Judicial Commission of Victoria Regulations 2017

The Regulations operate by applying definitional, procedural and financial prescriptions to the investigative machinery created by the Judicial Commission of Victoria Act 2016. The main concepts, and how they are concretely specified, are:

• Law enforcement agency, prescribed: Regulation 5 expands paragraph (g) of the Act’s s 3(1) definition of “law enforcement agency” by naming specific Commonwealth agencies and municipal inspectors/monitors from the Local Government Act 1989. The practical effect is to make those agencies’ information and involvement explicitly available for the Act’s investigative processes. The presence of specific agencies in the list ties cross-agency cooperation and possible information exchange from the Act to an enumerated set.

• Written notice to produce: Regulation 6 prescribes the minimum content of a written notice under s 69(2)(b) of the Act. The notice must tell the recipient how they may produce the document or thing and must include the statement that non-compliance is an offence unless there is a reasonable excuse. This calibrates a statutory coercive step with explicit notice of potential criminality, linking process validity to the adequacy of the notice’s content.

• Receipts for seized items: Regulation 7 lists the particulars required for a receipt when items are seized under a search warrant (s 87(2) of the Act). The list is concrete: premises, authorised officers’ names, date, time, description, location when seized and the name of the person from whom the item was seized. The rule ties the legality of seizure to documentation at the point of seizure.

• Tribunal eligibility list for Director: Regulation 8 prescribes a set of administrative tribunals across the Commonwealth and states for the purposes of eligibility to be Director under s 128(3)(a) of the Act. The prescribed tribunals are named, creating a defined pool of tribunal experience considered acceptable for appointment.

• Witness assistance, categorisation and caps: Part 3 (regs 9-14) sets out the “prescribed allowance” regime for witnesses under s 83 of the Act. The Rules draw distinctions and attach monetary caps: experts may recover income actually lost up to $300 per hour, capped at $1500 per day (reg 10); other income‑producing witnesses up to $100 per hour, capped at $600 per day (reg 11(2)); non-income witnesses may recover up to $50 per day for necessary expenditure other than childcare (reg 11(3)); childcare is reimbursed where incurred (reg 11(4)). Meals and accommodation have detailed per-meal figures indexed in the Regulation (reg 12) and accommodation capped at $150 per night for overnight absences (reg 12(3)). Travel reimbursement is anchored to the cost of the “most economical form of transport” (reg 13(1)), with an explicit rate for private vehicle use of 18 cents per kilometre (reg 13(2)).

• Evidentiary gate for payments: Regulation 14 requires the Judicial Commission to be satisfied with supporting evidence before approving payments for income loss, incurred expenditure, absence from home for meals entitlements, and transport costs. The evidence requirement operates as a pre-condition to payment and as an administrative control.

• Prescribed forms and pre-interrogation steps: Forms 1-4 in Schedule 1 are the prescribed templates for core procedural steps. Regulation 20 imposes two specific actions before questioning or compelling production: administer an oath or affirmation to an interpreter in accordance with s 22(2) of the Evidence Act 2008 where an interpreter is used; and inform a parent, guardian or independent person of the witness’ rights and obligations in cases where the witness must be accompanied by such a person.

Collectively, these concepts standardise the interface between the Commission’s investigatory powers and the individuals and bodies affected. The Regulations convert discretionary statutory references into specified forms, amounts and evidence rules, thereby narrowing uncertainty at the operational level while leaving certain evaluative judgements (for example, what is “the most economical form of transport”) to the Commission’s discretion.

The Regulations affect a defined but diverse set of actors. Naming who pays, who decides and who is subject to process is central to understanding compliance and behavioural effects.

Primary affected persons and entities

• Witnesses called by an investigating panel: This covers three categories , expert or professional witnesses (reg 10), witnesses engaged in income-producing work (reg 11(2)), and witnesses who are not in income-producing occupations (reg 11(3)). Entitlements, caps and evidentiary requirements differ by category. Childcare costs may be reimbursed for any witness incurring such expenses (reg 11(4)).

• Persons subject to witness summonses or written notices to produce: The prescribed content of notices and the Form 1 witness summons (reg 6 and reg 15, Schedule 1) create obligations on the recipients and warn that failure to comply may be an offence. The form also requires specification of documents or things to be produced.

• Persons from whom documents or things are seized, and premises searched: Regulation 7 prescribes the particulars to be recorded in a receipt when documents or things are seized under a search warrant issued under s 84 of the Act. Form 3 prescribes the search-warrant form and requires noting of conditions, the authorised searchers and the warrant’s expiry not later than 28 days after issue.

• Persons in custody who may be produced before an investigating panel: Form 2 (reg 16) is the model direction to custody authorities. It identifies the processes (dates, times and who should receive the person) for delivering a person in custody to an investigating panel. The Form contains an express note that if the person is aged under 16, the direction is of no effect.

• Agencies and bodies prescribed as law enforcement agencies: Regulation 5 explicitly names Commonwealth agencies (Australian Border Force, ASIC, ATO, AUSTRAC, Australian Crime Commission) and municipal positions under the Local Government Act 1989. These agencies are thereby placed within the Act’s definitional scope for purposes such as information provision or cooperation.

• Applicants for Director: Persons whose eligibility for appointment as Director of the Commission is assessed against prior service on specific tribunals will be affected by the prescribed list in reg 8. The named tribunals across the Commonwealth and states define a pool of tribunal experience that counts for eligibility under s 128(3)(a).

Decision-makers and administrative roles

• The Judicial Commission: The Commission decides whether to pay witness allowances subject to specified caps and supporting evidence (reg 14). It also interprets “most economical form of transport” and may exercise discretion under reg 13(1)(d). The Commission issues summons and notices using the prescribed forms where required, and must administer certain procedural safeguards under reg 20.

• Judges of the Supreme Court of Victoria: Search warrants under Form 3 are authorised by the Court under s 84 of the Act and must be signed by a Judge, as the prescribed form indicates.

• Custody authorities and persons in charge of custody facilities: They are recipients of Form 2 directions to deliver persons in custody for appearance before an investigating panel (reg 16).

Consequentially, the Regulations allocate costs and administrative obligations: the Judicial Commission bears administrative responsibility for processing and assessing claims and for producing notices and forms in the prescribed fashion; witnesses bear the compliance burden of providing supporting evidence to obtain reimbursement; custody authorities are required to act on directions for delivery; and prescribed agencies are brought within the Act’s reach for information and cooperation. The Regulations also create eligibility rules that affect career pathways to the Director role, by prescribing tribunal experience that counts.

The Regulations allocate a set of concrete duties and create defined entitlements. Below are the principal duties and rights established, with the specific regulatory hooks.

Key duties imposed on the Judicial Commission and investigating panels

• Use prescribed forms where the Act requires or contemplates a form. Regulation 15 prescribes Form 1 as the witness summons for s 71 of the Act; reg 16 prescribes Form 2 for s 75(2)(a); reg 17 prescribes Form 3 for s 84(3); and reg 18 prescribes Form 4 for s 94(6). The duty is to employ those forms where the Act calls for a prescribed form.

• Before questioning a witness or requiring production, the investigating panel must take additional steps set out in reg 20. Specifically, where an interpreter is used, the panel must administer an oath or affirmation to the interpreter in accordance with s 22(2) of the Evidence Act 2008 (reg 20(a)). Where the witness is required to be accompanied by a parent, guardian or independent person, the panel must inform that accompanying person of the witness’ rights and obligations as specified in s 77(1)(c) of the Act (reg 20(b)). Those are procedural safeguards for vulnerable witnesses or those requiring language assistance.

• The Commission must not approve payment of a witness reimbursement unless the witness produces evidence sufficient to satisfy the Commission of the claim, as detailed in reg 14. The items of evidence required correspond to different reimbursement heads: loss of income for the income-replacement allowances (regs 10 and 11(2)), evidence of incurred expenditure for non-income witnesses and childcare and accommodation (regs 11(3), 11(4), 12(3)), proof of absence from home for meal entitlements (reg 12(1)), and cost documentary evidence for travel (reg 13(1)).

• The Commission must consider the “most economical form of transport” for travel allowances and may take into account distance, time, income lost when travelling and any other matter it considers relevant (reg 13(1)). This imposes an evaluative duty but leaves room for administrative discretion.

Rights and entitlements created for witnesses and other persons

• Right to reimbursement of expenses for compliance with a witness summons. Part 3 is expressly titled “Assistance for witnesses,” and regs 9-14 create entitlements to reimbursement where a witness attends hearings or produces documents or things to an investigating panel. The scope of reimbursement is tiered and quantified: experts get “income actually lost” up to $300 per hour and $1500 per day (reg 10); other income‑producing witnesses may recover “income actually lost” up to $100 per hour and $600 per day (reg 11(2)). Non‑income-producing persons may recover necessary expenditure up to $50 per day (reg 11(3)). Childcare expenses are recoverable in reasonable amount when incurred because of attendance (reg 11(4)). Meals and accommodation entitlements are quantitatively set out in reg 12.

• Right of the recipient of a search to be given a receipt with particular particulars when documents or things are seized under a warrant (reg 7). The Regulation prescribes the content a receipt must record, thereby creating a documented right to information about the seizure.

• Right to a procedure for resolution of privilege claims: reg 18 prescribes a Form 4 notice of application to the Supreme Court under s 94 of the Act, preserving access to judicial determination of privilege claims.

• Right to proof of age recognition: reg 19 lists acceptable documents for proof of age for s 72(2) purposes, including Australian or overseas passports and birth certificates.

Duties on recipients of notices and witnesses

• A written notice to produce under s 69 of the Act must contain specified particulars, including the method of production and the warning that non-compliance is an offence unless there is a reasonable excuse (reg 6). This creates a duty on addressees to comply unless they have a reasonable excuse and it creates a procedural requirement on the Commission to include the warning in the written notice.

• Persons receiving a Form 2 direction concerning someone already held in custody will be required to deliver the person in custody as specified unless the direction is inapplicable (for example, where the person is under 16, in which case Form 2 notes the direction is of no effect).

The Regulations therefore create a tightly specified system of mutual duties and rights: processes must follow the prescribed forms and information thresholds, and witnesses have conditional entitlements to reimbursement and procedural protections that hinge on producing specified evidence.

The Regulations themselves do not create new criminal penalties but tie procedural warnings and enforcement steps to offences and judicial oversight created by the Act. Enforcement and penalty mechanisms, as reflected in the Regulations, are procedural and administrative as well as judicial.

Statutory offences and warning language

• Regulation 6(b) prescribes that written notices to produce must state it is an offence not to comply with a written notice under s 69 of the Act unless the person has a reasonable excuse. The witness summons form (Form 1, Schedule 1) explicitly warns that “FAILURE TO COMPLY WITH THIS WITNESS SUMMONS MAY BE AN OFFENCE. PENALTIES INCLUDING IMPRISONMENT MAY APPLY.” That language indicates the Act attaches criminal sanction to non-compliance with summonses or written notices, and the Regulations make notice of that mandatory in notices. The Regulations do not themselves set the penalty quantum; they require the notification of an existing statutory offence under the Act.

Search and seizure enforcement

• Regulation 17 prescribes the form of a search warrant for s 84(3) of the Act (Form 3). Form 3 demonstrates that search and seizure under the Act are executed by authorised officers, and that the search warrant must specify conditions, the premises or specified vehicle/vessel/aircraft, authorise certain personnel (for example, named officers or “all members of the police force”), and be signed by a Judge of the Supreme Court of Victoria. The Form also limits the warrant’s operation to no later than 28 days after issue. Enforcement of seizure power is therefore judicially authorised and recorded in a document that must be presented by officials on the ground.

Receipts, record-keeping and administrative controls

• Regulation 7 prescribes the particulars for receipts when documents or things are seized. The requirement to give a receipt with specified details is an administrative control that enables affected persons to challenge the legality of a seizure, and is an enforcement-related transparency measure tied into any subsequent legal remedy.

Payment controls as a form of administrative enforcement

• Regulation 14 is an administrative enforcement instrument: the Judicial Commission must not approve witness payments unless the witness produces evidence satisfying the Commission of income loss, incurred expenditure or travel cost. That rule places an evidentiary hurdle before payment, reducing improper claims and creating documentary grounds for audit and recovery if payments are improper.

Judicial review and privilege determination

• Regulation 18 prescribes the notice when the Commission applies to the Supreme Court under s 94 to determine a claim of privilege. This preserves the Court’s supervisory and adjudicative role, meaning enforcement of privilege claims is ultimately judicially determined.

Discretion and enforcement risk

• Several provisions leave room for administrative judgement. For example, reg 13(1) requires reimbursement to equal the cost of the “most economical form of transport” having regard to distance, time, whether income was lost while travelling, and any other matter the Commission considers relevant. That open‑ended clause may produce disputes about Commission decisions, and potentially judicial review if parties allege unreasonable or irrational denial of entitlements. The Regulations create procedural and documentary bases for enforcement while leaving penalty quantum and criminal enforcement to the Act.

Collectively, the Regulations operationalise enforcement mechanisms that are predominantly procedural and administrative, backed by judicial authorisation for coercive steps and by criminal penalties set in the Act. They place documentary and evidentiary checks in the path of payment and seizure, and require the Commission to give prescribed notices that inform affected persons of statutory penalties.

The Regulations are expressly designed as subordinate legislation to the Judicial Commission of Victoria Act 2016 and interact with a number of Commonwealth and State Acts which they cite directly. The interaction occurs through three mechanisms: definitional extension, procedural cross-reference, and administrative alignment.

Definitional extension and cross-jurisdictional interface

• Regulation 5 prescribes particular persons and bodies for the purposes of paragraph (g) of the definition of “law enforcement agency” in s 3(1) of the Act. By naming Australian Border Force, ASIC, ATO, AUSTRAC, the Australian Crime Commission, the Chief Municipal Inspector under s 223A of the Local Government Act 1989, and municipal monitors under s 223CA of that Act, the Regulations create an explicit bridge between the Commission’s investigative architecture and those agencies’ statutory functions. The practical effect is that information and cooperation pathways in the Act are calibrated to include those specified agencies.

Procedural cross-references to Evidence Act and tribunal statutes

• Regulation 20(a) requires that where an interpreter is used, the oath or affirmation be administered to the interpreter in accordance with s 22(2) of the Evidence Act 2008. This ties the Commission’s witness procedure to existing evidentiary practice under the Evidence Act and ensures a harmonised standard for interpreter oaths.

• Regulation 8 prescribes tribunal names established under a suite of Commonwealth and state Acts (Administrative Appeals Tribunal Act 1975, ACT Civil and Administrative Tribunal Act 2008, Northern Territory Civil and Administrative Tribunal Act, Civil and Administrative Tribunal Act 2013 (NSW), Queensland Civil and Administrative Tribunal Act 2009, South Australian Civil and Administrative Tribunal Act 2013, State Administrative Tribunal Act 2004 (WA)) for the purpose of defining eligibility for appointment as Director under s 128(3)(a) of the Act. By listing those tribunals, the Regulations cross-reference the character of adjudicative experience in appointive criteria.

Procedural and evidentiary harmonisation

• The Regulations link to the Act’s provisions on summonses, search warrants, privilege and payments by prescribing forms and particulars that implement those sections. Examples include reg 15 (Form 1 for s 71 summons), reg 16 (Form 2 for s 75(2)(a) directions to custody), reg 17 (Form 3 for s 84(3) search warrants), and reg 18 (Form 4 for s 94(6) privilege notice). The Regulations therefore supply the procedural templates by which the Act’s powers are realised, and ensure those processes are carried out in a manner consistent with the Act’s requirements.

Interaction with subordinate legislation and interpretation rules

• The Endnotes cite the Subordinate Legislation Act 1994 for sunset provisions and the Interpretation of Legislation Act 1984 (ILA) for style and interpretation matters. The ILA affects how headings, notes, punctuation and provision numbers are read into the statutory instrument. That interaction is procedural but important: it means that the Schedule headings, examples and notes are treated as part of the instrument, and the sunset in the Subordinate Legislation Act imposes a temporal constraint on the Regulations’ effect.

Financial and administrative interaction

• The prescribed witness rates, travel reimbursement rules and receipt particulars may interact in practice with other Victorian payment or expense regimes (for example, court witness allowances or public sector travel policies) although the Regulations govern only the Commission’s payments. The Regulations do not specify a funding source; public finance treatment depends on budgetary allocations to the Commission, which is outside the text.

Limits of interaction within the Regulations

• The Regulations often point back to the Act for substantive powers and sanctions. They do not themselves create new criminal offences or expand judicial power beyond what the Act authorises. Where the Regulations prescribe warning language that non-compliance is an offence, the substantive offence provisions and penalties remain functions of the Act.

In short, the Regulations are an implementing instrument that stitches the Commission’s investigatory processes to existing evidentiary and tribunal frameworks, names inter-agency connections, and prescribes the procedural details needed to operate the Act coherently with other statutes.

The document supplies a brief but explicit amendment record and dates of operation. The principal points are:

• The Regulations were made on 6 June 2017 by the Governor in Council under s 146 of the Judicial Commission of Victoria Act 2016, recorded in the Endnotes (General information). Regulation 3 confirms operation from 1 July 2017.

• The Endnotes contain a Table of Amendments section which, in this instrument, states there are no amendments made to the Judicial Commission of Victoria Regulations 2017 by statutory rules, subordinate instruments or Acts as at the date of publication.

• The Endnotes also indicate there are no amendments “Not in Operation” at the date of publication.

• A sunset is recorded: the Regulations will sunset 10 years after the day of making on 6 June 2027, pursuant to s 5 of the Subordinate Legislation Act 1994. This imposes a statutory expiry unless the instrument is remade or specifically preserved by subsequent legislation.

• The Endnotes include references to interpretive rules from the Interpretation of Legislation Act 1984 that affect style, punctuation and the status of headings and notes. Those are technical amendments to interpretation rather than substantive changes to the content.

There is no recorded history of amendment or variation to the Rates, Forms or prescribed lists contained in the Regulations in the version supplied. Any changes to the detailed prescriptions (rates, forms, prescribed agencies or tribunals) would therefore require the making of a new Statutory Rule or amendment to this instrument under the Act’s delegated power.

The text of the Regulations, including the published Endnotes, records no litigation history. The Endnotes and Explanatory details contain no entries reporting court challenges, judicial consideration or litigation arising under the Regulations themselves. The Schedule and forms note procedural interfaces with the Supreme Court for privilege determinations (reg 18 and Form 4) and require a Judge to authorise search warrants (Form 3), so litigation may arise in practice under the Act, but the Regulations do not record any judicial decisions, appeals or case law up to the publication date.

The absence of recorded litigation in the instrument and the Endnotes means there is no internal source material in this text to draw on for precedents, judicial constructions of the forms or rates, or litigation-driven changes to the Regulations. Any practical disputes about, for example, the Commission’s exercise of discretion under reg 13(1), or challenges to seizure or privilege processes under Form 3 or Form 4, would be litigated under the Act and relevant court rules; however such cases are not recorded in the Regulations’ publication.

Practitioners should therefore treat the Regulations as a set of prescribed procedures and amounts, but remain alert to the possibility that judicial interpretation of the Act and of how the Regulations are applied may generate litigation that could alter enforcement practice. The Regulations themselves do not supply judicial precedents or cases.

The Regulations are compact but contain a number of practical traps and sources of compliance friction that are visible on the face of the instrument. The following points identify precise operational pitfalls.

Evidentiary gate before payment

• Regulation 14 makes payment conditional on producing evidence of income loss, expenditure, absence times or transport cost. Practitioners should note that claims without documentary support will be refused. The types of evidence required are expressly linked to particular reimbursement heads (for example, income loss evidence for the hourly loss rates in regs 10 and 11(2)). There is no statutory provision in these Regulations for provisional payments pending later evidence.

Categorisation and caps

• The monetary caps and hourly rates differ substantially between experts and other witnesses. Experts have a $300 per hour cap and $1500 per day cap (reg 10), whereas other income‑producing witnesses are limited to $100 per hour and $600 per day (reg 11(2)). Non-income producing witnesses are limited to $50 per day for necessary expenditure (reg 11(3)). Payments that exceed those caps cannot be approved under these Regulations. Parties must ensure they are claiming under the correct category and have the supporting documentation to prove both the category and the monetary loss.

Timing constraints for meal entitlements

• Regulation 12(2) restricts entitlements for meals to specific attendance windows. For example, breakfast entitlement requires attendance between 7.00 a.m. and 9.30 a.m., lunch between 12.00 p.m. and 3.00 p.m., and dinner between 6.00 p.m. and 8.00 p.m. A witness who is absent overnight but whose attendance time does not fit those windows may not be entitled to the prescriptive meal amounts.

Ineligibility classes

• Regulation 9(2) disqualifies certain persons from receiving allowances: those whose conduct is being investigated by the Commission, or, in the case of a corporation, its representative, and prisoners of the Crown. This exclusion is potentially significant: the Act’s power to summons may apply to subject persons, but those subjects cannot obtain witness allowances under these Regulations. The exclusion may affect willingness to cooperate and creates a distinction between investigative witnesses and others called to give evidence.

Ambiguity and discretionary standards

• “Most economical form of transport” in reg 13(1) is an evaluative standard qualified by a non‑exhaustive list of factors and “any other matter the Judicial Commission considers relevant.” This open phrase invites administrative judgement and possible disputes. The Commission’s internal policy on how it interprets “most economical” will determine the predictability of travel reimbursements.

Search warrant practicalities

• Form 3 requires a Judge’s signature and limits the warrant’s effect to not later than 28 days after issue. Practitioners must ensure search operations are executed within that window and that the warrant includes clear conditions. Regulation 7 requires a detailed receipt for any seized items; failure to provide the prescribed particulars may raise procedural challenge.

Interpreter and accompaniment duties

• Regulation 20(a) mandates administering an oath or affirmation to the interpreter under s 22(2) of the Evidence Act 2008 where an interpreter is used. Failure to do so may affect the admissibility or validity of the evidence given. Regulation 20(b) requires informing parent/guardian/independent persons of the witness’ rights and obligations. Missing these preliminary steps may be said to breach the prescribed procedural requirements.

Minor but consequential form provisions

• Form 2 includes a specific note that a direction to bring a person in custody is of no effect if the person is under 16 years of age. Custody authorities and the Commission must check ages and ensure compliance with this limitation, or risk an unlawful direction.

Sunset cliff risk

• The Endnotes state the Regulations will sunset on 6 June 2027 unless remade. Organisations relying on the specific caps, forms and prescribed lists should plan for the administrative effort required to reinstate or revise the Regulations before expiry to avoid legal uncertainty.

Privilege process and Supreme Court involvement

• Regulation 18 prescribes a notice mechanism for applications to the Supreme Court under s 94. Parties asserting privilege should expect that privilege disputes may be determined by the Court and prepare for the necessary notice steps prescribed in Form 4.

Receipt particulars as evidence

• The particulars in reg 7 are the only prescribed items a receipt for seized documents must contain. Where a receipt lacks one or more of those particulars, affected persons may have a grounds to challenge the propriety of the seizure or later chain-of-custody claims.

In short, the “gotchas” arise from the interaction of strict evidentiary gates, defined caps and rates, procedural preconditions, and pockets of administrative discretion. Practitioners should structure collection of documentary support, check categories of witness eligibility carefully, and anticipate contested discretionary decisions about travel or necessity.

Compliance under these Regulations requires coordinated steps for both administrative actors (the Judicial Commission and associated officials) and for persons affected by investigative process (witnesses, custody authorities, prescribed agencies). The core compliance checklist below maps obligations to practical actions and the relevant regulations.

For the Judicial Commission and investigating panels

• Use the prescribed forms precisely where the Act requires. Adopt Form 1 for witness summonses (reg 15 and Schedule 1), Form 2 for directions about a witness already held in custody (reg 16 and Schedule 1), Form 3 for search warrants (reg 17 and Schedule 1) and Form 4 for notices of application to determine privilege (reg 18 and Schedule 1). Maintain version control so forms conform to the Regulations.

• Ensure any written notice to produce a document or thing contains the required information per reg 6: a description of how the document or thing may be produced to the investigating panel, and the explicit statement that non-compliance is an offence unless the person has a reasonable excuse. Failure to include these particulars risks procedural invalidity.

• When executing search warrants under s 84, use the prescribed Form 3 and ensure a Judge of the Supreme Court signs the warrant as required by the form. Specify any conditions in the warrant and be mindful that the warrant should not operate beyond 28 days from issue as indicated in the sample form.

• Provide receipts for seized documents or things with the particulars listed in reg 7: premises where seized, authorised officers’ names, date and time, description, location when seized, and the name of the person from whom the item was taken. Keep copies and ensure custody chains are recorded.

• Adopt and publish an internal policy outlining how “most economical form of transport” will be assessed under reg 13(1). Define criteria (for example: lowest direct cost modal choice, when time costs or lost income justify a different option, whether group travel discounts apply), document decision rationales and keep records to support reimbursement decisions to reduce disputes.

• Apply the evidentiary gate in reg 14 strictly. Create a checklist or claim form that matches the evidence types required in reg 14(a)-(d). For income-loss claims, require pay slips, employer confirmation, tax statements or other documentary proof. For travel, require receipts, tickets or mileage logs. For childcare and accommodation, require invoices or receipts.

• Before questioning a witness or requiring production, perform the steps in reg 20. If an interpreter is used, administer the oath or affirmation to the interpreter in accordance with s 22(2) of the Evidence Act 2008. Where a witness requires accompaniment, inform that parent, guardian or independent person of the rights and obligations set out in s 77(1)(c) of the Act.

For witnesses and organisations served with notices or summonses

• When served with a written notice to produce, check that the notice contains the particulars required by reg 6. If not, consider raising the deficiency with the Commission promptly. Be aware the notice must state how the document or thing may be produced and warn that non‑compliance may be an offence.

• For claims of reimbursement, collect and preserve documentary evidence up front. For income-loss claims: contemporaneous payslips, employer confirmations of time taken off, time sheets, invoices and tax records. For travel: tickets, public transport receipts, or a contemporaneous log of kilometres travelled together with dates, destinations and start/finish odometer readings if claiming at 18 cents per kilometre under reg 13(2). For childcare and accommodation: invoices, receipts and booking confirmations.

• For meal entitlements, note the strict time windows in reg 12(2). If attendance falls into those windows, obtain timestamped attendance records or written confirmation that the witness was required to be present in the relevant times.

• Where a person is under 16 and a Form 2 direction is issued, custodial authorities and the Commission must recognise the direction is of no effect. If in doubt, verify the date of birth against the proof-of-age documents listed in reg 19.

• If a privilege issue arises, expect the Commission to issue a Form 4 notice and that the Commission may apply to the Supreme Court under s 94 to determine the claim. Prepare to engage counsel and to collate documents supporting the privilege claim.

For custody authorities and persons in charge of detention facilities

• When served with a Form 2 direction (reg 16 and Schedule 1), confirm the identity, date of birth and custody status of the individual, and coordinate delivery to the person specified, unless the direction is inapplicable (for example because of the under‑16 rule). Maintain records of transfer and delivery times.

Administrative and record-keeping best practice

• Maintain standard claim and receipt templates that correspond to the Regulations’ required particulars and evidentiary standards. Use an electronic claims portal that mandates attaching the required evidence before submission to enforce reg 14.

• Keep audit trails for search warrants and seizures consistent with reg 7. Store copies of issued warrants, executed receipts with authorised officer names, and chain-of-custody logs.

• Track the sunset date of 6 June 2027 (Endnotes) and plan for regulatory renewal or replacement if the Commission intends to rely on these rates and forms beyond that date.

• For eligibility determinations for Director appointments, create a verification protocol to assess whether a candidate’s tribunal experience matches one of the tribunals listed in reg 8. Maintain records of tribunal service, instruments of appointment and judgments or decisions demonstrating tribunal functions.

By following the specified forms, collecting the required documentary evidence, and documenting discretionary decisions against published internal criteria, both the Judicial Commission and parties who interact with it can reduce disputes and align practice with the Regulations’ requirements.
