### 49 Retirement of jury on argument as to evidence
> If a question arises in a trial as to the admissibility of any evidence tendered, or about to be tendered, the court may direct the jury to retire until the question is determined if of the opinion that a party in that trial might be prejudiced if the evidence is given or the argument on the question takes place in the presence of the jury.
