#### 13 Membership (1) A Commission consists of 3 members appointed on the nomination of the Prime Minister. (2) Before nominating a member, the Prime Minister must consult with the Leader of the Opposition in the House of Representatives. (3) At least one member of each Commission must be: (a) a former Commonwealth judicial officer; or (b) a former judge of the Supreme Court of a State or Territory.
