Juries Regulation 2018

The regulation’s core concepts are disqualification, exemption, and entitlement to claim an exemption. These operate as categorical rules referenced to the Juries Act 1967 (see s 3). The regulation defines “standard” for purposes of linking the temporal effect of many exemptions to the period a person holds an occupation or is affected by a circumstance (schedule 1, part 1.1). That definition is short and functional: standard means the period during which a person is employed in the occupation or affected by the circumstance mentioned in schedule 1, part 1.3, column 2 (sch 1 pt 1.1). The notes point to external definitions in the Legislation Act (for example, doctor, nurse and public trustee and guardian are defined in the Legislation Act, and nurse includes midwife), so the regulation relies on cross-referenced statutory meanings rather than repeating them (sch 1 pt 1.1, notes).

Disqualification is exclusion by reason of criminal conviction or sentencing status. The regulation lists particular convictions that produce life disqualification: offences punishable by life imprisonment (item 1), terrorist offences (item 2), serious offences involving violence or endangering life and punishable by 15 years or more (item 3), certain sexual offences punishable by 10 years or more (item 4), and unlawful possession or making of explosives (item 5). Sentences of imprisonment trigger disqualification periods that depend on the sentence and the age at sentencing: an adult sentenced to imprisonment (other than for failing to pay a fine) is disqualified for five years after a sentence of less than three months, or ten years after a sentence of three months or more (item 6), whereas detention orders imposed on juveniles attract a three‑year disqualification from the end of the detention period (item 7). Persons subject to good behaviour orders are disqualified for three years after the order ends (item 8). Where a person convicted of an imprisonable offence is awaiting sentence or appeal, the disqualification runs until sentence is imposed or the appeal outcome is known (item 9). The regulation therefore uses both categorical (type of offence) and temporal (length of sentence, post‑sentence interval) criteria.

Exemption is a permitted non-participation category for persons whose continuing roles or circumstances the legislature has decided should temporarily remove them from the pool. Exemptions are typically expressed as either “standard”, meaning for the period the person occupies the role (e.g., practising doctors, practising nurses, official secretary to the Governor‑General, practising Australian legal practitioners and employees of legal practitioners), or for a specified period after the appointment or employment ends (commonly two years, in a number of items). The regulation includes both court-related exemptions (judges, magistrates, court staff, public servants providing legal professional services in particular agencies), executive and administrative office-holders (director‑general, emergency services commissioner, chief officers of emergency services), and specific classes recognised under Commonwealth laws (e.g., item 1 references the Jury Exemption Act 1965 (Cwlth) and the Navigation Act 2012 (Cwlth)). Some exemptions explicitly incorporate periods after the cessation of office or employment (e.g., two years after appointment as judge or magistrate ends; two years after employment in Supreme or Magistrates Court staff ends; two years after employment ends for certain legal aid and prosecution staff; two years after employment ends for ACT Corrective Services employees; two years after appointment ends for the public trustee and guardian).

The “people who may claim exemption” list identifies classes who can apply to be excused rather than being automatically exempt. These are qualified by occupation, age, disability status, linguistic capacity, caregiving responsibilities, or religious objection. The classes include ministers and practising members of religious orders incompatible with jury service, certain educators, editors of newspapers, practising nursing professionals, household officers of the Governor‑General, people aged 70 or older, persons with disability as defined in the Disability Services Act 1991, persons under mental health orders under the Mental Health Act 2015, persons unable to read and speak English, and full‑time carers of sick, infirm or disabled persons (sch 1 pt 1.4). The presence of statutory cross-references in these items imports external definitions and standards (for disability and mental health orders), so assessment of claims may require reference to source statutes.

The regulation does not describe the administrative steps for claiming exemption, nor the evidence necessary to substantiate a claim. It sets bright-line categories and temporal rules that the Juries Act framework will apply. The instrument therefore functions as a rule book of classes and timings that the jury administration must operationalise when applying the Act’s eligibility and excuse provisions (see s 3 and schedule 1).

Primary actors affected by the regulation are potential jurors, the jury administration (court registrars and officials acting under the Juries Act 1967), employers of people in listed occupations, and legal advisers who advise clients on eligibility or exemption. The regulation explicitly lists classes of people who are disqualified (sch 1 pt 1.2), exempt (sch 1 pt 1.3), or may claim exemption (sch 1 pt 1.4). Each of these lists identifies who pays a compliance cost in the sense of who loses eligibility for jury service or who must seek an exemption.

Disqualified people are affected by legal incapacity to serve. The list starts with people convicted of the most serious offences, including those exposing them to life sentences or convictions for terrorist offences (sch 1 pt 1.2, items 1-5). Adults given an imprisonable sentence are disqualified for fixed post‑sentence periods that depend on sentence length (item 6); juveniles given detention orders are disqualified for three years post detention (item 7); persons subject to good behaviour orders have a three‑year disqualification after the order ends (item 8); and persons still awaiting sentence or appeal are disqualified until those matters conclude (item 9). The practical effect for individuals is that conviction and sentence outcomes carry long‑term consequences for civic participation in the jury system.

Exempt people are those who do not have to serve during specified periods. That affects office‑holders and employees who either continue in public office or hold particular positions identified for policy reasons. The exempted categories range from judges and magistrates (two years after appointment ends) to police officers (five years after employment ends) and a number of court, prosecutorial and correctional staff (see sch 1 pt 1.3 items 2-23). Employers are affected because certain employees are not available to the jury pool either permanently while employed or for specified intervals after employment ceases, depending on the item (e.g., “standard” duration vs a two‑year post-employment exemption). Organisations that rely on staff for continuity in particular roles (courts, justice agencies, emergency services, corrective services) are directly implicated by exemptions expressed as “standard” or with post‑employment periods.

Those who “may claim exemption” are affected in that they must actively make a claim to be excused. These include older persons (70+), persons with disability under the Disability Services Act 1991, persons subject to mental health orders under the Mental Health Act 2015, non‑English speakers, full‑time teachers, practising nurses, clergy and persons in certain religious orders, newspaper editors, household staff to the Governor‑General, and full‑time carers (sch 1 pt 1.4). For these classes, service is not automatically barred; rather, the regulation signals that the Act provides a route for them to seek relief.

Secondary effects extend to litigants and the court system. The supply of eligible jurors is the aggregate residuum after disqualifications and exemptions. The regulation’s extensive list of exempt and claimable classes shapes the pool composition. Agencies administering summonses will face verification tasks when claims or proof of disqualification are made. Because the regulation imports definitions and cross‑references to other statutes (for example, Disability Services Act 1991, Mental Health Act 2015, Jury Exemption Act 1965 and Navigation Act 2012), it affects how multiple legal regimes intersect in practical assessment of eligibility.

Finally, legal practitioners advising clients about exposure to criminal proceedings must account for the regulation’s disqualification rules, particularly the dependence on sentence length and post‑sentence time windows (sch 1 pt 1.2, items 6-9). The regulation thereby affects advice on collateral civic consequences of sentencing outcomes.

The regulation itself does not create freestanding duties of action; instead, it prescribes categorical rights and limitations that the jury administration must apply under the Juries Act. Section 3 imposes a duty on the system administering juries to treat the entries in schedule 1 as determinative of disqualification, exemption, or an entitlement to claim exemption (s 3(1)-(3)). The primary statutory duty to convene juries remains in the Juries Act; this regulation defines who is eligible to be summoned and who is to be removed from or excluded from the pool.

Rights arising from the regulation include the right of listed persons to be treated as disqualified (automatic exclusion) or exempt (automatic non‑service for the stated period) where the facts correspond to a listed item (sch 1 pt 1.2 and pt 1.3). For those in part 1.4, the regulation confers not an absolute right to non‑service but the right to claim exemption, which must be assessed under the Act’s procedural rules. For example, a practising doctor is exempt for the duration of practice (sch 1 pt 1.3 item 6, read with definition of “standard” in sch 1 pt 1.1), so the jury administration must accept that exemption unless other procedural mechanisms under the Act apply. Conversely, a person convicted of a specified serious offence is disqualified for life or for the specified period (sch 1 pt 1.2 items 1-6), and the jury administration is required to exclude them accordingly.

The regulation relies on cross-referenced statutory definitions; therefore a person’s rights and a court’s duties often require consulting other Acts. For instance, the regulation treats a person with disability within the meaning of the Disability Services Act 1991 as eligible to claim exemption (sch 1 pt 1.4 item 8). The duty to evaluate such a claim necessarily involves reference to the Disability Services Act definition and possibly to evidence of the disability.

Administrative obligations flow to employers in an indirect sense: where employees occupy roles that the regulation designates as exempt (standard) while employed, employers should expect that those employees will not be available for jury service. The regulation sets bespoke post‑employment windows for some roles (commonly two years), which means employers and former employees must track dates to determine eligibility (sch 1 pt 1.3 items 2, 10, 13, 15, 17, 22 and others).

Where a person is awaiting sentence or appeal, the regulation prescribes a standstill in eligibility: disqualification continues until sentence or appeal outcome is known (sch 1 pt 1.2 item 9). This creates a timing effect that affects both defendants and court administrators, because eligibility can change quickly on finalisation of sentencing or appeals.

Finally, certain obligations outside the regulation are implied by its cross-references. The regulation incorporates exemptions arising under Commonwealth statutes (Jury Exemption Act 1965, Navigation Act 2012) and relies on the Legislation Act for definitions (sch 1 pt 1.1 note; sch 1 pt 1.3 item 1). Therefore, administrative officers applying the regulation must reconcile overlapping regimes and ensure that the relevant external statutory exemptions are applied as listed.

The regulation does not itself create a detailed enforcement regime beyond prescribing eligibility categories; the enforcement architecture is provided by the primary Juries Act 1967 and the general offence provisions that apply to subordinate legislation. The republication front matter records the penalty unit values applicable at the republication date,$160 for an individual and $810 for a corporation, pursuant to the Legislation Act 2001, s 133. Those values are relevant to any offence provision in the Act or regulation that references penalty units. The regulation’s text, however, does not specify particular offences or penalties tied to making false claims of exemption, nor does it reproduce procedural sanctions for failing to comply with a summons; such measures reside in the Juries Act and related procedural rules.

Operational enforcement occurs when the jury administration evaluates eligibility and exemptions as per s 3 and schedule 1. Administrative staff must verify whether a person falls into a disqualified or exempt category and apply the specified disqualification or exemption periods. For instance, they must determine whether a conviction falls within the life‑disqualifying categories in schedule 1 part 1.2 items 1-5, or whether a sentence triggers the time-limited disqualification in item 6. Where a person is awaiting sentencing or appeal, the regulation requires the continuation of disqualification until those matters are resolved (sch 1 pt 1.2 item 9), which places an evidentiary and monitoring duty on administrators.

Because several items import definitions or statuses from other statutes, enforcement may require liaison with other agencies. For example, exemptions tied to a person being subject to a mental health order under the Mental Health Act 2015 (sch 1 pt 1.4 item 9) will require administrators to determine whether such an order exists and remains in force. That creates an interface between court administration, health authorities and record systems.

The regulation’s enforcement is primarily ex post in the sense that courts and administrators apply the categories at the point of assembly and selection of jurors. If a person provides false information to avoid service, any criminal or civil consequences are governed by the Juries Act and other general law provisions, not by express penalty clauses in this regulation. The front matter’s penalty unit note indicates the monetary equivalents to be applied where the regulation or Act refer to penalty units, but the regulation itself does not specify particular monetary penalties.

Finally, the regulation’s amendment and commencement history (see Legislation history and Amendment history in the endnotes) affects enforcement timelines. Amendments that alter disqualification or exemption categories change who is to be excluded or exempted from the date of commencement. Administrators and practitioners must track those commencement dates to know which rules govern any particular summons period (endnotes 3-4).

The Juries Regulation 2018 is expressly made under the Juries Act 1967 and operates to implement s 11 of the Act (see regulation s 3 heading referencing Act, s 11). The regulation contains multiple cross-references to other statutes and relies on external definitions and exemption rules, so its operation requires coordination across statutory instruments.

Key cross‑statutory interactions in the regulation itself include:

• The Legislation Act: schedule 1 part 1.1 refers to definitions found in the Legislation Act (for example, doctor, enrolled nurse, nurse, nurse practitioner and public trustee and guardian) and notes that nurse includes midwife (sch 1 pt 1.1, notes). This means interpretation of those occupational categories depends on the Legislation Act’s dictionary definitions.

• Commonwealth Acts: schedule 1 part 1.3 item 1 exempts a person who is exempt under the Jury Exemption Act 1965 (Cwlth), s 4 or regulations under that section, or under the Navigation Act 2012 (Cwlth), s 89. That imports Commonwealth-made exemptions into the ACT scheme, creating a direct interaction between federal statutory categories and local jury administration.

• Disability and mental health legislation: schedule 1 part 1.4 treats “a person with disability within the meaning of the Disability Services Act 1991” and “a person who is subject to a mental health order under the Mental Health Act 2015” as classes who may claim exemption (sch 1 pt 1.4 items 8 and 9). Determinations under those Acts therefore bear on the local application of jury exemption rules.

• Royal commissions and inquiries legislation: schedule 1 part 1.3 item 20 exempts persons appointed to royal commissions and boards of inquiry under Commonwealth Acts (Royal Commissions Act 1991 and Inquiries Act 1991) and also certain judicial commissions (Judicial Commissions Act 1994). Further, part 1.3 item 21 exempts public servants made available to such bodies. The interplay here is administrative: presence on an inquiry consumes time and creates potential conflicts with jury service, and the regulation automates that outcome by reference.

• Children and Young People Act 2008 references: part 1.3 item 17 identifies employees at declared detention places or approved places of care under the Children and Young People Act 2008. That imports classifications from that Act into the exemption regime.

These cross-references mean that assessing eligibility under the regulation frequently requires recourse to external statutory records and regimes. The regulation therefore does not stand alone; it functions as a node in a network of legislation that collectively determines who can be required to serve on a jury in the ACT.

Practically, the regulator’s reliance on external Acts introduces an administrative interface risk: jury administrators must verify statuses or use registries or documentary proof from other agencies. For example, to apply the “person with disability” category, administrators will need authoritative evidence consistent with the Disability Services Act. Similarly, a claimed exemption under Commonwealth law (Jury Exemption Act 1965) requires assessment against Commonwealth regulations. That increases compliance and verification demands on the local jury administration.

Finally, the regulation’s amendment history demonstrates interaction with other legislative programmes. The instrument was made as part of the Courts and Other Justice Legislation Amendment Act 2018 and amended by the Justice and Community Safety Legislation Amendment Act 2019, the Courts Legislation Amendment Act 2023, and the Justice (Age of Criminal Responsibility) Legislation Amendment Act 2023 (endnote 3). Those amending Acts changed which occupations and circumstances are exempt or otherwise treated, and their commencement timelines are recorded in the legislation history, so the regulation’s current content is a product of broader statutory reform across the ACT justice portfolio.

The regulation was created under the Courts and Other Justice Legislation Amendment Act 2018 and is taken to have been made under the Juries Act 1967 (see Legislation history in endnote 3). The republication materials record successive amendments and their commencement dates. Relevant amendments and their sources are set out in the Legislation history and Amendment history endnotes.

Chronology and notable legislative amendments recorded in this instrument:

• Original formation: The Juries Regulation 2018 was made as part of the Courts and Other Justice Legislation Amendment Act 2018 and is recorded as taken to have been notified 29 March 2018 with parts commencing on 29 March 2018 or 26 April 2018 depending on the provision (endnote 3).

• Justice and Community Safety Legislation Amendment Act 2019 (A2019-17): This Act amended the schedule, specifically sch 1 pt 1.3 (exempt people) and sch 1 pt 1.4 (people who may claim exemption), with the relevant provisions commencing 21 June 2019 or upon notification as specified (endnote 3 and amendment history note). The republication table shows R1 and R2 changes, with R2 effective 21 June 2019 incorporating A2019-17 amendments.

• Courts Legislation Amendment Act 2023 (A2023-37): This Act amended schedule 1 part 1.3 (exempt people) (see endnote 3: sch 1 pt 1.9 amended by A2023-37 sch 1 pt 1.9). The amendment was notified on 29 September 2023 and parts commenced on 30 September 2023.

• Justice (Age of Criminal Responsibility) Legislation Amendment Act 2023 (A2023-45): The endnotes show that sch 1 pt 1.7 was amended and the provision was commenced 27 March 2024. The Amendment history notes that sch 1 pt 1.3 was amended by A2023-45 amdt 1.31 and that the people who may claim exemption (sch 1 pt 1.4) were amended earlier by A2019-17 (endnote 4).

The Amendment history entry summarises that exempt people (sch 1 pt 1.3) were amended by A2019-17 s 21; A2023-37 amdt 1.15; and A2023-45 amdt 1.31, and that people who may claim exemption (sch 1 pt 1.4) were amended by A2019-17 s 22 (endnote 4). The republication also records earlier republications (R1, R2, R3) with effective dates and amendment coverage (endnote 5).

From a practitioner’s perspective, the amendment history matters because the exemption and disqualification categories have shifted over time. The instrument records commencement dates for the amendments, which determines which version governed any particular period. Administrative practice must therefore account for the temporal operation of the various versions. The amendments appear to have focused on refining exempt categories and claimable classes, including the addition or modification of specified public servant and court-related exemptions. The republication notes also record that editorial changes under the Legislation Act (part 11.3) may have been applied and that any editorial changes do not alter substantive effect but take effect on the republication date (front matter).

The instrument’s endnotes and amendment history provide the authoritative timeline for when changes took effect and identify the Acts responsible, which is the basis for both retrospective legal analysis (what rules applied at a given time) and forward compliance (what current obligations and entitlements apply).

The text of the regulation and its endnotes do not record any litigation decisions, judicial interpretations, or case law that apply to the Juries Regulation 2018. The republication and endnotes strictly provide the statutory instrument, its contents, and the legislative history showing which amending Acts altered schedule 1 and when those amendments commenced (endnotes 3-5). The instrument itself does not cite cases or report any judicial determinations about the regulation’s operation.

Practically, litigation that engages these provisions would arise under two likely avenues: (1) challenges to the application of the Juries Act or the regulation in the context of jury selection or eligibility disputes within criminal or civil proceedings, and (2) judicial review of administrative decisions by jury administrators under administrative law principles. The regulation does not specify dispute resolution mechanisms; those are provided by the Juries Act and the ordinary court processes. Because the instrument imports definitions and statuses from other Acts (for example, the Disability Services Act 1991 and the Mental Health Act 2015), litigation about the correct characterisation of a person’s status under those Acts could have downstream effects on jury eligibility in the ACT.

Absent any cases in the instrument, practitioners must look to the Juries Act 1967 and to general principles of administrative law and statutory construction for guidance on likely dispute resolution pathways. Any litigated interpretation of the exemption or disqualification categories would normally be reported in court decisions under the Juries Act and would be accessible through judicial databases or the courts’ published decisions, but that material is outside the content of this regulation as republished.

Because the regulation is subordinate to the Juries Act and draws on external legislative sources, any litigation typically examines the proper application of the primary Act and the regulation together. For matters not addressed in the regulation (for example, application procedures), the Act and administrative law will supply the framework. In short, the instrument’s text contains no litigation history; practitioners must therefore treat its content as an input to broader statutory and administrative processes where litigation may arise.

This regulation contains several details that can catch practitioners and administrators who assume broad-brush rules. The following are concrete mechanics and pitfalls to note, with specific schedule references.

• “Standard” is the operative duration reference for many exemptions. The regulation defines “standard” to mean the period during which a person is employed in the occupation or affected by the circumstance mentioned in schedule 1 part 1.3, column 2 (sch 1 pt 1.1). The practical effect is that many exemptions continue only while the specified employment or circumstance exists. Practitioners must not assume that “exempt” equals permanent; for many occupational exemptions the entitlement evaporates once the person ceases the role.

• Post‑employment exemption windows vary. Some exemptions continue for two years after appointment or employment ends (e.g., magistrates and coroners, judges, certain court staff, legal aid and prosecution staff, corrective services employees, the public trustee and guardian , sch 1 pt 1.3 items 2, 10, 13, 15, 19, 22). Police officers have a five‑year post‑employment exemption (sch 1 pt 1.3 item 7). The existence of varying post‑employment windows means the same role may produce different statuses depending on the specific item; careful date tracking is necessary.

• Lifetime disqualifications are specified narrowly. Several criminal categories attract life disqualification, but the applicable conduct types and sentencing thresholds are explicit: offences punishable by life imprisonment (item 1), terrorist offences (item 2), offences involving actual or threatened violence or endangering life punishable by 15 years or more (item 3), sexual offences punishable by 10 years or more (item 4), and unlawful possession or making of explosives (item 5) (sch 1 pt 1.2 items 1-5). Practitioners must map conviction records carefully to these categories; not all violent or sexual offences will meet the listed thresholds.

• Sentencing length distinctions matter. Adult imprisonable sentences attract disqualification periods that depend on whether the sentence was less than three months (five years post-sentence or post-prison good behaviour order or parole) or three months or more (ten years post‑sentence or post-prison good behaviour order or parole) (sch 1 pt 1.2 item 6). This is a non-intuitive threshold (three months) that can significantly alter eligibility timelines.

• Awaiting sentence or appeal creates a pending disqualification. A person convicted of an offence punishable by imprisonment who is awaiting sentence or outcome of an appeal is disqualified until sentence or the appeal outcome is known (sch 1 pt 1.2 item 9). This creates a suspension of eligibility that can change the moment a court delivers sentence or the appeal is decided.

• Cross‑statutory definitions and thresholds require verification. Several items import definitions from other Acts (sch 1 pt 1.1 notes; sch 1 pt 1.3 item 1; sch 1 pt 1.4 items 8-9). Determining whether a person fits a class for exemption or for claimable exemption requires consulting those external statutes and may require documentary proof.

• “May claim exemption” vs “exempt” is a procedural difference. Items in part 1.4 permit a person to claim an exemption but do not automatically exempt them. Administrative processes under the Juries Act will determine whether the claim succeeds. Practitioners must advise clients that some grounds are discretionary or subject to administrative assessment, not automatic carve‑outs (sch 1 pt 1.4).

• Roles tied to public or court service have multiple coverage lines. Several exemptions are tailored to particular justice system roles, and some public servants providing legal professional services are exempt only while employed in specified agencies and for only two years after leaving (sch 1 pt 1.3 items 14-15). Employers, employees, and counsel should be alert to where a role sits in the table and which temporal rule applies.

• The regulation does not state the procedure or evidence for claiming exemption. The instrument lists who may claim exemption but leaves application procedure and standards to the Juries Act and administrative practice. Therefore, evidence requirements and timelines will be governed elsewhere, increasing uncertainty for claimants.

• Amendment timing matters. The legislative history records several amending Acts and different commencement dates (endnote 3). Practitioners dealing with historical events must ensure they apply the version of the regulation that was in force at the relevant time.

• Penalty unit values are recorded in the republication front matter and may change over time. Any monetary penalty referenced in subordinate instruments will be converted using those penalty unit values at the relevant time (front matter).

These “gotchas” are procedural and technical rather than normative. They arise from the regulation’s reliance on temporally-stated exemptions, inter‑statutory dependencies, and the difference between automatic exemptions and claimable ones. In practice they translate into proof, date‑tracking and cross‑agency verification burdens for court administrators and advising lawyers.

Compliance obligations are split across three practical tasks: (1) assessment of eligibility under the schedule, (2) documentation and evidence gathering where exemption or disqualification is claimed, and (3) operational record‑keeping to track post‑employment or post‑sentence temporal windows. The regulation sets categorisations; the Juries Act and court administrative practice supply procedures. Below are concrete steps derived from the regulation’s structure.

1. Map the person to the precise schedule entry

   • Start from schedule 1 part 1.2 (disqualified people). Check whether the person has any convictions matching the listed categories: offences punishable by life imprisonment, terrorist offences, offences involving violence or endangering life punishable by 15 years or more, sexual offences punishable by 10 years or more, unlawful possession/making of explosives (sch 1 pt 1.2 items 1-5). If convicted and the conviction fits, apply the life disqualification.
   • If the person received a custodial sentence, apply the specific post‑sentence disqualification periods in item 6, distinguishing adult sentencing lengths (less than three months v three months or more).
   • For juvenile detention orders or good behaviour orders, apply items 7-8 (three years after detention or good behaviour order ends).
   • If the person is awaiting sentence or awaiting the outcome of an appeal for an imprisonable offence, treat the person as disqualified until sentencing or appeal is final (item 9).

2. If the person is not disqualified, check schedule 1 part 1.3 (exempt people)

   • Identify whether the person’s role is listed and whether the exemption is expressed as “standard” or a fixed post‑employment period.
   • Use the definition of “standard” in sch 1 pt 1.1 to determine the temporal scope: the exemption applies for the period during which the person is employed in the occupation or affected by the circumstance.
   • For exemptions that continue after employment ceases, note the stated length (commonly two years, police officers five years; see specific items).
   • If the role engages a cross‑reference to another Act (for example, exemption under Commonwealth laws in sch 1 pt 1.3 item 1), obtain or verify documentary proof of that status.

3. If the person is neither disqualified nor automatically exempt, consider schedule 1 part 1.4 (people who may claim exemption)

   • The listed classes may apply to be excused. Identify which category is being claimed (religious objection, age 70+, disability as per Disability Services Act 1991, subject to a mental health order under the Mental Health Act 2015, non‑English literacy/speaking, full‑time carer, certain occupations).
   • Collect supporting documentation. For disability or mental health order claims, obtain authoritative evidence consistent with the referenced statutes. For age claims, verify birth date. For caregiving claims, obtain evidence of caring responsibilities (employment or medical certificates).
   • Because the regulation does not set evidentiary rules, consult the Juries Act and court administrative guidance for the form and weight of evidence required and for the procedural steps for submitting a claim.

4. Maintain precise date records and post‑event tracking

   • For exemptions and disqualifications that extend for a defined period after an event (e.g., two years after leaving a role, five years after police employment ends, five or ten years after sentence depending on duration), record the event date precisely and calendared end dates.
   • Ensure that HR and court administration systems can cross‑check employment records, sentencing dates and release/parole/good behaviour order end dates.

5. Coordinate with other agencies and statutes

   • Where schedule items import external statutory definitions or exemptions, liaise with the relevant agencies for verification (e.g., agencies administering the Disability Services Act, Mental Health Act, royal commissions, or Commonwealth exemptions under the Jury Exemption Act 1965).
   • Where a person is claimed to be exempt under Commonwealth law, obtain documentation under the relevant federal Act or regulation as identified in sch 1 pt 1.3 item 1.

6. Advise clients carefully about collateral effects

   • If advising clients on plea, sentence or administrative matters, note how sentencing outcomes affect jury eligibility under sch 1 pt 1.2 item 6 and how juvenile sentences create different windows (items 7-8). Make clear that disqualification windows begin to run from the end of sentence, detention, or good behaviour order, as specified.

7. Keep contemporaneous records of the applicable version of the regulation

   • Because the regulation has an amendment history (see endnotes 3-4), record the version of the schedule that applies to any particular summons or event. Use the legislative history and commencement dates to determine which categories were in effect at the relevant time.

8. Prepare for administrative questions and challenges

   • Because the regulation does not set procedural rules for claims, develop forms and guidance consistent with the Juries Act to collect evidence and ensure consistent decision‑making. Train staff on how to apply “standard” and how to calculate post‑employment or post‑sentence time windows.

In short, compliance requires precise categorisation, collection of documentary proof when a claim or exemption is asserted, calendar tracking for time-limited exclusions or exemptions, inter‑agency verification where other Acts are imported, and attention to the amendment and commencement history so that the correct version of the schedule is applied to any given summons period.
