance (reg 5(2)). The Commissioner must institute enquiries about the non-attendance of each such person (reg 5(3)). If the Commissioner determines that a person has not provided a reasonable excuse for failing to comply with a summons, the Commissioner must advise a judge (reg 5(4)).

• Court powers. The court may override administrative decisions by ordering otherwise on priority and panel allocation matters (reg 5(5); reg 6(1)). If a jury empanelled for any trial is discharged on the same day as it is empanelled, the court may order that the members of that jury again form part of the panel for that trial or a further trial in the same proceeding, and may order that members of the panel who were not empanelled again form part of the panel (reg 6(3)(a), (b)).

Rights and discretionary features

• Persons summoned. The Regulations create a procedural right of being given a "reasonable opportunity" to confirm attendance (reg 5(1)(a)). If a summoned person does not confirm attendance, they are entitled to an enquiry by the Juries Commissioner before a judge is advised, this builds in a fact-finding step before judicial action (regs 5(2)-(4)).

• Judicial oversight. Courts retain oversight rights to order otherwise at multiple stages; the repeated "unless the court otherwise orders" language protects judicial discretion over administrative exercises (regs 5(5), 6(1)).

• Administrative discretions. Terms such as "may direct" in reg 6(2) and "may be selected or allocated" in reg 6(1) confer discretion on pool supervisors and on the system for reallocation. Similarly, the Juries Commissioner’s investigatory duty in reg 5(3) requires enquiries but does not specify investigatory methods, timelines, or standards, leaving procedural choices to the Commissioner.

Observations about standards and evidentiary thresholds

• "Reasonable opportunity" and "reasonable excuse" are normative standards used at key junctures (regs 5(1)(a), 5(4)). The Regulations do not define these concepts, nor do they stipulate evidentiary thresholds or procedural safeguards for the Commissioner’s enquiries or for the judge’s response to the Commissioner’s advice. The absence of prescriptive definitions places reliance on institutional practice and on judicial interpretation in the event of dispute.

• The Regulations require record-keeping of names of non-confirmers (reg 5(1)(b)). That creates an evidentiary record that the Commissioner and courts may use, but the Regulations do not prescribe the form, content or retention period for those records.

Tasks left to implementing bodies

• The practical mechanics of how a pool supervisor provides a "reasonable opportunity" to confirm attendance, and how the Commissioner conducts and documents enquiries, are left to administrative practice rather than being specified in the Regulations. Those implementation choices will determine burden, timeliness, and the quality of information provided to courts.

Collectively, the duties focus on information flow, creating a chain from pool supervisor recording, to Commissioner enquiry, to judicial consideration, while preserving judicial primacy on allocation and reuse decisions.

The Regulations do not themselves establish express penalties, monetary fines, or specified enforcement sanctions. Instead, they construct an administrative pathway that can lead to judicial consideration, which is the enforcement mechanism expressly contemplated.

Enforcement mechanisms created by the Regulations

• Recording and escalation. The pool supervisor must record names of persons who do not confirm attendance and advise the Juries Commissioner of those persons (reg 5(1)(b); reg 5(2)). The Commissioner must then institute enquiries about the non-attendance (reg 5(3)). If the Commissioner determines there is no reasonable excuse, the Commissioner must advise a judge (reg 5(4)). This creates an administrative-enquiry-to-judicial-notification channel rather than an administrative sanction regime.

• Judicial disposition. The endpoint of the enforcement pathway is judicial: the Commissioner's advice goes to a judge (reg 5(4)). The Regulations do not specify what the judge may or must do upon receipt of that advice. The absence of statutory penalties within these Regulations implies that any consequence for non-attendance is to be derived from the enabling Act or other law, or to be determined by the court in its discretion.

Limitations and boundaries

• No immediate compulsion. The Regulations do not empower pool supervisors or the Commissioner to impose penalties directly, nor do they state that failure to confirm attendance is, by itself, an offence under these Regulations. Instead, the power recommended by the text is to inform judicial decision-making.

• Judicial override. The Regulations repeatedly allow courts to order otherwise (regs 5(5), 6(1)), which constrains administrative enforcement. For example, the pool supervisor’s priority decisions are subject to court orders (reg 5(5)), and the default rules about returning to the pool can be displaced by a court (reg 6(1)).

• Procedural indeterminacy. Because the Regulations do not set timelines for the Commissioner’s enquiries, nor define "reasonable excuse", procedural enforcement involves interpretive work and administrative discretion. That creates implementation risk around consistency and timeliness in enforcement.

Administrative burdens that function as de facto costs

• Although not labelled penalties, the recording, investigation and judicial processes create costs for individuals who do not confirm attendance. They create administrative transaction costs for the Commissioner and courts, and time costs and possible judicial consequences for jurors. The Regulations make that pathway explicit, but do not quantify outcomes.

Practical implication for enforcement strategy

• Enforcement under these Regulations is an administrative-to-judicial process. Practitioners should look to the Juries Act 2000 and court practice for details of potential judicial orders or sanctions available where a judge receives an adverse advice from the Commissioner. The Regulations, standing alone, do not set out sanctioning powers.

Authorising legislation

• The Regulations are made under section 90 of the Juries Act 2000 (reg 2). The Regulations’ scope and permissible content are therefore constrained by that section and by other provisions of the Juries Act 2000. The Regulations do not purport to modify the substantive requirements or powers that the Juries Act confers on courts or on the Juries Commissioner beyond procedural details, but they supplement the Act with operational requirements about administrative recording, enquiry and reporting.

Subordinate legislation framework

• Revocation of prior instrument. Regulation 4 expressly revokes the Juries Regulations 2011. The transition from the 2011 Regulations to the 2021 Regulations is effected by the revocation clause (reg 4) and the Explanatory details confirm the prior instrument as S.R. No. 68/2011.

• Sunset rule. The Endnotes record that these Regulations will sunset 10 years after the day of making, on 20 July 2031, under section 5 of the Subordinate Legislation Act 1994. That timetable creates a statutory deadline for review or re-enactment under the Subordinate Legislation Act, interacting directly with subordinate legislation lifecycle rules.

Interpretation and statutory construction

• The Endnotes invoke the Interpretation of Legislation Act 1984 (ILA) effects on headings, notes, punctuation and provision numbers. Those interpretive rules change how the Regulations are read and may affect the evidentiary weight of headings and examples in resolving ambiguities (Endnotes, Interpretation). Practitioners should therefore bear in mind that headings and notes in these Regulations have statutory weight for construction purposes.

Interaction with judicial discretion and court practice

• The Regulations repeatedly defer to the court with the phrase "unless the court otherwise orders" (regs 5(5), 6(1)); accordingly, the Regulations operate alongside court practice rules and judicial case management powers. The court’s established powers to control proceedings, to determine priorities among matters listed, and to make orders on panel composition will interact with any administrative decisions taken under these Regulations.

Missing cross-references

• The text does not specify offences, evidentiary standards, or penalties for non-attendance. Consequently, to understand the full enforcement and sanctioning regime that may follow an adverse finding by the Commissioner, a practitioner must consult the Juries Act 2000 and any related provisions in that Act or other laws which are not reproduced in these Regulations.

Practical interoperability issues

• Administrative processes directed by these Regulations will need to be aligned with existing court information systems, summonsing procedures, and the Juries Commissioner’s investigatory protocols as mandated or permitted by the Juries Act 2000. The Regulations provide procedural hooks but leave implementation details to those systems; interoperability work is therefore necessary to ensure consistent operation within the legal and administrative framework.

In sum, the Regulations are a subordinate instrument that supplements the Juries Act 2000 with administrative requirements, operates within the Subordinate Legislation Act lifecycle, and is subject to interpretive rules in the ILA that affect construction and application.

Baseline enactment

• The Regulations were made on 20 July 2021 by the Governor in Council under section 90 of the Juries Act 2000 and commenced on 25 July 2021 (reg 3; Endnotes). The document identifies itself as Version No. 001 as at 25 July 2021.

Revocation of prior regulations

• Regulation 4 revokes the Juries Regulations 2011. The Explanatory details cite that prior instrument as S.R. No. 68/2011. The revocation is an explicit, single-step repeal of the 2011 Regulations so that the 2021 Regulations are the operative subordinate instrument.

Subsequent amendments

• The Table of Amendments in the Endnotes states that there are no amendments made to the Juries Regulations 2021 by statutory rules, subordinate instruments or Acts (Endnotes, Table of Amendments). The version as at 25 July 2021 contains no later-in-operation amendments or not-in-operation amendments (Endnotes, Tables 2 and 3). This instrument therefore remains in its original made form for the period covered by the version posted.

Sunset and review timing

• The Endnotes record that, pursuant to the Subordinate Legislation Act 1994, these Regulations will sunset 10 years after the day of making, on 20 July 2031, unless re-enacted or otherwise dealt with under that Act. That statutory sunset imposes an implicit amendment/review timetable on the executive and legislature.

Interpretive modifications to statutory text

• The Endnotes explain that certain style and interpretation changes follow the Interpretation of Legislation Act 1984, including that headings, notes, punctuation and provision numbers form part of the Statutory Rule. Those interpretive shifts are not amendments to the operative provisions, but they alter how later amendments or judicial interpretations might read the text. See Endnotes: Interpretation of Legislation Act 1984.

Practical recordkeeping

• The Version No. 001 labelling and the Endnotes’ Table of Amendments record that, at the time of publication of this version, no amending instruments had been made. Practitioners should verify subsequent versions on the official legislation website, as the Endnotes themselves state: "See www.legislation.vic.gov.au for Victorian Bills, Acts and current Versions of legislation and up-to-date legislative information."

In short, the Regulation’s amendment history is limited to the express revocation of the 2011 Regulations at their commencement and, as at this version, no later amendments have been recorded. The instrument is subject to a statutory sunset in 2031 which creates a structural deadline for future amendment or re-enactment.

The Regulations and the version provided contain no recorded litigation history. The Endnotes include a Table of Amendments, and state explicitly that there are no amendments made to the Juries Regulations 2021 by statutory rules, subordinate instruments and Acts (Endnotes, Table of Amendments). There are no cases, judicial decisions or litigation references contained within the text of the Regulations or the Endnotes provided.

Consequences of the absence of recorded litigation

• No reported judicial interpretation. Because the instrument is recent as of the version date (made 20 July 2021 and commenced 25 July 2021) and because no litigation history is recorded in this version, there are no cited judicial constructions of ambiguous terms in the Regulations such as "reasonable opportunity" or "reasonable excuse" in this text.

• Implementation ambiguity remains. The absence of litigation leaves administrative actors and courts to develop practice and jurisprudence in real time. Questions about the scope of the Commissioner’s enquiries, evidentiary standards for "reasonable excuse", the content of records the pool supervisor must maintain, and the circumstances in which courts will override administrative allocations will be resolved in practice and in future judicial decisions.

Where to look for future litigation or precedent

• Primary place to monitor will be Victorian court decisions and any published determinations in matters where a person summoned to jury service is the subject of an advice by the Juries Commissioner under reg 5(4). Because the Regulations channel unresolved non-attendance to judges, future judicial decisions will develop the law about consequences and standards.

• Administrative appeal and review. If a person subject to a Commissioner’s adverse finding or a court order elects to pursue judicial review or to appeal a sentence or order arising from the Commissioner’s advice, those proceedings would form the litigation history for these Regulations. None are reported in this version.

For now, the lack of litigation history means that legal analysis must work from the statutory text and from the Juries Act 2000, which provides the authorising framework; practitioners should be cautious in asserting settled law on the Regulations’ ambiguous terms until courts have had opportunity to interpret them.

Unspecified standards: "reasonable opportunity" and "reasonable excuse"

• The Regulations use indeterminate standards without definition. A pool supervisor must give a "reasonable opportunity" to each person summoned to confirm attendance (reg 5(1)(a)) and the Juries Commissioner must advise a judge if a person "has not provided a reasonable excuse" (reg 5(4)). The Regulations do not define these terms, provide examples, set timeframes, or specify evidentiary burdens. That leaves scope for inconsistent application unless administrative policy documents or court practice adopt precise operational definitions.

Ambiguity about timing and methods of communication

• The Regulations do not prescribe how the "reasonable opportunity" is to be provided (for example by post, email, phone, SMS or in-person), nor do they set minimum notice periods. This creates operational risk for pool supervisors; different methods of communication may lead to different outcomes about who is recorded as a non-confirmer.

Record-keeping details are not prescribed

• Reg 5(1)(b) requires recording the name of each person who does not confirm attendance, but it does not require the form of record, retention period, security measures, or how to handle errors. Poor record-keeping could lead to disputes before the Commissioner or judge.

Commissioner enquiries are undefined

• The Commissioner "must institute enquiries" (reg 5(3)), but the Regulations do not set scope, timelines, required evidence, or appeal rights. Practitioners should not assume any particular investigatory standard or process; the Commissioner’s internal procedures will be determinative in practice.

"Unless the court otherwise orders" caveats

• Multiple provisions are subject to the caveat "unless the court otherwise orders" (regs 5(5), 6(1)). That wording leaves substantial power to judges and makes administrative rules provisional. Pool supervisors must be prepared to adapt to court orders and to document any divergence from default administrative practice.

Return-to-pool and reuse of jurors

• Reg 6 permits the reuse of jurors who were not empanelled or who were empanelled and then discharged on the same day or the following day. The pool supervisor "may direct" they return to the pool (reg 6(2)). Employers, counsel and litigants should note that a juror dismissed from one trial could be quickly reallocated to another, potentially on the same day or shortly after; the Regulations do not address notification obligations to employers, or juror welfare and scheduling.

Priority allocation by pool supervisor

• The pool supervisor determines questions of priority in relation to provision of panels to courts unless the court orders otherwise (reg 5(5)). That gives administrative officers real power over which matters receive panels first, subject to judicial oversight. Where courts and administration disagree, tensions in scheduling and court management can arise.

No penalties specified

• The Regulations do not create penalties; instead they require escalation to a judge when the Commissioner finds no reasonable excuse (regs 5(3)-(4)). Practitioners should not assume that the Regulations themselves give rise to fines or automatic sanctions.

Sunset and review timing

• The 10-year sunset noted in the Endnotes creates an expiry date of 20 July 2031. Stakeholders dependent on the Regulations for stable long-term process should note that the regulatory regime may be subject to review or reform at or before that date.

Interpretation Act effects

• The Endnotes make clear that headings, notes and punctuation form part of the Statutory Rule under the Interpretation of Legislation Act 1984. While helpful for construction, reliance on headings or notes for substantive obligations should be done with an awareness that these elements have been elevated in status; using them to resolve ambiguities can be a double-edged sword.

Operational friction points likely to produce disputes

• Disputed entries on non-confirmation lists and disputed Commissioner findings are likely sources of procedural challenge. Because the Regulations lack explicit appeal or review pathways for administrative findings, litigants and counsel may seek judicial remedies, which is exactly the channel these Regulations anticipate. Practitioners should anticipate disputes about method of summonsing and recording, fairness of "reasonable opportunity" and the sufficiency of evidence for "reasonable excuse".

In short, the Regulations outsource a lot of granular operational detail to administrative practice and court discretion. That design reduces legislative complexity but increases the need for clear administrative procedures and careful record-keeping to mitigate disputes.

Checklist for pool supervisors

1. Provide "reasonable opportunity" to confirm attendance. Establish clear, documented procedures that define the means of communication (post, email, telephone, SMS, online portal), the timing of initial contact and reminders, and evidence of delivery or attempts. Although the Regulations do not define the term, operationalising a standard across the pool ensures defensibility of decisions under reg 5(1)(a).

2. Record names of non-confirmers. Maintain a secure, timestamped register that records the name, contact details, date/time of summons, method(s) used to provide the opportunity to confirm, and the fact of non-confirmation (reg 5(1)(b)). Retain supporting logs (call records, email read receipts, portal logs) to demonstrate compliance during a Commissioner enquiry or judicial challenge under regs 5(2)-(4).

3. Advise the Juries Commissioner promptly. Establish a protocol for transmitting the list of non-confirmers to the Commissioner with the necessary contextual data: methods used to provide opportunity, dates and times, and any initial responses or attempt notes (reg 5(2)). Time-stamp transmissions and maintain an audit trail.

4. Priority decisions. Where questions of priority in panel provision arise, document the rationale for decisions made. Because reg 5(5) empowers the pool supervisor to determine priority unless a court orders otherwise, documentation should record criteria applied, conflicts considered, and any communication with court listings staff.

5. Return-to-pool management. If juries are discharged on the same day or the following day, require discharged jurors to report to the pool supervisor and be prepared to give directions about returning to the pool (reg 6(2)). Maintain records of any direction to return to the pool and any selection/allocation that follows.

Checklist for the Juries Commissioner

1. Enquiry protocols. Develop and document a standard operating procedure for instituting enquiries under reg 5(3). Specify the scope of enquiries, timelines for completion, information to be gathered from pool supervisors and summoned persons, and recordkeeping requirements.

2. Evidentiary standards. Define internal standards for what constitutes sufficient evidence of a "reasonable excuse" and create a template for decisions that can be provided to the court if reg 5(4) is engaged. Although the Regulations do not dictate standards, consistency will reduce the risk of criticism in judicial review.

3. Reporting to judges. Prepare formal advice templates for the instance when the Commissioner determines no reasonable excuse exists, and establish protocols for transmission to the appropriate judge (reg 5(4)). Include supporting documentation to enable judicial assessment.

4. Record retention. Maintain an auditable case file for each enquiry that records who was contacted, how, when, and the basis for any determination. This is important for internal accountability and for any judicial scrutiny.

Checklist for courts and judges

1. Communicate overrides. Where the court intends to exercise its power to "order otherwise" on priority or panel allocation (regs 5(5), 6(1)), specify and communicate orders clearly and promptly to pool supervisors and the Commissioner.

2. Consider procedural fairness. When receiving the Commissioner’s advice under reg 5(4), courts should be provided with the Commissioner’s enquiry file to enable assessment of whether a person had a reasonable excuse and whether any procedural deficiencies in the administrative process affected the outcome.

Practical touches for all parties

• Standardise notices and forms. Using standardised confirmation requests and templates reduces disputes about what constituted a "reasonable opportunity" and helps produce consistent records.

• Time-stamp everything. Because the Regulations rely on records to support enquiries and judicial consideration, ensure all communications are time-stamped and archived in a secure manner.

• Liaise with employers and external stakeholders. Although the Regulations do not create obligations on employers, court administrators and pool supervisors should provide guidance to employers about likely reallocation practices under reg 6(2) so that employer planning can be informed.

• Policy and training. Provide training to pool supervisors and Commissioner staff about evidentiary best practice for enquiries, privacy and data protection for recorded personal information, and the escalation pathway to judges under reg 5(4).

• Monitor judicial practice. Because the Regulations are brief and defer to courts on many matters, monitor reported judicial decisions and court practice directions affecting jury management to align administrative procedures with judicial expectations.

Compliance documentation to prepare

• Written procedure for providing a "reasonable opportunity" to confirm attendance.

• Non-confirmation register with audit trail.

• Transmission log of notifications to the Juries Commissioner.

• Enquiry files and decision templates for the Commissioner’s determinations.

• Templates for advising a judge under reg 5(4) with appended evidence.

• Records of any court orders altering default administrative procedures.

In sum, compliance requires active administrative process design, rigorous record-keeping and clear communication lines between pool supervisors, the Juries Commissioner and the courts. The Regulations place emphasis on recorded evidence and escalation; implementing bodies should translate the normative terms in the Regulations into concrete procedures and maintain auditable records.
