#### 46 Reimbursement of expenses of witnesses (1) The Commonwealth is liable to pay for the following amount of expenses of a witness who is required to appear, or is appearing, at a hearing of a Commission: (a) the amount worked out under the regulations; (b) if there are no regulations for that purpose, and the Commission has determined an amount in writing in relation to that particular witness—the amount determined by the Commission. (2) Subsection (1) does not apply in relation to the Commonwealth judicial officer in relation to whom the allegation of misbehaviour or incapacity is being investigated by the Commission. (3) A determination made under paragraph (1)(b) is not a legislative instrument.
